Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester,.Minnesota, held in the Council Chambers in the City Hall, in.
said City on June 16, 195.2•
President Bach called the meeting to order at 7:30 o'clock P, M.,, the
following members being present:- President Bach, Aldermen Brumm, Pavia„ Morris,
Schroeder and Thiem. Absent: Alderman Anderson.
Upon motion by Davis, second by Morris, the minutes of the meeting of
June 2, 1952 were approved.
President Bach stated this as being the time and place set for the
following hearings:
Second hearing on the paving and grading of the alley in Block 5,
Kutzky's Addition. Twelve residents from the area were present at the meeting
and again protested the construction of paving the said alley.
Hearing on the proposed change of zoning of the west 49.7 feet of
Lot 1, and the west 49.7 feet of the south z of Lot 2, Block 4.3. Original Plat
of the City of Rochester from a multiple dwelling zone to a commercial zone.
There was no one present wishing to be heard.
President Bach stated this as being the time and place set for
receiving and opening bids for the following projects:
The bids of Queen City Motors, Universal Motors, Burnham Motor Sales,
Truck Service Company and Clements Chevrolet Company for the furnishing of one
flat top bed dump body and hoist for mounting on a 1946 Studebaker truck in the
City Engineers Department, were each received and opened and upon motion by
Schroeder, second by Thiem, the -same were referred to the Street & Alley
Committee and the City Engineer for tabulation and report.
The bids of Queen City Motors, Allen Lloyd Company, Clements
Chevrolet Company, Burnham Motor Sales, Truck Service Company and Universal
Motors for furnishing one two -ton dump truck, complete with dump body and
hoist, for use in the City Engineer's Department, were each received.and
opened and upon motion by Thiem, second by Brumm, the same were referred to
the Street & Alley Committee and the City Engineer for tabulation and report.
The bids of Gordon Winslow Company and C. M. Boutelle for furnishing
all labor, materials, and equipment for construction of sidewalk, driveway
and improvement of parking area on the north side of the Mayo Civic Auditorium
were each received and opened and upon motion by Davis, second by Morris, the
same were referred to the Street & Alley Committesand the City Engineer for
tabulation and report.
Mr. Richard White, Attorney representing owners of property on 3rd
Avenue Southeast between 3rd and 4th Streets presented a petition which reads in

on Third Avenue S.E., north of Fourth Street S.E., between Fourth Street
S. E. and the new bridge in Rochester,.Minnesota hereby -petition the
it Mayor and Common Council of the City of Rochester, to abandon the plans
f, of the City of Rochester to widen Third Avenue S.E. between.Fourth
I+ Street S. E. and the new bridge and to abandon the purchase of property

Upon motion by Morris, second by Davis, the petition was referred to the Street &
Alley Committee and the City Engineer.
Mr. Samuel P. Allen, Attorney representing a number of persons and firms
engaged in the trucking business, appeared before the meeting in opposition to
Ordinance No. 794 which limits the axle load on certain streets in the City of
Rochester. A large number of truck owners were also present at the meeting, Mr.1
Allen stated that those interested represented owners of about'400 trucks and
that under the present ordinance many of their deliveries and much of their
business could not be carried out. He further stated that truck owners had made
a study of the situation and offered the following information, that street bases
are not constructed heavy enough; much damage is done to the streets due to frost
and seasonal rains; to much old material is used in patching streets; streets are
out in many places for the installation of sewer, water and gas; and when repairs
are made to holes to small an area is repaired. After hearing Mr. Allen, a motion,
was made by Davis, second by Brumm, that the Street & Alley Committee meet with
a three man committee representing the truckers and report back to the next
meeting of the Council.
Mr. C. 'A. Beck, representing a group of residents from the area West of
llth Avenue Northwest, spoke in opposition to the extension of lot and 2nd Streets.
west to Highway No. 52 beyond 16th Avenue N. W. Also Mr. Frank E. Pendle, Mr.
T. L. Martin and Mr. S. J. McComb opposed the extension of the said streets. Mr.
Beck then presented a protest against the extension of the said streets and a
recommendation that the City Council, the County Commissioners and the Highway
Department give serious consideration to the opening of a truck route at
approximately 6th Street N. W., so as to serve the various truck terminals now
established or being established in the location of lath Avenue and 5th,.'6th and
7th Street N. W. The petition was signed by 45 residents of lot and 2nd Streets
Mr. Leonard Witzke appeared before the Council to protest any increase

in the fee for "on sale" intoxicating liquor license. After hearing Mr. Witzke,
Alderman Morris presented a survey of license fees paid in other cities in the
State of Minnesota. This survey indicated that Rochester was charging below
the average fee for "on sale" intoxicating liquor licenses. Af-ter hearing Mr.
Witzke further, a motion was made by Morris, second by Brumm, that the matter of
license fees be referred to the Council for the purpose of considering increases
and penalties for those delinquent in making applications.
The recommendation of the Street & Alley Committee that the bid of
Queen City Motors for furnishing one flat-bed dump body and hoist for use in the
City Engineer's Department be accepted at the lump sum bid ($580.00) and checks
returned to the unsuccessful bidders was read and upon motion by Morris, second
by Thiem, the recommendation was approved.
The recommendation of the Street & Alley Committee that the bid of
Queen City Motors for furnishing one two -ton dump truck, complete with dump body
and hoist for use in the City Engineerls Department be accepted at the lump sum
bid ($2,806.33) and checks returned to the unsuccessful bidders was read and
upon motion by Schroeder, -second by Thiem, the recommendation was approved.
The recommendation of the Street & Alley Committee that the bids for
construction of a parking area and other improvements north of the Mayo Civic
Auditorium be rejected and checks returned to the bidders and the project be re -
advertised for the next meeting was read and upon motion by Davis, second: by
Morris, the recommendation was approved.
The report of the Planning and Zoning Commission that the plat of the
Brackenridge Addition had been examined and that it was found acceptable was read
and the same was ordered placed on file.
The recommendation.of the Rochester Real EstateBoard that the
application of Mr. William Bliesmer for a real estate salesman license be
granted was read and upon motion by Davis, second by Morris, the recommendation
was approved and the license granted.
A letter written by Mrs. Clara Postier protesting the construction of
sanitary sewers in Southeast Rochester was read and ordered placed on file.
A notice of hearing before the Railroad and Warehouse Commission of the
State of Minnesota in the matter of the application of Charles E. Retz, d/b/a
Rochester -Lake City Motor Coaches, for an increase in passenger fares and express
rates was read and the City Clerk was instructed to notify the Chamber of
Commerce of the hearing.
The request of James J. Macken, Jr., Chief of Police, for permission
to send 7 men from the Police Department to the annual convention for the

�I on June 23 and 24 was read and -upon motion by.Davis, second by Brumm, the request
was referred to the Police Committee with power to act.
The recommendation of the Public Health & Welfare Board that the milk
Ordinance No. 613 be amended to provide for the issuing of permits to milk
processing plants, to have a permit fee of five dollars payable at the time of

application for the permit, plus a fee of two cents per one -hundred pounds of
Grade A milk delivered at the plant and specifykng that these fees shall be used

to defray a portion of the expense incurred in milk.control work, was read and
upon motion by Davis, second by Schroeder, the same was referred to the City
Attorney to draft an amendment to the present ordinance.
The request of the Public Health & Welfare Board for'permission to
employ Mr. John D. Horan of St. P&ul as bacteriologist in the Health Department
at a salary of $300.00 per month, effective June 21, 1952, was read and upon
motion by Morris, second by Schroeder,'the request was approved.
A letter addressed to the City Clerk from the Board of Public Health &
Welfare transmitting a gift of $1,000.00 from General Mills for, the support_ of
the nutrition teaching kitchen and requesting that the gift belset aside in the
Sinking Fund to be kept available for the support of the said nutrition teaching
kitchen was read and upon motion by Schrodier, second by Thiem,'deposit of the
$1,000.00 in the Sinking Fund was authorized until such time as the Public Health
and Welfare Department wished to use the money.
The two following resolution adopted by the Public Utility Board were
eachread and ordered placed on file;
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota, that the Common Council of
the said City be and is hereby requested to authorize the said
Board to enter into a contract with the U. S. Steel Supply Company
for furnsishing, in accordance with plans and specifications -
Division M. of quantities of REINFORCING STEEL, the total amount
of the said contract to be approximately THIRTY FIVE HUNDRED
DOLLARS ($3500.00) the final amount to be adjusted to the exact
weights furnished and the said U. S. Steel Supply Company being
the only bidder."
"Be it and -it is hereby resolved by the Public Utiiity.Board
of the City of Rochester, Minnesota, that the Common Council of
the said City be and is hereby requested to authorize the said r---
Board to enter into a contract with the AMERICAN BRIDGE.COMPANY
for the furnishift, in accordance with plans and specifications -
Division L, of structural steel according to schedule of
quantities contained in said specifications, the total amount
of the said contract to be FIFTEEN THOUSAND NINE HUNDRED SEVENTY.
EIGHT DOLLARS ($15,978.00) adjusted to final weights furnished
and the said American Bridge Company being the lowest responsible
bidder."
The two following resolutions adopted by the Sinking Fund Commission
were each read*and upon motion by Morrie, second by Davie, the same were approved
and ordered placed on file:

"Be it resolved by the Commissioners of the Sinking Fund of the
City of Rochester, Minnesota:
That the sum of $101,717.34 be and the said sum is hereby
appropriated from the Sinking Fund of the City of Rochester, Minnesota,
and ordered paid to the First National Bank of Rochester, Minnesota
for the purchase of $100,000,00 United States of America 1 7/8%
Treasury Certificates of Indebtedness of Series B-1952, due July 1,
1952, together with remium in the amount of $78,00 and accrued interest
in the amount of $1,639.34•
Be it further resolved: That the said bonds be purchased for
the Electric Depneciation Reserve Investment account."
"Be it resolved by the Commissioners of the Sinking Fund of the
City of Rochester, Minnesota:
That the sum of $23,900.00 be and the said sum is hereby
approrpriated from the Sinking Fund and ordered paid to the First
National Bank of Chicago, Illinois for the July let, 1952 maturity
of interest on 1.70 General Obligation Sewage Disposal Plant Bonds,
Nos. 1 to 2900, Inclusive (interest-$23,800.00 and service charges
$140.00). "
The request of the Charter Commission for permission to engage the
services of an attorney was read and upon motion by Davis, second by Thiem,
said Commission was authorized to employ legal assistance and -requested to
advise the Council as to the cost of such services.
The petition of Charles M. Dorniden to have Outlot One, except the
South 100 feet thereof, of Hammer and Fanningis -Addition changed from a
residential zone to a commercial zone was read and upon motion by Davis, second
by Brumm, the petition was referred to the Board of Zoning.
A petition for the construction of a curb and gutter on both sides of
13th Avenue Southeast from East Center to 2nd Street Southeast was read and upon
motion by Morris, second by Thiem,-the petition was referred to the Street &
Alley Committee and the City Engineer.
The report of the City Weighmaster for the month of May, 1952 showing
fees collected for loads weighed in the amount of $129.05 was read and the same
was referred to the Finance Committee.
The reports of the Clerk of Municipal Court for the week ending June 7,
1952 showing total criminal fines and costs collected $1,412.00 and civil fees
received $5.95 and for the week ending June 14, 1952 showing total criminal fines
and costs collected $1,336.00 and civil fees received $1,55, were each read and
having been approved by the City Attorney, President Bach ordered that the sane
be placed on file.
The applications of John A. Holtorf for "on sale" and °off Sale" non -
intoxicating malt liquor licenses were each read and upon motion by Thiem, second
by Morris, the same were referred to the License Committee.
The application of Leonard Karstens for a Journeyman Hot Water and Steam
Fitter's License was read and upon motion by Thiem, second by Davis, the license
was granted.
The applications of Leonard Karsten and Robert Blanck for Journeyman
Plumber's License were each read and upon motion by Davis, second by Thiem, the

licenses were granted.
The application of Richard Pearson and Gordon Kranz for license to sell
cigarettes was read and upon motion by Morris, second by Schroeder, the license__;
was granted.
The applications of Peter J. Fuchs for license to sell cigarettes.and
soft drinks at Pete°s Grocery Store at 1009 - 2nd Avenue Northwest were each
read and upon motion by Brumm, second by Thiem, action on same was deferred,., .
until the neat meeting and the Chief of'Police was instructed to notify Mr.
Fuchs to discontinue the sale of cigarettes and soft drinks.
The application of LeRoy Spratti for license to sell soft drinks was
read and upon motion by Brumm, second by Thiem, action on same was deferred
until the next meeting.
The applications of Harry Salisbury, Gordon Kranz and Richard Pearson,
and Wm. Pan Hook, Supt. of Parks (2) for license to sell soft drinks were each
read and upon motion by Brumm, second by Thiem, the licenses were granted.
The application for transfer 'of the McGoonTaxi Company to the Yellow
Cab Company was read and upon motion by Morris, second by Schroeder, the same
was referred to the License Committee and the City Attorney.
The application of Carl A. Jenke for an -Electrical Contractors License
was read and upon motion by Davis, second by Morris, the same was referred to
the Electrical Inspector.
The two contract bonds of Carlisle G. Fraser in the amounts of
$5,090.95 and $2,037.00 with the United States Guarantee Company as surety were
each read and the same were referred to the Mayor for his a _ pproval.
The following resolution were each introduced and read:

Thiem, second by Davis, and all present voting in favor thereof, President Bach
declared the resolution duly passed and adopted.

City Motors for furnishing one two -ton dump truck and upon motion by Brumm,
second by Davis, and all present voting in favor thereof, President Bach
declared the resolution duly passed and adopted.

Utility Board to enter into contract with the U. S. Steel Supply Company and upon
motion by Davis, second by Morris, and all present voting in favor thereof,

Alderman Morris introduced a resolution ordering examination of books
and records for fiscal year April 1, 1952 to April 1, 1953and upon motion by
Schroeder, second by Thiem, and all present voting in favor thereof, President
Bach declared the resolution duly passed and adopted.
Alderman Morris introduced a resolution appropriating $510.21 from the
General Fund, $23.22 from the S & A Fund, $55, 4 from the Sewer Fund, $22.50 from
the Park Improvement Fund and $746.77 from the Lighting Fund and ordering payment •
made to City of Rochester, Public Utilities and upon motion by Thiem, second by
Brumm, and all present voting in favor thereof, President Bach declared the
resolution duly passed and adopted.

the General Fund, $11,031,12 from the Sewer Fund, $28.80 from the Fire Protection
Fund and $2,430.10 from the S & A Fund and ordering payment made to Standard Oil

Park Improvement Fund and ordering payment made to City Clerk - $302.25; Mayo
Civic Auditorium Revolving Fund - $1,365,64 and Collector of.Internal Revenue -
$2,365.99 and upon motion by Morris, second by Schroeder, and all present voting
in favor thereof, President Bach declared the resolution duly passed and adopted.

General Fund, $2,542.35 from the S & A Fund, $407.65 from the Sewer Fund, $9.60
from the Bridge Fund and $46.70 from the Parking Meter Fund and ordering payment
made to the Street & Alley Fund and -upon motion by Thiem, second by Morris, and

II Alderman Davis presented the following recommendations for the Lighting
Committee. That a larger bulb be placed in the street light at the East end of

{j Center Street bridge and that a new street light be installed where the intersec-
tion of 9th Street and 7th Avenue N. E. would be if said streets were extended
and upon motion by Brumm, second by Morris, the recommendations,were approved.

Alderman Schroeder reported that at the meeting of the League of
�! Minnesota Municipalities held in St. Cloud recently a Revenue Commission, made

connection with the allocation of any new or increased taxes. •A motion was made
by Brumm, second by Morris, that -Aldermen Schroeder and Thiem be authorized to
attend the meetings of•the said Revenue Commission at -city expense.
The regulations governing the use of signs in rooming houses and in.
multiple dwelling and residential zones was discussed and upon motion by Thiem,
second by Davis, the City Attorney was -instructed to prepare an amendment to
section 4 of the coning ordinance, which would permit the use of signs in the
multiple dwelling zone up to 12 sq, ft. in area.
President Bach announced the appointment'to the Board of Equalization ,
for the current fiscal year of Aldermen Anderson, Morris and Schroeder.
Upon motion by Davis, second by Schroeder, the meeting was adjourned.
