M., the �! it following members being present: President Bach, Aldermen Brumm, Davis, Morris, Schroeder, Thiem and Whiting. Absent: Hone. I ij Upon motion by Davis, second by Morris, the minutes of the meetings of February 16th, February 21st and February 25th, 1953 were approved. President Bach stated this as being the time and place set for the i' second hearing on the construction of a sanitary sewer in 2nd Avenue Southwest j from 1st Street to Center Street and in West Center Street from 2n.d Avenue to Broadway. There was no one present wishing to be heard. President Bach asked as to whether or not there was anyone present who I. wished to be heard on any matter. it Mr, George Pon ialea, representing property owners opposed to annexingI' ; the area West of the City limits, spoke in opposition to the annexation. Also i Mr..Wm. F. Young, Mr. M. L. Blee,and Howard Barr, residents of that area, were 'I present and protested the annexation. Mr. Claude H. Mcquillan°was present and stated that he did not think they should be forced to annex their property to the City. After hearing those present and -discussing the matter, a motion was made by Thiem, second by Whiting, that the matter of annexing lands west of the City I limits to the -City of Rochester be laid -on the table. All voted in.favor of the motion. Mr. Ray Narveson, of the Minnesota Fire Extinguisher Company -located at 110 East Center Street, stated that he had previously requested a loading zone at his place of business. He further stated that he -had received parking tickets for parking his truck and asked if it would notbe possible for him to have a loading zone. Upon.motion by Morris, second by Brumm, the matter was referred to the Police Committee and the 'Chief _ of Police. Mr. Frank Forsyth, representing the Exchange Club, was again before the � Council in regard to the matter of placing benches at bus stops in the residential!l area of the City.City Attorney Hunt y y gave an opinion that it would require an , ordinance to provide for the placing of such benches on the boulevards of the City.jl After discussing the matter further a motion wasmade by Schroeder, second by e Brumm, instructing the City Attorney to prepare an ordinance which would permit.the i� placing of the said benches on the boulevards in the residential area of the City, with the permission of the owner$ at the location of the bus stops. The petition of Charles H. Rersten to have Lot 6, Block 5, Head & McMahan's Addition -changed from a residential zone.to a multiple dwelling zone was ' i read and upon motion by Morris, second by Whiting, the same was,referred to the 2.6 Record of Official Proceedings of the- Common Council of the City. of Rochester, Minn., March 2, 19 53 Board of Zoning. A communication from-M. W. Price, City Assessor, requesting permission for himself and Mr. Gust Obst to attend the annual assessor's school, sponsored by the League -of Minnesota Municipalities, to be held on March 12, 13 and 14th,,was. read and upon motion by Davis, second by Schroeder, Mr. Price and Mr. Obst were authorized to attend the said school. The recommendation of the Street & Alley Committee that bids be taken for the season's supply of crushed rock, sand, gravel, pea gravel, ready mixed concrete, road oil and cutback asphalt, and hot mixed bituminous mixture 'for use in the Street & Alley Department was readand upon motion by Davis, .second by Brumm, the recommendation.was approved.' The recommendation of the Fire Committee that the Fire Department be instructed to draw up specifications for a volume plus high pressure fog truck and that the 1935 International 500 gallon pumper be traded in on the new truck, and that the City Council open bids for the new truck on May, 1953 was read and upon motion by Schroeder, second by Davis, the recommendation was approved. The recommendation of the Board -of Zoning that the petition of Robert H. and Rosemary A. Resler to have Lot 11, Block 2, of Reiss Sub -Division changed from a residential to a multiple -dwelling -zone be granted, was read aril upon motion by Davis, second by Schroeder, the recommendation was approved and the City Clerk was instructed•to publish a notice of hearing to be held at_7:30 o'clock P. M. on March 23, 1953* The recommendation of the Board of Zoning that the petition of Louis Golod to have the following described property changed from a residential to a commercial zone, be granted subject to the approval of the Planning and Zoning Commission in regard to the establishment of streets and avenues, was read: "Commencing at the Northeast corner of Lot 33, Auditot' s Plat "A" thence south 200 ft. , thence southwesterly 723.8 ft.,-thence Northerly 410 ft, - to the north line of said Lot 33, thence Bast 940.3 ft. to beginning and also Lot 3, Bilmar Addition." Upon motion by Davis, second by Thiem, the recommendation was approved and the City Clerk was instructed to publish a notice of hearing to be held at 7:30 o'clock P. M. on March 23, 1953. The City Clerk was further instructed to request the,Planning and Zoning Commission to submit their recommendation as to the establishment of streets and avenues in the above described property so that same would be available at the meeting to be held on March 23, 1953. A letter from C. P. The applications of J. W. Kyle for license to sell cigarettes and a license to sell soft drinks were each read and upon motion by'Brumm, second by Morris, the licenses were granted. The following resolutions were introduced and read and President Bach declared the same unanimously adopted; Resolution granting a permit to the Kehler Corporation to erect canopies on the new Kehler Hotel Building Addition: Upon motion by Brumm, second by Davis, resolution adopted. • Resolution granting a permit to Mayo Properiles Association to erect canopies on the Diagnostic Building. Upon motion by Davis, second by Morris, resolution adopted. Resolution granting two dance permits to Percy Cline. Upon,motion by Morris, second by Schroeder, resolution adopted. Resolution ordering bids for furnishing the 1953 season supply of crushed rock, sand, gravel, ready mix concrete, road, oil and cutback asphalt and hot mix bituminous mixture. Upon motion by Schroeder, second by Thiem, resolution adopted. Resolution ordering bids- for furnishing one volume plus high presbure fog truck for use in the Fire Department. Upon motion by Thiem,rsebond by Whiting, resolution adopted. Resolution appropriating $1, 536. 50 from the General Fund, $2,06s.63 from the Sewer Fund, $342.51 from the Bridge Fund, $193.11 from the Permanent Improvement Fund and,$319.00 from the. Parking Meter Fund and ordering payment made to.the Street & Alley Fund. Upon motion by Whiting, second by.Brumm, resolution adopted. Resolution accepting plans and specifications and ordering bids for ,construction of a sanitary sewer in 2nd Avenue Southwest from lot Street to • Center Street and in West Center Street from 2nd Avenue to Broadway. Upon 'motion by Brumm, second by Davis, resolution adopted. Resolution appropriating $552.69 from the Street & Alley Fund and $1,65s.49 from the Park Improvement Fund and ordering payment made to Morton .Salt Company, $277.20; Municipal Steel Corp., $275.49 and Mayo Civic Auditorium 8evolving. Fund, $1,658,49. Upon motion by Davis, second by Morris, resolution adopted. An Ordinance providing for the formation and government of the Police Department of the City of Rochester, Minnesota, was given its second reading. Upon motion by Davis, second by Schroeder, and upon.roll call and all voting in favor thereofIF the rules were suspended and the ordinance was given its third and final reading. Upon motion by Davis, second by Morris,.that the said ordinance be adopted as read, and all voting.in favor thereof, President Bach declared the said ordinance duly passed and adopted. The matter of providing maps of the City of Rochester'on which property descriptions could be checked and zones could be traced was discussed and the City Engineer was requested to prepare maps and look up equipment for holding same. Alderman Schroeder, Chairman of the Public Grounds Committee, brought to the attention of the Council the fact that many of the nipples in the lower part of the steam radiators in the City Hall were completely cut through from the circulation of the Boater or steam and were constantly having to. be repaired. Also some of the plumbing in the jail section of the City Hall was in need of repair. There was some question as to whether or not it wohld be more expensive to put in Improved radiation or repair the old radiators, also as to whether all of the plumbing in the jail should be repaired at this time. 0 3 0. Council and upon motion-by•Schroeder, second by Morris, the,Aldermen, thecity• Engineer, one operator from the•Sewage Disposal Plant and the City Clerk wore - authorized to attend the said courses. •Upon motion by Morris, second by Davis, the meeting w4.s adjourned unto 3:30 o'clock P.
