Minutes of an adjourned regular meeting of the Common Council of the City
of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said
City, on July 21, .1952.
President Bach called the meeting to order at 7:30 o'clock P.M., the
following members being present: President Bach,Aldermen Anderson, Brumm, Morris,
Schroeder and Thiem. Absent: Alderman Davis.
Upon motion by Schroeder, second by Thiem, the minutes of the meeting of
July 7, 1952 were approved.
President Bach stated this as being the time and place set for the first
hearing on the construction of a sanitary sewer and watermain in Westlawn Addition
Block 3, and in Mohn and Hodge Replat of Thurber's Third Division. There was no one
present wishing to be heard.
President Bach stated this as being the time and place set for the second
hearing on the widening, paving and curb and gutter on 4th Street Southeast from
6th Avenue Southeast to the Rochester State Hospital. Mr. James Spillane, Attorney
owners
representing abutting property,( was present at the meeting and objected to the
proposed width of the paving on 14th Street Southeast from 6th Avenue Southeast to
the State Hospital, stating that he could see no reason for the paving being
constructed wider East of 13th Avenue than it was proposed to be between llth
and lath Avenues. He also mentioned that the bridge over Bear Creek would be
considerably narrower than the paving, which would cause a bottle -neck at that
location. President Bach stated that no action would be taken on the matter at
this meeting and that the hearing would be continued until the meeting of
August 14, 1952*
President Bach stated this as being the time and place set for a hearing
on the petition of Mr. and Mrs. Ployd Campbell to have the north 78 feet of
Lots 7 and 8, in Block A, Moe & Olds Addition changed from a residential to a
commercial zone. There was no one present wishing to be heard.
President Bach stated this as being the time and place set for receiving
and opening bids for construction of a curb and gutter on loth Street Southeast
from lot to 315a. Avenue Southeast. Upon motion by Thiem, second by Brumm, the City
Clerk was instructed to open the bids received. The bids of Harry T. Earle in the
amount of $3, 283. 75 and Gordon Winslow Company in the amount of $3, i470.30 were
each opened and upon motion by Morris, second by Thiem, the same were referred to
the,Street & Alley Committee and the City Engineer for tabulation.
Dr. Viktor 0. Wilson, Health 0fficer, requested that the proposed milk
ordinance be read. He further requested that the Council give the ordinance all
three readings at this meeting. A representative from the Rochester Dairy was

present at the meeting and stated that the Dairies had no objection to the passage

of the said Ordinance. An Ordinance toregulate the production, transportation,
processing, handling, sampling, examination; grhding, labeling, regrading, and
sale of milk or milk products; the inspection of dairy herds, dairies, and milk
plants; the issuing and revoaction of permits to milk processors and distributors;
the placarding of restaurants and other establishments serving milk or milk
products, and the fixing of penalties, was given its first reading.
President Bachstated that he felt the ordinance was very good but did
not think it, -:advisable to give it all three readings at this meeting.
The recommendation of the Street & Alley Committee that the bid of H.T.
.Earle & Son for construction of a curb and gutter on loth Street Southeast from
lst to 3rd Avenue Southeast be accepted at the unit prices bid and checks returned'
to the unsuccessful bidders was read and upon motion by Morris, second by Thiem,
the recommendation was approved.
The recommendation of the Street & Alley Committee that the salaries
of employees at the Municipal Parking Lot be settled for the present, by increasing
the work week to 44 hours and compensating the employees at their,regular rate for
the overtime was read and upon motion by Morris, second by Thiem, the same was
approved.
The recommendation of the Sewer Committee that Claude Darst be granted

permission to return clear water to the sanitary sewer at a charge of 5¢ per 100
cubic feet instead of the regular charge of 19¢ was read and they same was ordered,
placed on file. i
Mr. John Miner presented a plan for the commermoration and celebration
of Rochester's Centennial to be held in 1954, which had been prepared by the
Centennial Planning Committee of the Olmsted County Historical Society and
President Bach ordered that the same be placed on file.
Mr. `Palter Burdick was presentat the meeting and stated that the
intersection of 1.5th Avenue and 2nd Street Southeast was flooded during recent
rains and asked that some provision be made to drain surface water from that
locality. Alderman Morris explained the situation, stating` that after each rain
considerable water was not drained off at that intersection. The City Engineer
stated that the new storm sewer running from th-e Railroad tracks to Silver Creek
was previously planned to drain that area but had not been constructed the full
distance on account of lack of funds." Upon motion by Brumm, second by Schroeder,
the matter was referred to the Sewer Committee and the City Engineer for report.
A copy of a letter addressed to the Water and Light Department of the
City of Rochester from the State of Minnesota, Department of Health, transmitting
a report from the Division of Municipal Water Supply and covering examination of

was read and the same was ordered placed on file.
A communication from Mrs. G. Lowell Larson suggesting that a parking
space be painted on the paving around let Avenue and.2nd Avenue and lot Street
S.E. was read and upon motion by Brumm, second by Thiem, the same was referred
to the Police Department.
A recommendation by a committee of citizens consisting of Harald
Thompson, Henry Postier and Willard Lampman requesting that the City adopt a
resolution changing the name of the airport from Rochester Airport to Lobb Field
was read and ordered placed on file.
A petition for the construction of a sidewalk on 14th Street Northeast
from North Broadway to the Jefferson School, signed by 24 residents of that area,
was read and upon motion by Schroeder, second by Morris, the same was referred to
the Street & Alley Committee and the City Engineer for report at the next meeting.
The Mayor's recommendation that rent control be continued in the City
of Rochester until September 30, 1953 and his request that the Council take steps
to make such a program effective was read. A motion was made by Thiem, second by
Morris, that no action be taken on the matter until the following meeting. All
voted in favor of the motion.
A request from the Minnesota State Organization of the Blind to hold
a White Cane Drive on the streets in the City of Rochester on August 14 and 15
was read and.upon motion by Thiem, second by Schroeder, the request was granted.
A communication from the Board of Park Commissioners requesting that
the parking lot East and south of Mayo Civic Auditorium be oiled and that the
expense of same be paid from the Parking Meter Fund was read and upon,motion by
Thiem, second by Morris, their request was referred to the Street & Alley
Committee and the City Engineer and the Park Superintendent with power to act.
A letter from Ralph E. Monson, City Engineer, stating that the plat
of the Miracle Mile Shopping Center conformed to the requirements of Ordinance
No. 704 and recommending that the plat be annexed to the City was read and
ordered placed on file.
The City Engineer's preliminary estimate for construction of concrete
curb and gutter on loth Street S.E. from lot to 3rd Avenue Southeast showing
costs for contract items in the amount of $3,509.20 and non -contract items in the
amount of $2,217.00 making a total of $5,725.20 was read and the same was ordered
placed on file.
A communication from the Rochester Charter Commission stating that
John de J Pemberton had been retained as attorney for the said Charter Commission
and stating that the said Charter Commission would like to know if the Common

'Flooded conditions adjoining Bear Creek are becoming more

extensive and damaging to some of our homes, never before

damaged,by floods, and these conditions, we feel are caused by
the changing of the channel and various -other man made factors.
'We the undersigned citizens are forced, in order to protect our
homes, to petition you, our city officials and the city engineer,

to take thenecessary action to alleviate these hazardous,
dangerous and damaging conditions without delay.'

The application of DeWaine C. Silker for "off sale" non intoxicating
malt liquor license was read and upon motion by Brumm, second by Morris, the license
was granted.
The applications of Spencer Holloway, William 0. Meschke, Leon J. Hicks,
Arthur Seaman, Minar L. Bussell, Jr., Clifford D. Sandberg, R. J. Warren, John A.
Fricke and Clarence Claude for Journeyman Electrician's license were each read
and upon motion by Thiem, second by Schroeder, the same were ordered held until
the next meeting.
The applications of Morey's Bar & Cafe, Inc. and DeWaine C. Silker for
license to sell soft drinks were each read and upon motion by Morris, second by
Thiem, the licenses were granted.
The applications of Cliff T. Igo and Albert F. Pries for real estate
brokers license and Bernard G. Mayou for real estate salesman's license were
each read and upon motion by Thiem, second by Morris, the same were ordered held
until the next meeting.
The application of the Rochester Yellow Cab Corporation for transfer
of a taxicab license form a 1949 Dodge - 7 passenger with license No. 531-005 to,
a 1952 Pontiac 5 passenger with license No. 534-549 was read and upon motion by
Schroeder, second by Thiem, the transfer was granted.
The application for transfer of "On Sale" liquor license No. 304 from
Hazel Kitzman to Morey's Bar & Cafe, Inc. was read and upon motion by Anderson,
second by Morris, the transfer was granted.
The report of the- City Treasurer for the month of June, 1952 was read
and the same wa-s ordered placed on file.
The reports of the Clerk of Municipal Court for the week ending July 12,
1952 showing total criminal fines and costs collected $1,170.00 and civil fees
received $6.75 and for the week ending July,18, 1952 showing total criminal fines
and costs collected $992.00 and civil fees received $2.35, were each read and
having been approved by the City Attorney, President Bach ordered that the same
be placed on file.
. The surety bonds of C. M. Boutelle in the amount 'of $3, 755.75 with the
Western Surety Company as surety and Morey's Bar & Cafe,,Inc. in the amount•of
$3,000.00• with the Western Surety Company as surety were. -each read and upon motion
by Thiem, second by Brumm, the bonds were approved, the surety thereon accepted
and it was ordered that the same be placed on file.
The following resolutions were each introduced and read:

Thiem, and all voting in favor thereof, President Bach declared the said resolution
duly passed and adopted. -
Alderman Schroeder introduced a resolution naming the Rochester Airport
"Lobb Field" and upon motion by Thiem, second by Anderson, and all voting in favor'
thereof, President Bach declared the said resolution duly passed and adopted. :.

An Ordinance repealing an Ordina.nce entitled, $.An Ordinance providing
that no petition, application or plat f-or.the annexation ,of any land to the City
of Rochester, shall b.e acc.epted or approved, nor any,land be made an addition to
said City unless at least ten per cent of the total area of such land, or •ten
per cent of the value thereof, exsclusive, .of the streets and alleys ,there,in, shall
have been dedicated to some public. purpose to be. approved by, the, Common Council
of said City", was given its first reading.
An Ordinance amending Ordinance No. 559 entitled, "An Ordinance for the
prupose of promoting health, safety, order,.convenience and general welfare, by
regula•t.ing. the use' of land, the location,. size, use and height of buildings,
and .the arrangement of buildings .on lots, and the density of population within
the City of Rochester, Minnesota, all in accordance with a comprehensive plan".,
was given its first reading. ,

present voting in favor thereof, the.rules, were suspended and the ordinance was
given its second reading.

Morris voted °no".
A discussion was held by the members of the Council as to limiting•the
time when items would be received in the City Clerk's office for consideration by
the Council and upon motion by Brumm, second by Thiem, it was determined to set
5:00 o'clock P. M..on Friday preceding the date of Council meetings as the dead

Alderman Schroeder recommended to the Council that the members of the
Rochester Fire Department be allowed the amount of $S.00 per month for the
purchase of uniforms. President Bach referred the matter.to the Fire Committee
for report at the next meeting.
Alderman Schroeder stated that street lights were very much needed at
the- intersection of Sth Street Southwest, 7th Street Southwest and Memorial
iDrive and also a light at the East end of Memorial Drive. Upon motion by
Schroeder, second by Brumm, the matter wsiz referred to the Lighting Committee.
Alderman Schroeder also mentioned that the present fixture on the light
pole at the entrance to the baseball park would not carry a larger bulb and*
recommended that the fixture on the pole be changed so that a larger bulb could
be used and upon motion by Thiem, second by Morris, the matter was referred to
the Lighting Committee.
The request of the Board of Park Commissioners for permission to employ
Mrs.'Doroihy'A Klause as Executive Secretary -Bookkeeper was considered by the Council
and upon motion by Thiem, second by Brumm, the request was approved, at a slary
of $250.00 per month.
Some discussion was -held by the members -of the Council as to the
possibility of combining the heating, plumbing, warm air and ventilating inspect-
ions under one position, and upon motion by Brumm, second by Schroeder, the same
was referred to the Building Inspector to study the matter and report at the next
Mee-t ing .
Upon motion by Schroeder, second by Brumm, the meeting was adjourned.
