Hall, in said City, i on January 5, 1953. President Bach called the meeting to order at 2:00 o'clock P.M., the following members being present: President Bach, Aldermen Brumm, Davis, Morris, Schroeder, Whiting and. Thiem. Absent: None. Upon motion by Davis, second by Morris, the minutes:of the meeting of December 15, 1952 were approved. President Bach stated that the hearing on the construction of a sanitary: sewer in West Center Street from 2nd Avenue West to Broadway had been continued until this date and inquired as to whether anyone was present who wished to be heard on the matter. Mr. Paul Grassle, spokesman for owners of.property from 2nd Avenue Southwest to Center Street, protested any assessment against. the property for sewer construction on the grounds that they had sewer service at the present time and were not in need of further connections. After hearing Mr. Grassle and others present, and discussing the matter further, a motion was made by Brumm, second by Thiem, that further action on the plan of financing the proposed sewer be postponed until the meeting of the Council to be held on January 19, 1953. All voted in favor of the motion. The recommendation of the Sewer Committee that bids be taken on January 19,1953 for the purchase of 10 Tons An#ydrous F rric Chloride and 1 Carloac. e (4o to 50 tons) Hydrated Lime for sewage treatment (vacuum filtration) use at the New Sewage Disposal Plant was read and the same was ordered placed on file. The recommendations of the Planning and Zoning Commission that the plat 1. of Willoyd Is Addition be accepted and that Lots 6 and 9, in Block 2, Dresbach's Addition and Hillside Additionbe annexed to the City of Rochester were each read and President Bach ordered that the same be placed on file. A communication from the League of Minnesota Municipalities addressed to the City Clerk acknowledging receipt of Council resolution regarding the exemption of household goods from taxation was read and ordered placed on file. Letters from the Public Examiner transmitting reports of the financial affairs of the Rochester Fire Department Relief Association and the Rochester Polici Relief Association, were each read and upon motion by Whiting, second by Thiem,, the!: re-oorts were ordered placed on file in the City Clerk's office., The Mayor's appointment of Mr. Louis Hemker of 246 15th Avenue Southeast as Weed Inspector for the cu' rrent year January 1, 1953 to January 1, 1954 was'read 1'� and upon motion by Brumm second by Whiting the appointment was approved. A petition to have Lots 3 in Block 3 and Lot 2, in Block 5 of Gooding's Addition'changed from a residential to a multiple dwelling zone; Lots 4 and 5, in Block j and Lots 3 and 4 in Block 5 and Lot 11 in Block 9 of Gooding's Addition now partially commercial and partially residential to multiple dwelling and Lots 9 and 10 in Block 4 and Lots 1 and 2 in Block 10, dooding's Addition from commercial to industrial zone, was read and upon motion by Brumm, second by Thiem, I the same was referred to the Board of Zoning. A petition signed by Mrs. Alice Carlosn and Mr. R. L. Carlson to have . Lot 6, Block 34, Northern Addition changed from a residential zone to a commercial zone was read and upon motion by Davis, second by Brumm, the same was referred to the Board of Zoning. The request of Milton W. Scholer that a street light be installed on 7th Avenue Sou-thwest between 4th and 5th Streets Southwest was read. Due to the fact that the light was requested on account of vandalism in that section, resulting in damage to automobiles, a motion was made by Schroeder, second by Morr�s, that the matter be -referred to the Chief of.Police. The report of the City Engineer for the month ofI-)ecember, 1952 was read and the same was ordered placed on file. The annual report from the Division of Public Institutions on Jail Inspection was read and the same was ordered placed on file. The report of the City Weighmaster for the month of December, 1952 showing fees collected for loads weighed in the amount of $139-00 was read and President Bach referred the same to the Finance Committee. The reports fDr the month of December, 1952 ofothe.-.Building Inspector showing fees collected for building permits issued $373-00; of the Electrical Inspector showing fees collected for electrical permits issued $1,66o.00; of the Plumbing Inspector showing fees collected for plumbing permits issued ,'$1,736.25; of'the Heating Inspector showing fees collected for heating permits issued $695-00; and fees collected for sign permits $105-39, were each read and President Bach referred the same to the Finance Committee. The reports of the Clerk of Municipal Court for the week ending December 20, 1 952 showino total criminal fines and costs collected $971-00 and civil fees received $2.70 and'for the week ending December 27, 1952 showing fines and costs collected $754.00 and civil fees received $1.20; and f or th-e week ending January 3, 19 53 showing total criminal f ines and costs 'collected $929.81 and civil fees received $5.60, were each read and having been approved by the City Attorney, President.Bach ordered that the same be placed on file,.. A motion was made by Davis, second by Brumm, that the matter be referred to the Finance Committee and the License Committee for recommendation. All voted in favor of themotion. The recommendation of the S rest & Alley Committee that the bid of t Andrew Byholt be accepted'for furnishing one front-en.d loader:,wit� tw'o buckets for the sum of $1,535.00 was read and'President Bach ordeied that the same be placed on file. The recommendation of the Sewer Committee that the bid of Municipal Equipment Company for furnishing one sewer rodding machine ana accessories be accepted for the sum of $4,196.67 was read and President Bach,ordered that',the same be placed on file. The application of Leo J. Smith and John McNiff for license to sell cigarettes was read and upon motion by Davis, second by Morris, the License was granted. The applicatiorB.of Leo J. Smith and John McNiff and Roy E. Wallenberg for license to sell soft drinks were each read and upon motion by Davis, second byli Schroeder, the licens'es were granted. The application of Leitzen Concrete Products Company for a House Moverls! License was read and upon motion by Davis, second by Brumm, the license was granted. The application of Leitzen Concrete Products Company for a permiCto move a school building over the following streets in the City,of Rochester was read and upon motion by Brumm, second by Thiem, the permit was granted, subject to'supervision by the Building inspector:* "The building will start from 1 mile,north of the Markay Dinner, come south on 52 to the Markay, down the cut off to llth Avenue N. W., down llth Avenue to 2nd Street N.W., down 2nd'St*reet N. W. to 6th Avenue N.W. to Center'Street, down Center Street to Broadway, down Broadway south to 4th Street S. E. and down 4th Street 6.E. to the city limits". The application of Howard Unger for a House Mover's,,License was rea& and upon motion by Brumm, second by Davis,. the license was granted. The surety bond of Stephen P. Gerkin in the amount of $2,000.00 with the American Casualty Company as surety and the license bond of Leitzen Concrete. Products Company in the amount of $7,500-00 with the Western Surety Company as surety were each read and upon motion by Thiem, second by Whiting, the.bo-nds were approved, the surety thereon accepted and it was ordered that :the same be placed on file. . Smith. Upon motion by Brumm, second by Davis, resolution adopted. Resolution ordering bids for construction of a sanitary sewer in 2nd Avenue S. W. from lst Street S. 11. to Center Street. Upon motion by Davis, second by Morris, resolution adopted. Resolution ordering bids for construction of a sanita.-y sewer in West Center Street from Broadway to 2nd Avenue Southwest. Upon motion by Morris, second by Schroeder, resolution adopted. Resolution ordering bids for furnishing chemicals for use at the new Sewage Disposal Plant. Upon motion by Schroeder, second by Thiem, resolution adopted. Resolution levying special assessments for construction of a sanitary sewer and watermain i.n Betcher's Sub -Division and rescinding former resolution passed on October 21, 1952. Upon motion by Thiem, second by Whiting, and all voting in favor thereof, except Aldermen Schroeder and Brumm who voted "no", resolution adopted. Resolution appropriating $1,295-14 from the General Fund and ordering payment made to A. E. Briese, County Treasurer. Upon motion by Whiting, second by Brumm, resolution adopted. Upon motion by Schroeder, second by Morris, and upon roll call -and all voting in favor thereof, the rules were suspended.and the ordinance was given its third and final reading. Upon motion by Brumm, second by Davis, that the said.ordinance be adopted as read, and all voting in favor.thereof, President Bach declared the said ordinance duly passed and adopted. An Ordinance annexing to the City of,Rochester, Minnesota, Lots 6 and 9, Block 2, of Dresbach's Addition, was -given its first reading. Upon motion by Whiting-, second by Schroeder, and upon roll call and all voting in favor thereof, the rules were suspneded and the ordinance was given its second reading. Upon motion by Brumm, second by-Thiem, and upon roll call and all voting in favor thereof, the rules were suspended and the ordinance was given its third and final reading. C21 Upon motion by Brumm, second by Davis, that the said ordinance be adopted as read, and all voting in favor thereof, President Bach declared the said ordinance duly passed and adopted. Upon motion by Brumm, second by Thiem, the meeting wris adjourned until 7: 30 o clo ck P. M. President Bach called the meeting to order at �:00 o'clock P. M., the following members being present: President Bach, Aldermen Brumm, Davis, Morris, Schroeder, Whiting and Thiem. Absent: None. Mr. Mark B..Fuller was present at the meeting and presented a petition protesting the change of zoning from.a commercial to a residential zone of property described on the following page and to leave the.property commercially zoned. I I Record of Official Proceedings of the Common Council ...-.Of the City. of Rochester, Minn., J.anuary 5:,_ 1953., I I 0 I 0 I I After discussion held, a motion was made by Whiting, second by Davis, that the Common Council of the City of Rochester go on record as being in favor .of the passage of an act relating to taxation, authorizing cities of the First and Second'Class to levy certain taxes subject to the right of popular referendum,�;' and providing for the collection of such taxes and the use of,,the proceeds, and instructing the City Clerk to forward a certified copy -'of the'adtion taken, to Mr. Orville Peterson, Attorney for the League of Minnesota Mui ! aicipal . ities. The matter of cleaning willow underbrush from Cascade Creek wAs brought up -and upon motion by Thiem, second by Davis, the City Engineer was authorized to spend -not to -exceed $300-00 in eradicating th6 said willow�brush. Alderman Whiting recommended that in new additions*to the City a regulation bo adopted which would require owners of duplex residenc6s and other multiple dwelling buildings, to provide parking space on their premises for cars of tenants. A motion was made by Whiting, second by Brumm, that the matter be referred to the Planning and Zoning Commission for study and report. The City Engineer brough-t up the matter of, holding a formal opening for the new Sewage.Disposal Plant. The date of January 24th was set, with the opening ceremony to be held'at 2:00 o'clock P. M. Upon motion by Brumm, second by Thiem, the meeting ivas adjourned until 11 7: 30 o'clock P. M. on Monday, January 19, 1953- City Clerk 0
