HomeMy WebLinkAbout11-02-1953Record of Official Proceedings of the Common Council of the City of Rochester, Minn., N o v e mb e r 2, 19 5 3 Minutes of a regular meeting of the Common Council of the City of Rochester, Minnesota held in the Council Chambers in the City Hall, in said City, on November 2, 1953. President Bach called the meeting to order at 2:00 o'clock P. M., the following members being present: President Bach, Aldermen Ackerman, Anderson, Morris, Schroeder, Thiem, and Whiting. Absent: None. Upon motion by Thiem, seconded by Ackerman, the minutes of the meetings of October 19th, 21st and 23rd, 1953 were approved. President Bach stated this as being the time andplace set for the following hearings: Hearing on the levying of special assessments for the construction of a sanitary sewer and water main in Gooding's Addition and Bielenberg & Giese Addition. There was no one present wishing to be heard. Hearing on the levying of special assessments for the. construction of a sanitary sewer and water main in 2nd Avenue Northeast and 17th Street North- east in Gregg's Addition. There was no one present wishing to be heard. First hearing on the construction of a sanitary sewer and water main in 7th Street Northeast to serve Outlot 1, E1 Rancho Subdivision. There was no one present wishing to be heard. First hearing on the construction of a sanitary sewer and water main on 3rd Avenue Northeast from 16th Street Northeast to 200 feet north of 17th Street Northeast. There was no one present wishing to be heard. First hearing on the construction of a sanitary sewer and water main in Riolen Addition. There was no one present wishing to be heard. President Bach stated this as being the time and place set for receiving and opening bids for furnishing 500 feet of 22 inch hose and 500 feet of 11 inch hose for use in the Rochester Fire Department. The following bids were received and opened and President Bach referred same 'to the Fire Committee and Chief of the Fire Department for tabulation and report: 500 ft. of 2211 500 ft. of 112" fire hose fire hose Fire & Safety, Inc. . . . . . . . 1.44 per ft. 1.02 per ft. President Bach stated this as being the time and place set for receiving and opening bids for the construction of a storm sewer in 312 Street Southeast from 13th to lhth Avenue Southeast. The bid of Carlisle G. Fraser in the amount of $3, 859- 50 was received and opened and President Bach referred same to the Sewer Committee and City Engineer for tabulation and report. The recommendation of the Fire Committee that the .bid of Fire & Safety Inc. be accepted f or the purchase of 500 ft. of 2a" fire hose ® 1.44 per { ft. and 500 ft. of 1211 fire hose @ 1.02 per ft. and that checks be returned to the unsuccessful bidders was read and upon motion by Whiting, second by Morris, the recommendation was approved. The recommendations of the Board of Zoning that the petition of Mrs. Mary E. Rinke to have the North 94 3/4ft. of Lot 12, Block 4, A. W. Kutzky's Addition changed from a residential zone to a multiple dwelling zone be. granted and that,the petition of Walter. A. Jacobsen toe have Lot 5, Block 20, Northern Addition changed from a residential to a commercial zone be,granted were each read together with a protest against the rezoning of Lot 5,;Block 20, Northern Addition signed by Margaret Cassidy. Upoh motion by Schroeder, second by Anderson, the City Clerk was instructed to publish notice of a hearing on the petitions for zoning change, said hearing to be held at 7; 30 O'clock P. M. on November 16., 1953. The recommendation of the Street & Alley Committee that bids be taken for the purchase of a tractor and dozer for the City Dump was read and upon motion by Anderson, second by Ackerman, the recommendation was approved. A letter from the State of Minnesota, Department of Highways, addressed to C. A. Armstrong, City -Engineer, authorizing the award of:;the contract for S.P. 5513-03 (T.H. 296) Storm Sewers to Carlisle G. Fraser was read together with a letter transmitting a fully executed copy of the agreement between the State Highway Department and the City of Rochester covering S.. P. 5513-03 (T.H.256). President Bach ordered the same placed on file. The request of the American Linen Supply Company to have a portion of curbing in front of their office designated as a no parking area was read and upon motion by Morris, second by Thiem, the same was referred to the Police Committee and the Chief of Police. A notice from the Railroad and Warehouse Commission, Department of Weights and Measures that a scale testing unit would be on a route including Rochester within a short time. A motion was made by Whiting, second by Morris, to notify the said Department of Weights and Measures to test the City's 100,000 lb. Howe Scale. A letter from the Rochester Central Area Improvement Association thanking the City officials and expressing their appreciation for their cooperation and assistance in parking matters was read and President Bach n U ordered the same placed on file, 5 4 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., November 2, 1953 • A letter from the State of Minnesota, Department of Aeronautics, offering assistance in the preparation of a zoning ordinance to meet the minimum standards required to protect the Rochester Airport was read and President Bach ordered the same placed on file. The City Engineer's preliminary estimate in the amount of '$3, 717.50 for storm sewer extension in 32 "Street Southeast from 14th to 15th Avenue Southeast was read and President Bach ordered the same placed on file. The request of the Board of Park Commissioners for an appropriation of $,2,167.00 from the General Fund,in addition to $4,000.00 previously appropriated, for the dredging of Streams in the City of Rochester was read and ordered placed on file. A communication from Mr. Harold Cooke, Director of the Rochester Symphony Orchestra, expressing the thanks of the said organization for the cooperation shown in making the trip to Red Wing possible was read and the same was ordered placed on file. A construction report and monthly estimate issued to Komatz 'Construction Company -in the amount of $46, 761.O8 for work completed on Airport Project 5501-06 was read together with a statement of engineering services in the sum of $1,019.98 due to K. M. McGhie .for professional service on the same project President Bach ordered the same placed on file. The application of Donald MacJunkin for an Electrical Contractor's License was read and upon motion by Ackerman, second by Thiem, the license was granted. The application of-Niesner's for a license to sell cigarettes at 'retail was read and upon motion by Thiem, second by Anderson, the license was granted. The license bonds of -Donald MacJunkin in the amount of $1,000.00 and (2) Elmer C. Johnson each in the amount of $1,000.00 with the Aetna CasuAlty and' Surety Company as surety were each read and upon motion by Ackerman, second by Anderson, the bonds were approved, the surety thereon accepted and the same were ordered placed on file. The contract bonds of -'Naegele Poster Service in the amount of $2, 444.40 with the Travelers Indemnity Company as surety; Komatz Construction Company in the amount of $28,658.80 with the American Employer's Insurance Company as surety; Minnesota Constructor's Equipment Company in the amount of $750.00 with the U. S. fidelity A Guaranty •Company as surety; and Carlisle G. Fraser in the amount of $40, 524.00 with the Federal Insurance Company as surety, were each read and upon motion by Ackerman, second by Anderson, the same were referred to the Mayor for his approval. The reports for the month of October, 1953 of the Building Inspector L� 1 • 1 1 U Record of Official Proceedings of the Common Council of the City of Rochester, Minn., November 2, 1953, j showing fees collected for building permits issued in the amount of $651.00; of the Electrical Inspector showing fees collected for electrical permits issued in the amount of $199..50; of the Plumbing Inspector showing fees collected for plumbing permits issued in the amount of $193.50; of the Heating Inspector showingfees collected for heating g permits issued in the amount of $259.00 and fees received for sign permits issued in the amount of $90.78, were each read ;. r, i and President Bach referred the same to the Finance Committee. The reports of the Clerk of Municipal Court for the week ending October 24, 1953 showing total criminal fines and costs collected $1,352.57 and I civil fees received $9.05; and for the week ending October 31, 1953 showing total! criminal fines and costs collected $1, 291.00 and civil fees received $3.30, were each read and having been approved by the City Attorney, President Bach ordered !' the same placed on file. The following resolutions were each introduced and read and President Bach ordered the .same placed on file: ' I Resolution accepting the bid of Fire & Safety, Inca for furnishing fire„ hose for the Rochester Fire Department. Upon motion by Schroeder, second by Thiem, resolution adopted. Resolution approving construction report and monthly estimate No. 2 (final) for Airport Project No. 5501-06 and authorizing the City Clerk to execute certificate on same. McGovern, $491.40 and Standard Oil Company, $1,017.55. Upon motion by Anderson, second by Morris, resolution adopted. Resolution appropriating $2, 288.65 from the General Fund and $773. 50 from the Bridge Fund and ordering payment made to Minnesota Box & Lumber Company, $226.50; Standard Oil Company, $2,061.50 and Gilbert H. MacMillan, $773.50. Upon motion by Morris, second by Schroeder, resolution adopted. An Ordinance amending the Zoning Ordinance (No. 558) was given its first reading. The City Attorney presented four copies of a separate risk permit covering the Music and Band Department of the City of Rochester and upon motion by Anderson, second by Ackerman, the Mayor and City Clerk were instructed to execute the said permit. Rochester, Minn., November 2 ,. 1953 near the Horace Mann School did not appear to be working properly and at times was very hard for automobile traffic to see. A motion was made -by Thiem, second j by Morris, referring the matter to the Police Committee, the Chief of Police and u the City Engineer. All voted in favor of the motion. It was reported that cars on Center Street East of lst Avenue were crowding on to the sidewalk when parking and -upon motion by Morris, second by Schroeder, the matter was referred to the Police Committee, the Chief of Police r and the City Engineer. I The City Attorney requested the Council to appoint a committee to work with him on the coding of ordinances. Upon motion by Ackerman, second by Anderson;, I' the chair was authorized to appoint the said committee. President Bach appointed ' Mayor McQuillan, Alderman Whiting and Alderman Schroeder. Upon motion by Whiting,;; second by Morris, the City Clerk was also appointed to serve on the said committee' At 4:45 o'clock P. M. President Bach declared a recess and the.Council �I adjourned to the office of the Mayor, where a report was received on the conviction of the holder of -an "off" and "on" sale non -intoxicating malt -liquor j license at the Brown Derby. Upon motion by Whiting, second by Ackerman, the meeting was adjourned until 4:30 o'clock-P. M. on November 3, 1953, City Clerk
