Minutes of a regular meeting of the Common Council of the City of Roches- _
ter, Minnesota, held in the Council Chambers, in the City Hall in said City, on
March 1, 1954.
President Bach called the meeting to order at 2:00 o'clock P. M. the
following members being present: President Bach, Aldermen Ackerman, Anderson,
Morris, Schroeder, Thiem and Whiting. Absent: None.
Upon motion by Morris, second by Thiem, the minutes of the meetings of
February 15th, February 22nd and February 24th, 1954 were approved..
President Bach stated this as being the time and place set for a hearing
on the levying of special assessments for the grading and surfacing of First
Avenue Northeast from 14th to 16th Street Northeast. There was no one present
wishing to be heard.
President Bach stated this as being the time and place set for a hearing
on the levying of special assessments for the grading and surfacing of streets
in Gooding's Addition. There was no one present wishing to be heard.
President Bach stated this was the date set for receiving bids for the
furnishing of one 3-Cubic Yard Street Sweeper for use in the City Engineer's De-
partment. The following bids were received and upon motion by Thiem, second by
Ackerman, the same were referred to the Street & Alley Committee and the City
Engineer for tabulation and recommendation: The bid of the Minnesota Public Works
Equipment Company in the net amount of $9,940.00 and the bid of the Rosholt Equip -
meat Company in the net amount of $8, 982. 50e
President Bach stated that this was the date set for receiving bids for
the furnishing of one 1,200 gallon street flusher for use in the City Engineer's

Department. The following bids were opened and upon motion Ackerman, second by
Schroeder the same were referred -to the Street & Alley Committee and the City
Engineer for tabulation and recommendation: Truck Service Company in the net
amount of $6,193.00; Universal Motors Company in the net amount of $5,9 54.50
and Clements Chevrolet Company in the net amount of $6,064.30.
President Bach stated that this was the date set for receiving bids for
the furnishing of traffic marking paint for the 1954 season. The following bids
were read and upon motion by Schroeder, second by Ackerman, the same were referred
to the Police Committee and the Chief of Police for tabulation and recommendation:
Harry V. Hanson.- 160 gallons yellow marking paint and 20 gallons thinner - $655.40
and 35 gallons concrete curb marking paint and .10 gallon of thinner - $148.50;
The B. Amundsen Company - 160 gallons yellow traffic paint, 20 gallons of thinner
for spray type paint, 35 gallons yellow traffic paint for brush and 10 gallons
thinner for brush - $798.60; The Bergstedt Paint Company - 160 gallons spray type -
$588.80, 20 gallons thinner spray type - $14.00; 35 gallons brush type-$128.80 and

10 gallons thinner brush type - $7.70 for a total amount of $739.10; The S. M.

The recommendation of the Street & Alley Committee -that the contract'

The recommendation of the Police Committee and the Chief- of Police

1accepted, was read. Upon motion by Whiting, second by Ackerman•the.recommendation
was approved.
The following copies of resolutions adopted by the Public Utility Board

,'were each read and President Bach ordered that same be placed on file:

COMPANY, for the furnishing of -

the total amount of the said contract to be XINE THOUSAND SIX

of the said City be and is hereby requested to authorize the said
Board to enter into a contract with the SOUTHERN.MINNESOTA SUPPLY
COMPANY, for the furnishing of -
THIRTY-THREE (33) LIGHTNING ARRESTERS
the total amount of the said contract to be THREE THOUSAND EIGHT
HUNDRED NINETY THREE DOLLARS AND FIFTY TWO CENTS ($3993.52) and the
said Southern Minnesota Supply Company being the lowest responsible
bidder."
"Be it and it is hereby resolved by the Public Utility
Board of the City of Rochester, Minnesota that the Common Council
of the said City be and is hereby requested to authorize the said
Board to enter into a contract with the R. E. BURMEISTER ELECTRIC
COMPANY, for the furnishing of -
THIRTY-SEVEN (37) DISTRIBUTION TRANSFORMERS
the total amount of the said contract to be FOURTEEN THOUSAND FIVE
HUNDRED SEVENTY-SIX DOLLARS ($14,576.00) and the said R. E.
BURMICISTER ELECTRIC COMPANY being the lowest responsible bidder."

"Whereas, the Public Utility Board considers it necessary to
construct. a SUBSTATION in the immediate downtown area of the City, and
Whereas, it would be in the best interest of the City of Rochester
if a part of Statuary Park be used for that purpose, and
Whereas, the Park Board of the City of Rochester is agreeable to
the release of the following area for the purpose herein mentioned -
HTHE NORTH 20 FEET OF LOT 6 AND THE NORTH 20 FEET

upon by the Park Board and the Public Utility Board, be and is hereby
paid from the Public Utility Fund to the Park Board of the City of
Rochester as compensation for the perpetual use of the property.above

The Engineer's Preliminary Report on the proposed improvement entitled
"Construction and replacement of water and sewer connections on 4th Street Southeast
from 6th Avenue Southeast to the State Hospital° was read and the same was ordered
placed on file.
A letter from William Bielenberg and Henry J. Giese submitting a plat for
annexation to be known as Bielenberg & Giese's Second Addition, was read together
with letters of approval by the Public Utility Department, the Planning & Zoning
Commission and the City,Eugineer. Upon motion by Morris, second by Ackerman, the
City Attorney was instructed to prepare an ordinance annexing the said plat to
the City of Rochester.

The petition of William Bielenberg and Henry J. Giese for street
�jlighting on lath and 14th Avenue Northwest in Bielenberg & Giese's First
Addition was read. Upon motion by Thiem, second by Ackerman the Public
;Utility Department was instructed to install the requested street lighting.

The petitions of William Bielenberg and Henry J. Giese for the don-
;struction of a sanitary sewer and watermain and the grading of streets in the
;proposed Bielenberg & Giese Second -Addition were each read and the same were
lordered placed on file.
I The petition for the construction of a sanitary sewer on 14th Street
Northwest from 3rd Avenue to 5th Avenue Northwest and on 5th Avenue:,Northwest
!from 14th to llth Street Northwest was read. Mr. William Lemke was ''present
at the meeting and urged that the sewer as petitioned for be installed as soon
as possible. It was explained by the City Engineer that it would be necessary
:to install a trunk line sewer in connection with the said sewer. Upon motion by

Thiem, second by Ackerman the matter of constructing the sewer petitioned for and

the trunk line in connection'with same was referred -to the Council as a Committee
of the whole.
A letter from the Board of Park Commissioners transmitting a copy of a
resolution adopted by their Board on February 3rd, 1954 opposing the use of
;'Soldier's Field or any part thereof for a high school site and requesting the
''Council not to sell the property, was read. Also communications opposing the
sale of any part of Soldier's Field for a school site from the Kahler Corporation,
;'',the Rochester Softball Association, Forest J. Bandel, Co. Supt. of Schools, Music
Band'Committee, the Rochester Centennial Music Committee, A. A. Jensen, Act. Ohm.

Folk Dancers were each read and ordered placed on file.
The request of Marvin W. Price City Assessor, for q y permission to employ
,;several deputy assessors to assist in canvassing the city for the purpose of

,Whiting second by Thiem, the request was approved.
The request of Marvin W. Frice, City Assessor, for permission for himself
j!and Alfred Nelsen, deputy assessor, to attend the annual Assessor's School sponsored
by the. League of Minnesota Municipalities to be held on March llth, 12th and 13th
I:was read and upon motion by Morris, second by Anderson, the request was granted.

A letter from Mr. A. C. Gooding, Agent for Frances G. Twyeffort, trans-
,,mitting a'replat of Blocks 4 and 10 in Gooding's Addition was read, and upon motion
' by Schroeder, second by Ackerman, the replat was approved and the City Clerk was
instructed to have same filed in the office of the Register of Deeds.
A letter from the Board of Park Commissioners asking the Council to -con-
sider the appropriation of funds to acquire the undeveloped portion of the Fitz-

The reports for the month of February, 1954 of the Building Inspector
shoeing fees collected for building permits issued $166.00; of the Electrical
'Inspector showing fees collected for electrical permits $124- 50; of the Plumbing ;

Inspector showing fees collected for plumbing permits $1, 559.25; of the Heating
Inspector showing fees collected for heating permits issued $999.50 and fees collected
'for sign permits issued in the amount of $74.20, were each read and President Bach
.referred the same to the Finance Committtee•
T-he report of the Clerk of Municipal Court for the week ended February
27th, 1954 showing total criminal fines and costs collected $900.95; civil fees

,received $6.95 was read and having been approved by the City Attorney, President
Bach ordered the same placed on file.

Resolution instructing the City Clerk to refer/individuals and companies
interested in procurring licenses to sell various products on the `streets during
the Centennial celebration to the proper Centennial Committee for 'their recommend-
ation and advice. Upon motion by Ackerman, second by Anderson, resolution

The following appointments by the Mayor were each read and upon motion
by Thiem, second by Ackerman the said appointments were approved effective as
of March 1st, 1954: Sgt. Carl J. Briese, 937 4th Avenue S.E., promoted to the

A recommended Official Plan of the Southeast Area of the 'City of Roch-
ester comprising of those lands within the corporate limits of the City bounded
by U. S. Highway 14 on the south; the corporate limits on the east; Sa Street
S. E. projected, on the north and old State Highway (13th Avenue) on the west,
was submitted to the Common Council for their consideration. Upon motion by
Whiting, second by Morris, the plan of the proposed development was approved.
It was brought to the attention of the Council that a number of com-
plaints had been received in regard to the traffic signals at llth Avenue and

• Center Street East. After some discussion on the matter, a motion was made by

Ackerman, second by Morris, that the signals be adjusted so as to operate on
stop and --go only and the Chief of Police was instructed to adjust the signals
to operate as requested.
The Mayor called to the attention of the Council an invoice in the amount
of $373.27 from the Madison.Advertising Agency covering advertising in various
papers for the Gene Autrey show. After discussion on the matter a motion was
made by Thiem second by Morris that the same be referred back to the Mayor.
The it inquired as to what action the Council wished to take

on the claim of Jess Hansen of Gladbrook, Iowa for damage to his car. Upon motion

by Morris, second by Thiem, the City. Attorney was authorized to settle the claim
with Mr. Hansen,.
Upon motion by Whiting, second by Thiom,,the Building Inspector was in-
structed to prepare specifications for the moving of the Denny house located at
118 lst Street Southeast.
Upon motion by Morris, second by Ackerman the meeting was adjourned to
