Record of Official Proceedings of the Common Council
of the City of Rochester, Minn., July 6, 1953
Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City,
on July 6, 1953.
President Bach called -the meeting to order at 2:00 o'clock P. M. , the
following members being present: President Bach, Aldermen Ackerman, Anderson,
Schroeder, Thiem and Whiting. Absent: Alderman Morris.
Upon motion by Ackerman, second by Thiem, the minutes of the meetings of
June 15th and June 25th, 1953 were approved.
President Bach stated this as being the time and place set for the ,
following hearings:
Second hearing on the construction of a sanitary sewer and watermain
and grading in Gooding's Addition and llth Avenue Northwest from 7th to 14th
Street Northwest. There was no one present wishing to be heard.
Second hearing -on the construction of a sanitary sewer and watermain
and grading in 6th Avenue Northeast in Leitzen's Second Sub -Division. There was
no one present wishing to be heard.
First hearing on the construction of a sanitary sewer and watermain in
Hillside Addition. There was no one present wishing to be heard. �
Second hearing on the widening, paving and curb and gutter on 4th
Street Southeast from 6th Avenue Southeast to the Rochester State Hospital. There
was no one present wishing to be heard.
President Bach stated this as being the time and place set for receiving
and opening the following bids:
Bids for furnishing traffic signals to be located at the intersection of.
llth Avenue and East Center Street. The bid of H & H Electric Company in the
amount of $3,045.00 was received and opened and President Bach referred the same
to the Police Committee and the City Engineer for tabulation and report.
Bids for furnishing 11 tons of Anhydrous Ferric Chloride. No bids were •
received.
Bids for the sale of one or more quonset huts. The bids of Phil Cassidy
in the amount of $265.00 for each but and the bid. of C. C. Hansen in the amount of
$605.00 for each but were each received and opened and upon motion by Thiem,
second by Ackerman, the same were referred to the Public Grounds Committee, the
City, Treasurer
and the City Attorney
for report.

received and opened and upon motion by

The two following resolutions adopted by the Public Utility Board were
each read and President Bach ordered the same placed on file:

"Be it and it is hereby resolved by the Public Utility
Board of the City of Rochester, Minnesota, that the Common
Council of the said City be and is hereby requested to
authorize the said Board to enter into a contract with the
!� GENERAL ELECTRIC SUPPLY CORPORATION for the furnishing, in !!
accordance with specifications on file, of ONE (1) A-C l
INDUCTION MOTOR of 150 H.P. the total amount of the said
contract to be EIGHTEEN HUNDRED SIXTY SIX DOLLARS($1866.00)
and the said General Electric Supply Corporation being the ,
lowest responsible bidder." !,
I "Be it and it is hereby resolved by the Public Utility
Board of the City of Rochester that the Common Council of
the said City be and is hereby requested to authorize the

said Board to enter into a contract -with the R. E. BURMEISTER
ELECTRIC COMPANY for the furnishing, in accordance with
specifications, of THIRTY FIVE (35) TRARSFORMERS, the total
amount of the said contract to be TWENTY TWO THOUSAND FOUR I'
HUNDRED THIRTY TWO DOLLARS ($22, 432.00) and the said R. E.
Burmeister Electric Company being the lowest responsible �•

The three following resolutions adopted by the Sinking Fund Commission
of the City of Rochester were each read and upon motion by Anderson, second by
Thiem, the same were approved and ordered placed on file. -
"Be it resolved by the Commissioners of the Sinking Fund
i� of the City of Rochester, Minnesota:
That the sum of $12, 241.12 -be and the said sum is hereby
j appropriated from the Sinking Fund of the City of Rochester,
i Minnesota, for the purchase of the following bonds for the
C Bridge Fund Investments Account:
$6•, 000.00 - 2% U. S. Treasury Bonds due 9-1- 53
f'I $2, 000.-4�% State of Minnesota due 6-1-54+!:
$, 200.0000 - U. S. Savings Bonds due 4-1-58
together with premium on State of Minnesota 4j% bonds in the

"Be it resolved by the Commissioners of the Sinking Fund
of the City of Rochester, Minnesota:
That the sum of $129241.12•for investments sold to the
Bridge Fund and uninvested funds in the amount of $3,996.13,
making a total of $16,227.25, be appropriated from the
Sinking Fund for Reserve for construction of a warehouse and
shop, and paid to the Permanent Improvement Fund of the City
of Rochester, Minnesota."
"WHEREAS, it now appears that funds are now available for
the maintenance and operating expense of the new Sewage
Disposal Plant for the current year in the Sinking Fund of
the -City of Rochester, Minnesota, the said funds having been
received from the collection of sewer service charges, all
interest on Sewage Disposal Plant 1.7% Bonds and $90 000,OO
maturity of bonds having been paid .to date of July 1 1953.
SO THEREFORE, Be it resolved by the Commissioners of the
Sinking Fund of the City of Rochester, Minnesota:
That the sum of $69, 285.00 be appropriated from'. the
Sinking Fund and that the amount of $17, 321.25 or 3/12 of the
total Sewage Disposal Plant Budget be paid to the Sewer Fund
of the City of Rochester, covering that part of the Sewage
Disposal Plant Budget for the months of April, May and June."
The recommendation of the Fireman's Civil Service Commission that
Donald Johnson and George Archer be appointed as members of the Rochester Fire
Department was read and upon motion by Thiem, second by Ackerman, the appointments
ware approved.
The Mayor's emergency order given to the City Engineer, because of the
• !, existing emergency at the Sewage Treatment Plant, resulting from lightning

damaged transformers, authorizing the said City
Engineer to
(1) to install two
temporary trandformer:s on a rental basis, (2) take
the three
damaged
Transformers
to St. Paul for inspection and possible repairs,
and (3) to
have one
repaired at
once and one other, if upon inspection it appears
practical
to do so,
was read
and upon motion by Anderson, second by Whiting,
the Mayor's
emergency
order was
approved.
The recommendation of Frank W. • Everett, Chief of the Fire Department,
that the outside trim on the fire hall be painted at an estimated cost of $850.00
was read and upon motion by Thiem, second by Ackerman, the same was referred to •
the Fire Committee with power to act.
A communication from the Automatic Voting Machine Corporation again
calling the attention of the Council to quotations previously made on 2 machines
which were loaned to the City for the Primary and General Elections held in 1952,
was read and upon motion by Thiem, second by Whiting, the same was referred to the
Finance Committee and the City Clerk, with power to act.
Notice from James J. 1.1acken, Jr., Chief of Police, that Mrs. Ivy
Ranfranz had been convicted of selling beer to a minor person on June 30, 1953
was read. A motion was made by Ackerman, second, by Thiem, that the license
issued to Glenn Ranfranz be revoked for a period of 30 days.
The request of Roy Kingrey for an appropriation of .$499.00 to apply on
the 4th of July fireworks display was read and President Bach, ordered the same
placed on file.
Request for a street light at 933 - llth Street Southwest was read and
upon motion by Ackerman, second by Thiem, the installation of the requested light
was approved and the City Clerk was instructed to advise the electric department
of the action taken.
The recommendation of the Police Committee and the City Engineer that
the bid of H & H Electric Company for furnishing and installing traffic signals •
on East Center Center Street and llth Avenue in the amount of $3,045.00 be accepted
was read and President Bach ordered the same placed on file.
The'recommendation of the Sewer Committee that since no bids were
received for furnishing Anhydrous Ferric Chloride for the Sewage Treatment Plant
that the City Engineer be authorized to purchase same in less than $500.00 lots
until such time as material is available in larger quantity, was read and upon
motion by Ackerman, second by Anderson, the recommendation was approved.
The recommendation of the Street & Alley Committee that the contract
for construction of sidewalks ordered by the Common Council be awarded to C. M.
Boutelle at the unit prices bid, and checks returned to the unsucces$ful bidders,
was read and President Bach ordered the same placed on file.

The recommendation of the Street & Alley Committee that the petition
to vacate the South ten (10) feet of 7th Street Northeast between loth and 15th

Avenues Northeast be rejected because reducing the street from its platted width
does not serve the best interests of the future roadway deve.iopment in this area
was read and upon motion by Anderson, second by Schroeder, the recommendation was!!

{ The recommendation of the Street & Alley Committee that the City
advertise for bids for .paving the alley in Block 103 and a �i portion of Block 104, I,
Willsons Addition, was read and upon motion by Schroeder, second by Thiem, the

recommendation was approved. i

The recommendation of the Sewer Committee that a third fine screen be
installed at the Sewage Treatment Plant, and that the consulting Engineers be
authorized to negotiate an extra order with the General Contractor for its
installation, was read and upon motion by Thiem, second by. Whiting, the
recommendation was approved.
The recommendation of the Public Grounds Committee that the closets
and lavatory fixtures in the Mens' cell block in" -the city jail be replaced and
that the City advertise for bids, the cost of the said improvement to be charged
to the Permanent Improvement Fund, was read and.upon motion by Whiting, second
by Ackerman, the recommendation was approved.
The bids for the sale of Quonset huts were again discussed and a motion
was made by Whiting, second by Ackerman, that if Mr. C. C. Hanson will accept
one hut, the sale of same is approved and if two huts are to be available - his
bid for two huts will be accepted.

A petition for the grading of llth Avenue Southeast from 10th to 102
Street Southeast was read"and upon motion by Thiem, second by Anderson, the same
was referred to the Street & Alley Committee and the City Engineer. !'
A petition by the Rundell Lumber & Fuel Company for annexation of lands
to the City of Rochester was read and upon motion by Anderson, second by Whiting,

the said petition was ordered returned for a more definite description of the
lands in question.
A petition to have the alley running north and South between 2nd and 3rd;.
Avenues and 3rd and 4th Street Southwest regraded was read and upon motion by
Anderson, second by Thiem, the same was referred to the Street & Alley Committee
and the City Engineer.
The fgllowing recommendations of the Steering Committee on parking
concerning the administration of the munici al p parking lot next -to the fire hall
was read:
1. It is recommended that the meters be replaced on the spaces on
South Broadway between 5th and 6th Streets.
2. It is recommended that the lot remain as it is at present - a
free parking lot.

3. It is recommended that a two hour parking limit be enforced on
the cars on the lot. Such enforcement to be done by patrolling
the lot and marking the cars.
A motion was made by Whiting, second by Thiem, that the Chief of Police be
instructed to re -install the parking meters on South Broadway between 5th and
6th Streets, which were re_cent:l;� removed. No further action was taken on the
recommendations of the Steering Committee until such time as a recommendation is
received from the Parking Survey.
The request of the Board of Park Commissioners for approval of the
action of their Board in adopting the employment policy set up by the Common
Council with the following changes was read:. j
1. Under working hours - Nos. 2,3, and 4 have been combined
to No. 2 in our policy.
2. Under Seniority: No. 3-the age has been changed to 45 years.
3. Under Vacations -Nos. 3,4 and 5 have been combined into Nos.
2 and 3 on our policy.

4. Under Promotions and Entry Salaries: Section 3 has been revised.
Upon motion by Whiting, second by Ackerman, the matter was referred to the Mayor.
A report of revenue and expendilhures in the. Park Improvement Fund for
the month of June, 1953 was read and President Bach ordered the same placed on
f ile.
The report of the City Weighmaster for the month of June, 1953 showing
fees collected for loads weighed in the amount of $148.25 was read and President
Bach referred the same to the Finance Committee,
The reports for the months of May and June, 1953 of the Building
Inspector showing fees collected for building permits issued in May in the amount
of $539.00 and June in the amount of $469.00; of the Electrical Inspector whowing
fees collected for electrical permits issued in,May in the amount of $190.75 and
June in the amount -of $756.50; of the Plumbing Inspector showing fees collected
for plumbing permits issued in May in the amount of $86.50 and June in the amount
of $759, 50; of the Heating Inspector whowing fees collected for heating permits
issued in May in the amount of $944.00 and June in the amount of $479.75; and
fees collected for, sign permits in the month of May in the amount of $219.72 and
June in the amount of $50.02, were each read and President Bach referred the same
to the Finance Committee.
The reports of the Clerk of Municipal Court for the week ending June 20,
1953 showing total criminal fines and costs collected $1,109.00 and civil fees
received $11,05; for the week ending June 27, 1953 showing total criminal fines
and costs collected $977.52 and civil fees received $4.35 and for the week ending
July 3, 1953 showing total criminal fines and costs collected $1,212.00 and civil
fees received $10.05, were each read and having been approved by the City Attorney,
President Bach ordered the same placed on file.

and drains was read and upon motion by Whiting, second by Anderson, the license !j

The application of A. H. Story for a license to move buildings was read,
and upon motion by Thiem, second by Anders -on, the license was, granted.
The applications of R. W. Mengelt (2) and -Gus Anton for a license to j

sell cigarettes were each read and upon motion by Anderson, second by Schroeder, S

soft drinks were each read and upon motion by Thiem, second by Schroeder, the
licenses were granted.
The surety bond of Armco Drainage & Metal P•roducts,' Inc. in the- amount
of $2•, 741. 27 with the Aetna Casualty & 'Surety Company as surety was read and the
same .was referred to the Mayor for his approval.
The following resolutions were•each introduced and read and President
Bach declared the same -duly. passed and adopted:

Minutes of an adjourned regular meeting of the Common Council of the

City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
said City, on July 6, 1553.
A motion was made by Thiem, second by Ackerman, that Alderman Anderson
.
be appointed as President pro tem of the Council. All present voted in favor of
the motion._
President pro tem Anderson called the meeting to order at 9:00 o'clock

P.M., the following members being present: Aldermen Ackerman, Anderson, Schroede,
Thiem and_ Whiting. Absent: President Bach and Alderman Morris.
Mr. Frank Everett, Chief of the Fire Department. -requested permission 1

to send four members of the Fire.Department to Lansing, Michigan, to attend a l
school of instruction on the operation.of the new pumper, the said school to be
I,
held on the 20th and 21st days of August. He further request',ed authorization fori
himself and the mechanic to go to Lansing, Michigan after the new truck when sa.mel

is completed. Upon motion by Schroeder, second by Thiem, his requests were

approved.

The Fire Chief again brought up the matter of painting on theexterior
{
and interior of the Fire Hall building and quoted estimates received for the
work. Upon motion by Thiem, sq'.cond by, Whiting, the matter of employing painting I'
contractors to complete the painting work at the fire hall was referred to the
Fire Committee and the Chief of the Fire Department with power to act. All
present voted in favor of the motion, except Alderman Schroeder, who voted "no".
Dr. L. A. Weed, President of the Board of Public Health & Welfare, Dr.
Viktor 0. Wilson and Mr. Thomas Wall were present at the meeting and spoke on
the matter of the disposal of garbage under the new law which took effect on
July 1st. They stated that since July 1st all commercial garbage being fed at
the hog farm had .been cooked and that residential garbage —was now dumped at the
dumping grounds in a sanitary fill. Also the matter of the disposal of barbage
through the installation of mechanical units was discussed and the effect on the
new Sewage Disposal Plant in the treatment of that type of sewage was brought to
the attention of the Council.
It was brought to the attention of the Council that the services of a
technician was now needed at the new Sewage Disposal Plant and upon motion by
Thiem, second,by Whiting, the Council authorized the said position.
The matter of disposing of commercial garbage through mechanical units
into the City sewer system was discussed further and upon motion by Whiting,
second by Ackerman, the Public Health & Welfare Board was requested to meet tritrh
the members of the restaurant and hotel organizations in the City in regard to
garbage disposal unit installations.

The City Engineer brought to the attention of the Council -.that in .the
negr future more land -would be required at the dumping grounds and upon motion
by Whiting, second by Thiem, the same was. referred to -the Public Grounds Committee
and the City Attorney and the City.Engineer•to investigate the dumping grounds
situation and to determine the possibil.ity�of securing additional land in that
area,
The City Engineer also brought to the attention of the Council the
petition previously received for'the annexation of East a of_ Block 6 and all of
Blocks 7 and 8, Highland Addition, stating that the matter of the installation of •
sanitary sewers, storm.sewers, watermains and other improvements in -the streets
should be given further study to determine the cost to the property owners and
the City. A motion was,ma-de by Schroeder, second by Thiem, referring the matter
to the Lighting Committee, the Police. Committee, the Fire Committee, the City
Attorney, the City Engineer and the Board of Education of School. District No. 8
for a report. All voted in favor of the -motion.-.*
The City Engineer also stated that a building to be used as a•paint ,
shop at the location of the City Warehouse was very much needed and upon motion
by Whiting, second by Thiem, he was instructed to prepare pland and specifications
for a building to be used for that purpose.
Mayor McQuillan read.a letter from the Chicago Northwestern Railway
Company in.regard to an entrance from-7th Avenue northeast along the Chicago
North Western Railway Company right of way to the East edge of Mayo Field, which
would allow access to space which could be used for parking of cars.- Upon motion
by Ackerman, second by Schroeder,. the Mayor was authorized to complete plans with
the Chicago North Western Railway Company for the said roadway.
Upon motion by Ackerman, second by Thiem, the meeting was adjourned
until 7: 30 o'clock P. M. on July 20, '953..
