II City of. Rochester, Minnesota,. held in the Council Chambers in the City Hall, in
said City, on October 19, 1953.
President Bach called the meetin
g to order at 7:30 o'clock P. M. , the ,I
following members being present: President Bach,, Alderman Ackerman, Anderson,

Morris, Schroeder, Thiem and Whiting. Absent: None.
Upon motion by Morris, second by Ackerman, the minutes of the meeting
of October 5. 1953 were approved.

Hearing on the proposed change of zoning of Lot 1, Block 1, Kut zky ' s
P 2nd Addition from a residential to a multiple dwelling zone. 'There was no 'one

Mr. Donald Franke, Attorney representing the petitioners, was present
and urged that the Zoning Ordinance be amended to include the three above
described pieces of land as commercial zone. About thirty residents of the. area
appeared before the Council and protested any change in the zoning petitioned for e
by David and Ethel Dee and Dorance and Alvina Munger. After hearing those present;;
a motion was made by Thiem, second by Anderson, that action be not taken on the
Petitions of David and Ethel Dee, Dorance and Alvina Munger and Ray and Belvadene !
McKenny, and upon roll call Aldermen Ackerman and Whiting voted "no" and Aldermen
Anderson, Morris, Schroeder and-Thiem, voted "yes". I'

sanitary sewer and water main in Leitzen s 2nd Addition. There, was no one present
wishing to be heard.
Hearing on the levying of special assessments for the paving of the
alley in Block 103 and part of Block 104 in Willson's Addition. There was no
one present wishing to be heard.
Hearing on the levying of special -assessments for the construction of a
sanitary sewer and water main in Hillside Addition. There was no one present
wishing to be heard.
Hearing on the leavying of special assessments for the construction of
a sanitary sewer on, -West Center Street from Broadway to 2nd Avenue Southwest and
on 2nd Avenue Southwest from Center to 1st Street Southwest. There was no one
present wishing to be, heard.
President Bach stated this as being the time and place set for
receiving and opening bids for the following:
Bids•for the construction of a storm sewer along trunk Highway No.
2g6. The bid of Carlisle G. Fraser in the amount of $CFO, 506.00 and the bid of
Barbarossa & Sons, Inc. in the amount of $414,313.60 were each received and
opened and President Bach referred the same to the Sewer Committee and the City.
Engineer for recommendation.
Bids for furnishing one hydraulic sand spreader. The bid• of• Minnesota
Constructors Equipment Co., Inc. in the amount of $745.50 was received and opened
.and upon motion by Whiting, second by Morris, the same was referred to the Street
& Alley Committee and the City Engineer for recommendation.
Bids for furnishing of Christmas Street Lighting. The bid of the
, Haegele Poster Service in the amount of $2,444.40 was received and opened and
upon motion by Morris, second by Ackerman, the bid was referred to the Council
Lighting Committee, the Lighting Committee of the Chamber of Commerce and the
Electric Light Department,
Mayor McQuillan told the Council that he had been contacted by several
residents from 2nd Street Southwest in regard to the proposed.building of a motel
in the 1000 block, which would.have 10 apartments. Several residents from that
locality were present at the meeting and objected to the proposed construction.
It was, however, determined that the area is now a multiple dwelling zone and
the Zoning Ordinance permits that type of construction. No action was taken on
the matter.
Rev. Vernon W. Emmerson, Pastor of the Seventh Day Adventist Church,
Egain requested the Council to grant permission to use a loud speaker on the
streets of the City of Rochester in the residential sections of the City during
the period between Thanksgiving and Christmas. The loud speaker device being

used only for the playing of Bhristmas Carols. Upon motion by Morris, second by •

Ackerman, the previous action taken by the Council, which limited the use of the �!

loud speaker to one week prior to Christmas was rescinded and Rev. Emmerson was
granted permission to operate the loud speaker as requested, between the hours of

7:00 and 9:00 P. M. each day.

A letter from the Rochester Bus Line, Inc. requesting permission to addil
the following services on school days only during the school year was read: I.

Upon motion by Morris, second by Ackerman, the same was approved and the City
Clerk was instructed to inform the Minnesota Railroad and Warehouse Commission of!

The Mayors appointement of Patrolman Arnold K. Mork to the classifica=�

tion of sergeant in the Police Department and Robert N. Radam to the position
and classification of patrolman was read and upon motion by Ackerman, second by ;

The recommendation of the Street & Alley Committee that the bid of

Minnesota Constructors Equipment Co., Inc. for furnishing one hydraulic sand
spreader for the City Engineers Department be accepted for the sum of $745.50

The recommendation of the Sewer Committee that the bid of Carlisle G. i!

The recommendation of the Sewer Committee that bids be taken forthe
extension of the storm sewer on 3z Street Southeast from 14th to 13th Avenue
Southeast was read and upon motion by Morris, second by Schroeder, the recommend-;,

The following recommendation was read:

The City Engineer's Preliminary Estimate for construction of a storm
sewer on 4th Street Southeast ( T. H. 296) between 6 Avenue Southeast and 2nd •Street
Southeast (State Project 5513-03) in the amount of $40,633.00 was read and
President Bach ordered that the same be placed on file.
An easement from the State of Minnesota granting permission to
construct a storm sewer across Lot 1, Auditor's Plat °A° was read and President
Bach ordered the same placed on file.
The City Engineer's report for the month of September, 1953 covering
the Street & Alley Fund, Sewer Fund, Bridge Fund and Street & Alley Expenditures
from the General Fund was read and President Bach ordered the same placed on
file.
A letter addressed to the Mayor and members of the Common Council fro&
Gilbert H. MacMillan transmitting two copies of formal agreement covering the
work on the East Center Street Bridge was read and President Bach ordered same
placed on file.
The request of the Public Health & Welfare Department for permission
to employ Miss Gertrude Adamson, of 201 - 9th Avenue Southwest as building
custodian at the Health Center, effective Octobern6, 1953 at a base salary of
$180.00 per month was read and upon motion by Morris, second by Schroeder,
the same was approved.
An invitation to attend a public hearing of the Minnesota Highway
Study Commission to be held in the Auditorium at the State office building, St.
Paul on October 21st and 22nd was read and President Bach referred the same to
the Street & Alley Committee.
A request by Paul H. Stephenson, Major; Armor Unit Advisor, for a
"no parking" zone at 117 East Center Street was read and upon motion by Morris,
second by Anderson, the request was referred to the Street & Alley Committeeand
the Chief of Police.
Two communications from the State of Minnesota, Water Pollution Control i
Commission advising that the following plans for sewage facilities in the City
had been approved, were each read and ordered placed on file:

The application of A. D. Mills for Electrical Contractors License was
read and upon motion by Morris, second by Whiting, the license was granted.
The application of Joe Grubb for transfer of his "on sale" Liquor
License No. 323 from the address at 313 First Avenue Northwest to 315 First
Avenue Northwest was read and upon motion by Morris,,second by Ackerman, the
transfer was granted.
The license bond of A. D. Mills in the amount of $1,000.00 with the
Fidelity & Casualty Company of New York as surety was read and upon motion by
Morris, -second by Thiem, the bond- was - approved, t-he surety thereon accepted and
the same was ordered placed on file.
The contract bonds of Universal Motors, Inc. in the amount of $2923.34
with the Western Surety Company as surety, Leon Joyce(2) in the amounts of
$2,150.00 and $2,14 2.50 with Seaborad Surety Company as surety, were each read
and upon motion by Morris, second by Thiem, the same were referred to the Mayor.

The following resolutions were each introduced and read and President
Bach declared the same duly passed and adopted: .
Resolution authorizing the Mayor and City Clerk to enter into -agreement .
with,Gilbert H. MacMillan, subject to .the approval of the City Attorney and the

Resolution ordering bids.for construction of a storm sewer in 31 Street
Southeast from 13th to 14th Avenue Southeast. Upon motion by Ackerman, second
by Anderson, resolution ,adopted,
Resolution ordering bids for fire hose for use in the Rochester Fire.
Department. Upon motion by Anderson, second by Morris, 'resolution adopted.
Resolution fixing salary of -Clerk -Stenographer in City Clerk's office
at $2,160.00 per year. Upon motion by Morris, second by Thiem, resolution
adopted.
Resolution requesting the Commissioner of Highways -.to plan an improved
approach of 7th Street Northwest (State Aid Road I) onto T-runk Highway No. 20-. -
Upon motion by Thiem, second by Whiting, resolution adopted.
Resolution fixing salary of parking meter maintenance man (part
time basis). Upon mot.ion by Thiem, second by Whiting, resolution adopted.
Resolution levying special assessments for the paving. of. the alley in

The City Attorney presented an agreement between the Rochester Civic
Symphony O.rchestra,. Rochester and- Community Concerts Inc., of 113 West 57th
Street New York-, wherein -it was agreed and understood that the Rochester
Minnesota Civic Symphony will appear for one community concert in Red Wing,
Minnesota on the date of October 28, 1953- for the agreed fee of Five Hundred
and. Fifty. Dollars• (4550.00). An action - on the matter had been previously made
at - the meeting of September 21, 1953 which reads as follows;
"A communication from the Music and Band Committee requesting per-
mission for the Rochester Philharmonic Orchestra to present a
concert at Red Wing on October 28th was read. After some discussion
on the matter and hearing an opinion from the City Attorney, it was
moved by Alderman Ackerman, seconded by Alderman Anderson, that the
City Clerk be instructed to notify the Music and Band Board that the
Common Council does not grant permission or authorize the Rochester
Philharmonic Orchestra to present a concert at Red Wing, Minnesota,
on October 28, or any other date. The Common Council has no objection

if the members of the orchestra, or the conductor, with to arrange L
to present this concert in Red Wing in the name of Rochester
Philharmonic Orchestra but in so doing they will not be acting

concert or for the individual members of the orchestra, or '
conductor, and will not handle any of the transactions,
financial or otherwise. All vented in favor of the motion."
A motioik, was made by Schroeder, second by Whiting, that this action be rescinded.
Upon motion by Thiem, second by Whiting, the Mayor and the City Clerk were
authorized to execute the agreement as requested.

Alderman Ackerman presented a request from the City;Engineer for three
more street lights at the Mill Property Parking Lot. He also stated that he had
received a request for a street light at 14th Avenue Southwest in the 400 block;
at 2nd Street Northeast off of 15th Avenue Northeast; 5th Avenue Northwest in the

1600 Block and at 1110 - Sth Avenue Southwest. Upon motion by Schroeder, second

by Whiting, the requests were referred to the.Lighting Committee with power to
act.
The question was brought to the attention of the Common Council as to
whether, it would be necessary to advertise for proposals for being designated as

consulting engineer to prepare plans and specifications for the proposed East
Center Street Bridge. Alderman Whiting moved that the matter be Deferred to the
i
City Attorney, for an opinion on the matter. Alderman Ackerman seconded the
motion and all voted in favor of the motion. The City Attorney submitted an
t
opinion wherein he stated that will not be necessary to call for bids for the
is
furnishing of professional -services in connection with the preparation of plans
and specifications for the East Center Street Bridge.
Upon motion by Ackerman, second by Anderson, the meeting was adjourned.'
