Minutes of a regular meeting of the Common Council of the City. of
! Rochester, Minnesota, held in the Council Chambers, in the City Hall in said
Ci-ty, on January. 4, 1954.
President Bach called the meeting to order at 2:00 o'clock P. M., the
following members being present: President Bach, Aldermen Ackerman, Anderson,,
Morris, Schroeder, Thiem and Whiting. Absent: None.
Upon motion by Morris,.second by Anderson, the minutes of the meeting of
December 28, 1953 were approved*
The following recommendation was read and upon motion by Schroeder,
second by Thiem, the same was approved: -
"Honorable Mayor 8- Common Council
City of Rochester, Minnesota
Gentlement
We, the undersigned, recommend that the City Council approve
the following recommendations of this committee, and instruct the
City Engineer to convey notice of this action to the Commissioner
of Highwayst
1. That the City of Rochester is aware of the need for the
proposed improvement on North Broadway (U.S.#63) from
14 St. N. E. to the North City Limits, consisting of
construction of Service Drives on each side of the
roadway, and requests the Commissioner of Highways to
proceed with its' construction in 1954.
2. That the State consider carefully the need for sidewalks
along the property lines on each side of Broadway, and
make every effort possible to provide In the plans for
an adequate sidewalk bench within the present right-of-way.
3. That the State reconsider the need for a storm sever outlet
into the Zumbro River at 14 Street Northeast to replace the
present culvert and surface -drainage system which will
become blocked whenever the property on the west side of
Broadway is filled -in and developed.

The following resolution adopted by the Public Utility Board was read
and President Bach ordered the same placed on file:
"Be it and it is hereby resolved by the Public Util:ity Board of
th4 City of Rochester, Minnesota, that the Common Council of the
said City be and is hereby requested to authorize the said Board to
enter into contracts with the following companies for the furnishing,
in accordance with specifications, of 20.000 tons of coal screenings:
5,000 tons of Western Kentueb:y coal screenings from the Nashville
Coal Company, Inc., at a price of $2.90 per ton F.O.B.
Mines making a total contract price of $14,500.00.
2,500 tons of Southern Illinois Coal Screenings from the Old Ben
Coal Company at a price of $3.65 per ton F.O.B. Mines
making a total contract price of $9,125-00.
5,000 tons of Southern Illinois Coal Screenings from the Republic
Coal Company at a price of $3-75 per Ton F. 0. B. Mines
making a total contract price, of $19,750-00-
3,T50 tons of Central Illinois Screenings from the Truax-Traer
Coal Company at a price of $3.00 per Ton F.O.B. Mines,
making a total contract price of $11,250-00-
3,750 tons of Central Illinois Coal Screenings from the Pittsburg -
Midway Coal Company at a price of $3.00 per Ton F,O.B,
Mines, making a total contract price of $11,250-00, and
Be it and It Is hereby further resolved that the said Public Utility
Board be and is hereby authorized to pay the freight on said coal
screenings'based upon the rate in effect at the time of shipment".

A letter from Mrs* Thomas R. St. George of- 908 - 2nd Street Northwest,
suggesting to the Council that they consider an ordinance prphibiting anyo' no
from going on the ice at Silver Lake and that a.fine be included for.violator
including the parents responsible for violations committed by their children,
was read and President Bach ordered the same placed on file.
The following communication from the'Board of Park Commissioners was
read and President Bach ordered the'same placed on file:
"Honorable Mayor McQuillan and
Members of the Common Council
City of Rochester, Minnesota
Gentlemen:
At a special meeting December 30 this Board voted -in favor of
permitting the Council to use the statuary section of Mayo
Park, with the exception of the piece to be used,lby the
Utility Department for the construction of a - sub -.station, for
a parking area with the understanding that at such time as
the property is no longer needed for parking It will revert
to -the Park Department.
Will you please give us a letter to this effect?

The application -for transfer of. "On Sale" non -intoxicating malt liquor,,
li.cense No., 805 from Jack R. Pougial6a to Billie Clark was read and upon motion
by Anderson, secondby Thiem, the transfer was granted.
The application of Billie Clark for an "Off Sale" non -intoxicating
malt liquor license was read and upon motion by Thiem, second by Schroeder, the
license was granted*
The application of Billie Clark for license to sell cigar4Ates was
read and upon motion by Ackerman, second by Anderson, the license was granted.
The applications of William R, Hislop and Douglas Jensen for Journeyman
Warm Air Heating, Ventilating and Air Conditioning Workerl.s License were each
read and upon motion by Anderson. second by Morris, the licenses were'granted.

The application of Billie Clark for a license to operate a pool hall
(5 tables) was read and upon motion by Morris, second by Ackerman, the license
was granted.
The application of Brede, Incorporated for a license to erect and
maintain signs was read -and upon motion by Schroeder, second by Anders on, the
license was
granted.
The applications of Rochester Methodist Hospital (2) and Billie Clark
for license to sell soft drinks were each read and upon motion by Morris. secondi:,
by Anderson, the licenses were granted,
The surety bond of Brede, Incorpgrated in the amount of $1,000.00 with

St. Paul Mercury Indemnity company as -surety was read and upon motion by Schroeder,
second by Anderson, the bond was approved, the surety thereon accepted and the
same was ordered placed on file,
The report of the City Weighmaster for the month of December, 1953
showing fees received for loads weighed in the amount of $129.50 was read and
the same was ordered placed on file.
The reports of the Clerk of Municipal Court for theweek ending
December 26, 1953 showing total criminal fines and costs collected $900.00 and
civil fees received $2.25 and for the week ending January 2, 1954 showing total
criminal fines and costs collected $727.65 and civil fees received $1.05, were
each read and having been approved by the City Attorney, President Bach ordered
the same placed on file,
Mr, Ray Kubly of 1924 - 3rd-Street Southwest was again before the
Council with a petition for the annexation of -a part of Highland Addition. He
inquired as to when this annexation might take place and as to when sewer and
water mains might be constructed. He also inquired as to whether or not the
matter might be brought into the District Court to determine whether the
annexation would be illegal.
Attorney, R. V. Zhrick,ex�lained that conflicting opinions had
City
been issued from the Attorney General's Office on the legality of annexing a
partof Highland Addition as previously petitioned for and it had been
recommended by that offide that the City ask the District Court for a
declaratory judgment on the question. Attorney Ehrick further stated that if
the Council annexed a portion of Highland Addition as petitioned for, a single
plaintiff could then sue the City on the grounds that the aiinexation was
illegal, which would settle the matter before making expenditures for public
improvements. Mr. Xubly was requested to contitet property owners in the area
to determine If those favoring annexatibn would be willing to share the legal
expense and if possible to locate a plaintiff.
Mr. Stanley Drips, representing the Central Area Improvement
Association,'asked that the Council take steps at once to put the area known
as Statuary Park im condition to be used as a parking lot.
The following resolutions were each introduced and read and President
Bach declared the same duly passed and adopted:
Resolution appropriating $514-50 from the General Fund, $300-00 from
the Fire Protection Fund and $300-00 from the Street & Alley Fund and ordering
payment made to T, 0. Wellner, M. D. $514-50 and city of Rochester, Public
utilities $600.00. Upon motion by Ackerman, second by Anderson, resolution
adopted.

President Bach called the meeting to order at 4:25 P- M-
Alderman Schroeder moved that the Ohair.appoint a committee to prepare
citations to be presented to the families of Stanley'J. O'Brien and Ambro.se J.
Riley for their efforts in attempting to save a child from drowning in Silver
Lake. Alderman Thiem seconded the motion. President Bach appointed Alderman
Schroeder, Alderman Whiting and R. V. Shriek, the City Attorney to prepare the
citations.
