Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
said City on September 8, 1952.
President Bach called the meeting to order at 2:00 o'clock P.M., the '
following members being present: President Bach, Aldermen Brumm', Davis, Morris,
Schroeder and Thiem. Absent: Alderman Anderson, due to illness.
Upon motion by Davis, second by Schroeder, the minutes of the meetings
of August 25th and September 2nd, 1952 were approved.
Mr. Charles MdDonald, acting as spokesman for a committee of 7
respresenting merchants on 1st Avenue Southwest between Center Street and 4th

Street South, read a petition signed by 79 merchants in that area protesting
any change in the present parking of automobiles on 1st Avenue Between 'nth
Street Southwest•and Center Street. After hearing the committee President Bach
notified them that they could be heard further at the evening session of the
Common Council.
The four following resolutions adopted by the Public Utility Board were��
each read and President Bach ordered that the same be placed on'file:
"Be it and it is hereby resolved by the Public Utility Board of the
City of Rochester, Minnesota, that the Common Council of the
said City be and is hereby requested to authorize the said
Board to enter into a. contract with the Fuel Economy Engineering
Company of St. Paul, Minnesota for,
DIVISION 1P1 - MISCELLANEOUS STEEL ANDIRON
in accordance with specifications, the total amount of the said
Contract to be SIXTEEN THOUSAND THREE HUNDRED SEVENTY SIX
DOLLARS($16,.376.00) and the said Fuel Economy Engineering +'
Company being the only responsible bidder."
"Be it and it is hereby resolved by the Public Utility
Board of the City of Rochester, Minnesota, that the Common
Council of the said City be and is hereby requested to
authorize the said Board to enter into a contract with the
FUEL ECONOMY ENGINEERING COMPANY of St. Paul, Minnesota for
DIVISION 'R' - FLUES'AND DUCTS
in accordance with specifications, the total amount of the
said contract to be Elevan Thousand Four Hundred Fifty Seven
Dollars ($11,457.00) and the said Fuel Economy Engineering
Company being the lowest responsible bidder."
"Be it and it is hereby resolved by'the Public Utility
Board of the City of Rochester, Minnesota that the Common
Council of the said City be and is hereby requested to
authorize the,said Board to enter into a contract with the
L. 11. FELLER COMPANY for -
DIVISION 'S' - CIRCULATING WATER DISCHARGE PIPING
in accordance with plans and specifications and with the
proposal- of the said Company, the total amount of the said
contract to be FIFTY.THOUSAND SIX HUNDRED FIFTEEN DOLLARS
($50,615.00) and the said L. M. Feller Company being the
lowest responsible bidder."
"Be it and it is hereby resolved by the Public Utility
Board of th-e City of Rochester, Minnesota that the Common
Council of the said City be and is hereby requested to
authorize the said Board to enter into a contract with
ALVIN E. BENIKE for
DIVISION IN' - GENERAL BUILDING WORK
in accordance with plans and specifications and with his
proposal, the total amount of the said contract to be FIFTY
SIX THOUSAND EIGHT HUNDRED FORTY SIX DOLLARS AND 00 cents

($56,s46.00) and the said Alvin E. Benike being the lowest
responsible bidder."
The request of the Board of Public Health & Welfare for uermission to
employ Miss Mary K. Graupman as assistant public health nurse supervisor,effective
September 2, 1952 at a smeary of $375.00 per month, to replace Miss Laura Weyrick
uho resigned, was read and upon motion by Davis, second by Schroeder, the request
was granted.
A communication from the Board of Park Commissioners requesting that
Ordinance No. 400 be not repealed but that the said ordinance be amended and
reworded to make it applicable to modern times and that no property be brought into
the City without having a portion dedicated to public purposes, other than streets
and alleys, was read and President Bach ordered the same placed on file.
A notice by the Federal Power Commission of an order denying a motion
by the Northern Natural Gas Company for a rehearing in the matter of the Northern
Natural Gas Company, Docket No. G-1991 was read and President Bach ordered same
placed on file.
A letter from M. G. Rolfson, Mayor of the City of Austin, asking that
the Council indicate whether or not they were in favor of approving the Minnesota
League of Municipalities recommendation that the fee for "off sale° intoxicating
liquor license be increased to $400.00, or should a higher statury limit be allowed
or should the matter of licensing off sale liquor stores be left to local option
was read, and upon motion by Thiem, second by Morris, the Council went on record
as being in favor of the licensing of "off Sale" intoxicating liquor stores
being left to local option.
A notice from the League of Minnesota Municipalities of regional meetings
to be held in the State of Minnesota during the fall was read together with a
schedule of the dates on which said regional meetings would be held was read and
President Bach ordered the same placed on file.
The request of the Elks.Drum and Bugle Corps for permission to operate
a dingo game on Friday nights during the coming year was read and upon motion by
Davis, second by Morris, the same was ordered placed on file.
The transfer of -"on sale" intoxicating liquor license No. 299 was
discussed by the Council but no action was taker_ at this beeting.
The request of Mr. Wm. H. Peters to drill a well at 13.33 — 5th Street
Northeast was read and President Bach ordered same referred to the Public
Utility Board.
The reports of the Clerk of Municipal Court for the week ending
August 30, 1552 showing total criminal fines and costs collected $1,120.15 and
civil fees received $10.67 and for the creek ending September 6, 1952 shoeing

A summary of disbursements by the City Engineer's Department for the

month ending August 31, 1952 was presented to the Council and ordered placed on !
file.
The report of the City Weighmaster for the month of August, 1952 showing
gees received for loads weighed in the amount of $102.00 was read and the same
was referred to the Finance Committee.
The reports for the month of August, 1952 of the Building Inspector
showing fees collected for building -tErmits $720.00; of the Electr.•ical Inspector
showing .fees collected for electrical permits $134.50; of the Plumbing Inspector '
showing fees collected for plumbing permits $461.25;' of the Heating Inspector
shooing fees collected for heating permits $177.00 and sign permits $22.65 were
each read and the same were referred to the Finance Committee,'
The applications of William Becker, John Papddakis and Benjamin Wong
for license to sell cigarettes were each read and upon motion by Thiem, second
by Schroeder, the licenses were granted.
The applications of John Papddakis and Benjamin Wong for license to sell,,
soft drinks were each read -and upon motion by Schroeder, second by Morris, the
licenses were granted.
The application of heslie,NcEathron for a Journeyman Electrician's`
license was read and upon,motion,by Schroeder,,second by Thiem, the license was
granted.
The surety bonds of Anne C, Jensen in the amount of $1,000.00 with the
American Surety Company as surety; Foster Electric Company in the amount of'
$6,985.16 with the United States Guarantee Company as surety and W. J. Hankee
Company in.the.amount of $1,000.00 with the St. Paul Mercury Indemnity Company
as $urety were each read and upon motion by Schroeder, second by Brumm, the bondsl
were approved the surety thereon accepted and the same were ordered placed on

file.
The follo.ming resolutions were each introduced and read: ;
Alderman Schroeder introduced a resolution authorizing the Public
Utility Board to enter into contract with the Fuel Economy Engineering Company
and upon motion by Brumm, second by Davis, and all present voting in favor thereof
President Bach declared the said resolution duly passed and adopted.
Alderman Schroeder introduced a resolution authorizing the Public

declared the said resolution duly passed and adopted.
Alderman Schroeder introduced a resolution authorizing the Public
Utility Board to enter into contract with L. M. Feller Company and upon motion by
Morris, second by Schroeder, and all present voting in favor thereof, President
Bach declared the said resolution duly passed and adopted.
Alderman Brumm_introduced a resolution authorizing the City Engineer to
publish notice regarding construction of sidewalks and upon motion by Schroeder,
second by Thiem, and all present voting in favor thereof, President Bach declared
the said resolution duly passed and adopted.
Alderman Morris introduced a resolution.appropriating $1,813.00 from the
General Fund, $3,994.70 from the S & A Fund, $424.70 from the Sewer Fund, $8.00
from the Bridge Fund and $92.20 from the Parking Meter Fund and. ordering payment
made to Street & Alley Fund and upon motion by Thiem, second by Brumm,•and all
present voting in favor thereof, President Bach declared the said resolution duly
passed and adopted.
Alderman Morris introduced a resolution appropriating $4,697.60 from
the General Fund, $2,692.24 from the S & A Fund and $129.45 from the, Parking Meter
Fund and ordering payment made to Rochester Sand & Gravel- $2,813.76; Rochester Post
Bulletin- $313.70; Val Bjornson, State Treasurer- $3,4 37.20; Blacktop Maintenance
Company-$326.63 and Queen City Motors- $628.00 and upon motion by Brumm, second by
Davis, and all present'voting in favor thereof, President Bach declared the said
resolutiom duly passed and adopted.
Alderman Morris introduced a resolution appropriating $1,273•g5•from the
P.I.R. Fund and ordering payment made to O'Loughlin & Hansen and upon motion by
Davis, second by Morris, and all present voting.in favor thereof, President Bach
declared the said resolution duly passed and adopted.
Alderman Morris introduced a resolution appropriating $1,512,14 from the
P.I.R. Fund and ordering payment made to Leon Joyce and upon motion by Morris,
second by Schroeder, and all present voting in favor thereof, President Bach
declared the said resolution duly passed and adopted,
Alderman Morris introduced a resolution appropriating $1,942.25 from the
P.I.R. Fund and ordering payment made to Leon Joyce and upon motion by Schroeder,
second by Thiem, and all present voting in favor thereof, President Bach
declared the said resolution duly passed and adopted.

Alderman Thiem.introduced a resolution appropriating $21,997.90 from the m
S.D.P. Fund and ordering payment made to Carlisle G. Fraser and upon motion by
Schroeder, second by Thiem, and all present voting in favor thereof, President
Bach declared the said resolution duly passed and adopted,
Alderman Thiem introduced a resolution -appropriating $2,195.60 from the
F.E•Williams Estate Fund -and ordering payment made to Park Improvement Fund and

An Ordinance regulating the installation of gas piping and gas appliances;.
in buildings in the City of Rochester, Minnesota, was given its second reading.
Upon motion by Thiem, second by Morris, and upon roll call and all present
voting in favor thereof, the rules were suspended and the Ordinance was given its
third and final reading.
-Upon motion by Morris, second by Schroeder, that the said Ordinance be
adopted as read, and all present.voting in favor thereof, President Bach declared

An Ordinance, repealing an ordinance entitled, $An Ordinance providing
that no petition, application or plat for the annexation of any land to the city
of Rochester shall be accepted or_.approved, nor any land be made'an addition to

said City unless at least t-en percent of the total area .of wu.ch land, or ten per
cent of the. value thereof, exclusive of the str-eet4 and alleys therein, shall
have been dedicatted to.some public purpose to be approved by the Common Council
of said City', was .given ,its third and final reading.
Upon motion by Davis, second by Brumm, that the said Ordinance be
adopted as read, and all present voting in favor thereof, President' Ba-ch declared
the. sa.•id Ordinance duly passed and adopted.,
An Ordinance amending an Ordinance entitled, °A.n Ordinance for the
purpose of promoting health, safety, order, convenience and generAl welfare by -
regulating the use of land, the location, size, use. and heighth -of bui-ldings,
and the arrangement of buildings, on lots and the density of population within
the City of Rochester, Minnesota., a.11 in accordance with a comprehensive plane,
was given its first reading.. t .
Upon motion by Brumm, second by Davis, -and upon roll call and all
the rules were suspended and
present voting in favor thereof,/the Ordinance was given its second reading.
Upon motion by Davis, second by.Brumm, and upon roll call and all
present voting in favor thereof, the rules were.suspended and the Ordinance was
given its third and final reading.,
Upon motion by Brumm,.second by Davis, that the -said -Ordinance be
adopted as, read, and all present voting in favor thereof, President Bach- 1.
declared the said Ordinance duly passed.and adopted.
An Ordinance amending an Ordinance entitled,."An Ordinance providing
for the licensing, supervision, inspection and -enforcement of heating, air-
conditioning, and ventilating, in tYje City of Rochester, Minnesota", was given
its first reading.
Upon motion by Morris,.second by Davis, and upon roll call and all
present voting in favor thereof, the rules were suspended and the Ordinance iias•
given its blecond reading.
Upon motion by Davis, second by Morris, and upon roll call and all
present voting in favor thereof, the rules were suspended and the Ordinance was
given its third and final reading.
Upon motion by Morris, second by Thiem, that the -said Ordinance be
adopted as read, and all present voting in favor thereof, President Bach
declaredthe said Ordinance duly passed and adopted,

Minnesota, and providing weight,restrictions on city streets, was given its

thereof at retail except in licensed premises and to any person under the age of _
twenty-one years of age, and repealing all ordinances or parts of ordinances

Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Nall, in
said City on September S, 1952.
President Bach called the meeting to order at 9:00 o'clock P. M., the
following members being present: President Bach, Aldermen Brumm, Davis, Morris,
Schroeder and Thiem. Absent: Alderman Anderson, Ine to illness.
Dr. H. F. Helmholz requested permission to use the Council Chambers for
a meeting of the Olmsted County Community Council on October 9, 1952 at 9:00 P. M.
and also permission to hold a meeting in January and one in April, 1953 and upon
motion by Schroeder, second by Thiem, his request was granted.
Mr. Charles McDonald was again before the meeting in regard to the
parking of cars on 1st Avenue Southwest between Center Street and 4tia Street.
Southwest. lhr; McDonald again.' *rotested the changing of angle parking in the
said area to parallel parking and recommended that study be given to the
conversion of the Williams Estate property,on the corner of 1st Avenue and 3rd
Street Southwest, to parking area. Alderman Davis recommended that the proposed
parking change be made on a 60 day trial basis. A motion was made by Davis,
second by Brumm, that the Chief of Police be instructed to convert the angle
narking on 1st Avenue Southwest between Center Street and 4th Street Southwest
to parallel parking and that the Clerk bring the matter to the attention of the
Council on the first Monday in November, after the trial parking period. All
present voted in favor of the motion except Alderman Morris, who voted "no".
Mr. Arthur Swan, Attorney representing the Rochester Bus Lines, Inc.,
was before the Council and advised them that the Rochester Bus Lines, Inc. was
petitioning the Railroad & Warehouse Commission for certain increases in bus
fares in the City of Rochester. He presented data prepared by the officials of
the Rochester Bus Lines, Inc. to support the request for increase in rates.
Alderman Schroeder introduced the following resolution and upon motion by Brumm,
second by Davis, that the said resolution be adopted as read, and all present
voting in favor thereof, President Bach declared the said resolution duly passed
and adopted:
"WHEREAS, the Rochester Bus Line, Inc. has given many years
of service at reasonable rates in the City of Rochester, Minnesota;, and
Whereas, said Rochester Bus Line, Inc. has to provide additional revenue
in order to pay the increased costs of operation; and, Whereas, the
Rochester Bus Line, Inc. has given information to the Common Council of
the City of Rochester, as to the necessity of a rate increase;
NOW, THEREFORE, be it resolved that the Common Council of the
City of Rochester, Minnesota, does hereby respectfully request the State
Warehouse and Railroad Commission to grant the Rochester Bus Line, Inc.
a rate increase that will be fair and equitable.1'

Grounds Committee, stated that the said committee was nxk in favor of signs in

multiple dwelling areas being.light.ed with incandescent or fluorescent lights ,
and that neon signs be not permitted. A motion was made by Schroeder, second by
B-Tumm, that the matter be referred to the Lighting Committee. Aldermen Davis,
Thiem and 'Morris voted "no" and President Bach declared the motion lost.
After discussing the matter further, a motion was made by Davis, second
by Schroeder, that the City Attorney be instructed to prepare an -amendment to the
ordinance governing the construction and erection of signs in a multiple dwelling,
district, which would allow only indirect lighting and restrict the illumination
to 50 watts on 6a.ch side of the sign and also prohibit the use of signs in red
color. Upon roll call Aldermen Brumm and Thiem voted Mno", Alderman Morris did i
not vote and Alderman Davis and Schroeder and President Bach voted "yes".
Mr..James Spillane,.representing residents on 4th Street Southeast who
are protesting the ,widening of certain parts of the street to 44 feet, was again
heard. He stated that his clients would not object to the project if the width
of the street did not exceed CFO feet. Mrs. Bunn Wilson stated that she was very
much in opposition to the street being. 44 feet in width,, which would require the
moving of her sidewalk and would change the slope of her lawn. Mr. Spillane
stated that property owners interested in the project would like -to be heard
before the State representative, due to the fact that the Minnesota State Highwayi)
Department would be a party to the contract. After discussing the muter further).

Misses Elma Starkson, Nell Stark -son and Evelyn MoA nke were present at

residences and others operating guest homes on 1st Street Southwest. Alderman
Davis moved that the discussion be discontinued at this time and that the matter
be referred back to the Police Committee and the Chief of Police for further
study. Alderman Brumm seconded the motion and all present voted in favor of same.
Alderman Morris read a letter from Walter C. Heins, Insurance Agent,
advising the Council that they now have a policy for bodily injury at the Mayo
Civic Auditoriam with limits.of $100,000 and $300,000 and that limits could be
Increased to $100,000 and $1,000,000 for an additional premium'of $36.12. A
Motion was made by Thiem, second.by Schroeder,,that the increased coverage be

was read together with a. statement of acquiescence signed by S residents in that
area and upon motion by Schroeder, second by Davis, the same was referred to the
Board of Zoning.
Alderman Schroeder reported verbally on plans for flood control of Bear
Creek in Southeast Rochester and recommended that the bed of the stream at the
bridge on 6th Street Southeast be cleaned and the expense of the work be paid from
the Bridge Fund. He further recommended that other work in connection with the
flood control project be done as soon as funds could be made available for the
cost of same. Upon motion by Schroeder, second by Thiem, the work of cleaning
the channel at the 6th Street bridge was authorized and the expense of same to be
paid from the Bridge Fund.
The recommendation of the Lighting Committee that Christmas Street
Lighting be handled this year as in previous years, the Council.to advertise for
bids using specifications approved by the Public Utility Dept;; supervision of
the lighting project to be in the hands of the Chamber of Commerce and the v0ity
to pay up to $1,000.00 of the cost of ,Christmas Street Lighting, was read. A
'Notion was made by Davis, second by Morris, approving the recommendation and
instructing the City Clerk to advertise for bids to be opened at the meeting of
October 6, 1552. All present voted in favor of the motion except Alderman Brumm
who voted "no".
The recommendation of the Lighting Committee that streets lights be
installed at loth Avenue and 9th St. N. E.; 9th Avenue and 9th Street N.E.; 16th
St. and Broadway N. E.; 2nd Avenue and 16th St. N. E. and in all appropriate
intersections in Peck's 2nd Addition was read. A motion was made by Davis,
second by Schroeder, that the recommendation be approved and that the City Clerk
be instructed to notify the Public Utility Board of the action taken by the
Council and that a study of improving the street lighting on 12th Street S.E.
from Broadway East be made.
The recommendation of the Sewer Committee of a budget for the
operation and maintenance of the new sewage treatment plant was again brought
to the attention of the Council and upon motion by Schroeder, second by Brumm,
the recommended budget for the balance of the fiscal year was approved with the
exception of the matter of travel allowance, which was referred back- to the Sewer
Committee. All present voted in favor of the motion.
Upon motion by Brumm, second by Schroeder, the meeting was adjourned
until 7a 30 O'clock P. M. on Monday, September 15, 1952.
