Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City
on November 3, 1952.
President Bach called the meeting to order at 2:00 o'clock P. M., the
following members being present: President Bach, Aldermen Brumm, Davis, Morris,
Sbhroeder and Thiem. Absent: Alderman Anderson,°due to illness.
President.Bach stated this as being the time 'and place set for the
following hearings:
Hearing on the levying.of special assessments for the grading of 2nd
Avenue Northwest from 13th to 13Z Street Northwest. There was no one present
wishing to be heard.
Hearing on the levying of special assessments for the grading of streets

in Parkside Addition. There was no one present wishing to be heard.
Hearing on the levying of special assessments for the grading of streets
in Betcher's Sub -Division. After hearing those present interested in the project
a motion was made by Davis, second by Thiem, to refer the matter of the assessment
to the Street & Alley Committee and the City Engineer.
Healing' on the levying of special assessments for the.grading of 14th
Street Northeast from 3rd to 14th Avenue Northeast. Mr. 0. G. Mathison was
present and stated that he felt the grading project was not satisfactory as water
had now drained onto his property. Also Attorney Raymond Wieland was heard on
the matter.
Hearing on the levydng-of special assessments for the grading of 15th
Avenue Northeast from East Center Street, north to the north line of Lot 16,
Block 3, Stebbins Addition. There was no one present wishing to be heard.
First Hearing on the surfacing of 12th Street Northwest from 2nd to )nth
Avenue Northwest. There was no one present wishing to be heard.
First Hearing on the --surfacing of lSth Avenue Northeast from 9th Street
Northeast to 150 feet north. There was no one present wishing to be hoard.
Mrs. F. F. Holloway was before the Council and again protested the
vacating of a part of 5th Street Southeast. She was informed that no action would
be taken on the matter at this meeting.
Mr. Leonard Ekstrand, Chairman of the City Parking and Traffic Commission,
presented a report on the first of a series of hearing on parking problems in the
City of Rochester. After hearing the report read in full by Mr. Ekstn nd, a motion
was made by Morris, second by Davis, that the recommendation of the Parking and
Traffic Commission be adopted, re-establishing diagonal parking on 1st Avenue
from Center Street to 4th Street Southwest as it was previous to the trial period

and approving parallel parking on.3rd and 4th Streets Southwest between lst Avenue;

and Broadway. Upon roll call all voted in favor of the adoption of the
recommendation except Alderman Brumm who voted "no".

The matter of prohibiting the.parking of cars on the south side of 1st II

Street Southwest between 7th and llth Avenue West was discussed briefly and upon
motion by Davis, second by Schroeder, the former action prohibiting the parking
of cars on.the south side of 1st Street Southwest from 7th Avenue to llth Aveme

Southwest was rescinded and the matter was referred to the Parking and Traffic ,

I' Commission.
The following resolutions adopted by the Public Utility Board were each';
read and President bordered the same placed on file:
(, nBe it and it is hereby resolved by the Public Utility
Board of the City of Rochester, Minnesota, that the Common
Council of the said City be and is hereby requested to authorize
the said Board to enter into a contract with the TRUCK SERVICE
COMPANY, for the furnishing of a G.M.C. 2 Ton Panel Truck, in
accordance with specifications, and with their proposal, the !
total amount of the said contract .to be ONE THOUSAND FIVE HUNDRED �!
FORTY SEVEN DOLLARS $1 >+

Company being the lowest responsible bidder.' Ii
"Be.it and it is hereby resolved by the Public Utility
Board of the City of Rochester, Minnesota, that the Common
Council of the said City be and is hereby requested to authorize
the said Board to enter into a contract with W. H. BARBER COMPANY,
for the furnishing, in accordance with specifications, of 200,000
gallons of No..6 Fuel Oil, the contract price to be $.0?35 per
gallon and the lump sum contract to be FOURTEEN THOUSAND SEVEN
HUNDRED DOLLARS ($14,700.00); the said 11. H. Barber Company being
the lour es-t responsible bidder.11
The request of lair. Jerry Reidh,ert to return cooling water to the storm
sewer at the special 5¢ rate was read and upon motion by Davis, second by Brumm,
the request was referred to the Sewer Committee and the City Engineer.
A petition for paving (concrete) the alley in Block 103, Wilson's
Addition was read and upon motion by Morris, second by Schroeder, the same was

referred to the Street & Alley Committee and the City -Engineer. II
A petition for construction of a sanitary sewer and watermain and grading

and surfacing in Goodings Addition was read and upon motion by Morris, second by

Davis,.the same was referred to the Sewer, Water and Street & Alley Committees and
the City Engineer.
A petition to have stop signs placed at the intersection of Center
Street and 7th Avenue East for the control of traffic on East Center Street was
read and upon motion by Davis, second by Thiem, the same was referred to the
Parking and Traffic Commission.
The request of the Rochester Fire Department Relief Association for
approval of a loan in the amount of $4,600.00 to Gerald Tupper on his property
located at 1126 - 9-gl Avenue Southeast was read and the same was ordered placed on

The recommendation of the Finance Committee that a loan by the Fire
Department Relief Association to Gerald Tupper on his property located at 1126-
9� Avenue Southeast -in the amount of $4.600.00 be approved was read and upon motion.
by Morris, second by Schroeder, the recommendation was approved.
The following recommendation of the Committee to select a site for a new
bend stand was read and upon motion by Schroeder, second by Thiem; the same was
referred to the Board of Park Commissioners:

My dear Mayor Amundsen, -
The Committee which you appointed to consider a site for the
new band shell, or shed, has spent considerable time discussing the
matter with various representative bodies and citizens of Rochester.
It is our unanimous opinion that the most desirable site for this
sturcture is in Mayo Park near the river in the grove south and east
of the new Mayo Memorial. It is our opinion and that of various
citizens that this will in no way detract from the beauty of the
Mayo Memorial, but will rather add to its interest and will also
in itself be a memorial'to the great interest which these
illustrious citizens always manifested toward summer music presented
in Mayo Park.

Lobb was read and upon motion by Schroeder, second by Morris, the same was ordered

Dear Mayor Amundsen:
I wish to thank you, Mr. Adolph Bach, President of the
City, and the members of the City Council for the scroll
which was presented to me and for the plaque which was placed
at the Airport in Rochester.
I consider it a great privilege to have lived in Rochester
for so many years and to have had small part in its development.
by work would have been impossible without the support of my
agsociates.
Mr. Don Swenson has been a most efficient Airport Manager.
He is respected by the State Department of Aviation and by •
Airport Managers in a number of other states. His experience
and sound judgment will be of great value in the future
development of the field.
I wish to thank you personally for your part in the
recent ceremony. I' send you my best regards.

"Dear Mr. Mayor:
Since arriving home I have endeavoured to find words to
express thanks to you and your Council for the most generaous
hospitality which was extended Mrs. Anderson and myself during '
our visit.
We were received -in such -a friendly spirit everywhere that
wecould not fail to feel at home and we shall always remember the
many kindnesses wereceived from everyone. We now have a store of
happy memories -on which to draw and we have made many new friends.

Davis, the recommendation was approved.
The recommendations of the Board ofZoning that the petition.of Charles
and Emma Hatch to have Lot 5, Block 24, Northern Addition changed from a
residential to a commercial zone be grunted and the petition of Mrs. Jessie Ellis,
Tubal H. Danford and Gladys E. Danford to have Lots 4 and 5, B1o'ck 34, Northern i
Addition changed from a. residential to a commercial zone be granted, were each

read and upon motion by Morris, second by Davis, the recommendations were approvedll
and the City Clerk was instructed to publish a notice of hearing to be held at
7:30 o'clock P. M. on November 17, 1952.
The report of the City Weighmaster for the month of October, 1952 showing
fees collected for loads weighed in the amount of $114.15 was read and President f

Bach referred the same to the Finance Committee.
The reports for the month of October, 1952 of the Building Inspector
showing fees collected.for building permits issued in the amount, of $427.00; of the;
Electrical Inspector showing fees collected for electrical permits issued-$55.00;
ofthe Plumbing Inspector showing fees collected for plumbing permits issued-$147.75•
of the Heating Inspector showing fees collected for heating permits issued-$99.50;,'
and fees collected for sign permits in the amount of $66.99, were each reed and

The reports of the Clerk of Municipal Court for the week ending. October
25, 1952 showing total criminal fines and costs.: -collected in the Amount of $2151.70

and civil fees received $4.60 and for the weekr'ending November 1, 1952 shooing.

The application of A. P. Barry for a license to sell non -intoxicating
malt liquor "on sale" was read and upon -motion by Thiem, second by Morris, the
license was granted.
The applications of Claude O'Malley and Erwin Glasena,pp and Alve
Birkeland for license to sell cigarettes were each read and upon motion by
Thiem, second by Morris, the licenses were Bead.
The application of Ervin Glasenapp and Alve Birkeland for license to
sell soft drinks was read and upon motion by Thiem, second by Schroeder, the
license was granted.
The application of Lewis J. Roessler for a Journeyman Plumber's License
was read and upon motion by Davis,. second by Brumm, the license was granted.
The application of YellQ,w Cab Company for transfer to two taxicab
licenses to new cabs was read and upon motion by Davis, second by Schroeder, the
transfers Mere granted subject to' review by the Chief of Police. -
The application of Lysne Construction Company for permits to move three
buildings over certain streets in the City of Rochester were each read and upon
motion by Davis, second by Brumm, the permits were granted, moving of the said
buildings to be done under the supervision of the City Engineer and the Building
Inspector.
The applications of Frank Kramer and Wilbur H. Viethe for a Journeyman
Warm Air Heating, Ventilating and Air Conditioning Workers License were .each read
and upon motion by Brumm, second by Thiem, the licenses were granted.
The applications of Holland Furnace Company and Yale Engineer's Inc. for
a Hot Air Heating, Air Conditioning & Ventilating Contractors License were each
read and upon motion by Davis, second by :Morris, the licenses were granted.
The application of Charles E. Phelps for a Journeyman Hot Water and
Steam Fitter's License was read and upon notion by Davis, second by Brumm, the
license was granted.
The applications of Bernard J. Steffes, Herbert Hohenthauer, J. G.
Bakula and Alvern 0. Grandy for Journeyman Plumber's License were each read and
upon motion by Davis, second by Morris, the licenses were granted.
The license bond -of Yale Engineers, Inc. in the amount of $1,000.00 with
the Continental Casualty Company as surety was read and upon motion by Thiem,
second by Schroeder, the bond was approved, the surety thereon accepted and it was
ordered that the same be placed on file.

Alderman Morris introduced a resolution appropriating $544.42 from the
P.I.R. Fund and ordering payment made to Leon Joyce and upon motion by'Thiem,
second by Brumm, and all present voting in favor thereof, President Bach declared
the said resolution duly passed and adopted.
Alderman Schroeder introduced a resolution appropriating $959.50 from
the P:I.R. Fund and ordering payment made to Leon Joyce and upon motion by Brumm,
second by Davis, and all present voting in favor thereof, President Bach declared
the said resolution duly passed and adopted.
Alderman Schroeder introduced a resolution appropriating $33.225:62 from
the P.I.R.Fund.and ordering payment made to Carlisle Graser and upon motion by

Alderman Thiem introduced a resolution appropriating $296.35 from the
General Fund and $2.34 from the Fire Protection Fund and ordering payment made to

and adopted.
Alderman Thiem introduced a resolution appropriating $1,390.15 from the
Park Improvement Fund and ordering payment made to Director of Internal Revenue
and upon motion by Brumm, second by Davis, and all present voting in favor thereof,
President Bach declared the said resolution duly passed and adopted.
Alderman Schroeder introduced a resolution ordering the first hearing on
construction of a sanitary sewer in 2nd Avenue Southwgst from 1st Street to Center
Street and upon motion by Davis, second by Brumm, and all present voting in favor
thereof, President Bach declared the said resolution duly passed and adopted.
Alderman Schroeder introduced a resolution ordering the first hearing on
construction of a sanitary sewer in Nest Center Streei from Broadway to 2nd Avenue
Southwest and upon motion by Davis, second by Brumm, and all present voting in favor
thereof, President Bach declared the said resolution duly passed and adopted.
An Ordinance amending an Ordinance entitled, "An Ordinance regulating the

within the City of Rochester, Minnesota", was given its second reading.
I s Upon motion by Brumm, second by Davis, and upon roll call and all
present voting in favor thereof, the rules were suspended and the Ordinance was
given its third and final reading.
Upon motion by Davis, second by Morris, that the said Ordinance -be
adopted as read, and all present voting in favor thereof-, President Bach
declared the said Oidd nance duly passed and adopted.
An Ordinance amending an Ordinance entitled, "An Ordinance to provide
for the cleanliness of streets, alleys, and premises as a protection against
fires, and to prohibit the burning of certain materials in streets, alleys and
premises", was given its second reading.
Upon motion by Davis, second by Brumm, and upon roll call and all
present voting in favor thereof the rules were suspended and the ordinance was
given its third 'and final reading.
Upon motion by Morris, second by Davis, that the said Ordinance be
adopted as read,; .and all present, voting in favor thereof, President Bach declared
the said Ordinance duly passed and adopted.
An Ordinance repealing Ordinance No— 790, amending: an ordinance to
provide for the cleanliness of streets and alleys and premises as a protection
against fire, and to prohibit the burning of certain materials in streets,
alleys and premises", was given its second reading.
Upon motion by Davis, second by Thiem, and upon roll call and all

present voting in favor thereof, the rules were suspended and the ordinance was
given its third and final reading.
Upon motion by Brumm, second by Davis, that the said Ordinance be
adopted as read., and all present voting in favor thereof, President Bach dellared
the said Ordinance duly passed and adopted.
An Ordinance amending an Ordinance entitled, 11 An Ordinance providing
for the licensing of plumbers, the supervision and inspection of plumbing and
sewers and the enforcement of minimum standards of the plumbing code of the
City of Rochester", was given its second reading.,
Upon motion by Brumm, second by Davis, and upo-n roll call and all
present voting in favor thereof, the rules were suspended and the ordinance was
given its third and final reading.
Upon motion by Thiem, second by Brumm, that the said Ordinance be
adopted as read, and all present voting in. favor thereof, President Bach
declared the said Ordinance duly passed and adopted.
An Ordinance to provide for registration of Dogs dnd for the

destruction of dogs not registered, was given its second reading.

Upon motion by Davis, second by Morris, a,nd upon roll call and all -present
voting in favor thereof, the rules were suspended and the Ordinance was given its
third and final reading. -
Upon motion by Davis, second by Morris, that the said Ordinance be
adopted as read, and all present voting in favor thereof, President Bach declared
the said Ordinance duly passed and adopted.
An Ordinance repealing an ordinance entitled, !'An Ordinance to provide
,for registration of dogs and for the destruction of dogs not registered and
amendments thereto, Nos. 563, 5s6,743 and 77511, was giver. its -first reading. •
Upon motion by Davis, second by Morris. and upon roll call and all
present voting in favor thereof , the rules were suspended and the ordinance was
given its second reading.
Upon motion by Davis, second by Morris, and upon r611 call and all
present voting in favor thereof, the rules were suspended and the Ordinance was
given its third and final reading.
Upon motion by Davis, second by Brumm, that the said O;dinance be adopt.ed
as read, and all present voting'in favor thereof, President Bach declared the said
Ordinance duly passed and adopted..
An Ordinance amending the Zoning Ordinance No.. 558 was given its second
reading.
A motion was made by Thiem, second by Brumm, that the rules be suspended
and the ordinance be given its third and final reading and upon roll call all
present voted in favor of the motion, except Aldgrman Schroeder, who voted "no".
An Ordinance repealing Paragraph (e).of Section Four (4) of the Zoning
Ordinance No. 558, was given its ssdcond reading.
An Ordinance amending an Ord*ina nce entitled, "An Ordinance regulating
traffic, the operation and parking of vehicles, the use of streets for driveway
entrances, and designating material highways in the City of Rochester, Minnesota", .
was given its first reading.
Upon motion by Davis, second by Schroeder, and upon roll call and all
present voting in favor thereof,.the rules were suspended and ,the ordinance was
given its second reading.
Upon motion by Thiem, second by Schroeder, and upon roll call and all
present voting in favor thereof, the rules were•suspended and the Ordinance was
given its third and final reading.
Upon motion by Davis, second by Schroeder, that the said Ordinance be
adopted as read, and all present voting in favor thereof, Presidd.nt Bach declared
the said Ordinance duly passed and adopted.
An Ordinance creating the office of Municipal Co-ordinator, providing

far his appointment and prescribing the duties of such Municipal Co-ordinator, was!
given its first reading.' I.
After the Ordinance was read; Alderman Thiem stated that he thought the
time for the adoption of such an ordinance was rather pre -mature. Mr. Raymond
Wieland, Members of the'Governmental Survey Committee, and Mrs. Louis Murphy,

Member of the Charter Commission, expressed themselves'as'being very much in favor)
I
of the office being created at this 'time. Mr. Robert Petersdo'rf, Mr. James Coon,
Mr. James Willis and Mr. C. H. McDonald expressed opposition to the passing of such
an ordinance, stating 'that they felt it was 'a matter which s1vuld be submitted to
the voters of the City.

The following claims were read and upon motion by Davis, second by
Morris the same were ap
proved and the Mayor and City Clerk were authorized and ;
directed to draw warrants upon the Ci6*y Treasurer and make payments accordingly:

Upon motion by Morris, second by Brumn, the City Attorney was instructed
to prepare an amendment to the traffic 'ordinance regulating the deliveries in the
down town area by semi -trucks.
Upon motion by Thiem, second by Brumm, the meeting was adjourned until
'7:30 o'clock P. M. on November 3, 1.952.

Minutes of an adjourned regular meeting of the Common Council of the
'City of Rochester, Minnesota, held in the Council Chambers of the City Hall, in
said City, on November 3, 1952.
President Bach called the meeting to order at 7:30 o'clock P. M., the
following members being present: President Bach, Aldermen Brumm, Davis, Morris,
Schroeder and Thiem. Absent: Alderman Anderson, due to illness.
Bids which had been received at the meeting on October 20, 1952 for the
purchase of two patrol cars for the Police Department were again brought to the
attention of the Council and upon motion by Thiem, second by Schroeder, all bids
were rejected and the City Clerk was instructed to re -advertise for bids to be
received on November 17,' 1952 at 7:30 o'clock P. M.
Alderman Brumm stated that it had been brought to the attention of the
,i,duncil that the secretary employed in the Mayor's office was not performing his
-duties properly, due to the -fact that he was not on duty in the Mayor's office a
greet dear of the time. After some discussion on the matter a motion was made by
Davis,'seco,Ad by Schroeder, that the City Clerk address a letter to Mayor Amundsen
stating that it had come to the attention of the Council that his secretary is not
devoting full time to his duties in the Mayor's office and that his salary be
terminated on November 17, 1952, and if the Mayor iias:desirous of: co.ntinuing`,tbe-.services.
of Mr. Smollet'in lils office, he should state his wishes on the matter- Upon roll
call Alderman Brumm,'Morris.and Thiem voted "no" and Aldermen Davis and Schroeder

Thiem, the matter was referred to the City Attorney to investigate the possibilityl,
of condensing the publications of the Council proceedings in order to reduce the fi
expense of the said publications.
Alderman Davis brought to the attention of the Council that certain
expenses for preliminary engineering charges and publications of notices on II
projects assessable to property benefited was being paid from the General Fund.

authorized to .execute a contract between the City of Rochester and Peoples Naturalli
Gas Company for gas for space hearing in customers new Sewage Disposal Plant. !'
Alderman Schroeder introduced a resolution instructing the City Clerk tol

advertise for bids for traffic signals to be ergcted at llth Avenue and loth Street
Northeast.; 14th Street Northeast between gth and loth Avenue; 12th Street Southeast,

and Sth Avenue; North Broadway and °th Street,; West Center Street and llth Avenue,'

the signals to be han& operated type primarily for the use of students attending
the outlying grade schools; the advertisement_for bids to also include automatic i
signals at llth Avenue and. East Center Street and llth Avenue and 4th Street
Southeast. Upon motion by Schroeder, second by Thiem, that the said resolution be '

adopted as read and all.present voting in favor thereof, except Alderman Brumm
who voted "no", President Bach declared

A motion was made by Morris, second by Thiem, instructing the Mayor and
City Clerk to execute an agreement between the State of Minnesota and the City '
of Rochester, Minnesota for the treatment of sewage from the Rochester State
