II Minutes of a regular meeting of the Common Council of the City of

Rochester, Minnesota, held in the Council Chambers in the City Hall in said City,
on September 8, 1953.

The meeting was called to order at 2;00 o'clock P. M. and upon motion 1

by Thiem, second by Schroeder, the regular meeting was adjourned until 3:30 o'clock

P. M., to allow members of the Common Council to attend the funeral of the late !'
Oscar Hargesheimer. !
President Bach called the meeting to order at 3:30 o'clock P. M., the

following members being present: President Bach, Aldermen Ackerman, Anderson, '
Morris, Schroeder, Thiem and Whiting. Absent: None.
Upon motion by Schroeder, second by Ackerman, the minutes of the
meetings of August 17th and August 27th, 1953 were approved.
President Bach stated this as being the time and place set for the t

Improvement Revolving Fund Bonds. The bid of Juran & Moody and Kalman & Company,
Inc. for the II purchase of $350,000.00 City. of Rochester 3% Permanent Improvement
Revolving Fund Bonds at par and a premium of $420,00 and accrued interest at 3%

was received _and opened and President Bach referred the same to the Finance

Committee, the City Attorney and the City Clerk.
Bids for the construction of a sanitary sewer and water main in loth
Avenue Northeast and 16th Street Northeast in Peck's Third Addition. The bids of

Bids for the construction of a sanitary sewer and water main in let

were each received and opened and upon' motion by Morris, second by Anderson, the
same were referred to the Sewer and Water Committees and the City Engineer for
tabulation and report.
Bids for furnishing anhydrous Ferric Chloride for use at the Sewage
Treatment Plant. The following bids were each received and opened and upon motion
by Thiem, second by Morris, the same were referred to the•Sewer Committee and the
City Engineer for tabulation and report:

Department. The bids of Clements Chevrolet Company in the amount of $2,574.00;
Truck Service Company in the amount of $2,942.00; Allen Lloyd Company in the
amount of $2,595.00and Universal Motors, Inc. in the amount of $2,779.85 were
each received and opened and upon motion by Schroeder, second by Morris, the same
were referred to the Street & Alley Committee and the City Engineer for tabulation
and report,
Bids for furnishing one power bucket machine for use in the City
Engineer's Department. The bid of The Municipal Equipment Company in the amount
of $2,966.25 was received and opened and upon motion by Schroeder, second by
Anderson, the same was referred to the Street & Alley Comm°itt.ee and the City
Engineer for tabulation and report,

Bids for furnishing one steel quonset-type building to be used as a
paint shop. No bids were received,
Mr. A. B. Brown was before the . Council and asked for information in
regard to the cost of street improvements if the .part of. Eighland Addition
recently petitioned for should be annexed to the City. Also a protest against
annexation of the said lands signed by 13 property owners of ,that area was read.
Mr. Bernard Trembley and Mr. Fred Barhoover of the Shell Oil Company
of the City were present at the meeting and requested the City.to increase the
1000 gallon limit on gasoline tanks delivering gas within the City.
The recommendation of the Sewer and Water Committee`s that the bid of
Carlisle G. Fraser for construction of a sanitary sewer and water main in loth
Avenue Northeast and 16th Street Northeast in Pack'.s 3rd Addition be accepted at
the unit prices bid and checks returned to the unsuccessful bidders was read and
upon motion by Morris, second by Anderson, the recommendation was approved.
The recommendation of the Sewer and Water Committees that the bid of
Carlisle G. Fraser for construction of a sanitary sewer and water main in lot
Avenue Northeast from 14th to 16th Street Northeast be accepted at the unit
prices bid and checks returned to the unsuccessful bidders was read and upon
motion by Whiting, second by Thiem, the recommendation was approved.

The recommendation of the Police Committee that the bid of H & H
Electric Company for furnishing traffic signals at nest Center Street -and let
Avenue, 2nd Street 3. W. and 3rd Avenue, and lot Street Southwest-an-d 3rd Avenue
in the amount of $9,969.00 be accepted and checks be returned to the unsuccessful
bidders was read and upon motion by Whiting, second by Thiem, the recommendation
was approved.
The recommendation of the Police 'Committee that a transmitter and
receiver unit be purchased for the ambulance in the Police Department was read
and upon motion by Whiting, second by Schroeder, the recommendation was approved.
The recommendation of the Police Committee that parking on 4th Avenue
Southwest adjacent to the post office be changed from angle to parallel parking
and: be reserved for use of post office patrons, the parking time being limited to
15 minutes; that the alley to the rear of the Telephone Company be made one way
for south going traffic and that parking be eliminated on one side of lath Avenue
Northwest between Center and 2nd Street Northwest was read. A motion was made by
Thiem, second by Schroeder, instructing the City Attorney to amend the- traffic
ordinance as recommended.
The recommendation of the Police Committee that bids be taken for the
purchase of two patrol cars was read and upon motion by Whiting, second by
Anderson, the recommendation was approved.
The recommendation of the Public Grounds Committee that bids be re -
advertised for construction of one steel quonset type paint shop was read and upon
motion by Thiem, second by Whiting, the recommendation' was approved.
The recommendation of the Finance Committee that the bid of Juran &' .
Moody and Kalman & Company, Inc. be accepted for the purchase of $350,000.00
City of Rochester 3% Permanent Improvement Revolving Fund Bonds at par and a
premium of $420,00 and accrued interest at 3% was read and upon motion by Morris,
second by Thiem, the recommendation was approved.
The following resolution adopted by the Public Utility Board was read
and President Bach ordered the same placed on file:
"Be it and it is hereby•resolved by the Public Utility Board
of the City of Rochester, Minnesota, that the Common Council of
the said City be and it is hereby reugested to authorize the
said Board to enter into a contract with the NEPTUNE METER COMPANY
for the furnishing of a SIX (6) INCH WATER METER; the total amount
of the said contract to be EIGHT HUNDRED FORTY DOLLARS ($s40.00)
and the said NEPTUNE METER COMPANY being the only qualified bidder."
The City Engineeres preliminary estimates for the construction of a
storm sewer -on 15th Avenue Northeast and Southeast from Railroad Right -of -Way
to 2nd Street$. E. to 31 Street in the amount of $47,004.30; storm sewer in
2nd Street Southeast from- 14th to 15th Avenue Southeast in the amount of
$3,902.60 and a storm sewer in 31 Street Southeast from 14th to 15th Avenue

Street Northwest in the 1400 block was read and upon motion by Anderson, second
by Thiem, the request was referred to the Lighting Committee with power to act.
The recommendation of the Planning and Zoning Commission that they
approved the .annexation of Rioland Addition with a strip of thirty-three feet
along the north boundary dedicated for street purposes., was read and upon motion
by Anderson, second by Ackerman, the recommendation was approved.
The recommendation of the Planning and Zoning Commission that they
approved, Krofchalk's First Sub -Division for annexation to the city, subject to
the approval of- the City Engineer, was read and upon motion by Thiem, second by

A letter from the Minnesota Department of Health transmitting a copy
i' of the report of- their Municipal Water Supply Section covering an examination of
plans and specifications on water main extensions in the City of Rodhester, was
read and President Bach ordered the same placed on file.
The re -appointment by the Mayor of Mrs. Thelma Degel,, Mrs. W. F. Braasch
and Mrs. Harry Gimbert to the Library Board, their terms to expire .on the 3rd

Saturday in July, 1956 was read and upon motion. by .Morris, second by Anderson,
the Mayor °s appointments were approved.
' The request of the Wm. T. McCoy Post No. 2 for q y 9 permission to conduct
it a bingo game and the request of the .Izaak Walton League for permission to conduct
a bingo game were each read and President Bach ordered the same placed on file.
The recommendation_ of the Public Health & Welfare Department that
equipment be purchased of a proper size and special design for the purpose of
conducting a landfill at the City Dumping Grounds was read and upon motion by a;

The request of the Public Health. & Welfare Department for permission to
employ Miss Twila Jean Hoffman as a public health nurse, effective September 1, ;�

1953 was read and upon motion by Whiting, second by Schroeder, their request was
granted.
A notice of personal injury by Mr. Hans Jensen was read and upon motion
by Whiting, second by Schroeder, the same was referred to the City Attorney.
The request of the Planning and Zoning Commission to enter into an
agreement with Ellerbe & Company for the preparation of a land use study, a
traffic way study and recommendations with respect to each, the total expenditure
not to exceed $400.00 was read and upon motion by Schroeder, second.by Thiem, the
request was approved.
The petitions of Bay and Belvadene McBenny to have Lot h, Block 5, of
Irelands Addition changed from a residential to a commercial zone; Dorance and
Alvina Munger to have Lots 2 and 3, in Block 2, of D. P. Madden's Addition changed
from a residential to a commercial zone and David E. and Ethel Dee to have Lot 1,
Block 3, D. P. Madden's Addition changed from a residential to -a commercial zone
were each read and upon motion by Anderson, second by Whiting, the said petitions
were referred to the Board of Zoning.
The petition of Bob Neill for permission to grade, under the supervision
of the City Engineer, gJ Avenue Northwest from the south line -of vacated 3rd
Street Northwest to 75 feet north, was read and upon motion by Whiting., second by
Anderson, the requested permission was granted.
A petition for the construction of a water main in 19th Avenue Northeast
from 9th to loth Street Northeast was read and upon motion by Whiting, second by
Ackerman, the .same was referred to the Water Committee and the City Engineer.
A petition for the construction of a curb and gutter on 14th Avenue
Southwest from 7th to 9th•Street Southwest was read and upon motion by'Schroeder,
second .by .Whiting,. the same was referred to the Street & Alley Committee and the
City Engineer.
The petition.of Mrs. Wm. Schultz to have Lot 32, Auditor's Plat A
changed from a residential to a multiple dwelling district was read together with
a statement of acquiescence signed by three property owners in that vicinity.
Upon motion by Anderson, second by Schroeder, the same was referred to the Board
of, Zoning.
A petition for the construction of a sidewalk on both sides of 6th Avenue
Northwest from 7th Street south across the Chicago and North Western railroad
tracks to the existing sidewalk and a petition for the construction of a sidewalk
past the one remaining lot on the east side of 6th Avenue Northwest between 6th
and 7th Street northwest were each read and upon motion by Thiem, second by
Ackerman, the same were referred to the Street & Alley Committee and the City
Engineer.
The matter of constructing sidewalks on 6th Avenue Northwest across the

Railraod Sight -of -Way was brought to the attention of the Council by the Mayor.
Upon motion by Whiting, second by Ackerman, the matter was referred to the
Mayor and the City Engineer for further study.
The .recommendation of the City Engineer that a _10 foot wide easement
for the construction and maintenance of a storm sewer along the East:line of
Lot 3 in the proposed Sub -Division of Outlot 1, E1 Rancho was read and upon
motion by Whiting, second by Schroeder, the City Engineer was instructed to
return the plat to the owner and that provisions be made for the easement as
recommended by the City Engineer.
The recommendation of the City Engineer that Lot 5 in the proposed plat

stipulate the intended use of the said lot was read. Upon motion by Whiting, !

second by Schroeder, that the plat be returned and that the owner be notified

the said lot.
The recommendation of the City Engineer that the proposed .plat of -
Huey Reynolds Addition to. the City of Rochester be accepted as submitted was
read and upon motion by Schroeder, second by Whiting, the City Engineer's
recommendation was approved.
The request of the Minnesota Organization of the Blind to conduct its
annual White Cane Drive in the City of Rochester on September 14 and 15, 1953

Alderman Ackerman recommended that llth Avenue Northeast from Center
Street north should be checked for parking, due to the fact Ghat the street is
very narrow and might require parking on one side only, Upon motion by i
Ackerman, second by Thiem, the matter was referred to the Police Committee and
the Chief of Police.
Alderman Ackerman also stated that he had received a request for three
street lights on lSth Avenue Southwest south of 2nd Street Southwest and.upon
motion by Thiem, second by Whiting, the matter was referred to the Lighting
Committee with power to act.

A letter from the American National Red Cross addressed to Mr. Ivan

Boyd, Bo d. thanking him for his valuable service at the time the Blood Mobile visit
was in Olmsted -County was read by -the Mayor and President Bach ordered that the
same be placed on file.
The report of the City Weighmaster for the month of August, 1953
showing fees collected for loads -weighed in the amount of $106.65 was read and
President Bach referred the same to the Finance Committee.

The reports for the month of August, 1953/showing fees collected for
building permits issued $267.00; of,the Electrical Inspector showing fees collected
for electrical permits issued $148.50; of the Plumbing Inspector showing fees
collected for plumbing permits issued $972.25; of the Heating Inspector showing
fees collected for heating permits issued $393.75 and fees collected for sign
permits issued $1,50, were each read and President Bach referred the same to the
Finance Committee.
The reports of the Clerk of Municipal Court for the week ending August 229
1953 showing total criminal fines and costs collected $713.00 and civil fees
received $8.95; for the week ending August.29, 1953 showing total criminal fines
and costs collected $859,30 and civil fees received $5.25 and for the week ending
September 5, 1953 showing t.otal criminal fines and costs collected $1,122,00 and
civil fees received $3.45, were each read and 'having- been approved by the City
Attorney, President Bach ordered the same placed on file.
The application of Peter Thomas Waitikowich for a Journeyman Electric-

ian•° s License was read and upon motion by Whiting, second by Schroeder, the
license was granted.
The license bonds of Raymond E. Karvel in the amount of $2, 500.00 with
the General Casualty Company of America as surety and Clifford E. Fauver in the
amount of $1,000,00 with the Western Surety Company as surety, were each read and
upon motion by Thiem, second by Whiting, the bonds were approved, the surety
thereonaccepted and the same were ordered placed on file
,
The contract bonds of H. Dornack & Son in the amount of $2,100.00 with
the St. Paul Mercury Indemnity Company as surety; C. M. Boutelle in the amount
of $3,640.00 with _the Western Surety Company as surety; and Carlisle G. Fraser
in the amount of $20, 256.90 with the Federal Insurance Company as surety, were
each read and President Bach referred same to the Mayor for his approval.

reading.
A communication from Furlow and Pemberton, Attorneys representing
the Rochester Bread Company, requesting that they have an opportunity to be heard `
ab ve
if and when.the�proposed ordinance -is introduced for action by the Council was
read and President Bach -ordered the same placed on•file.
A motion was made by Schroeder, second by Ackerman, that the
ordinance be amended to read 1500 gallons of Class I Flammable Liquids instead
of 1000 gallons. All present voted in favor of the motion. •
A motion was made by Thiem, second by Whiting; instructing the City
Attorney to amend the proposed ordinance on regulating and licensing flammable
liquids in the City. of Rochester, to include -a provision -that the ordinance
become effective .6 months after its passage.
Mr. Joe Kramer, from the Yellow Cab Company, requested three cab stands
to be located at, a two cab stand on the west curb of 2nd Avenue S•.W. immediately
north of ,its intersection with lot Street Southwest; a two cab stand on the south
curb of let .Str,.eet .Southwest immediately east of -its intersection with 3rd Avenue
Southwest and a two cab stand on the east curb of 3rd Avenue Southwest immediately
south of its intersection with 2nd Street Southwest. Upon -motion by Whiting,
second by Thiem, the request was referred to the -Police Committee and the Chief of
Poli-ce with power to act.
An Ordinance annexing to the City of Rochester, Minnesota, a part of
the Southeast Quarter. () . of Section Three,. Township One Hundred Six North of
Aa.nge Fourteen West, in -Olmsted County, Minnesota, was given its second reading.
Upon motion by Whiting, second by Anderson, -and -upon roll call and all
present voting in f ay.or thereof, the rules were suspended and, the ordinance was
given its third and, final reading.
Upon. motion by Thiem, second -by -Whiting'. that the said ordinance, be

adopted as read, and all voting in favor thereof, rresident Bach - declared the
said ordinance duly passed and adopted.
An Ordinance to - provide for the cleanliness of streets, alleys and other
;;premises and to provide protection against certain fire hazards, was given its
second reading.
The City Attorney stated.that.a lease between the City of -Rochester
and Mr. Bert Leitzen had been prepared and upon motion -by Whiting, second by
Schroeder, the Mayor and City Clerk were instructed to execute the lease.
Mayor Mc illan brought to the attention of the Council the matter of

signals at the Railroad crossing on llth Avenue Northwest. Upon motion by Thiem,
.second by Ackerman, the Mayor was instructed to again take the matter up with the
Railroad Company and if necessary, also take the matter to the Railroad and
