I� (j President Bach called the meeting to order at 7:30 o'clock P. M., the yj following members being present: President Bach, Aldermen Brum�i;, Davis, Morris, i I4 Schroeder and Thiem. Absent: Alderman Anderson, due to illness'I. I Upon motion by Davis,. second by Thiem, the minutes of jthe two meetings liheld , on September g, 1952 were approved. President Bach stated that this was the date set for a! hearing on the II matter of rent control in the City of Rochester, Minnesota. Mayor Glenn_ 0. I) Amundsen presented a survey of housing facilities in the City of, Rochester which I� had been prepared by the area rent office. He also stated thathe had in his i possession a petition signed by 125 residents of Rochester requesting that rent control be continued in the City. He further stated that he had received 25 j letters a.].1 of which, with the exception of 2, asked that rent control be not discontinued. i� Mr. Louis Wilson, Mr. Ed Ca.pelle, Mr. Emil Reiter, Mr.' George Leiferman !I I - ' and Mr. Wade were heard expressing their.opposition to rent control. Mr. Robert IIPetersdorf, Business Manager of the A.F.L., stated that he did not think it was L the proper time to discontinue rent control. ..r. Charles Clark, acting business I agent fdr restaurant -hotel employees, stated thatthey had members earning less i than $1.00 per hour who could not afford to pay high priced housing and for that ,j reason he felt that rent control should be continued. Mr. Magnss -Augustson, II I stated .that he noted that there was a. petition left at the union hall opposed to II rent control and that it was signed by two individuals. Mrs. Alice Lee, Realtor, � i I IIMr. Albert Pries,Realtor, Mr. P. A: Parker and Mr. Leo Niilostan'�stated their I, - 1 opposition to rent controls. �I Alderman Morris stated that he did not think it was the proper time of I, �I the year to remove rent controls for the reason R:acpxgt&gx2E=XQc= that it would be j a hard time to find housing during the fall season and --therefore- he was not j� in.favor of decontrolling rent until April 30, 1953. Alderman Brumm stated that �i he had been opposed to rent controls for the reason that owners of real estate I (! did not have control of their property and at the present time it appeared that ,II i the rent of some houses was controlled while others were not. j Alderman Davis read a, prepared statement in which he stated that he did I Ei not believe it proper for the Common Council to supervise the control of rents in II. i II the City. In concluding his statement he said that no evidence had been heard which would justify a decision that there exists a critical housing shortage in the City of Rochester and that he was opposed to any action which would continue rent controls. A communication from I,:iss Agnes Hoffman protesting the extension of rent controls was -read and the same was ordered placed on file. Alderman Morris introduced a resolution which would continue rent control in the City of Rochester until April 30, 1953, and moved its adoption. No second to his motion was received and President Bach declared the motion lost for lack of a second, President Bach stated this as being the time and place set for a hearing on the petition for the vacation.of that mart of 15th Avenue Southeast described as, "commencing at a Point 33 feet south of the north line of the Southeast Quarter of Section One, Township 109, North Range 14 West and extending in a southerly direction to the northerly right of way line of temporary trunk highway No. 20, said part of 15th Avenue Southeast being further described as a strip of land 33 feet on each side of the west line.of the Northeast quarter of the southeast quarter of said Section One. -Township 105 North, Range 14 West". There was no one present wishing to be heard. A letter from the State.of Minnesota, Department -of Aeronautics, transmitting 13 copies each of State Forms No. 202 and 220 to be executed by the City of Rochester was read and ordered placed on file. The request of.the Isaak Walton League for permission to hold a bingo game on September 27, 1952 was read and the same was ordered placed on file. A petition for a permit to construct, maintain and operate an industry track across 9a Street Southeast together with a plat of the proposed track was read and upon motion by Schroeder,,second by-Thiem, the same was referred to the Street & Alley Committee. A communication from the Rochester Police Benevolent Association, Grievance Committee, requesting a meeting with the Council was read and upon motion by Davis, second by Brumm, the same was referred to the Police Committee. A petition to have 12th Street Northwest between 2nd and 4th Avenues Northwest bla.ektopped was read and upon motion by Brumm, second by Schroeder, the same was referred,to the Street & Alley Committee. The recommendation of the Police Committee that two Ford cars now in service in the Police Department be replaced by new cars was read and upon 1 • I, I n U F-J 1 motion by Davis, second by Brumm, the recommendation was approved. An invitation from the City of Chatfield to attend a regional meeting of the League of Minnesota Municipalities to be held on October 14, 1952 was read and the City Clerk was instructed to make reservations for eight at the dinner to be held at 6:30 o'clock P. 114. Alderman Morris Chairman of the License Committee presented an affidavit signed by Alve Birkeland stating that he did not own a license for the sale of intoxicating liquors, nor does he have any financial interest in any such license in the State of Minnesota, and upon motion by Davis, second by Thiem, the transfer of intoxicating liquor license Wo. 299 from Joseph Dupere to Alve Birkeland was approved, subject to the statements made in said affidavit. The report of the Clerk of Municipal Court for the week ending September 1.3, 1952 showing total criminal fines and costs collected $1, 215.00 aad.. civil fees received $7.70 was read and having been approved bythe City Attorney,,' President Bach ordered the same placed on file. The applications of Alfred Betcher for license to sell non -intoxicating;' malt liquors "on sale" and "off sale".were each read and upon action by Davis, second by Brumm, the licenses were granted. The appl-Icatlons of Alfred Betcher for license to sell soft drinks and cigarettes were each read and upon motion by Brumm, second by Thiem, the licenses, were granted. The applications of Marie DeFosse for license to sell soft drinks and cigarettes were each read and upon motion by Brumm, second by Davis, the licenses were granted. The application of Gerald H. Breuer for a Journeyman Plumbers License was read and upon motion by Davis, second by Brumm,.the license was granted.. The applications of Walter F. Van Lith for license to sell soft drinks and cigarettes were each again read and upon motion by Brumm, second by Schroeder; the licenses were granted. The application of Allen DeFosse for license to sell soft drinks was again read and upon motion by Davis, second by Schroeder, the license was granted® Miss Elms. Starkson and Rev. W. W. Bunge were again before the Council and opposed any change in parking of cars on the South side of lst Street S. W. cast of llth Avenue S. W. Per. Andrew Koehnen, who resides on 1st Street S.W., stated that he was in favor of discontinuing parking on one side or the other of said street. They were informed that the matter was still in the hands of the Police Committee, which was not ready to report at this time. 0 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., September 15, 1952 The following resolutions were each introduced and read; Alderman Brumm introduced a resolution vacating a 'part of 15th Avenue Southeast described as, commencing at a point 33 feet south of the north line of the Southeast quarter of Section one, Township 109 North, Range 14 west and extending in a southerly direction to the northerly right of way line of temporary trunk highway TTo. 20, and upon motion by Davis,: second by Thiem, and all present voting An favor thereof, President Bach declared the said resolution duly passed and adopted. Alderman Thiem introduced a resolution appointing and designating the - Commissioner of Aeronautics as agent of the City of. Rochester and upon motion by Brumru, second by Davis, and all present voting in favor thereof, President Bach declared the said resolution duly passed and adopted. Alderman Thiem introduced a resolution_ firing salaries at -che New Sevage Treatment Plant and upon motion by Davis, second by Schroeder, and all present voting in favor thereof, Pres.ident Bach declared the said resolution duly passed and adopted. Alderman Thiem introduced a resolution ordering bids for Christmas Street Lighting for the 1952 season and upon motion by Schroeder, second by who voted "no" Thiem, and a.11 present voting in -favor thereof except Alderman "BrummV, Presiden t Bach declared the said resolution duly passed and adopted. Alderman Thiem introduced the following resolution; "WHEREAS, the death of John T. Lemmon has taken from -our City one who served Rochester well for many years through his services as Alderman, Mayor and President of the Common Council together with his untiring efforts on many committees whose interests were to further the general welfare of the City. His deep interest in governmental affairs, his energy in carrying tjrrough programs of benefit and his integrity and unLerstanding while serving the public was outstanding and will long be remembered. 110IT THEEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: Tha.t.we, the Common Council, representing the people of the City of Rochester, extend most sincere and heartfelt sympathy -to his wife and family. Be it further resolved: That this resolution be made a part of the records of the City of Rochester and a copy thereof be immediately forwarded to Mrs. John T. Lemmon." Upon motion by Thiem, second by Brumm, and all present voting in favor thereof, President Bach declared the said resolution duly passed and adopted. 0 Alderman Schroeder introduced a resolution appropriating $790.00 from the Street & Alley Fund and ordering payment made to H. T. EEorle & Son and upon motion by Brumm, second by Davis, and all present voting in favor thereof, President Bach declared the said resolution duly passed and adopted. Alderman Schroeder introduced a resolution appropriating $490.29 from the P.I.R. Alderman Brumm introduced a. resolution ordering a hearing on the levying of special assessments for construction of a curb and gutter on,10th Street S.E. from 3rd to 4th Avenue S. E. and upon motion by-Brumm, second by Davis, and'all present voting in favor thereof, President Bach declared the said resolution duly passed and adopted. Alderman-Brumm introduced a resolution ordering a hearing an the levying;' of -special assessments for construction of a curb and gutter on 6th Street S. E. from Sth to 9th Avenue S. E. and upon motion by Davis,•second. by Schroeder, and all present voting in favor thereof, President Bach declared the said resolution duly passed and.adopted. Alderman Brumm introduced a resolution ordering a hearing on the,levying� of special assessments.for cor_struction•of •a curb and gutter on 13th'Avenue S. E. from 4th to 5th Street,S. E. and upon motion by Schroeder, second by Thiem; and all ,present voting in favor thereof, President Bach -declared the said resolution duly passed and adopted. Amundsen stated that he thou ht- it would be g proper for al business places in the City of Rochester.to close from 2:00 o1clock to 4:00 o'clock P. 1K. during the dedicAtion of the Mayo Memorial on September 27, 1952. Upon motion by Davis, second by Thiem, the Mayor was authorized to request the closing of all business houses during the hours of 2:00 to 4:00 olclock P. M. on September 27, 1952. The matter of construction of signs in the multiple dwelling zone was again brought to the attention of the Council and upon motion by Davis, second by Brumm, the use of neon signs in white, blue or gold was authorized. Upon motion by Thiem, second by Davis, the City Attorney was instructed to prepare an amendment to the ordinance governing the construction, erection and maintenance of signs, permitting the use of white, blue or gold colors in neon a signs in a. multiple dwelling area. All voted in favor of the motion except Alderman Schroeder, who voted "no". The application of the Mrs. Jaycees, the League of Women Voters, the Jaycees, the Boy Scouts of America, the American Federation of Labor CLU and the American Legion for a permit to use sound trucks on the streets of. the City of 0 F'20S Record of Official Proceedings of the Common Council of the City of Rochester, Minn., September 15, 1952 Rochester, signed by Ge,orge F.
