HomeMy WebLinkAbout01-19-1953Record of Official Proceedings of the Common Council of the City of Rochester, Minn., January 19, 1953 Minutes of an adjourned regular meeting of the Common Council of. the City of Rochester, Minnesota, held in the Council chambers in the City Hall, in said City, on January 19, 1953. President Bach called the meeting to order at 7:30 o'clock P. M.-, the following members being present: President Bach, Aldermen Brumm, Davis, Morris, Thiem and Whiting. Absent: Alderman Schroeder, due to illness. Upon motion by Thiem, second by Whiting,the minutes of the meeting of January 5, 1953 were approved. President Bach stated this as being the time and place set for receiving and opening bids for furnishing chemicals for use at the sewage treatment plant. Upon motion by Brumm, second by Thiem, the City Clerk was instructed to open the bids received. The bids of The Kruse Company - "chemical lime" @ 19.45 per ton; Pennsylvania Salt Manufacturing Co.- Anhydrous Ferric Chloride ® $7.61 per 100 pounds; Lyon Chemicals, Inc., - Anhydrous Ferric Chloride ® $9.06 per cwt, were each received and opened and upon motion by Davis, second by Thiem, the same were 'referred to the Sewer Committee and the City Engineer for tabulation and report. President Bach inquired as to whether or not anyone wished to be heard o on any other matter at this time. Mrs. Murray Schomberg, Rev. Paul Downs of the First Christian Church, and Mr. Leonard Witzks, President of the Rochester "On Sale" Liquor Dealers Association were each present and protested the proposed amendment to the liquor ordinance, which would permit dancing in "on sale" intoxicating liquor establishments. Also letters and resolutions protesting the proposed amendment from the Rochester Ministerial Association; the .First Christian Church of Rochester; Miss Florence Schmidt; and from the members of the several Sunday School classes in the First Church Evangilical United Brethern, were each read together with a protest signed by all members of the "on sale" intoxicating liquor dealers association. Those present were informed that the proposed amendment would not be given its final reading until the meeting of February 2, 1953 at 2:00 o'clock P..M. A notice by Robert P. Gage of 915 - 1012- Street Southwest of damage to the curb in front of his residence by snow plows was read and upon motion by 'Davis, second by Morris, the same was referred to the Street & Alley Committee. The request by the Rochester Fire Department Relief Association that the Council approve the following proposed changes in.their Relief Association ,Laws, same being Minnesota Statutes 1949, Sec. 424.12: The sum of $100,000 in the Special Fund., instead of where it now reads $77,000. Tax levy not to exceed one and one half mills, where it now reads one mill. The pension payments not to exceed $125.00 per month, where it is now $100..00 per month. Peterson Attorney for the League of Minnesota Municipalities, acknowledging receipt of Council resolution endorsing • i the proposal of first and second class cities for a home rule tax enabling act i It was read and President Bach ordered that same be placed on file. I! A contract between the Peoples Natural Gas Company and the City of �! Rochester setting new rates for gas used in space heating at the new Sewage i' II Disposal Plant was read and upon motion by lhiem, second by Davis, the same was I� II approved and the Mayor and City Clerk were authorized to execute the contract. ! A letter from the Exchange Club of Rochester asking for an appointment ' • I, with the Common Council was'read and the City Clerk was instructed to notify the i! !' Club that they would be heard before the Council at 3;00 o'clock P. M. on February 2, 1953. The recommendation of the Sewer Committee that the Bid of Pennsylvania it ! Salt Manufacturing Company for furnishing 20,000 lbs. Anhydrous Ferric Chloride a $7. Ha.glin and Sons Co. for use of I' I' a portion of the alley in Block 23, Original Plat, for a period of 30 days from this date, the permit to specify that upon expiration of the 30 days, all obstruct2" ions shall be removed from the alley and the alley again opened to full use by the' I �i ! public, was read and upon motion by Morris, second by Davis, the recommendation was approved. i ' The recommendation of the Sewer Committee that the ,City Attorney be ' I �� it Record of Official Proceedings. of the Common Council of the City of Rochester, Minn., January 19, 1953 instructed to draw an amendment to the Ordinance on Sewer Service Charges, authorizing the City Engineer to issue permits to scavengers and cess pool cleaners for the dumping of cess pool cleanings into the City Sewer system at the New Sewage Treatment Plant, and fixing the fee for such -dumping at twenty (20) cents per 100 gallons with a minimum -of $1.00 per load, and to prohibit the dumping of such materials at any point within the City or into the City Sewer System except under the above terms, was read and upon'motion by Davis, second by Whiting, the recommendation was approved. The recommendation of the Sewer and Street & Alley Committees that the City Engineer be instructed and authorized to begin conversion of the Old Sewage Treatment Plant building to a warehouse for the Street and Alley Department, funds for improvement of this building not to exceed $3,000.00 and to be taken from the Permanent Improvement Fund, was read and upon motion by Morris, second by Davis, the recommendation was approved. The recommendation of the Chief of Police that a newer type light be installed in the streetlight on 7th Avenue Southwest between 4th and 5th Streets a.nd the reco-mme-ndation of the Lighting Committee that this change be effected were each read and upon motion by Davis, second ay Thiem, the recommendations - w ere approved. The recommendation -of the Finance Committee that bids be taken for the furnishing of one posting and bookkeeping machine for use in the City Clerk's office was read and upon motion by Davis, second by Thiem, the recommendation was approved. A report by Frank Z-T. Everett, Fire Chief, of the activities of the Rochester Fire Department for the year ended December 31, 1952 was presented and President Bach ordered that the same be placed on file. The report of revenue and expenditures in the Park Improvement Fund for the month of December, 1952 was read and ordered placed on file. The reports of the Clerk of the Municipal Court for the week ended January 10, 1953 showing total criminal fines and costs collected $947.00 and civil fees received $4. 35 and, for the week ended January 17, 1953 showing total criminal fihes and costs collected $1,237.00 and civil fees received $7.05 were each read and having been approved by the City Attorney, President Bach ordered that the sane -be placed on file. The applications of Lloyd Ashpole, Donald G. Witzke and Mayo Priebe, Jr. for a license to sell cigarettes were each read and upon motion by Davis, second 'by Morris, the licenses were granted. The applications of -Mayo Priebe, Jr. and Donald G. Livingston and Norman Wyatt from 11 - 4th Street Southwest to I` I: 411 First Avenue Southwest was read and upon motion by Thiem,, second by Davis, ' the transfer was granted. M The application of the Vets Cab Company for transfer of taxicab licensee no. 5 to a 1953 Plymouth was read and upon motion by Brumm, second by Davis, the transfer was granted. j The application of Clifford Strike for a Real Estate Broker's license was read and upon motion by Davis, second by Thiem, the license was granted. The surety bonds of Andrew Byholt in the amount of $1,535.00 with the National Surety Corporation as surety and Municipal Equipment', Company in the amount of $4,196.67 with the Anchor Casualty Company as surety, were each read and upon motion by Davis, second by Brumm, the bonds were approved, the surety thereon accepted and it was ordered that the same be placed on file. The following resolutions were introduced, read and President Bach declared the same unanimously adopted except where "no" votes are noted: Resolution accepting bid of The Kruse Company and Pennsylvania Salt Mfg. Company for furnishing chemicals at the Sewage Disposal Plant. Upon motion by Brumm, second by Davis, resolution approved. Resolution ordering hearing on the levying of, special assessments for surfacing lSth Avenue Northeast from 9th Street to 150 feet North. Upon motion by Davis, second by Morris, resolution adopted. Resolution ordering hearing on the levying of special assessments for surfacing of 12th Street Northwest from 2nd to 4th Avenue Northwest. Upon motion by Morris, second by Thiem, resolution adopted. Resolution ordering hearing on the levying of special assessments for construction of a sanitary sewer and watermain in Westlawn Addition, Block 3 and Mohn & Hodge Rep7.t of Thurber's Third Division. Upon motion by Thiem, second by Whiting, resolution adopted. Resolution ordering first hearing on paving the alley in Block 103 and a portion of Block 10 4, Willson's Addition. An Ordinance amending Ordinance No. 290, entitled, "An Ordinance to Preserve the Public Health by regulating the storing and handling of foodstuff intended for human consumption, offered for sale within the City of Rochester and providing penalties for the violation thereof", was given its first - reading. An Ordinance repealing Ordinance No. 459, same_being!an­amendment.to an ordinance enttled "An Ordinance to preserve the public health by regulating she storing and handling of foodstuff intended for human consumption, offered for sale within the City of. Rochester and providing .penalties for the violation thereof", j was given its first reading. An Ordinance amending an ordinance entitled, "An Ordinance regulating traffic, the operation and parking of vehicles, the use of streets for driveway entrances and designating arterial highways in the City of Rochester, Minnesota", was given its first reading. An Ordinance repealing ordinance No_. 770, same _being an amendment to an ordinance entitled, "An _Or.dirance regulating traffic, the operation and parking of vehicles, the use of -streets for driveway entrances and designating arterial highways in the City of Rochester., Minnesota", was given its first reading. An Ordinance defining restaurant, itinerant restaurant, employee, utensils, health officer, etc., requiring. certificates of compliance fox the operation of such establishments, prohibiting the sale of adulterated, unwholesome or misbranded food or drink, regulating the inspection and rating .of fi uch establish ments, the enforcement of this ordinance, and the fixing of penalties", was given its first reading. - I An Ordinance amending Ordinance No. 558, same being the Zoning Ordinance,; was given its third and final reading. i Upon motion by Davis, second by Brumm, that the said Ordinance be adoptedi' as read, and all voting in favor thereof, President Bach declared the said Ordinance duly passed and adopted. i� The matter of sending the Chief of, the Police Department to the F. B. I. School to be held in Washington, D.-C. was again brought to the attention of the Council and upon motion by Thiem, second by Brumm, the Chief of Police was authorized to attend the said school and.the sum of $950.00 was appropriated for his expenses. City of Rochester, Minn., J a nu a r y 19. 1993 ,Department was brought up by, Alderman Thiem, and upon motion by Davis, second by Brumm, the.same i-.as referred to the Mayor and the Police Committee, Alderman Thiem a,gai.n brought up the matter of. employing an Administrative ,Assistant to the Council, to assist in the Council work and the work of Council Committees. Alderman Thiem moved that the Council employ an administrative assistant.to.'the Common Council and Alderman Brumm seconded the motion. Upon roll call Aldermen Brumm and Thiem voted in favor of the motion and Aldermen Davis, Morris and Whiting voted "no". At the request of Alderman Whiting, President Bach declared a recess at 11:00 o'clock P. M. President Bach called the meeting to order at 11:20 o'clock P. I.I., and asked if there was anyone present who wished to b.e heard on the matter of the construction of a sewer in 2nd Avenue Southwest from 1st Street to West Center Street and on West Center Street from 2nd Avenue to Broadway. ,Air. Paul Grassle, representing property owners on @enter Street other than the.Kahler Corporation and. the Mayo Clinic, was heard. Also Mr. Roy Watson, Jr. was present at the meeting. After some discussion a motion was made by Aldermsn Whiting, seconded by Alderman Thiem, that the City construct the said sewer and pay for same from general taxation, and that the contribution of the Mayo Clinic and the Kahler Corporation, in the amount of $23,000.00, be accepted, no assessment for the sewer to be made against abutting property owners. President Bach called for a roll call vote on the motion and Alderman Thiem and Whiting voted in favor of the motion and Aldermen Brumm, Davis and Morris, voted "no!'. Mr. Watson then stated that the offer of the Mayo Clinic and the Kahler Corporation would be rescinded and requested that the Council notify them of future developments.
