President Bach called the meeting to order at 7:30 o'clock P.M., the following members being present: President Bach, Aldermen Brumm, Davis, Morris, Schroeder and Thiem. Absent: Alderman Anderson. Upon motion by Morris, second by Schroeder, the minutes of the meetings of October 6th and October loth, 1952 were approved. President Bach stated this as being the time and place set'for the following hearings: Hearing on the levying of special assessments for the construction of a cubb and gutter on 3a Street Southeast from lath to 15th Avenue Southeast. There was no one present wishing to be heard. Hearing on the levying of special assessments for the construction of a curb and gutter on loth Street Southeast from 1st to 3rd Avenue Southeast. There was no one present wishing to be heard, Hearing on the levying of special assessments for the construction of a curb and gutter in Peck's Second Addition. There was no one present wishing to be heard. Hearing on the levying of special assessments for the construction of a sanitary sewer in 2nd Avenue Northwest from 13th Street Northwest to Cascade Creek. Mr. Earl Pike, owner of Lots 9, 9 and 10, less the South 20 feet of Lot 10, Block 29, Northern Addition, was present at the meeting and stated his objections to the assessment for sewer abutting his property, in the amount of $542.69. No change was made in the assessment. Hearing on the levying of special assessments for the construction of a sanitary sewer And watermain and grading of 5th Street Southeast from 4th to 5th Avenue Southeast and in 5th Avenue Southeast from 5th to 6th Street Southeast. There was no one present wishing to be heard. Hearing on the levying of special assessments for the construction of a sanitary sewer and watermain in Betcher's Sub -Division. There was no one present wishing to be heard. Hearing on the levying of special assessments for the construction of a sanitary sewer and watermain and grading in 5th Street Northeast from 15th Avenue Northeast to the east line of Jane's Addition. There was no one present wishing to be heard. I! Street Southeast from let to 3rd Avenue Southeast. There was no one present wishing to be heard. Hearing on.the proposed change of zoning of Lot 24, Block 4, Kutzky's Addition from a residential to a multiple dwelling zone. Mrs. Guido Capirotti i! was present and urged that the zoning change as petitioned for be made. Hearing on the proposed change of zoning of the property located at Nos. 16 and 20 on 9th Avenue Northeast, from a residential to a multiple dwelling zone. There was no one present wishing to be heard. President Bach stated this as being the time and place set for receiving i bids for furnishing two patrol cars for use in the Police Department. Two.bids were received and upon motion by Davis, second by Schroeder, the same were ordered opened. The bids of Universal Motors,. -Inc. in the amount cf $1,152.09 ;. each and Burnham Motor Sales in the amount of $919.00 each were received and Ixx opened and upon motion by Davis, second by Thiem, the same were referred to the Police Committee and the Chief of Police for report. President Bach stated this as being the time and place set for receiving v bids for furnishing two carloads of coal for use at the Fire Hall and the Old Sewage Disposal Plant. One bid was received and upon motion by Davis_ second by Morris, the same was ordered opened. The bid of Dodge Lumber &,Fuel Company in the amount of $13.00 per ton was received and opened and upon motion by Davis, second by Thiem, the same was referred to the Fire Committee, the Sewer Committee, and the City Engineer for report. The recommendation of the Fire Committee, the Sewer Committee and the City Engineer that the bid of Dodge Lumber & Fuel Company for furnishing two carloads of stoker coal at a price of $13.00 per ton be accepted was read and upon motion by Davis, second by Schroeder, the recommendation was approved. Mr. Joseph F. Mackey was again before the Council in,regard to the matter of vacating a pa-rt of 5th Street Southeast. He strongly urged that the vacation, be made. ` 1 The following resolution adopted by the Public Utility Board was read and President Bach ordered that the same be placed: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that. the Common Council of the said City be and is hereby requested to j authorize the said Board to enter into a contract with Allis- Chalmers Manufacturing Company for the furnishing, in accord- ance with zpecifications, of ADDITIONAL 15 KV SWITCHGEAR AND CONTROL BOARD, the total amount of the said contract to be TWENTY SIX THOUSAND ONE HUNDRED FIFTY DOLLARS ($26,150.00) and the said Allis-Chalmers Manufacturing Company being. the only. responsible bidder. °. The request of the Rochester Fire Department Relief Association that the' Council approve a loan in the amount of $500.00 to Mr: Joe Brogan on his home at 228 Record of Official Proceedings of the Common Council of the - City of Rochester, Minn., October 20, 1952 1703 - lst Avenue Southeast was read and ordered placed on file. A letter from the Rochester Airport transmitting a check in.the sum of $it416.67 covering 1/6 of the City's share as sponsor of the medium intensity lighting project at,the Rochester Airport, State Project No. 5501-05, Federal Project No. 9-21-047-203., Contract No. 253, was read and ordered placed on file. ,The recommendation of the Planning and Zoning Commission that the plat of land to be known as Gooding Addition was entirely satisfactory and the . annexation was recommended was read and ordered placed on file. Also the recommendation of the City Engineer that the Gooding Addition to the City of Rochester be annexed was read and ordered placed on file. The recommendation of the Police Committee and the Chief of Police that traffic signals of an appropriate type be, installed at the following locations was read and upon moti®n by Davis, second by Thiem, the same was approved, Alderman Brumm voting "no": 11 Avenue and East Center Street; 11 Avenue and h Street Southeast; 11 Avenue and 10 Street Northeast; 14 Street Northeast between 8 and 10 Avenues; 12 Street Southeast and 9 Avenue; North Broadway and 9 Street; and West Center and 11 Avenue. The recommendation of the Lighting Committee that the contract for Christmas Street Lighting be awarded to Naegele Poster Advertising Company in the sum of $2,444.4o , $1,000.00 of the contract price to be paid from the Lighting Fund of the City of Rochester, was read and the same was ordered placed on file. The recommendation cf the Sewer Committee that the City start operation of the new Sewage Treatment Plant on November 5, 1952 and that an agreement be entered into with the contractor setting forth the terms of such operation, was read and upon motion by Davis, second by Brumm, the same was approved. The recommendation of the Sewer Committee that the proper city officials be empowered to enter into a service agreement with the Harco Corp. for the maintenance of Cathodic Protection Equipment at the new Sewage Disposal Plant was read and upon motion by Davis, second by Brumm, the same was approvedo and the Mayor and City Clerk were authorized to execute the contract. The recommendation of the Street & Alley Committee that 12th Street 11. W. from 4th to 2nd Avenue H. W. be surfaced was read and upon motion by Thiem, second by Schroeder, the same was approved. The recommendation of the Finance Committee that a loan by the Fire Department Relief Association to Joe Brogan in the amount of $'500.00 on his home at 1703 - 1st Avenue Southeast be approved was read and upon motion by Davis, second by Brumm, the same was approved. Since Lot '12 and the North 20 feet of Lot 11, Ylilholin Subdivision (owned by Clarence and Levera Dougherty) have already been assessed for SO feet of frontage for the construction of the sanitary sewer now in place, this property would not be assessed further if this sewer was ,extended to serve property to the north of the Dougherty property.. There is a possible exception to this statement in th,e case the platting of property to the north was such that the Dougherty propert.y•became a corner lot. II The request of Garnet Spring for permission to place a building 36 feet, I� wide on a lot 43.7 feet wide (said building to be moved from 621 - 2tid Street Southwest to 710 - 1st Street Southwest) within 3 feet of the.East property line was read and upon motion by Davis, second by Morris, the same was referred to the Board of Zoning. A petition for the construction of a•curb and gutter on 6th Avenue from the Chicago Northwestern Railroad tracks to 7th Street Northwest was read and upon motion by Morris, second by Davis, the same was referred to the Street ' Alley Committee and the City Engineer," A petition to have 18th Avenue Northeast from 9th Street to 150 feet north surfaced was read and upon motion by Davis, second by Brumm, the same was referred to the Street & Alley Committee and the City Engineer. The following recommendation of•the Chief of Police was read and the same was ordered placed on file: "Honorable Mayor - Members of the Common Council Gentlemen: Under the provisions of Section 4 of Ordinance 69,$ I do hereby recommend that Loading Zones be established in front of the following residential grocery stores: John's Grocery, 1� 4th ave NW; Just -Rite Market, 21.1 6th ave SW; 011ie's Food Center, o20 1st St S.W. These stores lie within the parking area of the Downtown Schools,and the Courthouse and are located in 12 hour parking zones. As there is generally always someone parked in front of their stores the only way that'th'ey can receive goods and merchandise is to have the wholesalers' double park in front of their stores which creates a traffic hazard. The application of Otto Kluge for license to sell non-11atoxicating malt liquor "off sale" was read and upon motion by Thiem, second by Brumm, the license was granted. The applications of Joe Mayo, Otto Kluge, Crenlo, Inc.•and Sam Golob for license to sell cigarettes were each read and upon motion by Davis, second is by Brumm, the licenses were granted. The applications of Sam Golob, Joe Mayo and Otto Kluge for license to sell soft drinks were each read and upon motion by Brumm, second by Morris, the licenses were granted. The application•of P.aymond E. Karvel for a real estate broker's license was read and upon motion by Davis, second by Thiem, the license was granted. The application of William Peters for a permit to drill a'well was read and upon motion by Davis; second by Brumm, the permit was granted. The application of Clarence Bystrom for a Journeyman Hot Water and' Steam Fitter's License was read and upon motion by Thiem, second -by Davis, the license was granted. The surety bonds of -Raymond E. Karvel•in the amount.of $2,500.00 with the General Casualty Company of America as surety; LeRoy H. Cook and C. R. Ostby each in the amount of $2,500.00 with the Globe Indemnity Company as surety were each read and upon motion by Thiem, second by Davis, the bonds were approved, the surety thereon accepted and the same were ordered placed on file. .The contract bond of Naegele Poster Service in the amount of $29444.40 with Travelers Indemnity Company as surety was read and upon motion by Thiem, second by Davis, the same -was referred to the Mayor. • The City Treasurer's report for the month of September, 1952 was read and the same was ordered placed on file. ..The statement of receipts and disbursements in the Park Improvement Fund for the.month of September, 1952 was read and the same was ordered placed on file. The reports of the Clerk of the Municipal for the week ending October 11, 1952 showing total criminal fines and costs collected $1,253.00 and civil fees received $6.90 and for the week ending October 18, 1952 showing total criminal. fines and costs collected $1,294.00 and civil fees received $14.75, were each read and having been approved by the City Attorney, President Bach ordered that the same be placed on file. 2'3 I. Ordinance amending an Ordinance entitled, "An Ordinance regulating the installation, operation and maintenance of electric wires, apparatus and machinery, within the City of Rochester, Minnesota", was given its first reading. An Ordinance amending an Ordinance entitled, "An Ordinance to provide. for the cleanliness of streets, alleys, and premises as a protection against fires, and to prohibit the burring of certain materials in streets, alleys and promises", was given its first reading. An Ordinance amending the Zoning.Ordinance, No. 559, was given its first reading. The applications of Roes Mayhood for license to sell cigarettes and soft drinks were each again regd and upon motion'by Davis, second by Morris, the licenses were granted. A discussion wqs held On a plan for posdible street improvements and upon motion by Davis, second by Brumm, the Common Council requested the Mayor's Parking Commission to make a survey of public streets and submit their recommendations for improvements'at the meeting of the Council to be held on November 3, 1952. All present voted in favor of the motion. Alderman Davis submitted the'followirg motion and upon second by Brumm, the motion was approved: "I move that the Mayor's Parking and Traffic Commission be requested ;:. to investigate the feasibility of establishing one or more additional public parking lots in or near the business district of downtown Rochester, if the need for such lots can definitely be established, and that the Commission check the legal and financial aspects, as well as the property owner's reactions, to the following suggested program: That all of the land in the block east of First Avenue Southwest, to the alley running north and sotLth between Third and Fourth Streets, Southwest, with the exception of the Hotel Francis., be purchased or leased by the City, that all buildings thereon be -raised and the land be surfaced and put in condition for attendant supervised in -and -out public parking; That this program be implemented as a public improvement. by condemnation, if necessgry, and financed by assessments levied on a reducing scale- against all of the downtown. property benefited to be repaid over a ten year period; That the property be owned by the City and thoreby, tax-free, and that the revenue, if any, realized from the small parking charges, be used to pay for costs of operation, supervision and maintenance and that any surplus be placed in the General Fund to partially compensate the City,for,the tax loss involved; That the Parking and Traffic Commission investiagate the possibility of similar parking lots near the Northeast and ITorthwestern'edges of the downtown business area." 1 7 Lj C� 1 • 1 1 r � U 3 7 Record of Official Proceedings of the Common Council of the City of . Feller, General Contractors on the new Sewage Disposal Plant project, was read and upon motion by Brumm, second by Thiem, the Mayor. -and City Clerk were 1, authorized -to execute the agreement, subject to the approval of the General I. Contractors: "WHEREAS, The undersigned have heretoforeentered into ij - a contract with the City of Rochester, Minnesota, for the construction of a sewage disposal treatment plant, and !' WHEREAS, Paragraph 14 of the specifications upon which jl I' the contractors based their bid provided that said contractors were to have charge of all work until final acceptance of the contract by the City of Rochester, Minnesota, and to assume the responsbility for protecting against damage -or injury,lincluding lli the work performed by the Engineer until said acceptance, and ' WHEREAS, It now -appears that the said sewage disposal I treatment plant may begin operations or or about the 5th day of November, 1952, such date being before the anticipated completion of all of the work to be performed by said contractors pursuant to their contract with said city, NOW THEREFORE, It is agreed and understood by and between the contractors and the City of Rochester, Minnesota, that the operation of said sewage disposal treatment plant before the completion of all of the work to be P performed under said contract j shall not be deemed an acceptance of said sewage disposal treatment plant until all of the requirements o'f said contract are performed and such tests have been made by the Engineer j as are permitted under said contract and the f'inal acceptance by the City of Rochester, Minnesota. IT IS FURTHER -AGREED AND UNDERSTOOD, that any employees working under the jurisdiction of the City of Rochester, Minnesota, receiving their compensation from the City for the work performed, shall not, during said period, be deemed employees of the contractor.
