President Bach called the meeting to order at 2:00 o'clock P.M., the following members being present: President Bach, Aldermen Anderson, Brumm, Davis, Morris, Schroeder and Thiem. Absent: None. Upon motion by Davis, second by Morris, the minutes of the meeting of July 21, 1952 were approved. President Bach stated this as being the time and place set for the second hearing on the construction of a sanitary sewer and watermain in Westlawn Addition, Block 3, and Mohn and Hodge Replat of Thurber's Third Division. There was no one present wishing to be heard. President Bach stated this as being the time and place set for receiving and opening bids for construction of a sanitary sewer and watermain in Westlawn Addition, Block 3 and Mohn & Hodge Replat of Thurber's Third Division. The following bids were received and opened and upon motion by Davis, second by Thiem, the same were referred to the Sewer and dater Committees for tabulation x and report: Carlisle G. Fraser - Wolff Construction Co. - Barbarossa & Sons, Inc.- San.Sewer $ -O.503.25 43, 694.00 43,759.15 Watermain $ 29 ,, 476I+5 31,11S.90 30,975. SO Total $ 69,979.70 74,912.90 74,734.95 The two following resolutions adopted by the Public Utility Board were each read and the same were ordere& placed on file: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with BERGSTROM - VERBARG COMPANY for the furnishing, in accordance with specifications, of 75 Class 3, 35 ft. WRC Poles 40 Class 3, 40 ft. WRC Poles 40 Class 3, 45 ft. V1RC Poles the total amount of the said pole contract to be FIVE THOUSAND SEVEN HUNDRED NINETY FIVE DOLLARS ($5795.00) and the said BERGSTROM-VERBARG C0MPANY being the lowest responsible bidder." "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into a'contract with the MACARTHUR COMPANY for the furnishing in accordance with specifications, of 16,000 feet 4" Transite gorduct 100- 4" end bells 100- 4" duplex adapters 100- 4" double duplex adapters the total amount of the said contract to be THREE THOUSAND EIGHT HUNDRED THIRTY SIR DOLLARS ($3,936.00) and the said MACARTHUR COMPANY being the only responsible bidder." A claim by Charles Smart for damage to his automobile, which he alleges was caused by striking a hole in a public street, was read and upon motion by Morris, second by Anderson, the same was referred to the City Attorney. 1 • I is 1 1 The request of the Public Health & Welfare Board for permission to 0 15< Record of Official Proceedings of the Common Council of the City of Rochester, Minn., August 4, .19 52 1 1 0 1 • 1 1 employ Miss Darlyn-Gae Haack as a clerk in the Health Department, effective August 27, 1952.at a salary of $150.00, to replace Miss Nancy Donaldson, was read and upon motion by Davis, second by Morris, the request was granted. The recommendation of the Planning and Zoning Commission that Ordinance No. 704, Section 5, Sanitary Sewers, starting with sentence two, be amended as follows, was read: Delete An exception to this regulation may be made in case the platted lot is at least twice the minimum width required under Section 3 (i.e. Interior lots 100 feet wide and corner lots 110 feet wide) and of such depth that, if sewer becomes available, each lot can i! later be sub -divided into four lots of 5,000 or more square feet area after proper. allowance for streets. Substitute .An exception to this regulation may be made in case -the lot size has the approval of the City Health Department based on "Requirements for Individual Water Supply and Sewage Disposal Systems of.the Federal Housing Administration," published October 1, 1943 and revised May, 1952. (1) Where city water.only is available, absolute minimum lot width shall be SO feet, and absolute minimum lot area shall be12,000 square feet. (2) Where neither city water or sewer is available, absolute minimum lot width shall be 90 feet,, and absolute minimum lot area shall be 13,000 feet. All cost and expense for the necessary investigation and soil test shall be borne by the land owner. Upon motion by Anderson, second by Thiem, the recommendation of the Planning anC Zoning Commission was accepted and ordered placed on files I Upon motion by Davis, second by Schroeder, the City,Attorney was instructed to prepare an amendment to Ordinance No. 704 making the above mentioned changes. The City Engineer's preliminary estimate of cost for the construction of a sanitary sewer, in Westlawn Addition, Block 3 and Mohn and Hodge Replat of Thurber's Third Division, in the amount of $35,679.05 and watermain in the amount of $29,422.10 was read and the same was ordered placed,on file. The recommendation by the Chief of Police that rediq_equipment be purchased for the ambulance presently in use in the Police Department and that if the Council is going to place this equipment in the fire department or at the City -County Hospital this radio equipment be ordered with, the same frequency, was read and upon motion by Davis, second by Brumm, the recommendation was referred to the Police Committee for report at the next meeting. The following recommendation by the Chief of Police was read and upon motion by Davis, second by Anderson, the same was referred to,the Police Committee: "Hon. Mayor and Common Council City of Rochester, Minresota Gentlemen: I don't think it is necessary to review our traffic problems as I feel that you are well aware of them. Neither do I believe that they can be solved over -night. However, I feel that there are some changes'vhich can be made which would facilitate our 4. traffic movements and reduce some of the hazards. I feel that some of the recommendations that I am going to make 1� Record of Official Proceedings of the Common Council of the City of Rochester, Minn.,_ August 4. 1952 • will have to be carefully considered and I sincerely hope that you will btudy and adopt them. (1) Statistics show that our greatest traffic volume in and out of Rochester is from the West and the North. I recommend that First Street Southwest and Second Street Southwest be made one-way streets - First Street Southwest, west bound and Second Street Southwest, east bound. This change from Third Avenue -to the west city limits. (2) I recommend that additional or better lighting facilities be provided on Twelfth StreetSoutheast to reduce the accident potential. (3) I recommend that parking be changed from angle to parallel, wherever possible. (4) I recommend that the Council, in lieu of widening, prohibit parking on certain streets on one side to increase safety, to facilitate the traffic flow and reduce the accident potential. (5) I recommend that one of the following measures be adopted at school crossing intersections presently policed by Officers on shift to increase our working strength and our efficiency: a. Install adequate traffic signals; b. Employ civilian men or women to protect the crossings; c. Employ off -duty Policemen to protect the crossings. (6) I also recommend that an examination of the lights in the City Mill Parking Lot'and the Mayo Civic Auditoriu Lot and North walk be checked to increase the amount of light so that car prowls can be reduced and greater safety afforded to both Pedestrians and Motorists. Sheridan as Directors of the Library Board', their terms to expire 0 the third Saturday of July, 1955 was read and upon motion by Anderson, second by Davis, the Maybr's appointements were approved. A telegram from the -State of Minnesota, Department of Aeronautics, requesting the City to call for bids on the lighting project at the Rochester Airport was read and the same was ordered placed on file. The application of Curtis H. Horton for Journeyman Hot Water and Steam Fitter's license was read and -upon motion by Brumm, second by Davis, the license was granted. The application of Charles 0. Ebenhoh for a real estate brokers license was read and upon motion by Brumm, second by Davis, the license was granted, subject to the approval of the Real Estate Board. The application of Allen DeFosse for a soft drink license was read and upon motion by Thiem, second by Anderson, the same was referred to the License Committee. Upon motion by Brumm, second by Thiem, the Council recessed at 3:30 o'clock P. M. President Bach called the meeting to order at 3: LO o'clock P. M. The report of the City Weighmaster for the month of July, 1952 showing fees collected for loads weighed in the amount of $125.10 was read and the same was referred to the Finance Committee. I) The recommendation of the Board of Zoning that the Building Inspector be authorized to issue a permit for the construction of a garage to William W. M. on August 25, 1952. The recommendation of the Board of Zoning that the petition of Alvina M. Klause to have Lot 4, and the East t of Lot 5, Block 9, Wm. McCullough's Addition changed from a multiple dwelling zone to a commercial zone be not granted was read and upon motion by Morris, second by Davis, the recommendation was approved. The recommendation of the Sewer and Water Committees that the bid of Carlisle G. Fraser for the construction of'a sanitary sewer and watermain,in Westlawn Addition, Block 3 and Mohr, and Hodge Replat of Thurber's Third Division be accepted at the unit prices bid and checks returned to the unsuccessful bidders was read and upon motion by Brumm, second by.Morris, the recommendation was approved. The following resolution were each introduced and read: Alderman Thiem introduced a resolution accepting the bid of Carlisle G Fraser for construction of a sanitary sewer and watermain in Westlawn Addition Block 3 and Mohn and Hodge Replat of Thurber's Third Division, and upon motion by Anderson, second by Brumm, and all present voting in favor thereof,'President Bach declared the said resolution duly passed and adopted; Alderman Thiem introduced a resolution ordering a hearing on vacation of part of 15th Avenue Southeast and upon motion by Brumm, second by Davis, and all present -voting in favor thereof, President BqLch declared the said resolution duly passed and adopted. Alderman Thiem introduced a resolution authorizing the Public Utility Board to enter into contract with Bergstrom-Verbarg Company and the MacArthur Company, and upon motion by Davis, second by Morris, and all voting in favor thereof, President Bach declared the said resolution duly passed and adopted. Alderman Thiem introduced a resolution authorizing the City Engineer to publish notice regarding construction of sidewalks and upon motion by Morris, second -by Schroeder and all voting in favor thereof, President Bach declared the said resolution duly passed and adopted. Alderman Morris introduced a resolution ordering bids for lighting installation at the Rochester Airport, and upon motion by Schroeder, second by Thiem, and all voting in favor thereof, President Bach declared the said resolution duly passed and adopted. Alderman Morris introduced a resolution appropriating $326.36 from the General Fund, $12.3.0 from the Sewer Fund and $250,00 from the Fire Protection Fund and ordering payment made to X. W. Alderman Schroeder introduced a resolution appropriating $55,955.99 from the S.D.P. Fund and ordering payment made to Feller & Pagenhart and upon motion by Anderson, second by Schroeder, and all voting in favor thereof, President Bach declared the said resolution duly passed and adopted. An Ordinance to regulate the production, transportation, processing, handling, sampling, examination, grading, labeling, regrading and sale of milk or milk products; the inspection of dairy herds, dairies, and milk plants; the issuing and revocation of permits to milk processors and distributors; the placarding of restaurants and other establishments serving milk or milk products, and the fixing of penalties, was given its second reading. An Ordinance repealing an Ordinance entitled, "An Ordinance providing that no petition, application or plat for the annexation of any land to the City of Rochester shall be accepted or approved, nor any land be made an addition to said City unless at least ten per cent of the total area of such land, or ten per cent of the value thereof, exclusive of the streets and alleys therein,, shall have been dedicated to some public purpose to be approved by the Common Council of said City", was given its second reading. Upon motion by Davis, second by -Schroeder, and -upon roll call and all voting in favor thereof, the rules were suspended and the Ordinance was given its', third and final r,eadi-ng. Upon motion by Davis, second -by Schroeder, that the said Ordinance be adopted as read, and all voting in favor thereof, President Bach declared the • said- Ordinance duly passed and adopted•.
