President Bach called the meeting.toorder at 2:00 o'clock P. M., the following members being present: President Bach, Aldermen Ackerman, Anderson, Morris, Schroeder, Thiem and Whiting. Absent: None. Upon motion by Morris, second by Ackerman, the minutes of the meeting ! of September 21, 1953 were approved. President Bach stated this as being tke-time and place set for receiving and opening bids for furnishing a steel quonset type building to be used as a paint shop. The bid of Komatz.Construction Company in the amount of $29,659.90 was received and opened and the same, was referred to the Street & Alley Committee and, the City Engineer for tabulation and report. President Bach stated this as being the' time and place set for receiving and opening bids for grading and surfacing let Avenue Northeast from 14th to 16th Street Northeast. The bid of Leon Joyce in the amount of $2,142.-00 was received and opened and the same was referred to the Street '& Alley Committee and .the City Engineer for tabulation and report. President Bach stated this as being the time and place set for receiving and opening bids for grading and crushed rock on 181 Avenue Southwest from 3rd to 5th Street Southwest.. The bid of Leon Joyce in. the amount of . $2,150.00 was received and opened and the same was referred to the Street &'.Alley Committee and �I the City Engineer for tabulation and report. ;! Mr. John Pemberton, Jr., attorney representing the Rochester Bread Co. I! and the Rochester Dairy, and Mr. A. H. Clemens, attorney representing the Marigold; 8airies, discussed the -matter of adopting the proposed ordinance governing the handling of flammable liquids -in the City of Rochester. It was suggested by the II Attorneys that the members of the Council meet with them to study the proposed ordinance further before final action be taken. Mr. Edward Capelle, representing the War Dads, requested permission to t hold a tag day on October 17, 1953 and also permission to nse aloud speaker on I� the streets on .that day. Upon motion by Schroeder, second by Ackerman, his requests were granted. I� i' Mr. James Spillane, representing residents on llth Avenue Northwest, stated that the wished to have y parking on the East side of the street. He stated,: further that occupants of the property on the West side would not object if the curb was painted yellow between Center Street and the Railroad tracks. The matter!! . r was left•> in.' the hands of the Police Committee. i, ! Mr. Joe Kramer, representing the Yellow Cab Company, and Mr. Carl I Peterson, owner of the Vets Cab Company, both inquired as to what action had been taken granting cab stands as requested by them. Mr. Peterson also requested permission to use a car as taxicab temporarily while one of his cabs was being repaired. A motion was made by Schroeder, second by Ackerman,'', granting Mr. Peterson permission to use a car temporarily while one of his taxicabs was. being repaired. All voted in favor of the motion. A motion was made by Whiting, second by Thiem, referring the matter to the Police Committee and the Board of Public Health & Welfare and the City Attorney with power to act. Residents of Highland Addition were again before the Council asking that the land in Highland Addition as petitioned for be annexed to the City. The City Attorney stated that he had been studying the petitions and the statutes governing the annexation of lands. The Attorney asked for time to determine as to what percentage of the property owners had petitioned for annexation and stated further that he would like time to receive an opinion on the matter from • the Attorney General's office. Mr. Kris Nielson stated that he wished to purchase a piece of land Northwest between 3rd Avenue and Cascade Creek. Upon motion by Whiting, second by Schroeder, his request was referred to the Public Grounds Committee. Also the matter of selling the property known as the City Hog Farm was discussed and upon motion by Whiting, second by Thiem, the same was referred to the Public Grounds Committee for study and recommendation at a later meeting. The sale of city owned real estate at the location of the old Sewage Disposal Plant was also discussed and upon motion by Thiem, second by Whiting, the matter was referred to the Public Grounds Committee. The recommendation of the Street &•Alley Committee that the bid of Komatz Construction Company for resurfacing 2nd Avenue Southwest from 1st to 3rd Street Southwest and 1st Street Southwest from 2nd to 3rd Avenue Southwest be accepted at the unit prices bid was read and upon motion by Anderson, second by Ackerman, the recommendation was approved. i The recommendation of the Street & Alley Committee that the bid of Leon Joyce for grading and surfacing lst Avenue Northeast from 14th to 16th Street Northeast be accepted at the unit prices bid was read and upon motion by Ackerman, second by Anderson, the recommendation was approved. The recommendation of the Street & Alley Committee that the bid of Leon Joyce for finish grading and crushed rock base on 18j Avenue Southwest from 3rd to 5th Street Southwest be accepted at the unit prices bid was read and upon motion by Whiting, second by Ackerman, the recommendation was approved. The following recommendation of the Street & Alley Committee was read and a motion was made by Ackerman, second by Anderson, that the recommendation be approved, all voted in favor of the recommendation except Aldermen Thiem, who voted "no": "Hon. Construction Company be permitted to construct a temprorary office and construct-:,! ion shed on.the south side of,2nd Street Southwest between the east driveway to Ii the old section of St. Mary's Hospital and a point 450 ft. west, extending from the south line of 2nd Street Southwest 9 feet into the roadway, for a period of two years, as requested by St. Mary's Hospital, was read and upon motion by Morris, second by Thiem, the recommendation was approved. The recommendations of the Board .of Zoning that the petition of James R. Wilson, Howard R. Wilson; Lorraine C. Willson, Dorothy M.`Erickson and Delbert I. Erickson to have Lot 1, Block 1, in Kutzky's tad Addition changed from a residential to a multiple dwelling zone be granted; that the petition of David and Ethel Dee to have Lot 1, Block 3, D. P. Madden's Addition changed from a residential to a commercial zone be granted; .that the petition of Ray and Belvadene'McKenny to have Lot .4, Block 5, Ireland's First Addition changed from a residential to a commercial zone be granted; that the petition of Dorance and Alvina Munger to have Lot 2, Block 2, D. P. Madden's Addition changed from a residential to a commercial zone be granted; and that the petition of Mrs. Wm. Schultz to have Lot 32, Auditor's Plat "A" changed from a residential to a multiple dwelling zone be granted, were each read and upon motion by Thiem, second by Ackerman, the City Clerk was instructed to publish notice of a hearing I' on the petitions for zoning change, to be held at 7:30 o'clock P. M. on I, October 19, 1953. Alderman Anderson presented a petition by residents in the area of 12th Street Southeast protesting the change in zoning of Lots 2 and 3, Block 2 and Lot 1, Block 3, D. P. Madden's Addition. The recommendation of the Sewer Committee that the agreement and resolution betWeen the City and the State of, Minnesota relative to storm sewer construction upon and along Trunk Highway 296 (4 St. S.E.) be executed in accordance with the instructions contained in Mr. J. C. Robber's letter of September 29, 1953 and that the City Clerk be authorized to advertise for bids on this storm sewer construction for October 19, 1953 was read and upon motion by Morris, second by Ackerman, the recommendation was approved. 520 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., October 5. 19 53 The recommendation of the Street & Alley Committee that the alley in Block 20, Moe & Olds Addition (-'g block east of Broadway running between 2nd Street S.E. and 3rd Street S.E. ) be resurfaced with bituminous surface and that the Komatz Construction Company be authorized to do this work at the prices bid for resurfacing 2nd Avenue Southwest was read and upon motion by Ackerman, second by Anderson, the recommendation was approved. The recommendation of the Sewer & Water Committee that a sanitary sewer and water main be constructed to serve Riolen Addition was read and upon motion by Thiem, second by Schroeder, the recommendation was approved. The recommendation of the Fire Committee that the Rochester Fire Department be instructed to draw up specifications for the purcbase of 500 feet of two and a half inch hose and 500 feet of one and a half inch hose and that bids be opened on November 2, 1953 was read and upon motion by Schroeder, second by Ackerman, the recommendation was approved. The City Engineer's preliminary estimate for finish grading and crushed rock base on 182 Avenue Southwest from 3rd to 5th Street Southwest in the amount of $2,150.00 was read and President Bach ordered that the same be placed on file. A copy of the request of A. M. Nelson, Assistant Chief of Police, addressed to the Police Civil Service Commission asking that they certify the appointment of the person standing highest on the eligibility list for Sergeant and also the party standing highest on the Patrolmens list for appointment, so as to bring the the Police Department up to its full strength, was read and the same was ordered placed on file.. A letter addressed to the Mayor asking permission to operate a wire recorder with two extension speakers to play Christmas Carols during the period beginning with Thanksgiving and ending Christmas and also a request from the TV Sales and Service Company, signed by Hoot Gibson, to rent their sound truck for commercial adv.ert-is.ir&ere each read. After some discussion a motion was made by Thiem, second'by Anderson, that the Seven Day Adventist Church be granted permission to operate a wire recorder with two extension speakers on the downtown streets of the City during the 10 days prior to Christmas and that no permission be granted for sound trucks on the streets for the purpose of commercial advertis- in'g. All voted in favor of the motion. The request of Richard V..Stull for the installation of a street light at the corner of 15th Avenue and Graham Court was read and the City Clerk was instructed to advise Mr. Stull that arrangements' had already been made for the installation of the said light; A notice from the Park-O-Meter Company of a school of instruction for 1 • 1 1 E 95 21 Record of Official Proceedings of the Common Council of the. The reports for the month of September, 1953 of the Building Inspector showing fees collected for building permits issued in the amount of $2,027.00; of the Electrical Inspector showing fees collected for elec$rical permits issued in the amount of $149#50; of the Plumbing Inspector showing fees collected for plumbing permits issued in the amount of $1, 526.25; of the Heating Inspector showing fees collected for heating permits issued in the amount of $404,00 and fees collected for sign permits issued in the - amount of $59.21, were each read and President Bach referred the same to the Finance Committee. The reports of the Clerk of Municipal Court for the week ending September 26, 1953 showing total criminal fines and costs collected $1,135.70 and civil fees received $4.35 and for the weekending October 3, 1953 showing total criminal fines and costs collected $1,676.00 and civil fees received $1.40, were each read and having been approved by the City Attorney, President Bach ordered the same placed on file. The contract bonds of The Municipal Equipment Company in the amount of $2,966.25 with the Anchor Casualty'Company as surety and Pennsylvania Salt Mfg. Company in the amount of $1,945.76 with the Indemnity Insurance Company of North America as surety were each read and referred to the Mayor for approval. painted Mrs. Robert.Hurrle asked permission to hate" signs/on-.the sidewalks notifying people to get out and vote at the coming special election. She -was informed that there was an ordinance which prohibits the painting of signs on sidewalks in the City of Rochester.
