M., the following members being present: President,Bach, Aldermen Ackerman, Anderson, Morris, Schroeder, Thiem and Whiting. Absent: None. i Upon motion by Thiem, second 'by Morris, the minutesof the meeting of July 20, 1953 were approved. President Bach stated this as being the time and place set for the following hearings: First hearing on'the construction of _a. sanitary sewer and watermain in 2nd Avenue Northeast and 17th Street Northeast in Gregg's Addition. There. was no one presentwishing to be heard. First hearing on the construction of a sanitary sewer and watermain in 10th Avenue Northeast and 16th Street Northeast in Peck's Third Addition. There was no one present wishing to be heard. First hearing on the grading and surfacing of loth Avenue Northeast and 15th and 16th Streets Nor'theast'in Peck -Is Third Addition. There'was no one present wishing to be heard. First hearing on the grading and construction of a sanitary sewer and watermain in lst Avenue Northeast from. 14th to 16th Streets Northeast. There was no one present wishing to be heard. ! First hearing on the construction of a curb and gutter on 4th Avenue Southwest from 3rd to 4th Street Southwest. There was no one present wishing to -beheard. P i. President Bach stated this as being the time and place set for receiving,; -and opening bids for grading and surfacing of loth Street Southeast in Willoydts Sub -Division. The _bid of Leon Joyce in the amount of $1,040.00 was received and opened and upon motion by Thiem, second by Ackerman, the same was referred to the Street & Alley Committee and the City Engineer for tabulation and report. j r P President Bach stated this as being the time and place set for receivingj; and opening bids for replacing of closets and lavatory fixtures in the Menus Cell li Block in the City jail. Rochester, Minn., August 3 ; 1953 of Journeyman Warm Air Heating, Ventilating and Air Conditioning License, as to whether or not they were issued in accordance with the ordinance governing the licensing of individuals in this trade. Upon motion by Whiting, second by Thiem, the matter was referred to the Building Inspector and the City Attorney. The recommendation of the Street & Alley Committee that the bid of Conner & Winslow for paving the alley in Block 103 and a portion of Block 104 in Willson's Addition be accepted at the unit prices bid was read and upon motion by Morris, second by Anderson, the recommendation was approved. The recommendation of the Street & Alley Committee that finish grading and crushed rock base be constructed on 182 Avenue Southwest from 3rd'to 5th Street Southwest was read and upon motion by Anderson,.second by Ackerman,°the recommendation was approved. The recommendation of the Street & Alley Committee that bids be taken for the purchase of a two ton dump truck for the City Engineer' s Department was reed and upon motion by Morris, second by Thiem, the recommendation was approved. The recommendation of the Sewer Committee that bids be taken for one power bucket machine for clearing storm sewers was read and upon motion by Schroeder, second by Morris, the recommendation was approved. The recommendation of the Street & Alley Committee that bids be taken for construction of a curb and gutter on 6th Avenue northwest from the C. N. W. Ry !'to 7th Street Northwest was read and upon motion by IJlorris, second by Anderson, the recommendation was approved. The recommendation of the Sewer Committee that the request of John Kasos, Capital Cafe to discharge metered clear water from air conditioner into the sanitary sewer at a. reduced rate be granted and that the rate of 5¢ per 100 cu.ft. be charged, beginning with the August meter reading for this clear water, was read and upon motion by Schroeder, second by Ackerman, the recommendation was approved. The recommendation of the Street & Alley Committee that Francis Clark be employed as Engineering Aid I at base rate of $3390.00 was read and upon motion bySchroeder, second by Morris, the recommendation was approved. The recommendation of the Police Committee that traffic signals be installed at West Center and First Avenue; Second Street Southwest and Third Avenue and First Street Southwest and Third Avenue and that the City Engineer be instructed to draw specifications for the said signals was read and. upon motion by Schroeder, second by Thiem, the recommendation was approved. P. 11adden' s Addition changed from a .residential to a commercial zone be granted was read and upon motion by Thiem,,second by Anderson, the recommendation was approved and a hearing was ordered to be held on August 17, 1953. Upon motion by Thiem, second by Anderson, the City Attorney and the Building Inspector were instructed to submit recommendations for the classifica- tions of commercial and industrial zones as defined by Ordinance No. 558. The recommendation of the Board of Zoning that the petition to have I� Lot 14, Block 2, Kutzkys 2nd Addition changed from a 'residentia.l to a multiple dwelling zone be not granted was read and upon motion by Thiem, second by Anderson', i( the recommendation was approved. The recommendation of the Public Grounds Committee and the Chief of i Police that the bid of H. Dornack & Son in the amount of $2,100.00 for removing i; and replacing the sanitary facilities in the men's cell block in the City Jail be accepted was read and upon motion by Whiting, second by Thiem, the recommendation was approved. The recommendation of the Street & Alley Committee that the bid of Leon Joyce for grading and surfacing of loth Street Southeast in Willoyd' s Sub -Division be accepted at the unit prices bid was read and upon motion by Morris, second by Ackerman, the recommendation was approved. The following resolution adopted by the Public Utility Board. was read and the same was ordered placed on file: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota, that the Common Council of said City be and is hereby requested to authorize the said Board to enter into a contract with the GENERAL ELECTRIC SUPPLY COMPANY for the furnishing, in accordance with specifications, of FORTY THOUSAND (40, 000) POUNDS OF WEATHERPROOF WIRE; the total amount of the said contract to , be SIXTEEN THOUSAND ONE 'HUNDRED DOLLARS AND FIFTY CENTS ($16,100.50) and the said General,Electric Supply Company being the lowest responsible bidder.1t The request of the Public Health & Welfare Department for approval of 171V per week charge for the collection of garbage in residential districts and g 3/40 charge per can per collection for commercial places was read and upon motion by Schroeder, second by Ackerman, the request was approved. The request of the Rochester Planning and Zoning Committee for an appropriation of $500.00 to procure the necessary technical advice on plot plans in Southeast Rochester' was read and upon motion by Norris, second by Whiting, the request was approved. The request of Crenlo, Inc. to have additional -street lighting installed on 3rd Avenue Northwest was read and upon motion by Schroeder, second by Thiez, the same was referred to the Lighting Committee with power to act. A bill of sale given to the City of Rochester by the Mayo Memorial Association, Inc. transferring - all of the statues, granite, marble, plumbing, wiring, trees, or any other article or thing located in Mayo Memorial Park, pertaining to -the -Mayo Memorial, was read and upon motion by Schroeder, second by Anderson, the -bill of sale was accepted and the City Clerk was insturcted to have.the same filed with the Register of Deeds. A petition for finish grading and crushed rock surfacing on 192 Avenue Southwest from 3rd to.5th Street Southwest was read and upon motion by Morris, second by Ackerman, the same was referred to the Street & Alley Committee and the City Engineer. A petition for the construction of a curb and -gutter on 7th Street N.W. from Broadway to 2nd Avenue Northwest was read and upon motion by :forris, second by Schroeder, the same was referred to the Street & Alley Committee and the City Engine er. _ A petition for construction of a curb and gutter on loth Avenue N. W. from loth Street Northeast to 16th Street Northeast and on 15th Street and 16th Street Northeast in Peck's 3rd Addition was read and upon motion by Ackerman, second by Thiem, the same was referred to the Street & Alley Committee and the City Engineer. A petition for the construction of a curb and gutter on 9th Avenue Southeast from 9tr to loth Street Southeast was read and upon motion by Schroeder, second by Morris, the same was referred to the Street & Alley Committee and the City Engineer. A notice addressed to James J. Macken, Jr., Chief of Police, of a meeting of the Minnesota Safety Council to be held in Duluth on August 14, 1953 was read and ordered placed on file. A letter from the Federal Bureau of Investigation addressed to James J. Macken, Jr., Chief of Police -extending to him an invitation to attend the 52nd Session of the F. B. I. Academy beginning August 31, 1953 was read and upon motion by Thiem, second by Whiting, the Chief of Police was authorized to attend at City expense. A communication from the Department of Aeronautics, State of Minnesota, stating that the Department concurred in the recommendation of the City that the Airport Project be awarded to the low bidder, Komatz Construction Company of St. Peter, Minnesota and also transmitting Forms No. 202 and 220 for execution 1 1 0 711. Civil Defense Director,' covering the period since June 1st was read and. the same was orcbred• placed on file. j The reports for .the month of July of the Building- Inspector showing fees collected for building permits issued $354.00; of the Electrical Inspector showing - fees collected for electrical permits issued $162.00;; of the Heating - I c Inspector showing fees- collected for heating permits issued $14.3.75• of the Plumbing Inspector showing fees collected for plumbing permits issued $76.50; and fees• ccllected for sign permits $23.95, were each read and the same were referred to the. Finance Committee. The reports df the Clerk of Municipal Court for the week ending July 25, 1953 showing total criminal fines and costs collected $702.00 and civil fees received $15:05. and for the :we6:k ending August 1, 1953 showing total criminal fines and costs collected $916.32 and civil fees received $6.25, were each read and having been approved by the City Attorney, President Bach ordered - the same placed on file. The applications of A. H. Reynolds and Dorothy Nichols for license to sell cigarettes were each read and upon motion by Thiem, second by Ackerman, the licenses were granted. The applications•of A. H. Rochester, Minn., August 3 19 53 1 • 1 • 1 1 An Ordinance prohibiting the purchase, receipt or acceptance of pistols ,i or revolvers by, and the sale, delivery or transfer of pistols or revolvers to, persons not holding the written permission of the Chief of Police, to purchase, accept, or, receive such, pistol or revolver; prohibiting the sale, delivery or Ii transfer of pistols or revolvers without the approvel of the Chief of Police; providing for the issuance of permits by the. Chief of Police t,o purchase, accept 11 or receive pistols or revolvers; providing for the approval by the Chief of Police of sales or transfers of pistols and revolvers; prescribing the method of i� making sales or transfers of pistols or revolvers, and fixing`a penalty for the violation of this ordinance, was given its first reading. �I An Ordinance annexing to the City of Rochester, Minnesota, the East one-half of Block 6 and all of Blocks 7 and 8, in Highland Addition, was given its f irst reading. i; Upon motion by Thiem, second by Ackerman, . the meeting was adjourned until 7:45 o'clock P. M. on August 3, 1953. r Record of Official Proceedings of the Common Council of the City of Rochester, Minn., August 3. 195 3 Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall in said City, on August 3, 1953. President Bach called the meeting to order at 7: 45 o'clock P. M. , the following members being present: President Bach, Aldermen Ackerman, Anderson, Morris, Schroeder, Thiem and Whiting. Absent: None. Dr, Kurt Reinhold Baehr, a local government official in Germany, now visiting this country and participating in the °leader Exchange" program, was present at the meeting and gave a short talk on the difference of German • government and ours. Mr. R. V. Ehrick, City Attorney, brought up the matter of the demolition of the Old Mill Building and suggested that the City get an insurance policy, Kris Nielson to pay for the said policy. After discussing the matter ,a motion was made by Morris, second by Ackerman, authorizing the Mayor and City Clerk to execute the contract for wrecking the old mill -building and garage, on the basis of insurance being procured in the name of the City alone, said insurance to carry $100,000.00 to $300,000.00 public liability and $10,000.00 property damage. Upon roll call Aldermen Ackerman, Anderson and Morris and President Bach voted in favor of the motion and Aldermen Schroeder, Thiem and 1+Thiting voted. no!'. A proposed plat -of land to be known as Riolen Addition was presented. A report by the City Engineer recommending that the plat be accepted was read. A motion was made by Schroeder, second by Ackerman, that the plat of Riolen Addition together with the City Engineer's report thereon be re -submitted to the Planning Commission for its recommendation and that the Planning Commission be advised that the City Engineer's report is acceptable to the Common Council. All voted in favor of the motion. The City Attorney read a report on the Attorney'- Generals opinion as to whether or not a school can be put on Soldier's Field. After hearing the • opinion a motion was made by Anderson, second by Thiem, that the School Board be requested to make a determination of the acreage needed in Soldier's Field for the construction of a high school and that a joint meeting of the Council and the School Board and interested groups and citizens be arranged. All voted in favor of the motion. Mayor Mcquillan requested permission for bus service to be provided to and from the Fairgrounds druing the Olmsted County Fair.
