Minutes of an adjourned regular meeting of the Common Council of the City
of Rochester, Minnesota, held in the Council Chambers, in the City Hall-, in said
City, on May 19, 1953•
President Bach called the meeting to order at 7:30 o'clock P., M., the
following members being present: President Bach, Aldermen Ackerman, Anderson,
;Morris, Schroeder, Thiem and Whi'ting, Absent: None.
Upon motion by Whiting, second by Thiem, the minutes of the meeting of -
May 4, 1953 were approved.
President Bach stated this as being the time and place set for the
following hearings:
Secondhearing on the finish grading and surfacing of 18th Avenue S. W.
from 3rd to 5th Street Southwest. There was no one present wishing to be heard.
i.
Second Hearing on the construction of a sanitary sewer on loth Street
Northwest from 3rd to 5th Avenue Northwest. A report and. recommendation by the
City Engineer on the cost of construction of the proposed sanitary sewer in loth
Street Northwest from 3rd Avenue to 5th Avenue Northwest together with the cost of
'construction of connecting sewer from the corner of 14th Street and 3rd Avenue
Northwest to the trunk line sewer in 2nd Avenue Northwest was read. The cost of
'constructing a 10" Main in 14th Street Northwest from 3rd to 5th Avenue being
$7, 432.00 and the cost of a 27" Main from the trunk.line sewer at Cascade Creek
and 2nd Avenue Northwest to 14th Street and 3rd Avenue being $16,238.00. One
interested party was present at the meeting and strongly urged that the sewer
petitioned for be constructed. After the reading of the City Engineer's preliminary
estimate of cost and hearing the request that the sewer .be constructed, a motion
;was made by Whiting, second by Thiem, that the City Engineer's estimate and
recommendation be accepted and the project be abandoned.
Hearing on the proposed change of zoning of the property described as -
the West 60 feet of the North 45 2/7 feet of Lot 7, Block 3, Original Plat from a.
residential to a multiple dwelling zone. There was no one present wishing to be
heard.
Hearing on the proposed change of zoning of the property described as
Lot 17, Block 4. A. W. Kutzky's Addition from a residential to a multiple dwelling
zone. There was no one present wishing to be heard. -
The City Engineer's preliminary 'estimate -for finish grading and surfacing
on 18th Avenue Southwest from 3rd to 5th Street -Southwest i•n the amount of $2,050.00
was read and the same was ordered placed on file.
A letter from Raymond N. Wieland, Parade Marshall giving the parade line
up and route for Memorial Day observance and inviting the Mayor andthe Members of
the Counbil to ride in the Parade was read and ordered placed on file.

The application of W. M. Campion for the position of parking attendant

at the City Parking Lot was read and ordered placed on file.
A communication from lames J. Macken, Jr., Chief of"Police, inquiring
as to the -legality of Albert J. Kos, a member of the Rochester Police force,
taking a vacation beginning on May 2, 1953 was regd•and upon motion by Whiting,
second by Morris, the matter was referred to the Police Committee and the City
Attorney.
The following communication was read and upon motion by Thiem, second
by Ackerman, the matter was referred to the Fire Committee and the City Attorney:;'
"To, The Honorable Mayor and Members
of the Common Council {;
City of Rochester, Minnesota.
This is to notify you that Captain Lyle W. Brown has used up i
all of his sick leave for the year 1953 also his vacation time
and is not able to come back to work at the Fire Department at
the present time.
It may be 60 or 90 days before he can work again or he may never
be able to work, he dont know nor do I. I
The only thing that I can do is put him on disability pension,
however if the Council sees fit they can keep him on thepay
roll for the 60 or 90 days and by that time we will know one
way or the other whether he will ever be able to work again or
not.

An invitation to the League of Minnesota Municipalities Convention to bey
held on June 11, 12 and 13, 1953 at Virginia, Minnesota was read. Those interested

in attending the convention were instructed to notify the Mayor or the City Clerk:
A notice of National Public Servants Week was read.The Mayor stated Il
that the date of June 3rd would be designated as Rochester day and requested thati,

the Council approve the cost of opening the theater at the Mayo Civic Auditorium

where a talk would be given by Governor C. Elmer Anderson. Upon motion by

The request of Mr. Arthur.Holtan that the City pay a $3.00 medical bill

to the Mayo Clinic for services to his son who got his finger caught in a parkin

meter, was read and upon motion by Schroeder, second by Anderson, payment of the i°

bill was authorized.
The request of the B.P.O.E. Elks Lodge No. 1091 for a permit and

permission to display fireworks at Mayo Field on -June 12th at the annual observance
of Flag Day was read and upon motion by Morris, second by Thiem, their request
was granted together with a permit to display the fireworks.
A resolution endorsing fluoridation of the water supply in the City of

Rochester signed by the Wm. T. McCoy Post No. 92 was.read and,up&n motion by
Morris, second by Schroeder, the same was referred to the Public Health & Welfare
Department.

for flood control on the Zumbro River at and in. the vicinity of Rochester, Minnesota
was read. After some.discussion a motion was made by Morris, second by Anderson,
that the matter be investigated further and that the Public Grounds Committee of
the Council meet with the District Engineer, Corps.of Engineers, 1217 II. S. Post
Office and Custom House in St. Paul, to investigate the matter of flood control
within the City of Rochester and area as suggested by Alderman Schroeder. The
Mayor suggested that Senator Hubert H. Humphrey also be contacted on the.matter.
A notice of personal injury received by Calvin L. Benson on the 15th of
April, 1953 and received in the City Clerk's office on May 11, 1953 was read and •
upon motion by Morris, second by Thiem, the same was referred to the City Attormiey.
A letter from the State of Minnesota, Department of Conservation,
acknowledging receipt of $375.00 from the City of Rochester to be used in the
operation of the gaging station in the Zumbro River at the Sewage Disposal Plant
was read together with an acceptance of the gift and the same were ordered
placed on file.
A communication from the State of Minnesota, Department of Highways,
stating that the matter of widening bridges on 4th Street Southeast over the Bear
,Creek and the Zumbro River had been discussed with their District Engineer, Mr.
Swanson and up to the present time there was no definite proposal as to the amount
of widening that may be considered suitable for this section of trunk highway
No. 296, but that Mr. Swanson would doubtless confer with the City Council in
,order that more definite information may be available relative to this matter was
read and the same was ordered placed on file.
An extra order issued by Toltz, King & Day, Inc. to Feller & Pagenhart in
the amount of $578.59 for additional construction at the new Sewage Disposal Plant
was read and upon motion by Morris, second by Ackerman, the same was referred to
the City Engineer and Mr. Hogenson, Superintendent of the Sewage Disposal Plant.
A letter from the Board of Public Health & Welfare advising that the •
Board had elected the following officers was read and ordered placed on file:
Dr. L. A. Freed, President, Ralph J. Stevens, Vice President and Mrs. E. S.
Burrington, Secretary.
A letter from the Board of Public Health& Welfare stating that Mrs.
'E. S. Burrington had resigned as Secretary of the Board and that Mrs. N. W.
Barker had been elected to serve in her place was read and ordered placed on file.
A letter from Dr. L. A. Weed, President of the Board of Public Health &
Welfare explaining in some detail the methods of spraying for the elimination of
mogquitoes and flies, was read and upon motion by Thiem,' second by Schroeder, the
matter was referred to the Public Grounds Committee. '
The request of the Board of Public Health & Welfare for the approval
of the Council in accepting a gift of funds offered by the Rochester and Marigold •

Dairies to defray increased expenses in the expanding milk program was read and �!

The request of the Board of Perk Commissioners that the Council approve li
the appointment of Miss Alberta Chance as executive secretary in the Park Board
office at the salary approved by the Council was read and upon motion by Thiem,
second by Schroeder, the appointment of Miss Chance was approved..

The request of the Board of Park Commissioners that the Council consider

the re-enactment of Ordinance 400, drawn up in such a manner that the platting of j
small plats would furnish finances to be used towards the purchase of other areas
to be used for'park purposes, was read and upon motion by Morris, second by Thiem,'

their request was referred to the Public Grounds Committee and the City Attorney. ;

The request of the Board of Park Commissioners that the Park Department f'
be authorized to take care of dangerous trees or dangerous parts of trees and i
that the expense of doing the work be charged to the General Fund in an amount not i

to exeeed $3,000,00 was read and upon motion by Schroeder, second by Thiem, their
request was referred to the Finance Committee.
A communication from the Board of Park Commissioners stating that they
would like to continue the dredging operations in Silver Lake and the Zumbro River!;

and requesting that the Common Council grant them permission to do so and that the;;

project be financed through the General Fund, in an amount not'to exceed $6,000.00,1
was read and upon motion by Schroeder, second by Morris, their request was referred

A petition for the grading and surfacing of 16th Avenue Northwest from

the same was referred to the Street & Alley Committee and the City Engineer.
The petition of James Zazubek to have Lot 5, Block 2, Dresbach's Addition
annexed to the City was read and upon motion by Thiem, second by Whiting, the !'

petition was referred to the City Attorney to prepare an ordinance annexing the
above described property to the City of Rochester.

The following communication from Mr. & Mrs. Owen Brause was read and
upon motion by Anderson, second by Morris, the same was referred to the Sewer i.

We are writing you in regards.to the New Disposal Plant. i
We have purchased on contract for deed -the remaining 65 acres
from Mrs. Roxie Weih and we understood there was to'be no
odor from the plant. But that has failed to be so. The odor

at times is so bad it is. just awful we can't even have the
doors or windows open and then we can still smell it in the
house. We have decided we would like to dispose of it to
the City if we can agree on price. You can either contact

A petition signed by Marion Roy Hendrix, Eduth Hendrix, Amos Seymour
and John Margellos to have Lot 14, Block 2, Eutzky's Second Addition changed from
a residential to a multiple dwelling zone was read together with a statement of
acquiescence signed by g property owners in that vicinity. Upon motion by
Schroeder, second by Thiem, the petition was referred to the Board of Zoning.
A petition to have Lot 2, Block 33, Lot 3, Block 33 and Lot 4, Block 33
in Northern Addition changed from a residential zone to a commercial zone was
read together with a statement of acquiescence signed by 6 property owners in that
vicinity. Upon motion by Morris, second by Thiem, the petition was referred to
the Board of Zoning.
A representative from the Minnesota Mining & Mfg. Company was before the
Council in regard to the sale of a "Scotchlite" Applicator to be used in recon-
ditioning stop signs and other traffic signs. The 4' X 61 heat lamp applicator
he offered for sale was a model which had been used as a demonstrator and he
would now sell it to the City of Rochester at the price of $499.00. A_.mo.tion was
made by Morris, second by Ackerman, that the City pruchase the scotchlight
applicator at the price of $499.00. All voted in favor of the motion.
A plat of land to be known as The Riolen Addition and described as
follows was presented to the Council and upon motion by Anderson, second by
Schroeder, the same was referred to the Planning and Zoning Commission for
recommendation:
"Commencin for place of beginning at the Northwest corner of -
the East -g of the SEi of the NWa of Sec. 3e106-14 and running
thence east along the north line of the South a of the NWi of
said section 37 .3 feet; thence south parallel with the east
line of said NW a distance of 299.1 feet; thence North 61057'
west 167.3 feet, thence North 610571 west 233.6 feet to the
west line of said east of the SE thence north along the
west line of said East a of the SE4 a distance of 175.91 feet
to the place of beginning."
Mr. Charles McDonald was before the Council and presented recommendations
from the Steering Committee on Parking in the down town area of the City. After
some discussion in regard to the removal of the buildings on the parking lot East
of Broadway and between 2nd and 4th Street Southeast, a motion was made by
Morris, second by Ackerman, that the -City Clerk be instructed to advertise for
bids for the sale of the buildings, to include removal from the premises, and'
that the bids be received on June 15, 1953 at 7:30-P. M. All voted in favor of
the motion.

The recommendation of the Police Committee that the request of the Vets i
Cab Company for a sight seeing taxi stand on 1st Avenye Southwest in front ofthe
Smoke Shop be granted was read and upon motion by Morris, second by Thiem, the
same was accepted. j�

A quotation from the Marvin Law Book Company in the amount of $225.60
for the purchase of 20 volumes of McQuillan on Municipal Corporation was read and

The reports for the month of April,-1953 ofthe Building Inspector
showing fees collected for building permits issued $523.00; of the Electrical !;

reading.
Upon motion by Thiem, second by Anderson, and upon roll call and all
voting i�n favor thereof, the rules were suspended and the ordinance was given its
second rea8ing.

Gentlemen:
The following report is submitted on matters which have been re-
ferred to the undersigned for advice and action.
1. Fred W. Bauler vs L. N. Haggerty, Frank Lent and City
of Rochester.
This action against the City of Rochester and others which arose
•
out of a collision between a private automobile and a city snow plow
on January 29, 1951 is still pending. No further report.
2. Dog Ordinance..
Submitted.to the Common Council on this date.
3. Parking Space amendment to Ordinance No. 558.
Submitted to the Common Council on this date.
4. Ordinance to allow private individuals to do grading or other
PUBLIC improvements under agreement with the City on specified
terms and conditions.
This matter is still pending. Recommendations, suggestions and
instructions are expected soon from the Street and Alley'Committee and
the City Engineer,
5. State law on "public dances".
A "Public dance" is defined in MSA 6617.42 as any dance wherein the
public may participate by payment, directly or indirectly, of an admis-
sion fee or price for dancing, or a fee for a membership in a club, and
shall include any manner of holding a dance which may be'participated in
b the public through the payment of money, directly or indirectly.
96y17. 43 and 617.44 provide that a permit must be obtained from the
governing body of the municipality before a "public dance" may be held.
9617.51 provides that no public dance whall be held or conducted between
the hours of 1:00 a.m. and 6:00 a.m. on week days and no dance shall be
held on Sundays before 12:00 noon. The city has the authority to
regulate the hours of dancing within the above limits. Therefore, under
the state law, the Council may permit public dances up to 1:00 a.m.
on week days and up until midnight on Saturday night. The Council may
grant a permit to dance until 1:00 a.m. on Sunday. The aboge law has
no application to private dances which may be held during any hours.
6. Bonds to pay for voting machines.
It is the opinion of your city Attorney that under MSA 9209.11,
the City may issue bonds to pay for voting machines purchased without
submitting the matter to the voters.

Alderman Schroeder suggested that a study be made of employing a_police

surgeon to work in connection with the of the City and upon
motion by Schroeder, second by Thiem, the matter was referred to the Police
,'Committee and the Chief of Police to make a study to determine as to whether or
not it would be feasible to employ a police surgeon to work in conjunction with
the Police Dep artment.
A letter from Walter C. Hogenson, Superintendent of the Sewage Disposal
Plant, addressed to Mr. Emrold Thiem, Chairman of the Sewer Committee, stating

that under date of February 22, 1952 a proposed extra order to the construction
of the new Sewage Treatment Plant in the amount of $7, 500.00 was submitted to the
City by Toltz, King & Day, Inc. for the installation of a 3rd rotary fine screen
was read and upon motion by Thiem, second by Whiting, the same was referred to the
Sewer Committee.

Alderman Thiem stated that a request had been made in regard to can -
.collation of an easement reserved by the City for public utilities through a iI
piece of land which was formerly a part of 4th Street Southwest west of 15th
Avenue Southwest. Upon motion by Anderson, second by Schroeder, the request was
referred to the Street & Alley Committee, the City Engineer and the City Attorney.'
The matter of an agreement for the treatment of sewage from the Rochester
State Hospital was again discussed and the City Engineer and the City Attorney j
were instructed to study the matter of making a charge.to the Rochester State
Hospital for sewage treatment.
The request of Carl F. Peterson of the Vets Cab Company for license to I!

operate two additional cabs was again brought to the attention of the Council and"

upon motion by Ackerman, second by Anderson, the City Clerk was instructed to

publish a notice of a hearing on the necessity for more cabs in the City, the
same to be held• on June 1, 1953.
The Chief of the Fire Department requested authorization .of the expense

of three members of the Rochester Fire Department to the Firements Annual

Convention to be held at Sauk Center, Minnesota on June 9, 9 and 10 and upon
motion by Anderson, second by Schroeder, the expenses of three members of the
Rochester Fire Department was authorized.
The City Engineer advised the Council that two of the public drinking
fountains were damaged beyond repair. Upon motion by Thiem, second by Schroeder,
the matter was -referred to the Water Committee and the City Engineer with power
to act. All present voted in favor of themotion.
Mr. C. A. Armstrong, Acting City Engineer, requested that the revenue
from the sale of scrap iron at the old Sewage Disposal Plant be credited to the
Permanent Improvement Fund and that the said funds be used in'reconditioning the
old plant for a warehouse. Upon motion by Ackerman, second by Thiem, the City
Clerk was instructed to deposit the funds received from the sole of scrap iron
in the Permanent Improvement Fund.
Upon motion by Ackerman, second by Whiting, the meeting wqs adjourned.
