Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in.the Council Chambers in the City Hall, in
said City,on November 3, 1953.

President Bach called the meeting to order at 4:30 o'clock P. M., the
following members being present: President Bach, Aldermen Ackerman, Anderson,
Morris, Schroeder, Thiem and Whiting. Absent: None.
President -Bach -stated that the members of the Council were familiar
with the question to be considered i.e. question of holidays to be worked by City
Employees. •
The question of holidays which had. been previously broughtrto the
at.tention of the Council by the Mayor was again disueseed. The City Employment
Policy now includes six holidays for the employees of the City of Rochester and
under the State Statutes eleven holidays are listed. It was agreed that the City
could not transact legal business on any of the eleven holidays but the Common
Council has authority to determine whether or not to conduct routine business on
holidays. A motion was then made•by Alderman Whiting, second by Alderman
Ackerman, instructing the City Clerk to write all department heads immediately
calling special attention to Section A (Working Hours), Subdivision 6, of the
City Employment Policy which reads as follows, and further that the Council goes
on record as re -affirming the said section of the City Employment Policy:
116. Holidays, within the meaning of this Agreement, shall include
New Year's Day, Memorial Day, Independence Day, Labor Day,
Thanksgiving Day, Christmas Day, or days celebrated for the
foregoing. When a Holiday falls on a Sunday, the following
day shall be considered the Holiday."
The following motion was made by Alderman Whiting, second by Alderman
Thiem, and upon roll call all voted in favor of the motion:
"In the light of the convic.-.tion of Gerald Ryan on October 28th,
1953 of the offense of selling non -intoxicating malt liquor to a
minor, and in the light of previous convitions in 1943 and 1945 and
the evidence submitted by the Police Department concerning other
violations of the law prohibiting the sale of non -intoxicating malt
liquor to minors and the warnings given to Mr. Ryan by the Police
Department with respect to such violations, I move that "On Sale"
license to vend non- intoxicating malt liquor in the City of Rochester,
Minnesota No. 798 issued on April 7th, 1953 to Gerald Ryan and the
"Off Sale" license to vend non -intoxicating malt liquor in the City of
Rochester, Minnesota No. 1492 issued on April 7th, 1953 to Gerald Ryan
be revoked and that the City Clerk be instructed to bring this action
on the part of the Common Council to the attention of the Mayor in his
capacity as head of the Police Department for proper enforcement."
Alderman Schroeder moved that the Mayor' direct special attention to
infraction of the laws, especially in regard to liquor violations pertaining to
Juveniles and as Chief Magistrate with the Police Department conduct such special
investigations as are deemdd necessary. Alderman Whiting seconded themotion and
all voted in favor of same,
A motion was made by Schroeder, second by . Morris, that the Council

authorize the Street & Alley Committee to represent the Council.at the next

meeting of the County Commissioners to petition for road funds as provided by i
State Statutes, Chapter 707, S. F. No. 1161 (An act relating to the use of the
county .road and bridge fund, amending Minn. Statutes 1949 Section 162.01, Sub -
Div. 2.). i
Upon motion by Morris, second by Ackerman, the meeting was adjourned
