Rochester, Minn.,_ December 7, 1953 Minutes of a regular meeting of the Common Council of the City of Rochester, ,•.innesota, held in the Council Chambers in the City Hall, in said. City, on December 7, 1953. President Bach called the meeting to order at 2:00 o'clock P. M. , the following members being present: -President Bach, Aldermen Ackerman, Anderson, Morris, Thiem and Whiting. Absent: Alderman Schroeder. Upon motion by Ackerman, -second by Thiem, the minutes of the meeting of November 30, 1953 were approved. President Bach stated this as being the time and place set for the • following hearings: Hearing on the levying of special assessments for the construction of a sanitary sewer and water main in 1st Avenue Northeast from 14th to 16th Street Northeast. There was no one present wishing, to be heard. Hearing on the levying of special assessments for the grading and surfacing of 18,—Avenue Southwest from 3rd to 5th Street Southwest. There was no one present wishing to be heard. President Bach stated this as being the time and place set for receiving �j 1 and opeaing bids for construction of a, sanitary sewer and water main in 3rd Avenue Northeast from 16th Street Northeast to 200 feet north of .17th Street Northeast. The bid of Carlisle G. Fraser in the amount of $26,051.30 was received and opened and upon -motion by Thiem, second by Ackerman, the same was referred to the Sewer Committee and the City Engineer for tabulation and report. Mr. Owen Brause was present at the meeting and inquired as to an agreement with the City 'of Rochester for the pruchase of his -property located at the new Sewage Disposal Plant. After some discussion, he was informed that the Common Council would be required to follow the terms of the agreement. The .recommendation of the Sewer Committee and the City Engineer that the bid of Carlisle G. Fraser for the construction of a •sanitary sewer and water • main in 3rd Avenue Northeast from 16th Street Northeast to 200 feet north of 17th Street Northeast be accepted at the unit prices bid was read and upon motion by. Thiem, second by Ackerman, the recommendation .was approved. The recommendation, of the Sewer Committee that bids be received for annual supplies (1954) of snhyd-rous ferric chloride, approximately 35 tons and chemically pure hydrated lime, approximately 150 tons, was read and upon motion by Thiem, second by Ackerman, the recommendation_ vias approved. The recommendation of the Police Committee that the Minnesota Highway Department be requested to make a traffic survey at 4 Street Southeast (T.H. 296) and venue Southeast for the ru ose of determining the need for traffic a 11 A p P g signals, and that a project for installation of traffic signals at that inter- section be initiated if warranted by the survey, was read and upon motion motion • ei,-67 Record of Official- Proceedings of the Common Council of the City of Rochester, Minn., December 7. .1 g-5 3 . 1 1 <1 1 E • Thiem, second by Anderson, the recommendation was approved. The following recommendation was read and upon motion by Ackerman, I. second by Morris, the same was approved: "Honorable Mayor & Common Council .Of the City of Rochester, Minn. Gentlemen: ;I We, the undersigned, recommend that the City Engineer be authorized to spend. up �o $3; 000.00 from the Permanent Improvement Fund between now and April 1, 1954, on the former sewage treatment plant buildings. This work to be done under this authorization is to begin filling the tanks to eliminate the hazard caused by their present condition, and to remove one post in the section which is being converted into garage space. ANDERS ON" I, The recommendation of the Public Grounds Committee that Mr, Harold H. jl II - Crawford be engaged to drag plans and spe-cificatiOns for an addition to the Scale; ji House at the City Scales was read and upon motion by Thiem, second by Ackerman, the recommendation was approved. A communication from the Board of Education, of School District No. S, transmitting a sketch of an area of Doldier'.s Field and requesting that same be I made available at a mutually agreed price,for the building site of e. proposed new high school, was read. After some discussion a motion was made by Morris, second by Thiem, that the Board of Education be contacted for, further information!. before any action is taker.. li A letter from the Board of Park Commissioners listing 18 locations where i� trees should be taken care of, for the reason that they are in a dangerous condition and requesting that the Council adopt some uniform policy for the Park Board to handle the said tree situation was read. Due to the fact that the present ordinance does not cover all situations which seem to'appear in the matter of taking care of trees in the public streets, a. motion was made by Thiem, second'i by Anderson, that the matter of amending -the said ordinance be referred to the Public Grounds Committee, the Board of Park Commissioners, the City Engineer and the City Attorney for revision. A letter from the State of Minnesota, Water Pollution Control Commission,, transmitting plans of a sanitary sewer in 192 Avenue Southwest, 5th Street Northwest and an easement totalingI' 316 feet of 9-inch diameter pipe, which had been approved was read and President Bach ordered same placed on file, r The following resolutions adopted by the Commissioners of the Sinking Fund were each read and upon motion.by Anderson, second by Thiem, the same were approved: •i "Be it resolved by the Commissioners of the Sinking Fund of I' the City of Rochester, Minnesota: i That the sum of $23,035.00 be and the said sum, is hereby 1 Ii 1 P- a 6 s :Record of Official Proceedings of the Common Council of the City of Rochester, Minn., December 7, 1953 appropriated from the Sinking Fund and ordered paid to the First National BaAk of Chicago, Illinois for the January 1st, 1954 maturity of interest on 1.70% General Obligation. Sewage Disposal Plant Bonds, Nos. 91 to 2800, Inclusive (Interest $23,035.00 and service charges $i3 5.50) , "Be it resolved by the Commissioners of the Sinking Fund of the City of Rochester, Minnesota: That the sum of $50,161.37 be and the said sum is hereby appropriated.from the Sinking Fund of the City of Rochester, Minnesota., and ordered paid to the First National Bank of Rochester, Minnesota, for the pruchase of $50,000.00 U. S. Treasury Notes 1 7/8% dated December 1, 19.53, and due December 15, 1954 (Purchase price of bonds $50,000.00, premium $156.25 and accrued interest $5,12). Be it furhher resolved: That the said bonds be purchased for the Bridge Fund Reserve Investment account." "WHEREAS, the following investments of Public Utility funds in Electric Depreciation Reserve 4ccount have matured on December 1, 19 53: $100, 000.00 2 1/ 8% U. S. Treas. C Ds 7,000.00 U. S. Savings Bonds, Series F and WHEREAS, the said funds are now needed for improvement at the Silver Lake Plant. SO THEREFORE, Be it resolved by the Commissioners of the Sinking Fund of the City of Rochester, Minnesota: That the sum of $107,000.00 be appropriated from the Sinking Fund and ordered paid .to the Public Utility Fund." "WHEREAS, It now appears that funds are now available for the maintenance and operating expense of the new Sewage Disposal Plant for the current year in the Sinking Fund of the City of Rochester, Minnesota, the said funds having been received from the collection of sewer service charges, all interest on SewageDisposal Plant 1.7% Bonds and $90,000.00 maturity of bonds having been paid to date of January 1, . 19 54. SO THEREFORE, Be it resolved by the Commissioners of the Sinking Fund of the City of Rochester, Minnesota: That the sum of $28, 868. 75 be approrpriated from the Sinking Fund and paid to the Sewer Fund of the City of Rochester, ( $28, 868. 75 or 5/12 of the total Sewage Disposal Plant Budget) covering that part of the Sewage Disposal Plant Budget for the months of July, August, September, October and November, 1953.11 I A protest against the installation of a street lamp and pole on the Southeast side of Graham Court at No. 1421, signed by M. W. Rahn, J. N. Woodford, James E. Frick, George D.J. Griffin, M.D., John A. Yaeger and Mrs. Murray M. Nelson was read and upon motion by Morris, second by Ackerman, the same was referred to the Lighting Committee with power to act. The following communication was read and President Bach ordered that the same be placed on file: "Mr. F. R. Finch City Clerk City Hell Rochester, Minnesota Dear Mr. Finch: We have been advised of the action taken on November 30 by the Mayor and Common Council of the City of Rochester relative to the $46,457.90 obligation of the City to Mayo Association for the trunk line sanitary sewer to Graham Addition. We appreciate very much the Councils formal recognition of this obligation. the plan of repayment to Mayo Association is, of course, acceptable so far as we are concerned. We shall be grateful if you will convey this expression of our appreciation to the Mayor and the Counbil at its meeting on December 7. Very truly yours, H. A. The reports for the month of November, 1953 of the Building Inspector i showing fees collected for building permits issued $530.00; of the electrical � Inspector showing fees collected for electrical permits issued $163.75; 'of the !; Plumbing Inspector showing fees collected for plumbing permits issued $132.75; of the Heating Inspector showing fees collected for heating permits issued • � k $99.75 and fees collected for sign permits $49.00, were each read and President Bach referred the same to the Finance Committee. The report of- the Clerk of Municipal Court for the week ending �? December 5, 1953 showing total criminal fines and costs collected $1,181.99 and ' civil fees received 12. ' $ 35 was read and having beer. approved by the City Attorney President Bach ordered that the same be placed cn file. The application of the Rochester A. F. of L. Union Club for transfer of ' the location of "On Sale" Club License No.,316 from 3141 South Broadway to the it i Temple Building, 4 Fourth Street S. W. (main floor) to be effective February 1st, 1954 was read and upon motion by Anderson, second by Thiem, the transfer was granted. 1' The surety bond of Robert N. Radam in the amount of $500.00 with the I; Saint Paul Mercury Indemnity Company as surety was read and upon motion by Thiem, second by Morris, the bond was approved the surety thereon accepted and the same was ordered placed on file. i! Alderman Thiem suggested that a committee should be.appointed by the Chair to study the Zoning Ordinance further before submitting same to the Council for their consideration. President Bach appointed the members, of the Planning I. Commission, the Board of Zoning, the Building Inspector, the City Attorney, the !` Chief of Police and the City Engineer. ! Alderman Anderson brought to the attention of the Council that the- . 4 traffic signals at the school crossings on North Broadway and 9th Street and on 12th Street and 8th Avenue Southeast' were not located so that they could be seen from all directions. He stated that he thought thay should be -located diagonally a.cress the intersection from each .other instead of directly across.. Upon motion by Ackerman, second by Anderson, the matter -was referred to the- Police Committee l and the Chief of P.olize to .get an estimate of cost for re-1.oca,ting the signals ;. diagonally across the street from each other which would make 'them visible from I' I' all directions. Upon motion by Morris, second by Anderson, the Chief of Police and the City Engineer were instructed to make whatever construction is necessary to set up parallel parking in the above mentioned locations. Upon motion by Thiem, second by Morris, the Fire Committee and the Chief of the Fire Department .were authorized to contact an architect for information in regard to preparing plans and specifications for the new proposed sub -fire station and report to the Common Council at thenext regular meeting. The following resolutions were each introduced and read and President Bach declared the same duly passed and adopted: Resolution accepting the bid of Carlisle G. Fraser for construction of a sanitary sewer and water main on 3rd Avenue Northeast from 16th Street N atheast to 200)feet north of 17th Street Northeast. Upon motion by Ackerman, second by Anderson, resolution adopted. Resolution levying special.assessments for the grading of 192 Avenue Southwest from 3rd Street to 5th Street.Southwest. Upon motion by Anderson, second by Morris, resolution adopted. Resolution levying special assessments for construction of a sanitary sewer and water main in lst Avenue Northeast from 14th to 16th Street Northeast. Upon motion by_Morris, second by Thiem, resolution adopted. Resolution assessing sidewalks for 1953. Upon motion by Thiem, second by Ackerman, resolution adopted. Resolution granting one dance permit to the Rochester Art Center. Upon motion by Ackerman, second by Anderson, re"luticn adopted. Resolution appropriating $466.94 from the General Fund, $50,161.37 from the Bridge Fund and $101,550.00 from the P.I.R. Fund and ordering payment made to First National Bank of Rochester, $101, 550.00; Sinking Fund of City of Rochester, $50,161.37, Rochester Post Bulletin, $227.90 and International Business Machine Corp., $238.94. Upon motion by Anderson, second by Morris, resolution adopted. Resolution appropriating $496.20 from the General Fund, $1,666.79 from the S & A Fund, $297.00 from the Sewer Fund, $1, 575.00 from the Bridge Fund and $199.2.4 from the P. Upon motion by Ackerman, second by Anderson, and upon roll call and all present voting .in favor thereof, the rules were suspended and the ordinance was given its third and f inal reading. Upon motion by Thiem, second by Ackerman, that the said ordinance be adopted as read and, all present voting .in favor thereof, President Bach declared the said Ordinance duly passed and adopted.
