Absent: None, ;i Upon motion by Ackerman, second by Thiem, 'the minutes of the meeting of �I March 1, 1954 were approved. 1 President Bach stated this as being the time and place set for a, hearing' i� on the construction and replacement of water and sewer connections on 4th Street Southeast from 6th Avenue Southeast to the State Hospital. There was no'one j present wishing to be heard. A' proposal from Mr. Sam Rueb of Route 3,. Chatfield, Minnesota, to wreck the house at 118' First Street Southeast for •th'e material and a fee of $150.00 was read and upon motion by Thiem, second by Ackerman, the proposal was ordered placed on file and the City Clerk was instructed to re -advertise for bids to be received on April 5, 1954. Alderman Anderson read a description of lands to be used for a sub fire station on 7th Street Northeast. After discussion on the matter, Alderman Morris moved that an informal meeting be held with the Board of Park Commissioners to determine on what basis a transfer of the land for the proposed sub -fire station would be made from the Park Improvement Fund to the Fire Protection Fund. Also the plans and specifications be referred to the Fire Committee and the Chief of the Fire Department for recommendation at the next meeting. Alderman Thiem seconded the motion and all voted in favor of same. The recommendation of the Street & Alley Committee that a. curb and gutter be constructed on llth Avenue Southeast from 4th to 6th Street Southeast was read and upon motion by Ackerman, second by Schroeder, the recommendation was approved. The recommendation.of the Street & Alley Committee that a curb and gutter be constructed on 5th Avenue Southeast from llth to 12th Street Southeast was ready and upon motion by Whiting, second by Morris, the recommendation was approved. �I The recommendation of the Street & Alley Committee that a curb and gutter ii be constructed o.n 7th Avenue Northeast from 14th .Street Northeast to .Silver Lake Park was read and upon motion by Thiem, second by Morris, the; recommendation was approved. The recommendation .of the Street & Alley Committee that the bids of it Rochester Sand & Gravel Company and Patterson Rock Products --for furnishing the " season's supply of crushed rock, sand, gravel and pea gravel be accepted at the unit prices bid was read and upon motion by Schroeder, second by Morris, the j recommendation was approved. The recommendation of the Street & Alley Committee that the bid of Rochester Ready -Mix Concrete -Company for furnishing the season's supply of. ready mixed concrete be accepted at the unit prices bid and checks be returned to the unsuccessful bidders was read and upon motion by Schroeder, second by Ackerman, the recotmendation was approved. The recommendation of the Street & Alley Committee that the bids of Standard Oil Company for furnishing the seasons supply of road oil and cutback asphalts for 10,000 tank car delivery, Northwestern Refining Company for furnish- ing the season's supply of road oil and cutback asphalt in; truck transport delivery and L. N. Sickels Company for furnishing asphalt emulsions in truck transport delivery, be accepted at the unit,prices bid and checks be returned to 0 650 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 15. 1954 the unsuccessful bidders was read and upon motion by Morris, second by Anderson, t-he recommendation was approved. - The recommendation of the Street & Alley Committee that the bid of Rochester Sand & Gravel Company for furnishing the season's supply of plant mixed bituminous mixture be accepted at the unit .prices bid and checks be returned to the unsuccessful bidders was read and upon motion by Anderson, second by Schroeder, the recommendation was approved. The recommendation of the Sewer Committee that the bid of Neenah Foundry Company for furnishing sewer castings be accepted at the unit prices bid and checks be returned to the unsuccessful bidders was read and upon motion by Schroeder, second by Ackerman, the recommendation was approved. Upon motion by Whiting, second by Morris, the Public Grounds Committee was authorized to sell one of the quonset huts which is still located at -the fairgrounds. A letter from the Board of Public Health & Welfare recommending the passage of the proposed new -milk sanitation ordinance was read and President Bach ordered the same placed on file. .The following letter from the Podein Freight Ways was read and upon motion by Schroeder, second by Morris, the matter -gas referred to the Public - Grounds Committee and the City Clerk was instructed to return the $550.00 check to the Podein Freight Ways. All voted in favor of the motion. fillonorable Mayor and Common Council City of Rochester Minnesota Gentlemen: Enclosed please find our check in the amount of $550.00 .which is 10% of the appraised value of $5500.00 for the three (3) Lots south.of property now known as Podein Freightways Terminal. I have had my present property surveyed and submitted the surveyor's report to Mr. Armstrong, the City Engineer, so that the West lire of these Three (3) Lots will coincide with my present western boundary. Postier, Chairman of the Y-Teens Committee, to conduct a taffy sale on the streets on Saturday, the 20th day of March, was • read and the same was ordered placed on file. !i The request of Mr. Merrill L. Lewis to have his name withdrawn from the �! petition for curb and gutter on 14th Avenue Northeast was read and upon motion by Morris, second by Schroeder, the same was referred to the Street:&.Alley Committeejl and the City Engineer. i, A pe-tition for the construction of a sanitary sewer and water main in j Bielenberg & Giese's, 2nd Addition and a petition for the grading of streets in I� I� Bielenberg & Giese's 2nd Addition were each read and upon motion by Morris, secondii by Schroeder, the same were referred to the Sewer Committee,. the Water Committee, i II h the Street & Alley Committee.and the City Engineer. �! r I� Upon motion. by Thiem, second by Morris, the Public Grounds Committee was I authorized to take the necessary action to have the buildings at the City Hog Farm;; 'I it � IJ b: Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March. 15 , - 1954 exclusive of houses, appraised and advertised for sale. The report of the Clerk of Municipal Court for the week ending March 13, 1954 showing total criminal fines and costs collected $1,937.00 and civil fees received $15.0-5 was read and having been approved by the City Attorney, President Bach ordered the same placed on file. The contract bonds of Minnesota Public Works Equipment Company in the amount of $9,940.00 with the Great American Indemnity Company of New York as surety and Clements Chevrolet Company in the amount of $7,20.0.00 with the Fidelity and Casualty Company of New York as surety were each read and the same were referred • to the Mayor for his approval. - The question as to whether Permanent Improvement Revolving Fund projects should be done under the Charter provision or the new law was again brought to the attention of the Council by the City Attorney. The City Attorney explained that the procedure for floating Permanet Improvement Revolving Bonds under the State Law had been outlined by Mr. Hugh Barber but the procedure was not entirely. clear. A motion was made by Alderman Morris, second by Alderman Schroeder, that the City Attorney and the City Clerk call -on Mr. Barber at his office in Minneapolis for further information. The following resolutions were each introduced and read and President Bach declared the same duly passed and adopted: Resolution accepting bids of Rochester Sand & Gravel -Company and Patterson Rock Products for the 1954 seasons supply of crushed rock, sand, gravel and pea gravel. Upon motion by Ackerman, second by Anderson., resolution adopted. Resolution approving plan of a proposed construction project on Trunk .Highway No. 63. Upon motion by Anderson, second by Morris, resolution adopted. Resolution authorizing the Building Inspector permission to issue a permit to Morey's Bar & Cafe for the erection of a canopy. Upon motion by • Ackerman, second by Thiem, resolution adopted. The Mayor's veto message was read together with a resolution finding a portion of Soldier's Field no longer needed for Park or other Municipal purposes, which contains his veto dated March 11, 1954 were each read. President Bach then asked if there was anyone who wished to be heard on the Matter. -Dr. T.B. Magath spoke in opposition to releasing any part of Soldier's Field for any other purpose, stating that in a matter of -years the park known as Soldier's Field located as it is would prove to be one of the City's most valuable assets. Dr. Mark Anderson stated that he was opposed•to the use of Soldier's Field for any other purpose than a.park. Mr. Earl Cooke and Mr. Edward.Garbisch both opposed the taking .of any part of Soldier's.Field for other than park purposes. Mr. E.A. 655 Record of Official Proceedings of the Common Council of .the. Mr, Albert J. Toddie, President of the Board of Park Commissioners, stated, as Dr. T. B. Magath had l� previously done, that if this. area was used for other than park purposes the City jf would have approximately 300 acres, of usable parks and according- to national �! statistics. a C,it y having a population of .30,000 people should contain approximately 500 atcres to meet national park. standards. I! declared the -resolution duly passed and adopted: WHEREAS, the Common Council of the City of Rochester.passed a resolution on the loth day of March, 1954, finding as a matter of fact that a certain. portion of Soldier's Field therein described - was no longer needed for park or other municipal purposes, and WHEREAS, the Honorable Claude H. McQuillan, Mayor of the City of Rochester, on the llth day of March, 1954, vetoed the aforesaid resolution,and oA the 12th day' of March, 1954. returned the same to the City Clerk with a statement of his objections thereto, and WHEREAS, the said resolution. was thereafter presented to, the Common Council by the City Clerk pursuant to the provisions -of the Charter of the. City lof Rochester•, and the. question was again put upon the passage of the said resolution notwithstanding the objections of the Mayor, and the Common Council, on the. 15th day. of March voted in favor of said resolution bya 5/7ths vote, thereby enacting the.same over.the•Mayor's veto, and WHEREAS, the aforesaid resolution contained a legal description of the land determined, by the Council to be no longer needed for park and other municipal purposes, which description inadvertently included a certain portion of the park streets and drives in Soldier's Field, and WHEREAS, it•was not the intention of the Common Council to find that the portion of the park streets or drives included in said description were no longer needed for, park. or other; municipal purposes; .NOW THEREFORE, Be it, resolved by the Common Council of the City of Rochester that, that certain resolution passed by the Common Council of the City of Rochester, Minnesota, on the loth day. of March, 1954, vetoed by the Mayor on the llth day of ,March, 1954 and returned to the City Clerk on the 12th .day of March, 1954 and. passed by the Common Council over the Mayor'sveto on the 15th day of March, 1954, which resolution, was a determination of fact by the Common Council that the,portion of Soldier's !'Field therein described was no longer needed for park or.any other municipal purposes is hereby amended as follows: by eliminating from the legal description of the land -involved the last sentence thereof which reads, "Containing approximately 23..7 acres more or less".
