M., the following members being present: President Bach, Aldermen Ackerman, Anderson, Schroeder, Thiem and Whiting. Absent: Alderman Morris, due to illness. Upon motion by Thiem, second by Anderson, the minutes of the meeting of February 1, 1954 were approved. • Mr. Carl F. Peterson dba Vets Cab Company was again before the Council and requested that he be granted license for -two more taxicabs. Mr. James 1. Spillane, -Attorney spoke in behalf of the Yellow Cab Company, stating that there was now adequate taxi service in the City of Rochester without granting additional; 1 n taxicab licenses. Also Mr. J. H. Kramer, Manager of the Yellow Cab Company,. , opposed the granting of additional taxicab licenses. The Mayor stated that he felt the franchises now -in effect were discriminatory. It was' then brought to the " attention of the Council that, franchises were issued for the purpose of protecting, the investments of the companies furnishing a public service.' Alderman Schroeder moved that there appeared to be a necessity for more taxicabs„, in the City of Rochester. Alderman Ackerman seconded the motion and upon roll call all present voted in favor of the motion, except Alderman Whiting, who voted "no". i Alderman Schroeder then moved that it was the findings of the Common Council, based on a hearing and evidence submitted, that there now appeared to be i a necessity for additional cabs in the City of Rochester and that two additional cabs be licensed to operate on the streets of the City of Rochester and that the City Clerk be instructed to request each Cab Company to make application for one additional cab. Alderman Ackerman seconded the motion and upon roll call all present voted in favor of the motion, except Alderman Whiting, who voted "no". � �I A communication addressed to the Common Council from Mr. Alvin Costello stating that he had called the Vets Cab Company several times' to transport patients to the clinic and had to wait from a hour to 1 hour for service and that he thought more cab licenses should be issued to the Vets Cab; Company, p y, was read and ordered placed on file. p financial statement sworn to by Mr. J. H. KramerGeneral Manager of the Yellow Cab Company, covering the fiscal years ending October 31, 1952 and October 31, 1953 was read and ordered placed on file. Mr. Carl F: Peterson'dba Vets Cab Company, then stated that the Yellow Cab Company now held a license for a sight seeing bus which was not in use and requested that the license covering the said bus be issued to,his firm. Alderman Schroeder moved that the matter be referred to the License Committee and Alderman ! • Anderson seconded the motion,, r,O,16 Record of Official. Rochester, Minn., February 15, 1954 The recommendation of the Street & Alley Committee.that the -City advertise for bids for the purchase of a 3 Yard Street Sweeper was read and upon motion by ,Ackerman, second by Anderson, the recommendation was approved. The recommendation of the Street & Alley Committee that the City advertise for bids for the purchase of a 1200 gallon street flusher was read and upon motion by Anderson, second by Ackerman, the recommendation was approved. The recommendation of the Street & Alley Committee that the request to erect commercial advertising signs on the public parking lot be denied and that no ,signs be permitted on the public parking lots except those Pertaining to its use . was read and upon motion by Ackerman, second by Anderson, the recommendation was approved. The recommendation of the Street & Alley Committee that the request of Mr. J. Mullins to purchase a portion of Lot 31, $lock R0, Moe & Olds Addition be rejected, and that -he be so advised by the City Clerk, was read and upon motion by ,'Ackerman, second by Thiem, the recommendation was, approved. The recommendation of the Street & Alley Committee that the City Engineer be authorized to move a machine shed from the hog farm to the City Dump and set it up as a machine shed for the dumping grounds equipment at an approximate cost of $500.00 was read and upon motion by Schroeder, second by ;Ackerman, the recommendation was approved. The following recommendation was read and upon motion by Anderson, second by Ackerman, the recommendation was approved: "Honorable Mayor and Common Council City .of Rochester, Minnesota Gentlemen: We, the undersigned,- recommend that the following Bridge Program be adopted in order to provide.an outline for the orderly planning and financing of' the Bridge Fund: 1. Replank East Center Street Bridge as soon as possible in 1954. 2. Build new bridges over Zumbro ,River at 7th Street Northeast and new road from river to 11 Avenue Northeast. 1955- 56 3. Resurface the exterior concrete beams and side- walk brackets on the existing bridges on 11 Avenue Northeast and 7th Street Northwest. 1954 4. Widen to 441 roadway both bridges on 4th Street Southeast in conjunction with the street widening from Broadway to 6th Avenue Southeast. 1956 5. Build new East Center Street Bridge in conjunction, with the street widening of East Center from 2nd Avenue to 11 Avenue east. 6. Build new bridge over Bear Creek at 10 Street Southeast when the residential development east of Bear Creek demands. The recommendation of the Police Committee that the Common Council advertise for bids for furnishing to the City of Rochester Yellow Traffic Marking i Paint., in the amount of .160 .gallons and an additional 20 gallons of thinner, and also that each bidder .give a price on 35 gallons of paint that .can be brushed into!; it the concrete curb plus 10 gallons of thinner, was read and upon motion by Ackerman; I second by Schroeder, the recommendation was approved. li The following.resolution adopted by the Public Utility Board was read I and President Bach ordered the same placed on file: i flBe it and it is hereby resolved by the Public Utility Board of jl the City of Rochester, Minnesota that the Sinking Fund'Commission be j! and is hereby requested to invest in short-term U.S. securities $ 5,000.00 in uninvested Funds - Sinking Fund for Employees Comp. A letter from the United States Conference of Mayors stating that the action of the House Committee of Ways and Means of January 20th, in regard to Federal Taxation of Certain Municipal Securities, had been repudiated was read and President Bach ordered the same placed on file. The request of the Board of Public Health & Welfare for approval of the employment, effective February 16, 1954, of Mr. James J. Waldeck, as assistant milk sanitarian, at a. beginning salary of $355.26 per month which is 90% of the base salary, was read and upon motion by Schroeder, second by Ackerman, the same was approved. The request of the Board of Public Health & Welfare, for approval of the employment of Miss Mildred L. Lewis, as Laboratory Technician in the Health I, Department, effective February 4, 1954.at a salary of $260.00 per month, was I read and upon motion by Thiem, second by Anderson, the same was approved. The following communication was read and President Bach ordered the same; 1. placed on file: "Honorable Mayor Claude McQuillan and Members of the Common Council City of Rochester, Minnesota Gentelemen: The Board of Park Commissioners has decided to accept the J ~1 F,64S- Record of Official Proceedings of the Common Council of. the City of Rochester, Minn., February 15, 1954 i . proposal of the Council on the conditions stated in the Council's resolution dated January 19, 1954. Although the Board of Park Commissioners retain the control and management of the Statuary parking area, we agree that the efficiency and economy of the !' operation of this parking area would be promoted by having the present parking lot personnel under the jurisdiction of the Engineer's Department operate the lot. A letter' from the State of Minnesota, Department of Highways, transmitting I , i'six copies of an agreement, with resolution attached, between thh City of Rochester ,and the State of Minnesota covering the installation of traffic control signals ��at the intersection of llth Avenue Southeast and T. H. No. 296 (4th St. S. E. ) ,was read and President Bach ordered the same placed on file. A letter from the Rochester Public Schools transmitting a copy of a ,plat togetherwith a legal description of the lands proposed for a senior high 'school site in Soldier's Field was read and'President Bach ordered the same placed on file. A petition for the construction of a curb and gutter on 2nd Avenue Northwest between 6th S.tr.eet and 7th-Street Northwest was read and upon motion by Thiem, second by Ackerman, the same was referred to the Street &.Alley Committee and the City Engineer. Reports from the Appraisal Committee.on the property known as the City Hog Farm and Lots 1, 2 and 3, of a tentative plat of lands on North Broadway just south of the Podein Freight -Ways were each read. Mr. George Leiferman was present at the meeting and also made suggestions as to the 'handling of the sale of the said real estate, he recommended that a plat of the !City Farm be prepared and also that grading be done on the property on North Broadway before advertising the same for sale. Also a letter from the Public ',Health & Welfare .Department stating that they had investigated the land at. the 1 ,city farm and which reads in part as follows: 5) There has been some question as to whether the continued use of certain areas for hog feeding lots would place any restriction upon the use of the land. Based upon careful Investigation and consultation with specialists on animal diseases transmissible to man, we have determined that there will be no public health significance in future uses of this land and, therefore, no restrictions should .be placed upon it. Alderman Schroeder moved that the expense of preparing a survey and plat of the city farm be authorized. Alderman Thiem seconded the motion and all present ,voted in favor of same. It was noted that no provision had been made in the budget for this project and upon motion by Thiem, second by Schroeder, consideration of the request was deferred. The City Treasurer's report for the month of January, 1954 was read and! I President Bach ordered the same placed on file. j The report of the City Weighmaster for the month of January, 1954 showing fees collected for loads weighed in the amount of $117.35 was read and i. The reports of the Clerk of Municipal Court for the week ended I` li February 6, 1954 showing total criminal fines and costs collected $1,015.40 and �I civil fees received $4.65 and for the week ended February 11, 1954 showing total i criminal fines and costw collected $757.00 and civil fees received $5.05, were each read and having been approved by the City Attorney, President Bach ordered I� the same placed on file. y The application of Mr. Joseph Daly for transfer of the location of his �! "off sale" intoxicating liquor license from No. 24 - 17th Avenue Northwest to No. 12 - 17th Avenue Northwest was read and upon motion by Ackerman, second by j! Peterson for. transfer of a taxicab license from a 1973 Ford with license No. 917-951 to a 1953 Chevrolet with license No. - I 215-609 was read and upon motion by Whiting, second by Thiem, the transfer was granted. Alderman Ackerman read a letter from the Juvenile Department requesting that acoustic tile be placed on the ceilings of certain rooms in the basement of the city hall, used by the Juvenile Department. The matter of disposing of the house on the Denny property was discussed and upon motion by Whiting, second by Thiem, the same was referred to the Public Grounds Committee and the City Engineer to determine which would be the most feasible way to dispose of the house on the Denny property, tear same down or move the house f rom the lot. An Ordinance providing for the formation and government of the Fire Department of the City of Rochester, Minnesota, was given its first reading. Upon motion by Thiem, second by Whiting, and upon roll call and all present voting in favor thereof, the rules were suspended and the ordinance was given its second reading.
