Record of Official Proceedings of the Common Council
of the City of Rochester, Minn., November 16, 1953
Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council••Chambers, in the City Hall in
said City, -on November 16, 1953•
President Bach called the meeting to order at 7:30 o'clock P.-M;, the
following memberw being present: President Bach, Aldermen Ackerman, Anderson,
Morris, Schroeder, Thiem, and Whiting. Absent: None.
Upon motion by Morris, second by Ackerman, the minutes of the meetings
of November 2nd and November 3, 1953 were approved.
President Bach stated this as being the time and place set for the •
following hearings:
Hearing on the levying of special assessments for construction of a
curb and gutter on loth Street Northwest from 9th to loth Avenue Northwest. There
was no one present wishing to be heard.
Hearing on the levying of special assessments for construction of a
curb and gutter on 9th Avenue Northwest from 7th to 14th Street Northwest-. There
was no one present wishing to be heard.
Hearing on the levying of special assessments for the construction of a
curb and gutter on 6th Avenue Northwest from the Chicago Northwestern Ry. Company
to 7th Street Northwest. There was no one present wishing to be heard.
Hearing on the levying of special assessments for construction of a
curb and gutter on 13th Avenue Southeast from East Center Street to 3rd Street
Southeast. There was no one present wishing to be heard.
Hearing on the levying of special assessments for construction of a
sanitary sewer and water main in Peck's Third Addition. There was no one
present wishing to be heard.
Second hearing on the construction of a, sanitary sewer and water main
on 3rd Avenue Northeast from 16th Street Northeast to 200 feet north of 17th
Street Northeast. There was no one present wishing to be heard. •
Second hearing on construction of a sanitary sewer and water main
in 7th Street Northeast to serve Outlot 1, E1 Rancho Sub -Division. There was
no one present wishing to be heard.
Second hearing on construction of a sanitary sewer in Riolen Addition.
There was no one present wishing to be heard.
Hearing on the petition for vacation of the alley lying East of
Block 4, and north of 6th Street Southwest in Flather's Addition. There was no
one present wishing to be heard.
Hearing on the proposed change of zoning of Lot 5, Block 20, Northern
Addition from a residential to a commercial zone. 'There was no one present
wishing to be heard. A letter from Walter A. Jacobson, owner of the said lot,

stating his reasons for wanting the said change in zoning was read at this time. j

After hearing Mr. Jacobson's letter read, a motion was made by Anderson,.second
by Ackerman, instructing the City Attorney to prepare an amendment to the Zoning
Ordinance making -the requested change in zoning. All voted in favor of the motion.
Hearing on the proposed change of zoning of the North 94 3/4 feet of
Lot 12, Block 4, A. W. gutzky's Addition from a residential zone to a mulitple
dwelling zone. There was,no one present wishing to be heard. A motion was made
by 1 Anderson, second by Ackerman, instructing.the City Attorney to prepare an

amendment to the Zoning Ordinance making the requested zoning change. All voted
in favor of the motion.

President Bach stated this as being the time and place set for receiving
and opening bids for furnishing one tractor and dozer for use' at the City Dump
Grounds. The bids of Borchert Ingersoll, Inc. in the amount of $13,995.00;
Rosholt Equipment Company in the amount of $12,990.70 and Wm., H. Ziegler Co. in

the amount of $15,500.00 were each received and opened and upon motion by

Whiting, second by Morris, the same were referred to the Street & Alley Committee'
and City Engineer for tabulation and report.

The following resolution adopted by the Board. of Education was read
and the same was. ordered placed on file:
"BE IT RESOLVED, by the,Board of Education of School District
Number Eight (S) in Olmsted County, Minnesota, being the school
district included in the limits of the City of Rochester, Olmsted l
County, Minnesota, that there be, and is hereby 17evied upon all !
taxable property in said district a special school tax for:
Maintenance $1,115,600.00
Capital Outlay 164, 300.00
Debt Service 119,250.00
or a grand total of one million, three hundred ninety-eight thousand,
one hundred fifty dollars ($1,398,150.00) for the use of said district,
and the Clerk of said Board of Education is hereby instructed to
notify the Common Council of said City of Rochester, Minnesota, and
to request their approval of the said levy in accordance with the'.
provisions of the City Charter."
The following communication was read and upon motion by Thiem, second
by Schroeder, the same was accepted and ordered placed on file:

In regards to my plans that I wrote you in my letter of
October 30, 1953, the County Commissioners have approved
appointment and salary, so an at this time asking for my
retirement on the 30 day of November, 1953, as I will
take over my new duties on December 1, 1953.

A motion was made by Ackerman, second by Morris, instructing the City
Attorney to prepare a resolution thanking Mr. Enoch Dison for his years of

service on the Rochester Police Department.

Dear Sir:" City of Rochester
We wish to acknowledge receipt of resolution, forwarded to
this office by Mr. C. Swanson, District Engineer, requesting an
improved approach to T. H. No. 52 and Seventh Street Northwest
in Rochester.
At. the present time this department is giving consideration
to the possibility of constructing a four lane divided highway from
the junction of T.H. Nos. 14 and 52 north on T.H. No. 52 to some
point beyond this intersection. As soon as a satisfactory layout
has been prepared we will submit a copy to your City Council for

their approval.

A motion
was made by Thiem, second by Schroeder, that the letter be placed on
file and
the Street.& Alley Committee, on behalf of the Council, draft a reply
to the above letter.
A letter from Stanley F. Drips, Civil Defense Director, submitting a
report of activities of the Office of Civil Defense for the period of August 1st
to November lst, 1953 was .read and upon motion by Morris, second by Ackerman,
the report was accepted and ordered placed on file.
The recommendation of the Street & Alley Committee that the bid of
Borchert Ingersoll, Inc. for furnishing a tractor and shovel type loader for the
City Dump be accepted at the prices bid and checks returned to the unsuccessful
bidders was read and upon motion by Morris, second by Ackerman, the recommendation -
was approved.
The recommendation of the Street & Alley Committee that Thomas C. Moore
be appointed as Assistant to the City Engineer (Construction)at a base rate of
$4,500.00 per year, with salary for the first 19 months to be in accordance with
the City's Employment Policy and that Frank D. Eaton, presently employed, be •
appointed as Assistant to the City Engineer (Plans & Surveys), was read and upon
motion by Ackerman, second by Morris, the appointments were approved.
A petition for the construction of a curb -and gutter on 12th Avenue
Northeast from 8th'Street Northeast thence north to the north line of West's
Sub=Division was read and upon motion by Anderson, second by Morris, the same
was referred to the Street & Alley Committee.
The City Engineer's preliminary estimate for construction of a sanitary
sewer and water main in 3rd Avenue Northeast and 17th Street Northeast in Huey -
Reynolds Addition in the amount of $29,093.50 was read and ordered placed on
file.

The application for transfer of "Off Sale" Liquor License from Leo A.
Huey and Gene F. Huey as a partnership to a corporation to be known as Huey's
Liquor Store, Inc. was read and upon motion by Whiting'. second by Schroeder, the
transfer was granted.
The license bonds of Huey's Liquor Store, Inc. with the Hartford
Accident and Indemnity Company as surety and in the emount of $1,000.00 and
Dale C. Patterson in the amount of $1,000.00 with the State Automobile
Insurance Association as surety were each read and upon motion by Thiem, second
by Whiting, the bonds were approved the surety thereon accepted and the same
were ordered placed on file.
The contract bonds of Carlisle G. Fraser in the amount of $3, 959- 50
with the Federal o Insurance Company as surety and Fire & Safety, Inc. in the amount
of $1,230.00 with the American Employer's Insurance Company as surety were each
read and referred to the Mayor for his approval.
The following claims were read and upon motion by Morris, second by
Ackerman, the same were approved and the Mayor and City Clerk were authorized
and directed to draw warrants upon the City Treasurer and make payments
accordingly:

President Bach declared a 15 minute recess at 8:30.o'clo.ck P. M.
The City At.tor.ney read a resolution acknowledging the indebtedness of
the City of Rochester to the Mayo Properties Association in the amount of
$46,457.80 for the construction of. a trunk line sanitary sewer to Graham Addition.
After discussing the matter, -a motion was made by. Alderman Morris, second by
Alderman Thiem, that action on same be .postponed until the meeting to be held on
December 7th. Upon.roll call, Aldermen Ackerman, Anderson, Morris and Thiem
voted ."yesil and Aldermen Schroeder and Whiting voted "no"..
The following resolutions were each introduced and .read and President
Bach declared the same duly passed and adopted.

Alderman Whiting, Chairman of the License Committee, verbally reported
that the•caid Committee had met on the applications of Snyder Drug Company for
"off sale" non -intoxicating malt liquor - license and Dolores L. Ryan for "off"
and "on" sale non -intoxicating malt liquor licenses and -recommended that the
licenses be granted. A motion was then made by Alderman Whiting, second by
Alderman Morris, that the said three licenses be granted and upon roll call all
voted in favor of the motion.
A motion was made by Thiem, second by Morris, that the City Attorney and
,City Clerk prepare new application forms for license -to sell non -intoxicating malt

Upon motion by Morris, second by Schroeder, and upon roll call and all

voting in favor thereof, the rules were suspended and the,ordinance was given its

Upon motion by Morris, second by Anderson, that the said. ordinance be
adopted as read, and all voting in favor thereof, President Bach declared the said!
ordinance duly passed and adopted.

Alderman Ackerman stated that he received requests for street lights i

on 14th Avenue Northeast and also at 2nd Street and 5th Avenue Northwest. Upon
motion by Whiting, second by Schroeder, the same were referred to the Lighting
Committee with power to act. i
Alderman Anderson stated that the Public Grounds Committee had been out
to the City Farm, which is now out of operation, and they recommended that the
Council as a whole go out and view the city farm and try and reach some conclusion!
as to how to dispose of same: 4:00 o'clock P. M. 'on Tuesday, November 17th, was
set as the time for the Council to go and view the said farm.
The City Attorney requested permission to attend a meeting of the !!

League of Minhesota Municipalities to be held at the University on November 20,
1953 and upon motion by Morris, second by Ackerman, he was authorized to attend ati'
city expense.
Upon mbtion' by Morris, second by Thiem, the • meeting was adjourned until
3:00 o'clock P. M.'on November 25, 1953 and the custodian of the voting machines
was instructed to contact the voting precincts so that same would be open.
