July 7, 19 52
Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said
city, on July 7, 1952.
President Bach called the meeting to order at 2:00 o'clock P. M. the
following members being present: President Bach, Aldermen Anderson, Brumm, Davis,
Morris, Schroeder and Thiem. Absent: hone.
Upon motion by Davis, second by Thiem, the minutes of the meetings of
June 16th and 26th, 1952 were approved.
President Bach stated this as being the time and place set for the first
hearing on the widening, paving and curb and gutter on 4th Street Southeast from
6th Avenue Southeast to the Rochester State Hospital. Mr. James Spillane, Attorney
representing owners of abutting property on 4th Street Southeast, objected to the
improvement of the said street at this time. Other individuals objected on the
grounds that they did not know what the assessment would be against abutting
property. Alderman Brumm explained the plan to make the improvement, which would
be partailly paid for by the Minnesota State Highway Department. Those present
were also notified that the second hearing on the project would be held at 7:30
o'clock P. M. on July 21, '1952.
President Bach stated this as being the time and place set for receiving
bids for construction of sidewalk, driveway and parking area on the north side of
the Mayo Civic Auditorium. Upon motion by Thiem, second by Davis, the City Clerk
was instructed to open the bid received. The bid of C. M. Boutelle in the amount
of $3.755.75 was received and opened and upon motion by Brumm, second by Thiem,
the same was referred to the Street & Alley Committee and City Engineer for
report.
The recommendation of the Street & Alley Committee that the bid of
C. M. Boutelle for concrete construction for parking area north of the Mayo Civic
Auditorium be accepted at the unit prices bid was read and upon motion by Morris,
second by Schroeder, the recommendation was approved.
Mr. Prichard Manahan, Attorney representing Mr. Charles M. Dorniden who
had previously petitioned for a change of zoning of Outlot 1, Hammer and Fannings
Addition, except the South 100 feet thereof, advised the Council that Mr. Dorniden
now wished to withdraw his petition for the above requested zoning change, and
upon motion by Davis, second by Morris, the matter was tabled and the City Clerk
was instructed to notify the Board of Zoning of the action taken.
Mr. A. H. Clemens, Attorney representing Marigold Dairies and Mr. A. J.-
Furlow, Attorney representing the Rochester Dairies, were before the Council and
opposed the proposed ordinance regulating the production, transportation, pro-

ceasing, handling, sampling, examination, grading, labeling, regrading, and sale
of milk or milk products, until representatives of the Dairies, the Milk
Producers, the'Board of Public Health & Welfare and the Common Council could meet' -
and study the matter further. President Bach stated that the Council would be
willing to meet with the above.organizations and asked that Dr. Wilson call a
meeting for Tuesday, ,evening, July 15, 1952 at 9:00 o'clock P.M.
Mr. Stanley Drips, Civil. Defense Director, explained to the Council
that it had been recommended that observers stations be set up in the various
cities and requested that one be located on the roof of the City Hall, which

would require two short sets of stairs and a platform. Upon motion by Anderson,

second by Morris, the matter was referred to the Public Grounds'Committee with
power to act.
A letter from Raymond N. Wieland, Attorney, stating that he had been
consulted by Mrs. B. W. Mitchell of 1220 First Street S.W., Mrs' Harold S. Haugen
of 1224 First Street S. W. and Mr. G. L. Barbaree of 1229 First Street S.W. asking
that his letter be referred to the proper committee for action on the matter of
regrading the alley to take care of surface water in -Block 3, 8utzky's Addition
and suggesting that instead of costly paving the grade of the alley be lowered
approximately 1 ft. which would drain water from the alley into the storm sewers
in the streets. Upon motion by Davis, second by Morris, the communication was
referred to the Street & Alley committee and the City.Engineer.
A notice of claim for damage to property owned by Mr.,O. G. Mathison of
1309 Thirteenth Avenue. N. E. in the amount of $2, 500.00 by Raymond N. Wieland,
Attorney was read and upon motion by Brumip, second by Schroeder, the claim was
referred to the City Attorney.
The recommendation of the License Committee that the following adjust-
ments be made in license fees, to be effective as of April 1, 1953, was read and
upon motion by Davis, second by Schroeder, the recommendation was referred to
the City Attorney to draw the proper amendments to the ordinances governing the
said licenses:

A petition.by the Executive Committee of the Rochester Guest Home
Association(107 members) submitting an appeal for the establishment of a city
ordinance regulating and controlling the operation of all rooming houses in the
City of Rochester and requiring a city license to operate rooming houses, at a
nominal fee, was read and upon motion by Anderson, second by Davis, the same
was referred to the License Committee and the City Attorney.
A communication from Arthur Thompson, Melvin Koch and Mark Gravley
requesting an adjustment in wages was read and upon motion by Schroeder, second
by Davis, the same was referred to the Street & Alley Committee and the City •
Clerk was instructed to notify the above petitioners that any further matter in
connection with their employment be taken up with the head of their department
and not directed to the Common Council.
The recommendation of the Planning and Zoning Commission that the plat
of Mohn & Hodge Second Sub -Division, formerly known as Thurber s. Third Sub -
Division be accepted was read and the same was ordered placed on file.
The recommendation of the Planning and Zoning Commission that the
following described property, commonly known as the Dansingburg property, be
annexed to the City of Rochester was read:
"South a of - commencing at intersection of west line of 14th
Avenue S.W., if extended, and south line of 7th Street S.W,,
if extended, running thence west 134.3 feet, thence south
165.71 feet, thence east 134,3 feet, thence north to the*
point of beginning.1'
Upon motion by Brumm, second by Davis, the City Attorney was instructed to draw
an ordinance annexing the above described property to the City of Rochester, all
voted in favor of the motion except Aldermen Anderson and Morris, who voted "no".
A communication from the Planning and Zoning Commission calling
attention to Ordinance No. 400, and recommending that when large areas are
annexed 10% of the land should be dedicated for park, school, or other public
purpose, but that when small parcels are admitted to the city 10% of the value of
said land should be dedicated, and that this money should be set aside for •
specific public purposes,.was read and the same was tabled until the next
regular meeting.
The recommendation of the Board of Zoning that the petition of Mr. &
Mrs. Floyd Campbell to have the north 7S feet of Lot 7 and S, in Block 84, Moe &
Olds Addition changed from residential to commercial zone be granted was read
and upon motion by Brumm, second by Davis, the recommendation was approved and
the City Clerk was instructed to publish a notice ordering hearing on the change
of zoning to .be held at 7:30 o'clock P. M. on July 21, 1952.
The.City Engineerls preliminary estimate for concrete construction for
the parking area north of Mayo Civic Auditorium in the amount of $3,159,42 was

read and the same was ordered placed on file.
The proposal of the Sterling Waterproofing Company for repointing
I structural cracks and pointing coping stone at the Rochester Fire Hall was read

j; and President Bach referred the same to the Fire Committee.
A letter from the Department of the Public Examiner transmitting requests'

for signature of the governing body of the City of Rochester was read and the
II request was signed by all members of the Common Council.
The Mayor's appointment of a committee to determine a site for the new

I band shell consisting of Alderman Ray Schroeder, representing the Common Council;

��. L. R. Benson, representing the Park Board and Dr. A. R•. Sanford, representing the
Band and Music Committee was read and upon motion by Morris, second by Thiem, the ;.
I� appointments -were approved.

i A letter from David Fanning stating that a, piece of alfalfa and -clover
on his property had been cut by order of the.Weed Inspector was read and upon
motion by Morris, second by Davis, -the matter was referred to the Mayor.
+� The•request of William W. Welch for a permit to build a garage attached
t& his home which would not be in -accordance with the existing.zoning ordinance -
was read and upon motion by Morris, second by Davis, the same was referred to the
Board of Zoning. ;.

The request of J. D. Mortensen, Branch President, Rochester Branch,
Church of Jesus Christ of Latter Day Saints, to vary the provisions of Ordinance

No• 558 to permit the construction of a semi public building was read and upon
I� motion by Brumm, second by Anderson, the same was referred to the Board of Zoning.;
hThe request of J. R. Doyle, M. D. for parking space adjacent, to his
office at 3a South Broadway was read and upon motion.by Anderson, second by Brumm,
the same was referred to the Police Committee.
A communication from the Board of Park Commissioners dated July 2, 1952

"The'Park Board hereby petitions you, in veiw of obvious
i misconception of hers_ duties, to change her,job classification
on your records .to conform with our classification "Execu,tive
Secretary", and to correct the injustice done Mrs. Schroeder
by granting her the same 4,7 living cost adjustment given others,
such adjustment to be retroactive to the second Monday in April."
After considering the matter a motion was made by Davis that the administration of

the F. E. Williams Estate Fund be removed from the Park Improvement Fund and be
�I under the supverision of the -City Treasurer, the said transfer to be effective as
�i of April 1,.,19 53. Mr. Davis' motion received no second. alderman'Brumm then moved
(� that the administrALtion of the P. E. Williams Estate be removed from the Park
�i Improvement Fund and transferred to the office of the City Treasurer and that the
II I salary of the Executive Secretary in the Park Board office be reduced by.the amount

of $300.00 per year, effective April 1, 1953. All voted in favor of the motion
except Alderman Davis, who voted "no". Alderman Davis then moved that the
communication from the Park Board be placed on file and upon roll call all
voted in favor of the motion except Aldermen Anderson and Morris, who voted "no".
A notice of hearing before the Federal Power Commission in the matter
of the Northern Natural Gas Company, to be held in Washington, D. C. on July 17,
1952 at 10:00 A. M. was read and President Bach ordered same placed on file.
A petition for installation of a street light at the intersection of
9th Street and loth Avenue N. E. was read and upon motion by Schroeder, second by •

Davis, the same was referred to the Lighting Committee.
A petition for construction of a curb and gutter on both sides of 9th
Avenue Southeast from 4th Street Southeast to Bear Creek was read and upon motion
by Davis, s$:cond by Schroeder, the same was referred to the Street & Alley
Committee and the City Engineer.
A protest against the improvement of 4th Street Southeast from 6th
Avenue to the Rochester State Hospital was read•and,President Bach ordered the
same placed on file.
A petition to grade and oil the alley, in Block 3, Rutzky's 2nd
Addition was read and upon motion by Davis, second by Morris, the same was
referred to the Street & Alley Committee and the City Engineer.
A communication from the Rochester Bus Line Inc. inquiring as to
whether or not chapter 221 of the Minnesota Statutes giving the Minnesota Railroad
and Warehouse Commission jurisdiction to fix bus rates in the City•of Rochester
superceded the franchise Aiven to the Rochester Bus Line by the City was read and
referred to the City Attorney. A motion was made by Schroeder, -second by Thiem,
that a meeting be arranged with representatives from the Railroad and Warehouse
Commission, the Rochester Bus Lines, Inc., employees of the Rochester Bus Lines,
the Mayor,,the Common Council and the City Attorney to discuss the matter of the •
bus drivers strike.now in prog%ess.
Upon motion by Brumm, second by Davis, the Council recessed until 7:30
o'clock P. M.
P.tesident Bach called the Council meeting to order at 7:30 o'clock P.M.,
Aldermen Anderson and Brumm being absent.
The report of the City Weighmaster for the month of June, 1952 showing
fees collected for loads weighed in the•.amount of $121.25 was read and the same
was referred to the Finance Committee,
The City Treasurer's report for the month of May, 1952 was read and the
same was ordered placed on file.

fees collected for building permits issued $99.00; of the Electrical Inspector
showing fees collected for electrical permits issued $44.00; of'the Plumbing
Inspector showing fees collected for plumbing permits issued $90.25; of the
Heating Inspector showing fees collected for heating permits issued $27.00-and
fees collected far sign permits $53.19, were each read and the same were referred;
to the Finance Committee..
A motion was made by Davis, second by Thiem, that the City Clerk prepare,
a•statement of.all fees received in the -office of the Building, Electrical, Heating
and Plumbing Inspectors for the period of January 1, 1952 to July 1, 1952. All

present voted in favor of the motion.
A statement of receipts and disbursements in the'Park Improvement Fund
for the month of May, 1952 was read and the same was ordered placed on file.
The reports of the Clerk of Municipal Court for the week ending June 21,
1952 showing total criminal fines and costs collected $1,453.00 and Tivil fees
received $1.35; for the week ending June 29, 1952.showipg total criminal fines and

costs collected $954..75 _and civil fees received $9, 77 and for the week .ending
July 5, 1952 showing total criminal fines and costs collected.$1,005.00 and-Bivil
fees received $.70, were each read and having been approved by the City Attorney,
President Bach ordered that the same beplaced on file.
The application.of Linda Walters for license to sell s,'oft drinks was
read and upon motion by Morris, second by Davis, the license was granted. -
The application of Alvin E. Benike for license to do cement work in the
City of Rochester was read and upon motion by Thiem, second by Schroeder, the
license was granted.

The application of S. E. Bennett for permission to conduct an •auct-ion
sale at 605 North Broadway on July 7, 1952 was read and upon motion by Davis, �

second by Morris, the permit.was granted.
The application of Marvin Viker for license to connect with sewers and
drains was read and upon motion by Davis, second by Thiem, the license was -granted,
The applications of Hickey Bros. Inc. (2) and David Dee�for license to
sell cigarettes and the application of David Dee for license to sell soft drinks
were each again read and upon motion by Davis, second by Thiem, the licenses were
granted.
The surety bonds of Velie Ryan, Inc. in the amount of $1,000.00 and
Universal Motors, Inc. in the amount of $2,145.00 with the Western Surety Company
as surety and Queen City Motors (2) in the amounts ofo$2,06.33 and $590.00 with
the Continental Casualty Company as surety, were each read and upon motion -by '
Davis, second by Schroeder, the bonds were approved, the surety thereon accepted
and the same were ordered placed on file.

A motion was made by Davis, second by Schroeder, that the parking of
cars on-4th Street Southwest from Broadway to 1st Avenue Southwest be changed
from angle parking to parallel parking. All present voted in favoP of the
motion.

the General Fund and $3,533.03 from the Street & Alley Fund and ordering payment
made to Rochester Sand & Gravel - $395.35; Blacktop Maintenance Co. - $2,762.83;
Ruffridge Johnson Equipment Co. - $290.00; Municipal Steel Corp:-$231.17 and •
Rochester Quarry Company - $203.03 and upon motion by Davis, second by Morris,
and all present voting in favor thereof, President Bach declared the resolution
duly passed and adopted.
Alderman Schroeder introduced a resolution appropriating $3,335.80 from
the General Fund and.$48.00 from the Street & Alley Fund and ordering payment
made to Standard Oil Company- $1,912. 65; Rochester Post Bulletin-$373. 50; Enoch J.
Dison-$245.00; City of Rochester, General Fund-$383.45; A. L: Campion-$221.20
and Wm. Peters-$248.00 and upon motion by Morris, second by Schroeder, and all
present voting in favor thereof, President Bach declared the resolution duly
passed and adopted.
Alderman Morris introduced a resolution appropriating $3,921,65 from
the P.I.R. Fund and ordering payment made to The Grodon Winslow Company and upon
motion by Schroeder, second by Thiem, and all present voting in favor thereof,
President Bach declared the resolution duly passed and adopted.
Alderman Morris introduced a resolution appropriating $1,343.85 from
the P.I.R. Fund and -ordering payment made to Leon Joyce and upon motion by
Thiem, second by Schroeder, and all present voting in favor thereof, President
Bach declared the resolution -duly passed.and adopted. -
Alderman Morris introduced a resolution appropriating $1, 179. 37 from •

An Ordinance amending an Ordinance -entitled, "An Ordinance for the
purpose of promoting health, safety, order, convenience and general welfare, by
regulating the use of land, the location, size, use and height of buildings and
the arrangement of buildings on lots, and the density of population within the
City of Rochester, Minnesota, all in accordance with a comprehensive plan", was
given its first reading.
An Ordin&nce'regulating the installation of gas piping and gas
appliances in buildings in the City of Rochester, Minnesota, was given its first
reading.
The matter of studying flood control in the area through which'Bear
Creek passes in the City was suggested by Alderman Schroeder and it was recommend-
ed to the Council that a committee be appointed by the chair to look into the
matter further. President Bach appointed Aldermen Schroeder, Morris, and Davis
to act on the said committee.
Mr. Robert Kennedy was before the Council and inquired as to the
procedure of transferring his -"off sale" intoxicating liquor license to Sam Golob
and upon motion by Davis, second by Thiem, his request was referred to the License
Committee.
Alderman Davis stated that while in Chicago he had called at the office'
of the International City Manager's Association and had been informed that a
cooperating membership in the head organization was available at a fee of $15.00
per year and also a copy of a pamphlet entitled "Public Management" was available
at a cost of $2.00. Upon motion by Schroeder,'second by Davis, the above
membership was authorized.
The matter of adopting an employment policy covering the employees of
the City of Rochester, which had been previougly submitted to the members of the

Council, was again considered by the Council and upon motion by Thiem, second by
Davis, the said employment policy was adopted, the same to be effective April 1,
1953.
Upon motion by Davis, second by Morris, the meetin was adjourned until
7 % 30 o'clock P. M. on July 21, 1952.6C4
