Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City is
on October 6, 1952•
President Bach called the meeting to order at 2:00 o'clock P.M., the
following members being present: President Bach, Aldermen Brumm, Davis, Morris,

and Thiem. Absent: Aldermen Anderson and Schroeder.
Upon motion by Davis, second by Thiem, the minutes of the meetingsof
September 9th and September 15th, 1952 were approved.
President Bach stated this as being the time and place set for the
receiving and opening of bids for Christmas Street Lighting for'1952. A motion was
made by Morris, second by Davis, that the bid. - received be opened, and all
present voted in favor thereof, except Alderman Thiem, who voted "no". The bid
of Naegele Poster Service in the amount of $2,444.40 was received and opened. X
A motion was made by Morris, second by Davis, that the bid be referred to the
Lighting Committee of the Common Council and the Christmas Street Lighting
�I Committee of the Chamb-er of Commerce, with power to' act. All present voted in
favor of the motion, except Alderman Brumm who voted "no".
II President Bach stated this as being the time and place set for the

Hearing on the levying of special assessments for the construction of a'
curb and gutter on 6th Street Southeast from Sth to 9th Avenue Southeast; there
was no one present wishing to be heard.
Hearing on the levying of special assessments for the construction of a

curb and gutter on 13th Avenue Southeast from 4th to 5th Street Southeast. There
was no one present wishing to be heard.
Hearing on the levying of special assessments for the construction of a
curb and gutter on Sth Avenue Southeast from loth to llth Street Southeast. There"
was no one present wishing to be heard.
Hearing on the levying of special assessments for the construction of a'
curb and gutter in Peck's First Addition. There was no one present wishing to be
heard.
Hearing on the levying of special assessments for the construction of a,
curb'and gutter on 12th Avenue. Northeast from 9th to 14th Street Northeast. There
was no one present wishing to be heard.
Hearing on the levying of special assessments for the construction of
a curb and gutter on loth Avenue Southeast from East Center Street to 4th Street
Southeast. There was no one present wishing to be heard.
Mr. Harold Patterson was before the Council and stated that the sewer
lateral to his property on North Broadway did not drain due toa defective trunk
line in Broadway to which it was connected. No action was taken by the Common
Council on the matter.

The four following resolutions adopted by the Public Utility Board were
each read and President Bach ordered that the same be placed on file:
"WHEREAS, water mains were installed in 15th Avenue Southeast
from Durand Court to Graham Court, des-cribed as Lots 14 to 39 inclusive,
Homestead Addition, the total cost of the said mains being $6.668.39,
and
WHEREAS, the Mayo Association paid for the said installations and
same was not assessed against the properties benefited, and
WHEREAS, the said Mayo Association has applied for a refund'of
said costs for certain lots, and
WHEREAS, the Public Utility Board has received no authorization
from the Common Council to make said refunds,
THEREFORE, be -it and it is hereby resolved by the Public Utility
Board of the City of Rochester, Minnesota that the Common Council be and •
is hereby requested to authorize the Water Department to make s6ld
refunds and the amount of refund for each lot benefited by the
installation. q
"Be it and it is hereby resolved by -the Public Utility Board of
the City of Rochester, Minnesota that the Common Council of the said
City -be and is hereby requested to authorize the said Board to enter into
a contract with the SOUTHERN MINNESOTA SUPPLY COMPANY for the furnishing,
in accordance with specifications, of
DIVISION .ol - 600 VOLT MOTOR CONTROL CENTER
the total amount of the said contract to be TWENTY SEVEN HUNDRED FIFTY THREE
DOLLARS AND EIGHTY SIX CENTS ($2,753.86)."
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochest.er,-Minnesota that the Common Council of the said
City be and is hereby requested to authorize, in behalf of the City Water
Department, the purchase of -
Lots.6-7-8 of Block 12, West Zumbro Addition
from Ray-J. Arend, the purchase price for the three lots to be 'WHIRTY
THREE HUNDRED DOLLARS ( $3, 300.00) . "
"Be it.and it is hereby resolved by the Public Utility Board
that the Sinking Fund Commission be and is hereby requested to appropriate,
from uninvested funds in the Sinking Fund for Electric Department
Depreciation Reserve, the amount of WWENTY THOUSAND DOLLARS ($20,000.00)
to the Public Utility Fund." t
The request of the Wm. T. McCoy Post No. 92 for permission to spmnsor
Bingo games in their club rooms in the Mayo Civic Auditorium on each Monday Night
was read and President Bach ordered that the same be placed on file.
The request of the American War Dads for permission to sell tags on the
streets of Rochester, Minnesota for the annual Marigold Tag Day on October 19,1952
was read and upon motion by Davis, second by Thiem, the said request was granted.

The recommendation of the Planning and Zoning Commission that the plats
of Leitzen's Sub -Division and the Hillsidd Addition (formerly known as Faber and
Gores Addition) had been examined and the same were satisfactory and that they be
accepted was read and President Bach ordered that the same be placed on file.
A letter from Local No. 897 requesting a meeting of their Committee with
the Common Council before the budget is set was read and the date of October 17th
was set to meet with the said committee.
A lettef from Clarence Dougherty stating that a sewer line had been
extended in 7th Avenue Northwest north of 16th Street approximately 75 feet,
25 feet of which abutted on his property and for which he had been assessed
$257.00. He further stated that parties interested in property to the North of

his. place might wish to have the said sewer line extended north,to service their i!
property and if the sewer was extended, about 55 feet of it would"be abutting on
h&s property. He inquired as to whether or not he would be assessed for
additional sewer line and upon motion by Davis, second by Thiem, his letter was
referred to the Sewer Committee and the City Engineer.

The' request of the Board of Public Health & Welfare that the gift from the

General Mills, Inc. in the amount of $1,000.00 which was previously deposited in
the Sinking Fund until such time as the said Board wished to have the gift made
available for the support of the nutrition teaching kitchen was read and President:

Bach ordered the same placed on file.
The request of the Board of Public Health & Welfare for permission to
employ Mrs. Evelyn Maassas secretary to the Counseling Clinic and the -Family
Service Division at a beginning salary of $210.00 per month was read and upon
motion by Morris, second by Davis, the request was approved,
The two following resolutions adopted by the Sinking Fund Commission
were each read and upon motion by Davis, second.by Thiem, the same were approved:
"WHEREAS, on June 11, 1952 the sum of $1,000.00 was received
from General Mills, Inc. of Minneapolis as a gift for the support
of the Nutrition Teaching Kitchen in the Public Health Center, and
-WHEREAS, the Public Health and Welfare Department requested
that the said sum be set aside in the Sinking Fund until such time
as the Nutrition Teaching Kitchen project was started," and
WHEREAS,,the said project was started on September 2, 1952
and request is made for the transfer of the $1,000.00 from the
Sinking Fund to the Public Health and Welfare Fund.
SO THEREFORE, Be it resolved by the Commissioners of the
Sinking Fund of the City of Rochester:
That the said $1.000.00 be appropriated from the Sinking
,:Fund and ordered paid to the Public Health and Welfare Fund."
"WHEREAS, the Public Utility Board of the City of Rochester,
Minnesota, has ddopted the following quoted resolution:
"Be it and it is hereby resolved by the Public
Utility Board that the Sinking Fund Commission'be
and is hereby requested to appropriate, from
uninvested funds in the Sinking Fund for Electric
Department Depreciation Reserve, the amount of
TWENTY THOUSAND ($20,000.00) to the Public Utility
Fund."
SO THEREFORE, Be it resolved by the Commissioners of the
Sinking Fund of the City -of Rochester, Minnesota:
That the sum of $20,000..00 be appropriated from the Sinking
Fund for Electric Department Depreciation Reserve and paid to'the
Public Utility Fund."
A letter f r.om Mr. Earl W. Leaf stating that he was taking a leave of
absence from the duties of operating his magazine agency and for that reason
;could not need the parking space until he returned was read and President Bach
ordered the same placed on file.
Notice of hearing in the matter of the application of the Rochester
Bus Line, Inc. for an increase in fares to be held on October 16, 1952 at 11:00
A. M: in the City Hall was read and the same was ordered placed on file.
The recommendations of the Board of Zoning that the petition of Guido

and Mafe Capriotti to have Lot 24, Block 4, 8utzky's First Addition changed from
a residential to a multiple dwelling zone be granted and that the petition of
Roy H. Bremer and Fred Arnold to have the property located at Nos. 16 and 20,.
9th Avenue Northeast changed from a residential to a multiple dwelling zone be
granted were each read and upon motion by Davis, second by Thiem, the recommen-
dation was approved and the City Clerk was instructed to publish a notice ordering
a hearing on the said zoning changes on October 20, 1952 at 7:30 o'clock P.M.
A communication from the Board of Park Commissioners stating that
parapet walls •
the waterproofing of the W=bE= at the Mayo Civic Auditorium had now been completed
at a cost of $475.58 and that the Council had previously agreed to pay for this
work from the Permanent Improvement Fund was read and the same was ordered placed
on file.
Mr. James Spillane, Attorney representing the Chicago Great Western
Railway Company in the matter of constructing an industrial track across 9j
Street Southeast, again requested that the Council approve the petition of the
Chicago Great Western Railway Company. The following recommendation of the
Street & Alley Committee was read and upon motion by Morris, second by Thiem,
the same was approved:
"Honorable Mayor & Common Council
City of Rochester, Minnesota
Gentlemen:
We, the undersigned members of the Street and Alley
Committee, recommend that permission be granted to the
Chicago Great Western Railway to construct a spur line
across 9j Street Southeast to serve the new location of
the Botsford Lumber Company.
We further recommend that they be required to enter
into agreement with the City to maintain a width of
seven (7) feet each side of the centerline of their track.

Mr. James Spillane, representing owners of property on 4th Street
Southeast again requested that the Council.consider a 40 foot width in the
street East of llth Avenue to lath Avenue, instead of 44 feet as shown on the
plans.
A petition for the construction of a curb and gutter on 10i Street
Southeast from lot to 3rd Avenue Southeast was read and upon motion by Davis,
second by Thiem, the same was referred to the Street & Alley Committee and the
City Engineer.
The petition of Charles E. and Emma B. Hatch to have Lot 5, Block 24,
changed from a residential to a commercial zone was read together with a
statement of acquiescence and upon motion by Davis, second by Brumm, the same

was referred to the Board of Z-oning.
The petition of Frances G. and Louis V. Twyeffort to,have a plat of a
part of the -northeast quarter of Section 34, Township 107, Olmsted Cou#ty
annexed to the City, to be known -as Gooding's Addition, was read and upon motion;
by Davis, second by Brumm, the same was referred to the Planning Commission, the
City Engineer and the Public Utility Board for recommendation*
The recommendation of the Fire Committee and the Chief of the Fire
Department that Section 5 of Ordinance No. 790 be amended to read as follows was
read:
"The burning of any or all of the waste herein mentioned
outside of the Fire Limits in the City of Rochester in or
upon grounds public or private within 30 feet of any dwelling
is hereby prohibited. Burning may be done within 20 feet of
all other buildings such as, sheds or garages, provided burning
be.done in an approved type tight burner with a spark arrester
on smoke pipe."
Upon motion by Morris, second by Brumm, the recommendation was approved and the
City Attorney wasinstructed to prepare an Ordinance amending Section 5 of
Ordinance No. 790.
A petition, signed by 59 residents on let Street Southwest between 7th
and llth Avenue Southwest, to reconsider and further investigate the question of
the restriction of parking and stopping on the south side (or either side) of
li lot Street Southwest was read and upon motion by Davis, second by Brumm, the same,.
was referred to the Police Committee.
A petition for vacating that portion Of 5th Street Southeast that lays
between 10th'and llth Avenue Southeast, signed by 29 interested property owners
in that vicinity, was read and the same was referred.to the Street & Alley
Committee and the City Engineer.
A protest against the vacation of 5th Street Southeast between 1,Oth and,
llth Avenue'Southeast, signed by 52 interested residents in that area, was read
and upon motion by Morris, second by Thiem, the same was referred to the Street 80
Alley Committee and the City Engineer.
A petition signed by 24 members of the Lincoln School P.T.A. for the
immediate installation of some type
.of automatic signal device at West Center
Street and llth Avenue for the control of traffic and protection of children was
read and upon motion by Brumm, second by Davis, the petition was referred to

the Police Committee and the Chief of Police.
A petition for the construction of a curb and gutter on both sides of
10th Street Northwest from 9th to 10th Av'enue Northwest was read and upon motion
by Morris, second by Davis, the same was referred to the Street & Alley Committee,,
and the City Engineer,

Northwest from 5th to 6th Street Northwest was read and upon motion by Thiem,
second by Davis, the -same was referred to the Street & Alley Committee and the
City Engineer.
A petition for the construction of a curb and gutter on 9th Avenue
Northwest from 7th to loth Street Northwest was read and upon motion by Thiem,
second by Davis, the same was referred to the Street & Alley Committee and the
City Engineer.
The following recommendation of the Fire Committee and the Chief of the
Fire Department was read and upon motion by Davis, second by Brumm, the same was •
approved:
"Honorable Mayor and Common Council
City of Rochester, Minnesota
Gentlemen:
We, the undersigned, recommend that a clothing allowance
of $5.00 per month be granted to the Members of the Rochester
Fire Department iiiediately (the Chief not included) and the
City Clerk be instructed to.draw a check for said amount for
the remaining months of the City year, and send same to
George Davis, Treasurer of the Rochester Relief Association.
In years hereafter, a check for the first.six months
clothing allowance be sent to the Treasurer of the Relief
Association not later than the second meeting in April and
the last six month clothing allowance be sent to the Treasurer
not later than the last meeting in October.

The City Engineer's summary of disbursements for the month ending
September 30, 1952 was read and the same was ordered placed on file.
The 'reports for the month of September, 1952 of the Building Inspector
showing fees collected for building permits issued in the amount of $382,00; of
the Electrical Inspector showing fees collected for electrical permits issued
in the amount of $73.50; of the Plumbing Inspector showing fees collected for
plumbing permits issued in the amount of $231.75; of the Heating Inspector
showing fees collected for heating permits issued in the amount of $19.50; and •
fees for sign permits in the amount of $54.33, were each read and President Bach
referred the same to the Finance Committee.
The report of the City Weighmaster for the month of September, 1952
showing fees collected for loads weighed in the amount of $126.05 was read and
President Bach referred the same to the Finance Committee.
The report of the City Treasurer for the month of August, 1952 was read
and the same was ordered placed on file.
The reports of the Clerk of Municipal Court for the week ending
September 20, 1952 showing total criminal fines and costs collected $734.00 and
civil fees received $4.95; for the week ending September 27, 1952 showing total
criminal fines and costs collected $1,193.05 and civil fees received $4.70; and

for the week ending October 'Z4, 1952 showing total criminal fines and costs
collected $765.00 and civil fees received $5.65, were each read and having been
approved by the City Attorney, President Bach ordered the same placed on file.
'The applications of William J. Murphy and:John L. Feller, Red Owl Stores,
Inc. and G. E. Rucker for -license to sell non -intoxicating malt liquors "off Sale"
were each read and upon motion by Brumm, second by Thiem, the licenses were granted.
The application of G. E. Rucker for license to sell non -intoxicating
malt liquors "on sale" was read and upon motion by Davis, second by Thiem, the
license was granted.
The applications of Red Owl Stores, Inc., Alve Birkeland, Joe M.
Endrizzi, William J. Murphy and John L. Feller, Ben and Hazel gittleson and'G.E.
Fucker for license to sell cigarettes were each read and upon motion by Morris,

two story frame dwelling over certain streets of the City was -read and upon

The application of Glen H. Archer for a license to sell beer at whole-
sale was read and upon motion -by Morris, second by Brumm, the license was granted.;
The application for transfer of "On Sale" 3.2 Beer License No. 759 from''
Jessie C. Steele to William J. Murphy and John L. Feller was read and upon motion
by Brumm, second by Morris, the transfer was granted.

The application of Carl Hutchings for license to construct sidewalks was'
read and upon motion by Brumm, second by Thiem, the license was granted.
The applications of Ross Mayhood for license to sell cigarettes and soft;
drinks were each read and upon motion by Thiem, second by Brumm, the same were
referred to the License Committee and the Chief of Police was instructed to notify'
the applicants to discontinue the sale of cigarettes and soft drinks until a
license is granted.
The application for transfer of "on sale" and "off sale' 3.2 beer
licenses from George Barbee to Ben and Hazel 8ittleson was read and upon motion
by Davis, second by Thiem, the transfer iof the lice,Ases was granted.

brokers license were each read and upon motion by Brumm, second by Thiem, the
licenses were granted.
The application of Donald McJunken for Electrical Contractors License
was read and upon motion by Brumm, second by Davis, the license was granted.
The application of Donald McJunken for a Master Electrician's License
was read and upon motion by Davis, second by Thiem, the license was granted.
The application for transfer of "On Sale' liquor license No. 299 from
Alve Birkeland to Alve Birkeland and Erwin Glasenapp was read and.upon motion by
Thiem, second by Davis, the transfer was granted.
The license bonds of Alve Birkeland dba Normandy Bar in the amount of
$3,000.00 with the St. Paul Mercury Indemnity Company as surety; Clifford Fauver
in the amount of $1,000.00 with the Western Surety Company as -surety; Donald
McJunken in the amount of $1,000.00 and Elmer C. Johnson (3) each in the amount
of $1,000.00 with the Aetna Casualty dnd Surety Company as surety, were each read
and upon motion by Morris, second by Davis, the bonds were approved, the surety
thereon accepted and it was ordered that the same be placed on file.
Thecontract bond of H. T. Earle & Son in the amount of $917.65 with
the Western Surety Company as surety was read and upon motion by Morris, second
by Davis, the same was referred to the Mayor for his approval.
The matter of payment for mileage from the homes of City employees to
their employment was discussed and a motion was made by Brumm, second by Davis,
that all compensation be discontinued for the use of City employees private cars
for driving to and from their work. All present voted in favor of the motion.
The following resolutions were each introdu-ced and read:

to 3rd Avenue Southeast and upon notion by Brumm, second by Davis, and all present
voting in favor thereof, President Bach declared the said resolution duly passed
and adopted.
Alderman Brumm introduced a resolution ordering a hearing on the levying
of special assessments for grading lSth Avenue Northeast from 9th Street N. E. to
the south line of Westlund's Addition, and upon motion by Davis, second by Morris,
and all present voting in favor thereof, President Bach declared the said
resolution duly passed and adopted.
Alderman Brumm introduced a resolution ordering a hearing on the levying
of special assessments for construction of a sanitary sewer and watermain and
grading of 5th Street Northeast from 15th Avenue Northeast to the east line of
Lot 10, JaneIsAddition and upon motion by Morris, second by Thiem, and all present
voting in favor thereof, President Bach declared the said resolution duly passed

An Ordinance amending an ordinance entitled, "An Ordinance establishing
minimum standards for plats in the.City of Rochester, Minnesota, and providing
regulations for the submission of plats to the Common Council for approval", was
given its first reading.

present voting in favor thereof, ,the rules were suspended and the ordinance was
given its second reading.

present voting in favor thereof, the rules were suspended and the ordinance was
given its third and final reading.
The matter of handling claims for the purchase of clothing for
uniformed members of the Police Department was considered by the Council and upon
motion by Morris, second by Brumm, an appropriation covering the next 6 months of
the fiscal year of allowance for police uniforms to be paid to the Treasurer of
the Police Relief Association was authorized. The said Police Relief Association
to take care of payment of all claims for police uniforms.
A plat of land to be known as Leitzen's Second Sub -Division and described
as follows was presented and upon motion by Brumm, second by Davis, the same was
approvedi "Commencing at the Northwest corner of Lot 33, Sec. 360107-14,
running thence east on the north line of said lot a distance
of 74 rods for a place of beginning, , runnifig thence south a
distance of 390 feet, -running thence west a distance of 316
feet, running thence north a distance of 390 feet, running
thence east a distance of 316 feet to the place of beginning."
Upon motion by Davis, second by Brumm, the meeting was adjourned until
