President Bach called the meeting to order at 2:00 o'clock P. M., the �I

Ij following members being present: President Bach, Aldermen Anderson, Ackerman, �!
Morris, Schroeder, Thiem and Whiting. Absent: None.
Upon motion by Morris, second by Thiem, the minutes of the meeting of
�1April 20, 1953 were approved.
President Bach stated this as being the time and place se't for receiving!

i and opening bids for furnishing one volume plus high pressure fog, truck and upon
motion by Anderson, second by Thiem, the City Clerk was instructed to open the

�j bids received. The bids of John Bean Division in the amount -of $16,942.37;
Peter Pirsch.& Sons Co, in the amount of $18,463.00; The Four Wheel Drive Auto
I.
Co. in the amount of .$18, 235.00 and Ward LaFrance Truck -Corporation in the amount;
of'$18,728.45 were each received and opened and upon motion by Morris,. second by

Schroeder, the same were referred to the Fire Committee and the Chief of the Firel'
Department for tabulation and report.
!; President Bach -stated this as being the time and place set for receivingi-
and opening -bids for the sale of scrap metal from the old sewage treatment plant,
j and upon motion by Morris, second by Schroeder, the City Clerk was instructed to
! open the bids received. The bid of Bemel Auto Parts in the amount of $21.55 per
ton was received and opened and upon motion by Schroeder, second by Morris, the
'I same was referred to the Se:we-r Committee and the City Engineer for tabulation and

proposals for being designated as City Depositories. The proposals of the First
National Bank, the Union National Bank and the Olmsted County Bank & Trust Company'
were received and ordered placed on file.

President Bach stated this as being the' time and place set for' the
following hearings:
First hearing on the finish grading -and surfacing of 18th Avenue Southwest
from 3rd to 5th Street Southwest. There was no one present +rishing to be heard. l;
First hearing on the construction of a sanitary sewer in 14th Street
is
Northwest between 3rd and 5th Avenue Northwest. There was no'one present wishing
to be heard.
Continued hearing on the widening of 4th Street Southeast from 6th Avenue

to the Rochester State Hospital. No one was present at the meeting wishing t)
be heard on the matter and the Mayor stated that he had attended a meeting of
the property owners interested in the improvement and that they appeared to
be satisfied.
The recommendation of the Street & Alley Committee that Lots 109, 110
and 111 in Belmont Addition be annexed to the City of Rochester was read and
the:.same'was'.ordered placed on file.
The following recommendation was read and ordered placed on file:

Gentlemen:
We, the undersigned, recommend that the request of Bert
Leitzen to construct the sanitary sewer in 6 Avenue Northeast
be filed; and that the Sanitary Sewer and Water Main construction
previously petitioned on this street be let out for bids in
accordance with regular proceedure governing local improvements.

The recommendation of the Sewer & Water Committees that a sanitary
and watermain
sewer/be constructed in Gooding's Addition was read and.ordered placed on file.
The recommendation of the Sewer & Water Committees that a sanitary
sewer and watermain be constructed in Bielenberg & Giese Addition was read and
the same was ordered placed on file.
The recommendation of the Sewer Committee that the bid of Bemel Auto
Parts for the sale of scrap metal from the old Sewage Treatment Plant be
accepted at $21.9.5 per ton was read and the same was ordered placed on file.
The recommendation of the Planning and Zoning Commission that Lots
109, 110 and 111 in Belmont Addition be annexed to the City of Rochester, subject
to the City Engineer's approval, was read and ordered placed on file.
'The recommendation of the Board of Zoning that the petition of Mr. &
Mrs. H. P. Potvin to _have Lot 17, Block 4, Kutzky's First Addition changed .from
a residential to a multiple dwelling zone be granted was read and upon motion by
Morris, second by Ackerman, the same was approved and a hearing was ordered to be
held on May 19, 1953 at 7:30 o'clock P. M.
The recommendation of the Board of .Zoning that the petition of Lowell G.
and Lorraine Darling to have Lot 3, Block 33, Northern Addition changed from a
residential to a commercial zone be not granted was read and upon motion by Morris,
second by Anderson, the recommendation was approved.

The recommendation of the Board of Zoning that the petition of Mr. & !;

granted was read and upon motion by Thiem, second by Ackerman', the same was
approved and a hearing was ordered to be held on May 19, 1953,at 7:30 o'clock P.M1

The recommendation of the Fire Committee and the Fire Chief that the
bid of John Bean Company for furnishing one volume plus high pressure fog truck �!
be accepted in the amount of $15,942.37 and certified checks be returned to the
unsuccessful bidders was read and ordered placed on file.

Gentlemen:
The undersigned herewith resubmits his application for
appointment to the office of City Engineer for the; City of
Rochester, Minnesota.
In view of the fact that the Common Council is still
deliberating. on• the appointment of a City Engineer, the
undersigned,•as•Aeting City Engineer, suggests to the Council
that he.be appointed Assistant City Engineer and that the
salary of the Assistant City Engineer, together with the
temporary salary of the Acting City Engineer, be fixed by j
the Common Council.

The recommendation of the Street & Alley Committee ;that the request of
Bert Leitzen to grade and surface 6th Avenue Northeast in Leitzen's Second Sub-
division be granted, subject to the requirements of the City Engineer, was read
and ordered placed on file.
The recommendation of the Street & Alley Committee ;that the request of
John Faber to.grade and surface the streets in Hillside Addition be granted,

subject to the requirements . of the City Engineer, was read and ordered placed on
file.
The recommendation of the Street & Alley Committee that the•grading and
surfacing of streets in Gooding's Addition and llth Avenue Northwest from 7th to
14th Street Northwest be done was read and ordered placed on file.
The following recommendation was read and upon motion by Schroeder, i
second by Thiem, the recommendation was referred to the Street & Alley Committee,i
the City Engineer and the City Attorney for the purpose of drafting an' ordinance
governing the grading and surfacing or other public improvements as recommended:

compliance with plans, work specifications, and public liability.
To implement this requirement, it is further recommended,
that before permission is granted proprietors to do their own
grading, surfacing, or other public improvements, that they enter
into a written agreement with the City, setting forth the conditions
of the permit; that the City Attorney be instructed to draft a form
of Agreement for this use; and that the City Engineer be instructed
to stipulate the requirements of schedule, completion date, plans,
and work specifications for each case.

The recommendation of the Street & Alley Committee that the request of

be granted, subject to requirements of the City Engineer, was read and upon motion

We, the undersigned, recommend that the plans for the
widening and paving on Fourth Street Southeast from Sixth
Avenue Southeast to the Rochester State Hospital be approved
and that the City of Rochester enter into an Agreement with
the Minnesota Highway Department, for the work to be done.
Further, that we reaffirm the Assessment. Policy as
listed in "Recommendation dated August 25, 195211, which is
hereto attached.

Engineer"
A letter from.the Rochester Central Area Improvement Association
requesting the Council to consider the following suggestions to relieve the
parking situation in the down town business area was read:
1. That the buildings on the municipal parking lot be razed
and the area bey improved for parking, thus providing approximately
50 more parking spaces. Further, when the lot is prepared for
parking that the spaces be marked out and traffic lines be marked
out in order to use space to best advantage.
2. That an additional entrance and exit to the lot be
provided on Second Street S. E.
3. That consideration be given to the fees charged at the lot.
The present fee of ten cents for the first hour is inconsistent with the
parking provided. We are charging a primary fee for secondary parking.
4. That more signs be erected directing vehicles to this and
all other parking facilities.
5. That parking meters be removed from the area behind the fire
hall, thus providing more all day parking in the fringe areas. That
at the same time, consideration be given to razing of the unused garages
to the North of the fire hall and preparation of this area and the city
owned area to the West of the fire hall for parking thus providing more
free all day parking in the fringe areas.
6. That consideration be given to the whole problem of the metered
areas. If metered zones are being used less than 25% of the time that
meters in those zones should be removed thus providing appropriate use
of parking areas.
7. That the traffic signal on Broadway and Third Street South be
tided so that traffic traveling East and West have more time to get
through the intersection."

Upon motion by Thiem, second by Schroeder, the matter of razing the buildings -on +i
the Old Mill Property in order to make more space for parking of cars was referred,
to the Public Grounds Committee and also the matter of opening, an entrance from

After further discussion on the matter of parking meters a motion was
made by Whiting, second by Schroeder, that the parking meters on South Broadway
south of 5th Street be removed and also all parking meters in the parking area at
the rear of the City Warehouse on South Broadway be removed, these changes to be
made on a trial basis.
The "request of the American Legion Auxiliary and the Veterans of Foreign i,
Wars for permission to sell poppies on the streets on May 23, 1953 was read and
upon motion by Thiem, second by Ackerman, the permission was granted.

Dear Sir:

Your letter of the loth enclosing certified copies, in duplicate,
of resolutions adopted by the Common Council of the City of Rochester
at a meeting held on April 61 1953, has been received.
A study will be made to determine the extent to which this
department can cooperate in the improvement of 4th Street, including i
the widening of the bridges over Bear Creek and the Zumbro River. You
will be advised relative to this matter when data is available.
In connection with your resolution requesting that this department;;
enter into'a cooperative agreement for the resurfacing of Broadway Street
(T.H. No. 63) from 4th Street north to the South Broadway bridge, you
are advised that we.recognize the desirability of resurfacing this
section of T. H. No. 63 and we are willing to enter into such a cooper-
ative agreement on the basis of our usual share relative to cooperation
with cities for work on trunk highways. Under this,policy the.State will
pay 100 per cent of the cost of construction on the traffic lanes and I'
75 per cent of the cost of construction on the portion outside of the li
traffic lanes including such burb and gutter construction as may be
involved.

In the case of Broadway we have four traffic lanes extending from the
junction of T. H. No. 63 with T. H. No. 14 northerly and that fact
together with the large volume of traffic on Broadway from the South
Broadway bridge to 4th Street north justifies the assumption that the
100 per cent participation by the_State will cover four traffic lanes
having a total width of 48 feet. The portion on which the City will be
required to pay 25 per cent is, therefore, the portion outisde of the
middle 48 feet. On projects of this kind it is our requirement that
the City shall agree to provide parallel parking and eliminate any curb
pumps that might be in existence.
If your Council will pass a resolution agreeing to the above
conditions favorable consideration will be given for appropriate
programming of this work as soon as plans and funds are available.

The request of Percy Cline for permission to operate public dances at .
the armory until 1:00 o'clock A. M. instead of 12:00 o"clock midnight was read
and upon motion by Morris, second by Whiting, the request was referred to the
Police Committee, the Chief of Police and the City Attorney.
A communication -from Stanley F. Drips, Manager of the Rochester Central
Area Improvement Association, advising that the Governor had signed the bill
concerning the regulation of on and off street parking was read and the same was
ordered placed on file.
The request of t-he Board of Public Health & Welfare that the Council
approve a salary of $300.00 per year to be paid to the City Treasurer from the
Public Health & Welfare Fund was read. A motion was made by Morris, second by
Anderson, that the recommendation be accepted and a salary be paid from the
Public Health & Welfare Fund to the City Treasurer at the rate of $300.00 per
year was approved, and upon roll call all voted in favor of the motion, except
Alderman Thiem, who voted "no". President Bach declared the motion carried.
A resolution from the Wm. T. McCoy Post #92 American Legion Auxiliary
endorsing fluoridation of the City Water Supply was read and upon motion by
Schroeder, second by Morris, the same was referred to the Public Health & Welfare .
Department.
A request for permission to hold religious services in Silver Lake
Park was read and upon motion by Morris, second by Schroeder, the same was
referred to the Board of Park Commissioners.
Alderman Thiem stated that street lighting on 1st Street Southwest and
other streets - in the area of the Miracle Mile was not adequate at this time.
President Bach stated that a street light was needed at. the location of 933 -
llth Street Southwest. Chief of Police Macken also brought up the matter of
lighting on 12th Street Southeast, he stated that he had discussed the matter
with the Public Utility Department and that they stated that the services of an
expert on street lighting could be obtained to make a recommendation for the

April 25, 1953 showing total criminal fines and costs collected $1,417.00 and
civil fees received $4.25 and for the week ending May 2, 1953 showing total

each read and having been approved by the City Attorney, President Bach ordered

adopted as read, and all voting in favor thereof, President Bach declared the
said. Ordinance not passed and adopted.

traffic, the operation and parking of vehicles, the use .of streets for driveway

Four references to the qualifications of Mr. ,Gilbert McMj.11an as a .

huts, was now in the hospital and would not be able to remove the huts at this
time. Mrs. Jones had requested that his certified check be returned and that he (;
be relieved of the purchase of the said huts. Upon motion by Schroeder, second

Alderman Morris stated that he .thought that stop and go traffic s.ignals .
were very much needed at the intersection of East Center Street and llth Avenue

and upon motion by Morris, second by Whiting, the matter of traffic signals.at
this location was referred to the Police Committee and the Chief of Police for
study and report at the neat Council meeting.
It was also brought to the attention of the Council that a number of
bulbs in traffic signals were out and should be replaced. Upon motion by
Morris, second by Thiem, the matter was referred to the Building Inspector.

Gentlemen:
Report of the Police Committee on matters referred to it by the
Common Council:
(1) That the request of the Quinn Hotel for a loading zone for
guests be denied at this time, because'of the possibility of
meters there, which, it is believed, will relieve the situation.
(2) That information has been disseminated that it is illegal
,for anyone to drive a motor vehicle unless they have attained
15 years of age and hold a, driver' s license.
(3) Request of the Thompson Drug Store for a loading zone be
denied at this time.
(4) That the solo motorcycle; the property of the Police Department,
is now in service and will attempt to more thoroughly check those
streets upon which -speeding has been reported.
(5) That the problem of destruction of property of those people
living south of the right field fence at Mayo Field has been
discussed with the Baseball Manager of the Rochester Baseball
Association, who has advised that the Baseball Association is
employing two Senior High School Boys to retrieve balls knocked
over the fence, which should relieve the problem. At present
this is for practice sessions only, and details for regular
games have not been completed at this time. In addition it is
felt that the reactivation of the 'knot hole' gang; by the
B.P.O.E. will help to reduce this problem.
