Minutes of the annual meeting of the Common Council -of the City of
i,
Rochester, Minnesota, held in the Council Chambers to the City Hall, in said
City, on April •6, 1953-
President Bach called the meeting to order at•2:00 o'clock P. M., the
,following members being present: President Bach, Aldermen Ackerman, Anderson. -
.Morris, Schroeder, Theim and Whiting. Absent:- None.
Upon motion by Thiem, second by Schroeder, the minutes of the. meting
of March 23, 1953 were approved.
President Bach addressed the Mayor, the Members of the Council and those •
present at this meeting. He welcomed the new members who had been elected to
serve on the Common Council, stating that he felt that they, together with the
other members,of the Council, should be able to work well together and accomplish
,much during the ensuing year. He further stated that the Council needs the help
of citizens of the City and that all should feel free to come -before the governing
body when they may have any problem that comes under the jurisdiction of the
Council. President Bach then requested the Clerk to read the appointments to the
Council Committees for the year 1953-1954:
STREET & ALLEY COMMITTEE: Raymond C. Schroeder, A. G. Whiting and
Emrold Thiem.
SEWER COMMITTEE: Emrold Thiem, Stanley M. Morris and Leo C. Anderson.
FINANCE COMMITTEE: Stanley M. Morris, Raymond C. Schroeder and
A. G. Whiting.
POLICE COMMITTEE: Leo C. Anderson, Raymond C. Schroeder and Archie M.
Ackerman.
PUBLIC GROUNDS COMMITTEE: Archie M. Ackerman, Stanley M. Morris and
Leo C. Anderson.
FIRE COMMITTEE: Leo C. Anderson, A. G. Whiting and Emrold Thiem.
LIGHTING COMMITTEE: Archie M. Ackerman, Raymond C. Schroeder and
Stanley M. Morris.
LICENSE COMMITTEE: A. G. Whiting, Emrold Thiem and Leo C. Anderson. ;

President Bach then introduced Mayor Claude H. MC Quillan, who
delivered the following address%
"Mr. President, Honorable Council, member.s of the Official
Family, and citizens who hage honored us with their presence
today.
We are beginning our duties as officials of the City of Rochester
for the fiscal year 1953-1954, and in behalf of the peoples of this
community it is my privilege to extend greetings to all of you and a
warm welcome to the new members of our City Council.
We are entering a year - not unlike any other year - when we are'.
faced with perplexing problems -- demands upon our time and resources -
tasks to be promptly performed and I have no doubt, but that this
Council and administrative offices will close the year with a record
of achievements that will be satisfactory to the citizens of Rochester.
I personally hope that you and I,never forget that we are represen-
tatives of the people and that we are here for only one purpose - and
that is to administer the affairs of this Community as the vast
majority of our people would have it done.
I believe that we have the kind of men on this Council with the

intelligence, experience and ability to exact sensible legislation
safeguard and control the finances and property of the City and do
all of those things which they have the authority to do for the
enhancement of the general welfare of our people and for the
advancement of good government. I belieive that this Council realizes
that ours is also a Government of Boards wherein the various Boards
have the management and control of their particular. departments -
as, set forth in our Home Rule Charter -- and that none of us have
any authority or powers beyond that specifically set up for us in
our Charter. Quite often, in the past, we have had infringements
upon the authorities and powers of Officials and Boards - and the
assumption of individual authority - when there is no individual
authority. I am confident that we will not have these demoralizing
and disrupting proceedures to contend with this year.
In my position as Mayor of the City of Rochester, I shall never
assume to have any authority beyond that given to the Mayor by the
terms of our Home Rule Charter or the General Laws of the State of
Minnesota applying to Mayors of Cities of the Second Class. Neither
will I seek to evade any of the responsibilities of the Chief
Executive of this City. However, until I sever my connections with
the Post -Bulletin on or about the labt week in June - it will be
practically impossible to efficeintly take over the "General
supervision and control of all the officers and departments of the
City Government" as required by Charter.. After July 1st - I shall
devote all my time to the office - even tho the present salary be
only $400 a year. I shall keep the Council informed and recommend
advantageous measures as I see them. (Which again is required by
Charter).
There is no reason why we cannot have perfect cooperation between
the Mayors office.and the City Council to the advantage of all of us
and the City in general. I shall come to you whenever I need help -
and sincerely hope that you will call upon me when I can be of
service to you.
The Mayor's office will be open from 9 A.M. to 6 P.M. every day
except Saturday, where I may be contacted at any time by officials
or citizens. I shall attend all Council meetings, and any Board
meetings when invited to do so by Board members.
There are some important Charter changes, which°I am certain the
voters will approve when the amendments are submitted, but of course,
they will not be in the new form of government which the Charter
Commission is now preparing.
All -in All, the coming year should be most interesting - and one
of considerable accomplishment."
Mayor McQuillan then read the following communication and upon motion
Morris, second by Thiem, the appointments were approved:

for a period of three years.
TO the Music and Band Committee -

Alderman Whiting introduced the following resolution which was read and
upon motion by Thiem, second by Anderson, that the said resolution be adopted as

read, and all voting in favor thereof, President Bach declared the said resolution
duly passed and adopted:
"WHEREAS. It is deemed expedient and necessary that the
Common Council of the City of Rochester, Minnesota, adopt roles
of order for the conduct of its business, and
WHEREAS, A copy of Robert's Rules of Order (revised)
of the 1915 Copyright, is before this Common Council:
SO THEREFORE, Be it resolved by the Common Council of
the City, of Rochester,, 1innesota:
That the said Roberts rules of Order be adopted by
this Common Council as rules of order for the conduct of its
business."
Alderman Thiem introduced the following resolution which was read and
upon motion by Anderson, second by Schroeder, that the said resolution be adopted
as read, and all voting in favor thereof, President Bach declared the said
resolution duly passed and adopted:
"Be it resolved by the Common Council of the City of
Rochester, Minnesota:
That the said Common Council of the City of Rochester,
Minnesota, hereby adopts the following rules, and regulations for
the order of business of said Common Council:
1. Roll Cell. The roll cell of the Common Council
shall be had and taken in its alphabetical order according
to the names of the members, except that the name of the
President of the Common Council shall be called only at the
first roll call of each meeting and then after that, at that
meeting, only in case of a tie vote when his name shall be
called and vote taken after the expression of each of the
other members of the said Common Council, or when a 5/7 vote
is required.
2. Reading and approval of the minutes of the proceeding
meeting.
3. At first meeting, the appointment .of officers and
committees.
4. Public hearings.
5. Reading of petitions and communications.
6. Reports of committees. All reports of committees
shall hereafter be made in writing, unless ordered otherwise
by said Common Council.
7. Unfinished business.
S. Resolutions and ordinances.
9. Bills and claims.
10. Adjournments."
President Bach stated that the next order of business would be the
reading of applications and appointment of officers.
The application of F. R. Finch for reappointment to the office of City
Clerk was read and upon motion by Morris, second by Ackerman, F. R. Finch was
appointed as City Clerk for the ensuing official year.
The application of R. V. Ehrick for appointment to the office of City
Attorney was read and upon motion by Thiem,_ second by Schroeder, H..V. Ehrick
was appointed as City Attorney for the ensuing official year.
The application of C. A. Armstrong for appointment to'the position of
Acting City Engineer was read and upon motion by Schroeder, second by Ackerman,
C. A. Armstrong was appointed as acting City Engineer for the ensuing official
year.
The application of Garnet Spring for reappointment to the office of
Building Inspector was read and upon motion by Whiting, second by Morris, Garnet
Spring was appointed as Building Inspector for the ensuing official year.

The application of Paul Plantz for reappointment to the office of
Electrical Inspector was read and upon motion by Morris, second by Ackerman, Paul it
Plantz was appointed Electrical Inspector for the ensuing official year.

Bennett and Louis Bennett for appointment to the.office of Scavenger and Dog
Catcher were,ea.ch read and upon motion by Thiem, second by Schroeder, the said
applications were referred to the Public Grounds Committee.
The application of Flora C. Anderson for reappointment as Stenographer
for the Chief of Police, Juvenile Officer and City Attorney was read and upon
motion by Ackerman, second by Schroeder, Flora C. Anderson was appointed as
stenographer for the Chief of Police, Juvenile Office and City Attorney for the
ensuing official year.
The application of Barbara Koebke for reappointment as secretary to the
Building, Electrical, Plumbing and Heating Inspectors was read and upon motion by
Whiting, second by Schroeder, Barbara Koebke was appointed as secretary to the
Building, Electrical, Plumbing and Heating Inspectors for the ensuing official
year.
The application of Mark E. Blanchard for reappointment as City Painter
was read and upon motion by Anderson, second by Ackerman, Mark E. Blanchard was
appointed as City Painter for the ensuing official year.
The application of Ivan Boyd for reappointment as assistant custodian
for the City'Hall and custodian of the voting machines was read and upon motion

The application of Harold Wiesener for reappointment as assistant
custodian of the City Hall was read a.nd upon motion by Morris, second by Thiem,

ensuing official year.
The application'of Paul Sandberg for reappointment as assistant custodian
of the City Hall was read and upon motion by Anderson, second By Schroeder, Paul „

Sandberg was appointed as assistant custodian of the City Hall for the ensuing
official year.
.The application of Paul Dornack for reappointment as first assistant
and foreman of the City Dumping Grounds was read and upon motion by Thiem, second
:by Anderson, Paul Dornack was appointed as first assistant and foreman of the
City Dumping Grounds for the ensuing official year.
The application of Fred C. Zimmerman for reappointment as second
,assistant at the Dumping Grounds was read and upon motion by Thiem, second by
;Ackerman, Fred C. Zimmerman was appointed as second assistant at the Dumping
.'Grounds for the ensuing official year.
The application of Norbert A. Huiting•for reappointment as machine
operator at.the City Dumping Grounds was.read and upon motion by Ackerman, second
'by Thiem, Norbert A. Huiting was appointed as machine operator at the City
Dumping Grounds for the ensuing official year.
The application of W. J. Barden for reappointment as assistant to the
';City Treasurer was read and upon motion by Thiem, second by Morris, W. J. Barden
,was appointed as assistant to the City Treasurer for the ensuing official year.
The application of James A. Waters for reappointment as Meter Maintenance
man was read and upon motion by Schroeder, second by Thiem, James A. Waters was
appointed as meter maintenance man for the -ensuing official year:
The application of Joe Healey for reappointment as assistant in the
meter maintenance department was read and upon motion by Schroeder, second by
Thiem, Joe Healey was appointed as assistant in the meter maintenance department
for the ensuing official year.
The application of -Frank W. Everett for reappointment to the office of
Fire Warden was read and upon motion by Anderson, second by Ackerman, Frank W.
Everett was appointed as Fire Warden for the City of Rochester for the ensuing
official year.
President Bach stated this as being the time and place set for a hearing
do the proposed change of zoning of Lot 6, Block 5, Head & McMahonla Additionf rom
a residential to a multiple dwelling zone. There was no one present wishing to be
'heard.
President Bach stated this as being the time and place set for receiving
,and opening bids for leasing the City property located at the corner of 1st Avenue
and 6th Street Southwest. Upon motion by Schroeder, second by Morris, the City
Clerk was instructed to open the bid. received. The bid. of Clare Fischer Motors in
the amount of $1,260.00 per year was received and opened and upon motion by
Schroeder, second by Morris, the bid was referred to the Publ-ic Grounds Committee
for report.

andopening ening bids for construction of a curb and gutter on Sth Street Northeast I'
it from lat to 2nd Avenue Northeast. Upon motion by Schroeder, second by Thiem, the
City Clerk was instructed to open the two bids received. The bids of C; M.
�! Boutelle in the amount of $2, 325.90 ,and Conner and Winslow in'' the amount of i.
$2,398.140 we're each received and opened and upon motion by Thiem, second by
Anderson, the same were referred to the Street & Alley Committee and the City
Engineer for tabulation and report.
The recommendation of the Street & Alley Committee that the bid of C. X, -'
Boutelle for construction of a curb and gutter on Sth Street Northeast from 1st
to 2nd Avenue Northeast be accepted at unit prices bid and checks be returned to
the unsuccessful bidders, was read and upon motion by Morris,,second by Ackerman,
the same was approved.
Mr. Thomas M. Dick was before the Council and stated that he wished to
I connect with the sewer in 7th Avenue Northeast south of 14th Street and that the
City Engineer's Department had requested a fee of $1.00 per foot before issuing
a permit for him to connect to the said sewer line. He stated that he understood
others had connected to the line and had not paid $1.00 per foot. A motion was
made by Schroeder, second by Morris, that the matter be?referred to the Sewer
Committee and the City Engineer for report.
The request of Marvin W. Price, City Assessor, for permission to employ

four or five deputy assessors and to reappoint Henry Ifildenborg, Alfred Nelson
and Gust Obst as Deputy Assessors was read and upon motion by Anderson, second
' by Schroeder, the appointment of Henry Wildenborg, Alfred Nelson and Gust Obst
as deputy assessors was approved.
A communication from Max Durand, representing General Drivers Union
I' Local 997, requesting an informal meeting prior to April 6th,'1953 with members
of the Council was read and ordered placed on file.
A letter from the Kiwanis Club notifying the Council that at their i
weekly meeting held on March 19th a resolution -was adopted favoring a program of
flouridation in the City of Rochester was read together with copies of resolutions
adopted by the Exchange Club and the Rochester Council of P.T.A. endorsing and
petitioning the Common Council to establish flouridation of the City water supply
and upon motion by Schroeder, second by Morris, the said communications were
referred to the -Water Committee.
The Mayor°s certification of Robert D. Miller, 111 - 13th Street N. W.
as a member of the Police Department —of the City of Rochester, in accordance r-.='th
proceedures set forth by the Police Civil Service Commission was read and upon
motion by Schroeder, second by Thiem, the appointment was confirmed.
The request of Lyle Johnson, General Chairman of the Gypsy Frolic, to

conduct a. 'oi n o z.me on May 2, 1953 was read and ordered placed on file.

A recommendation by Mr. John W. Feller, Postmaster, in regard to the
,installation of 15 minute parking meter on the east,.e-muth and west sides of the
• post office block and on certain parts of other streets and avenues in the area
of the post office block was read and upon motion by Schroeder,.second by Thiem,
the same was referred to the Police Committee and the Chief of Police,
A communication from the Board of Education of the Rochester Public
Schools regarding the problem of securing a location for the new senior high
school and asking the serious consideration by the Council of their proposal to
locate the school in Soldiers Field was read and upon motion by Thiem, second
by Morris, the matter was referred to t:e Council as a committee of the whole
and the City Attorney and the Attorney representing the Schools.
A letter from the Firemen's Civil Service Commission submitting the names
of George Davis, Carroll Kettlekamp and Arthur Riess for the position. of
captains in the Rochester Fire Department was read and upon motion by Whiting,
second by Morris, the appointements were confirmed.
A petition for the construction of a curb and gutter on 2nd Avenue
Northwest between llth Street and 12th Street Northwest was read and upon motica
by Thiem, second by Morris, the same was referred to the Street & Alley
Committee and the City Engineer.
A petition by Lowell G. Darling and Lorraine A. Darling to have Lot 3,
Block-33, Northern Addition (912 North Broadway) changed from a residential to a
commercial zone was read and upon motion by Morris, second by Anderson, the same
was referred to the Board of Zoning.
The recommendation by the City Engineer.that the hearing on the project
.of widening 4th Street Southeast be re -opened at the meeting of April lath in
order that the City may be in a position to enter into a contract agreement with
'the Minnesota State Highway Department as soon as the plans are completed was
read. A motion was made by Thiem, second by Schroeder, that the hearing be again
opened at the meeting of April 13th. All voted in favor of the motion.
The following resolution adopted by the Public Utility Board were each
read and President Bach ordered that the same be placed on file:
"Be it and it is hereby resolved by the Public Utility Board of
the City of Rochester, Minnesota, that the Common Council of the
said City be and is hereby requested to authorize the said Board to
enter into a contract with the GENERAL ELECTRIC SUPPLY COMPANY, for
the furnishign in accordance with specifications on file, of-;
10,000 pounds 2/0 W. P. Wire
the total amount of the said contract to be FOUR THOUSAND FORTY NINE
DOLLARS ($4,049.00) and the said General Electric Supply Company
being the lowest responsible bidder."
O'Be it and it is hereby resolved by the Public Utility Board of
the City of Rochester. Minnesota, that the Common Council of the
said City be and is hereby requested to authorize the said Board to
enter into a contract with Allen Lloyd Company for the furnishing,
in accordance with specifications, of
ONE (1) INTERNATIONAL Model RC 192 Truck equipped
with Powers Model 6000 - 131 311 body,

said Allen Lloyd Company being the low eat responsible bidder.��
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota, that the Common Council of
the said City be and is hereby requested to authorize the said
Board to enter into contract with FUEL ECONOMY ENGINEERING COMPANY
for the ERECTION OF MISCELLANEOUS STATION EQUIPMENT AND DUCT WORK
"DIVISION W", the total amount of the said contract to be THIRTEEN
THOUSAND FIVE HUNDRED NINETY THREE DOLLARS ($13,593.00) and the
said Fuel. Economy Engineering 8ompany being the lowest responsible
bidder."
"Be it and it is hereby resolved,by the Public Utility Board
of the City of Rochester, Minnesota that the Common Council of the
said City be and is hereby requested to authorize the said Board
to enter into a contract with the STERLING ELECTRIC COMPANY for
the furnishing, in accordance with -specifications, of-;
FIVE (5) 400 MOM, 310 Splicing kits
2000 feet 4%0, if c Cable
2000 feet 2/0, 1/0 Cable
1000 feet 400 MOM, l/C Cable
the total mount of the said contract to be FOUR THOUSAND EIGHT
HUNDRED SEVENTEEN DOLLARS AND TWENTY CENTS ($4,817.20) and the said
Sterling Electric Company being the lowest responsible bidder." .
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota that the Common Council of said
City be and is hereby requested to authorize the said Board to enter
into a contract with ANACONDA WIRE AND CABLE COMPANY for the
furnishing, in accordance with specifications, of
2000 feet 400 MOM, 3/0 Cable for 15 KV Service
2000 feet 400 MOM, 310 Cable for 5000 Volt Service,
the total amount of the said contract to be FIFTEEN THOUSAND NINE
HUNDRED DOLLARS ($15,900.00) and the said Anaconda Wire and Cable
Company being the lowest responsible bidder."
A letter from the Public Health & Welfare Department transmitting a
schedule of recommended salaries for officers and employees of that department was
read and ordered placed on file.
The proposal of the Rochester Post Bulletin for doing the official
pprinting for the fiscal year of 1953-1954 was read and upon motion by Morris, it
second by Whiting the same.was referred to the Purchasing Committee.
The request of the Gloria Dei Lutheran Church re street lights at the
future intersection of 12th Street and llth Avenue Northwest was read and upon
motion by Morris, second by Thiem, the same was referred to the Lighting,Committee'
with power to act. i
The following letter was read and upon motion by. Schroeder, second by
Thiem, the same was re,Perred to the City Attorney:

We.have been engaged by your insurance carrier, the Globe
Indemnity Company, to defend the above entitled action.
The purpose -of this letter is to call to your attention'
the fact that the policy limit is $50,000.00 for damages to any
one person and that Fred*W. Bauler has sued you for $50,000.00.
Should Mr. Bauler obtain a verdict for more than $50,000.00
the amount in excess of $50,000.00 would'have to paid by you.
You have a right to engage your own counsel to represent you

on your exposure in excess of the policy limit of $50,000.00; if -
you desire.

A petition for the City of Rochester to spray, or otherwise effectively
treit, for the prevention of the breeding of mosquitoes in the low areas lying
North of the Outdoor Theater was read and upon motion by Schroeder, second by
Ackerman, the same was referred to the Public Health & Welfare Department.
A le6iter from Mr. Gilbert H. MacMillan submitting references as to his
ability and personal integrity with regard to the designing of the proposed 7th
Street Bridge was read and upon motion by Morris, second by Thiem, the same was
referred to the Street & Alley Committee and the City Engineer who were empowered
to check the listed references.
The request of Bert Leitzen for permission to grade the streets and
install sanitary sewer in 6th Avenue Northeast in Leitzenss 2nd Sub -Division was
read and upon motion by Schroeder, second by Thiem, the same was referred to the
Sewer Committee and the City Engineer.
An invitation from the Central Labor Union, A.F. of L. to the Mayor
and the members of the Council to be present at their regular meeting to be held
Thursday, April 9th, was read and upon motion by Schroeder, second by Ackerman,

The report of the City Weighmaster for the month of March, 1953 showing
fees received for loads weighed in the amount of $169.10 was read and President
Bach referred the same to the Finance Committee.
The report of the Clerk of Municipal Court for the peek ending
March 29, 1953 showing total criminal fines and costs collected $1, 520.E+5 and
civil fees received $1.05 was read and having been approved by the City Attorney
President Bach ordered that the same be placed on file.
The annual report of the Rochester Bus Lines, Inc. was presented and
President Bach ordered that the same be placed on file.
The matter of collecting rentals and care of the Williams Estate
property was discussed by the members of the Council and upon motion by Morris,
second by Schroeder, the handling and collection of rentals was transferred to
the office of the City Treasurer.
