Minutes of a regular meeting of the Common -Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City
on February 2, 1953.
President Bach called the meeting to order at 2:00 o1c.lock P. M., the
following members being present: President Bach, Aldermen Brumm, Davis, Morris,
Schroeder, Thiem and Whiting. Absent: None.
Upon motion by Thiem, second by Davis, the minutes of the meeting of
January 19, 1953 were approved.
President Bach stated this as being the time and place set for the I'

Hearing on the levying of special assessments.for the construction of
a sanitary sewer and watermain in.Westlawn Addition, Block 3 and Mohn and Hodge

President Bach stated this as being the time and place set for receiving';

and opening bids for furnishing one bookkeeping machine for use in the City Clerkis
ioffice. Upon motion by Davis, second by Morris, the City Clerk was instructed to
open the bids received. .The bids of Burroughs Adding Machine. Company in the
amount of .$2, 659. 50 and National Cash Register Company in the amount of $4, 405.00
were each received and opened ar.a the same were referred to the Purchasing
Committee and the City Clerk for tabulation and report.
President Bach stated this as being the time and place set for rec-
eiving and opening bids for construction of a sanitary sewer in 2nd Avenue S.W.
from 1st Street S.W. to Center Street and in West Center Street from Broadway to
2nd Avenue Southwest. Upon motion by Davis, second 'by Brumm, the City Clerk
was instructed to open the bids received. The bids of Carlisle G. Fraser in the
amount of $47,?4g.50 and Ba,rbarrOssa & Sons, Inc. in the amount of $54,60g.00
were each received and opened and the same were.referred to the Sewer Committee
and the City Engineer for tabulation and report.
The following recommendation was read and upon motion by Davis, second
by Brumm, and upon roll call and all voting in favor thereof,. the recommendation
was accepted and the Council went on record as being in favor of the plan set
forth in the recommendation:
"Honorable Mayor and Common Council
Of the City of Rochester, Minnesota
Gentlemen:
We, the undersigned after careful consideration of
several alternate plans,•recommend the construction of
sanitary sewers on 2nd Avenue Southwest between 1 Street
Southwest and West Center Street and or. West Center
Street from 2 Avenue Southwest to Broadway ue financed as
follows:
1. The entire cost of the sewer on 2 Avenue to
be paid by the Kahler Corporation and Mayo Clinic.
2. An assessment of $14.50 per assessable front
f6ot.(less 50 ft. deduction on each corner) on
,Center Street.
j. One-half oS the balance of the cost of the Sewer
on Center Street to be paid by the City of Rochester
(Sewer Fund) and one-half by the Mayo Clinic and
Ka.hler Corporation.

Mr. George Pougiales, Attorney representing residents in the area
West of the City limits appeared at the Council meeting and stated that he

thought there was some question as to whether the property could be legally
anneated to the City under the proposed plan. City Attorney Hunt recommended
to the Council that the question be submitted to the Attorney General for a
ruling and upon motion by 'Davis, second by Schroeder, the City Attorney was
instructed to request the Attorney General for an opinion on the matter.
A number of citizens interested in the proposed dancing ordinance
were present at the meeting. A motion was made by Brumm, second by Thiem, that

the final reading on the proposed dancing ordinance be tabled at this time. AZ1 II
voted in favor of the motion except Alderman Whiting, who voted °noel. !
A motion was then made by Alderman Brumm, second by Alderman Thiem, that
tr.e City Glerk be instructed to place on the'ba.11ot at the Charter Election to be
held on March 10, 1953 the question, "Should dancing be permit,ted'in ten of the II
lion sale"' intoxicating liquor establishments together with the serving of meals inl,
said establishments". Upon roll call Aldermen Brumm, Davis, Morris and Thiem

voted "yes" and Aldermen Schroeder and Whiting voted IlAo!l.

Mr. Frank Forsythe,'representing the Exchange Club, was again before the;;
Council regarding the matter of .placing benches at certain locations in the
business district of the City. He stated that permission had been secured from
20 business places in the City of Rochester. He further stated that the benches
would be built of concrete and would carry advertising to defray a. part of the
.I
expense of constructing and handling the said. benches. After hearing Air. Forsythel

a motion was made by Alderman Morris, second by Alderman Thiem, that the matter bei-
referred to the Public Grounds Committee and the City Attorney for report at the
next meeting.

petition by Fabian G. King was read and upon motion by Schroeder, second by Thiem,
the same was referred to the City Attorney. I'

A summons and complaint in the matter of Fred 11. Bauler, Plaintiff vs

H. L. Haggerty, Frank Lent and City of Rochester was -read and upon motion by Davis,l'
second by Thiem, the same was referred to the City Attorney.
A petition signed by 45 individuals opposing the passage of an amendmentj!

to paragraph (1), Section 12, of Ordinance No. 645 and two letters opposing the
amendment to the dancing ordinance together with•one anonymous letter approving the�l
proposed ordinance change were each presented and ordered placed on file.
Two credit memorandums in the amounts of $599. 70 and $65, 436.25 reducing jl
the amount of Carlisle G. Fraser's contract for construction of sanitary sewer,
sewage pump station, pressure main and gravity sewer to the new Sewage Disposal �I

Plant were each read and upon motion by Davis, second by Schroeder, the same were
approved and the City Clerk was instructed to sign same for the City of Rochester.

A letter from the chairman of the Safety Committee of the Jefferson
P.T.A. expressing their appreciation for the installation of safety signals
installed near the Jefferson School was read and ordered placed on file. I

A petition for the construction of a watermain in Block 103 of Wilson's },
Addition was read and upon motion by Morris, second by Davis, the same was referred!;

Sec. 3-106-14 and the Southeast quarter of the southwest quarter and the
southwest quarter of the southeast quarter of Sec. 34-107-1.4 west, escept those
portions already within the corporate limits of the City of Rochester was read
and upon motion by Davis, second by Schroeder, the same was referred to the
Survey Committee.
The following recommendation was read and upon motion by Morris,
second by Schroeder, the sa.me.was approved and the City Attorney was. instructed
;,to prepare an amendment to the Police Ordinance:

Gentlemen:
We the undersigned do respectfully propose to the Common
Council that three additional police patrolmen be appointed
to the Police Department of the City of Rochester,-sub-ject
to the regulations thereof, the appointments to be effective
at the start of the new fiscal year, April 1., 1953•

A notice by Mrs. John E. Bruton of snjury and claim for same in the
amount of $250.00 was read and upon motion by Davis, second by Morris, the same
was referred to the City Attorney.
The petition of Robert H. and Rosemary A. Nesler to have Lot 11,
,Block 2, Reiss Sub -Division changed from a residential to a multiple dwelling

zone was read together with a statement of acquiescence signed by 9 owners of
adjacent property. Upon motion by Morris, second by Davis, the same was referred
to the Board of Zoning.
The City Engineer's estimate of cost of constructing a sanitary sewer
in 2nd Avenue Southwest from 1st Street to West Center Street and in West Center
Street from Broadway to 2nd-Avenue Southwest in the amount of $39, 326. 50 was read
and President Bach ordered that the same be placed on file;
The recommendation of the Sewer Committee that the bids for construction
of a sanitary sewer in 2nd Avenue S.W. from 1st Street to West Ceinter Street and
in West Center Street from Broadway to 2nd Avenue S. W. be rejected and checks
returned to the bidders was read and upon motion by Davis, second by Whiting, the
recommendation was approved.
The recommendation of the Board of Zoning that the petition of Mrs.
Alice Carlson and Mr. R. L. Carlson to have Lot 6, Block 34, Northern Addition
changed from a residential to a commercial zone be granted was read and upon motion
Eby Morris, second by Davis, the same was approved and the City Clerk was instructed
to publish a notice of hearing to be held at 7:30 o'clock P. M. on February 16,
19 53.

The recommendation of the Board of -Zoning that the petition of Frances
G. Twyeffort to have the following described property rezoned as follows be
granted was read and upon motion by Davis, second by Brumm, the recommendation
was approved and the City Clerk was instructed to publish a 4notice of hearing to
be held at 7:30 o'clock P. M. on February 16, 1953: a
"Lots 3 in'Block 3-and Lot 2, in Block 5; Gooding's Addition
from residential to multiple dwelling zone.
• Lots 4 and 5, Block 3 and Lots 3 and 4. Block 5 and Lot 11

adjacent to'the Mayo Park Bridge which has been undermined by'flood waters, using
available city for.ces to do the work (funds for 'this wdrk are' available `in the
bridge fund) was read and upon motion by -Norris, second by Thiem, 't'he recommend-

The annual,report of the Clerk of Municipal Court was presented and
President Bach "ordered ,t•hat the same be placed on file.,

. The report of the- Clerk of Municipal Court for the Meek ending January
24,•195S showing total criminal fines and cost's collected $1,116.00 and civil
fees received $.85 and for the week ending January 31, 1953 showing total crimina
fines and costs collected $1, 117. 5•4' and- civil fees' received' $. Y5, were each read
and having been approved by the CitS Attorney, President Bach, "orde'red that the'
same be placed on file.
The financial repibrt of the Fire Department Relief As`sociati`on was read
and President Bach ordered that the same be placed on file.
The report of the City Weighmaster for the month of January, 1953
showing fees collected for loads weighed in the' amount of $174.45 ,•gas' read and
President Bach referred - the same to the' Finance Committee. ' ..
The application of Cedric Grossbach for a license to sell soft driiiks'
was read.and upon motion by Schroeder, second by Brumm, the license was granted.
The application of E. R. Pitt for a Journeyman Electricians License
was read and upon•motion by Schroeder; second by Thiem, the license was granted.
The surety,bonds of Clifford Strike ifi the amount of $2, 500.00 with the '
Travelers Indemnity Company as surety and The Kruse Company in the amount of
$496.25 with the National Surety Corpora.tiot as surety were each read and upon

An Ordinance defining restaurant, itinerant restaurant, employee,
utensils, health -officer, etc., requiring certificates of compliance for the I�
@peration of such establishments, prohibiting the sale of adulterated, uriwholesomelI
or misbranded food or drink, regulating the inspection and rating of such I!

establishments, the enforcement of this. ordinance and the fixing of penalties, p

Upon motion by Davis, second by Norris, and upon roll call and all voting
in favor thereof, the rules were suspended and the ordinance was given its third

An Ordinance repealing Ordinance No. 459, same being an amendment to
and ordinance entitled, "An Ordinance to preserve the public health by
regulating the storing and handling of foodstuff intended for human consumption,
offered for sale within the City of Rochester.and providing penalties for the
violation thereof", was given its second reading.
Upon motion by Morris, second by Schroeder, and upon roll call and all �I
voting in favor thereof, the rules were suspended and the ordinance was given its �I
third and final reading.
Upon motion by Thiem, second by Morris, that the said ordimiace be
adopted as read, and all voting in favor thereof, President Bach declared the
said ordinance duly passed and adopted.
An ordinance amending an ordinance entitled, "An Ordinance regulating
traffic, the operation and parking of vehicles, the use of streets for driveway
entrances and designating arterial highways in the City of Rochester", was given
its second reading. I

Upon motion by Davis, second by Thiem, that the said ar.dina.ace:'. be
adopted as read, and all voting in favor thereof, President Bach declared the
said ordinance duly passed and adopted.
An Ordinance amending an ordinance entitled, "An ordinance regulating
the sale cf intoxicating liquor within the City of Rochester",(No. 6451, was
given its first reading.
Upon motion by Morris,' second by Brumm, h.nd upon roll call and all •
voting in favor thereof, the rules were suspended and the ordinance was given
its second reading.
Upon motion by Morris, second by Brumm,'and upon roll call and all
voting in favor thereof, the rules were suspended and the ordinance was given
its third and final reading.
Upon motion by Thiem, second by Davis, that the said ordinance be
adopted as read, and all voting in favor thereof, President Bach declared the
said ordinance duly passed and adopted.
Alderman Davis made the suggestion that the number of committees of.
the Common Council be reduced to"three, consisting of a Public Works Committee,
a Finance Committee and a Public Safety Committee'ard Upon motion by Davis,
second by Brumm, the recommendation was referred to the c6mmittee consisting
of the Alderman at Large and the City Attorney for study.
Discussion was held as to whether or not a survey should be made of
various down town locations to determine as to whether or not :Wore parking meters
should be installed. A motion was made by'Davis, second by Brumm, referring the
matter to the Police Committee and the Chief of Police and the City Engineer to
make the proposed survey and submit same to the Council.
Alderman Schroeder recommended that the Chief of the Fire Department be
authorized to attend the 25th annual Fire Department Instructors Conference to be
held at Memphis, Tennessee on February 24-27, 1953'and upon motion by Schroeder,
second by Brumm, the Chief was authorized to attend the said convention at City
expense.
The City Engineer requested permission to attend a conference of
pre -stressed concrete construction to be held in Denver, Colorado'on February 9,
10 and 11, 1953. Upon motion by Davis, second by Brumm, the City Engineer was
authorized to attend the conference 'and his transportation to be paid from City
expense.
Upon motion by Morris, second by Schroeder, the meeting was adjourned
until 7:30 o'clock P. M. on February 16, 1953• .
