President, Bach called the meeting to order at 7: 30 O'clock P. M. , the following members being present: President*Bach,* Aldermen Brumm, Davis, Morris, Schroeder, Thiem and Whiting. Absent: None. i� Upon motion by Thiem, second by Morris, the minutes of the meeting of I December 1, 1952 were approved. President Bach stated this as being the time and place set for a hearingi on the levying of special assessments for the construction of a sanitary sewer andl` watermain in Betcher's Sub -Division. Mr. Gerhardt Betcher and, Mr. Robert Swanson were again present and stated their dissatisfaction over'the assessments for I, sewer and waterrmain in Betcher's Sub -Division. A motion was made by Thiem, second O by -Davis, that a re -assessment of the sewer and water project be made on the basisl' of two lots for Mr. Swanson's property and'the"difference between the re -assessment. r and the original assessment to Mr. Swanson be spread over all other lots abutting on the project. After further discussion President Bach asked that the roll be called and Alderemen Davis, Morris, Thiem and Bach voted in favor of the motion i p and Aldermen Brumm, Schroeder and Whiting voting "no". President Bach stated'this as being the time and place set for the second hearing on the construction -of a sanitary sewer in 2nd Avenue southwest from 1st r Street.Southwest to Center Street. There was no one present wishing to be heard. ji President Bach stated this as being the time and place set for the second' hearing on the construction of a sanitary sewer in West CenterStreet from Broadway' to 2nd Avenue Southwest. Mr. Paul Grassle, Sr. was present and stated that he had!' i met with other abutting property owners on the project and stated their opposition) to being again assessed for sewer when they already had service. Those represented), by him were the Botsford Lumber Company, the Methodist Church, Skelly Oil Company, W. W. Lawler, Shell Oil Company and H otel Carlton. He further stated that it was not the intention of the property owners to oppose the construction of a necessaryii 'I sewer, but he did emphasize the point that the above property owners would be baying another assessment for service they already have. Upon motion by Davis, second -by Schroeder, the hearing was continued until -the next regular meeting in January, 19 53-' !i Presiden't Bach stated this as being the time and place set for a hearing II, I . on the proposed change of zoning of Lots 1, 2 and 3, in Block 1, of Sunnyside Addition from a residential to a multiple `dwelling zone. There was no one present" wishing to be heard. 0 President Bach stated this as being the time and plac4 set for a hearing 270 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., December 15, 1952 on the proposed change of zoning of Lots 2, 3, 6 and-7 in Block 1 and Lots 1, 2, 3 and 4 in Block 2 of West's Sub -Division; Lots 1 and 2 in Block 1 and Lots 1, 2, 3, 4 and 5 in Block 7, Mohn & Hodge Sub -Division; and the no.Lbth 175 feet of the east 152 feet of the West 435 feet of Lot 49, in Section 36-104-17, from a ,commercial to a residential zone, Mrs. Ruth Dye was present and stated that her property was included'in the commercial area and she did not wish to have it changed to residential. A letter from Dr. Donald W. Tarun stating that he was the owner of Lot 1, Block 1, Mohn & Hodge Sub -Division and wished to have the property • changed to residential was read and placed on file. President Bach stated this as being the time and place set for receiving and opening bids for furnishing one front-end loader attachment for use in the Street & Alley Department. Upon motion by Davis, second by Thiem, the City Clerk was instructed to open the bids received. The bids of The George T. Ryan Company in the amount of $2,095:00; Andrew Byholdt in the amount of�$1,535.00 and Wm. H. Ziegler Company in the amount of $1.895.00 were each opened and upon motion by Brumm, second by Thiem, the same were referred to the Street & Alley Committee and City Engineer for recommendation. President Bach stated this as being the time and place set for receiving and opening bids for furnishing one sewer rodding machine for use in the Sewer X Department. Upon motion by Davis, second by Brumm, the City Clerk was instructed ,to open the bids received. The bids of Municipal Equipment Company in the amount of $4,196.67 and Roto-Rooter Flex-o-matic Sewer Service Company in the amount of $3,350.00 were each opened and upon motion by Brumm, second by Davis, the same were referred to the Sewer Committee and the City Engineer for recommendation. Mr. George Henke was before the Council and objected to the number of front feet included in an assessment against his property, stating that the frontage was 143 feet and he was assessed on the basis of 155 feet. He also • inquired as to whether or not a building, which he did not owns, could be constr- ucted in his front yard, the building being a gas metering station. The City. -- Engineer was asked if the building was located on Mr. Henke's property and he stated that it was actually in the street. Mr. Henke did not agree with that statement. He further stated that a storm sewer had been constructed across his property and that the soil was being washed away at the outlet of the'sewer. r After hearing Mr. Henke a motion was made by Brumm, second by Morris, referring the matter to the Street & Alley Committee and the City Engineer. The request of the Board of Public Health & Welfare for permission to II employ Mr. John B. Shulze, Jr. as bacteriologist in the Health Department, Ij Ij j, effective December 22, 1952, at a salary of $300.00 per month to replace Mr. John'{ I. Horan who has resigned, was read and upon motion by Morris, second by Schroeder, li the request iras approved. f j; A notice of application to vacate that portion of 13th Avenue -Southwest',: formerly known and originally platted as Elliott Street, lying outside of the �I City of Rochester and between Lots nos. 109,110,111 and Lots Nos. 96,97 and 99, j in Belmont an, -.Addition to Rochester, Minnesota, was read and ordered placed on i, file. i A letter from_ Olmsted County, Department of Highways, transmitting three I , j copies of an agreement covering maintenance of State Aid Roads within the fi corporate limiter of the City was'read and the same was ordered placed on file. The appointment of Mr. Earl C. Wolf, by, the Mayor, as a member of the I. Public Library Board, to fill 1 the unexpired term of Dr. George B. Eusterman, who !;, i j has resigned, was read and upon motion by Thiem, second by Schroeder, the Mayor'sl� 1i appointment was approved. I! W. and Sth and 9th Avenue S. The recommendation of the Street & Alley Committee that loth Street S.E. in Willoyd's Sub -Division be graded and surfaced was read and upon motion by Morris, second by Schroeder, the recommendation was approved. The recommendation of the Street & Alley Committee that the alley in 'Block 103 and a portion -of 104, Willson s .Addition be -paved with concrete was read and upon motion by Schroeder, second by Morris, the recommendation was approved. The recommendation of the Lighting Committee that a street light be installed on_a pole approximately 100 feet west of what was formerly 9th Avenue on.11th Street Southwest and on 15th Avenue Northeast at or just north of Center -Street was.read and upon motion by Schroeder, second by Thiem, the recommendation 'was approved. The reports for the month of November, 1952 of the Building Inspector ;showing fees collected for building permits issued in the amount of $348.00; of the Electrical Inspector showinig fees collected for electrical permits issued $93.25; of the Plumbing Inspector showing fees.collected for plumbing permits issued $631.50; of the Heating Inspector showing fees collected for heating permits issued $393.00; and fees for sign permits issued in the amount of $19.97, were each read and President Bach referred the same to the Finance Committee. The report of the City Weighmaster for the month of November, 1952 showing fees collected for loads weighed in the amount of $139.45 was read and President Bach referred the same to the Finance Committee. The report of the City Engineer for the month of November, 1952 was read and President Bach ordered that the same be placed on file. The statement of receipts and disbursements in the Park Improvement Fund 'for the month of November, 1952 was read and President Bach ordered that the same be placed on file. The City Treasurer's report for the month of November, 1952 was read and President Bach ordered that the same be placed on file. The reports of the Clerk of Municipal Court for the week ending December 6, 1952-showing total criminal fines and costs collected $843.00 and civil fees received $2.95 and for the week ending .December 13, 1952 showing total criminal fines and costs collected $1,079.00 and civil fees received $7.92, were each read and having been approved by the City Attorney, President Bach ordered that the same be placed on file. Williams Estate Fund: John Oliphant Insurance Co.,$77.261 President Bach announced the appointement of Alderman Whiting to serve jl I on all committees of the Common Council to which the late..Geo. J. Anderson had I' been appointed, except the Finance Committee to which Alderman Thiem had already been appointed. James J. Macken, Jr., Chief of Police, stated that the regulations governing the Police Relief Association did not permit the handling of payments for police uniforms.and recommended that all claims for police uniforms be again handled through the City Clerk's office as had previously been done and uuon motion by Schroeder, second by Thiem, the recommendation was approved. The Chief -of Police also stated that Mr. Frank Halloran's leave of absence for illness had now expired and recommended that Mr. Stephen Gerkin be appointedto fill the position as meter maintenance man, now vacant. Upon motion by Schroeder, second by Thiem, the recommendation was approved. A letter signed by -Mr. J. W. Engle of 711 2n4 Street N. if. objecting to the recommendation made by Alderman Brumm, that dancing be„permitted in 'ion Sali into liquor establishments was read and the same was ordered placed on file. Unfinished Business: Regarding zoning of the property owned by the Miracle Mile, City Attorney Hunt ruled that this property had been zoned as commercial under the coutny government and would remain commercial after being annexed to',the City of Rochester. City of Rochester, Minn., December 15, 1952 referred to the Public Grounds -Committee at the meeting of ,December 1, 1952• Alderman Schroeder, Chairman of that Committee,•reported that he had met with. Mr. Vogel; of the Naegele Poster Service Company, in regard to rental -charges for space on the said building. Mr. Vogel stated that he was making a survey of other available sign space in the City and would report back to Mr. Schroeder later. Upon motion by Morris, second by Davis; the meeting wqs adjourned.
