Apr11 19, 1954 11 Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on April 19, 1954. President Bach called the meeting to order at 7: 30 o'clock P. M. , the following members being present: President Bach, Aldermen Ackerman, Anderson, Moody, Morris, Schroeder and Whiting. Absent: None. Upon motion by Ackerman, second by Morris, the minutes of the meeting of April 12, 1954 were approved. President Bach stated this as being the time and place set for the following hearings: Second hearing on the construction of a curb and gutter on llth Avenue Southeast from 4th to 6th Street Southeast. Mr. Joseph Mackey was present at the meeting and stated that his name was not on the petition requesting the said curb and gutter and inquired as to what benefit he might receive from the construction of a curb and gutter in front of the property which he owned on llth Avenue Southeast. He also inquired as to whether an approach would be left for the intersection of 5th Street and llth Avenue Southeast. Second hearing on the construction of a curb and gutter on 5th Avenue Southeast from llth to 12th Street Southeast. There was no one present wishing to be heard. Second hearing on the construction of a curb and gutter on 7th Avenue Northeast from 14th Street Northeast to Silver Lake Park. There was no one present wishing to be heard. Second hearing on the construction -of a curb and gutter on 2nd Avenue Northwest from 6th to Sth Street Northwest. There was no one present wishing to be heard. Second hearing on the construction of a curb and gutter on Sth Street Northeast from Broadway to lot Avenue Northeast. There was no one present wishing to be heard. Second hearing on the construction of a curb and gutter on 7th Avenue Southeast from 6th to 7th Street Southeast. There was no one present wishing to be heard. President Bach stated this as being the time and place set for receiving and opening bids for the construction and replacement of water and sewer connections on 4th Street Southeast from 6th Avenue Southeast to the State Hospital. The bid of Carlisle G. Fraser in the amount of $27,932.20 was received and opened and upon motion by Schroeder, second by Ackerman, the same was referred to the Street & Alley Committee, the Sewer Committee, the Water other Committee and the City Engineer. No/action was taken on the matter at this meeting. n U 1 L� I� Mr. Rarold Whiting presented a plat of Peck's 4th Addition and requ$sted 0 Record of Official Proceedings of the Common Council c� of the City of Rochester, Minn., Apr 11 19, 19 54 that same be .annexed to the City of Rochester. Upon motion by Whiting, second by :Schro.eder, the said plat was referred to the Street & Alley Committee, the Sewer Committee, the Water Committee, the City Engineer and the Planning & Zoning Commission for recommendation. The recommendation of the Street & Alley Committee that the City enter into the Cooperative Agreement with the State. of Minnesota for the improvement of 4th Street Southeast,.T. H. 296, was read and the same was ordered placed on file. The three following resolutions adopted by the Public Utility Board were each read and President Bach ordered the same placed on file: • "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota, that the Common Council of the ®aid City be and is.hereby requested to authorize the said Board to enter . into a contract with the LAYNE-MINNESOTA COMPANY for the furnishing, in accordance with specifications,; ONE'(1) DEEP WELL TURBINE AND MOTOR furnished and installed ONE (1) WALLACE AND TI-ERNAN CHLORINATOR furnished F. 0. B. Rochester the total amount of the said contract to be SEVEN THOUSAND THREE HUNDRED EIGHTY DOLLARS ($7,390.00) and the said Layne -Minnesota Company being the lowest responsible bidder." "Be it end it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota, that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with the AMERICAN STEEL. AND WIRE DIVISION OF THE U. S. STEEL COPRORATION for the -furnishing, in accordance with specifications, of fencing for 5 plots of ground, the total amount of the said contract to be SEVENTEEN HUNDRED SIXTY FOUR DOLLARS AND SEVENTY SIX CENTS ($1,764.76) and the said company being the lowest responsible bidder." "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with the STERLING ELECTRIC COMPANY for the furnishing, in accordance with specifications,; ONE (1) CUTLER HAMMER MOTOR STARTER ONE (1) FUSED DISCONNECT SWITCH the total amount of the said contract to be ELEVEN HUNDRED THIRTY THREE DOLLARS AND TEN CENTS ($1,133.10.) and the said Sterling Electric Company being the lowest responsible bidder." A notice from the League of Minnesota Municipalities of the Minnesota State Fire School to be held at the Fair Grounds in St. Paul the week of April 26 • to 30 was read and upon motion by Whiting, second by Schroeder, the same was referred to the Fire Committee. The following estimate of cost submitted by the City Engineer was read and the same was ordered placed on file; "Honorable Mayor and Council City of Rochester, Minnesota Gentlemen: The Engineers estimate of the cost of the proposed construction and replacement of water and sewer connections on 4th St. S. E. from 6th Avenue S. E. to the State Hospital is as follows. 54 Water Service Replacements $ 149897. 18 Sewer Service Replacements 4,792. 7 New Sewer and Water Connections 2 081. $ 21�. Of this amount it is estimated that approximately $5400 of the first item and all of the second and 'third items are assessable. The balance of $9497 will have t_o be met with City Funds. The avenues can be served by reasonable extension of the sanitary sewer, but only the extreme west.end and the extreme east end of 7th Street can be served. The south half of the plat is extremely low and must be filled to a depth of 4 to 6 feet. It is recommended that the plat be accepted after easements for storm sewers from 7th Street Southerly to Silver Creek are granted. Yours respectfully, C. A. Armstrong City Engineeru A supplementary recommendation by the City Engineer regarding the City's responsibility for the drainage of a' _; •portion of the proposed annexation of Jefferson Slopes was read and upon motion by Whiting, second by Schroeder, the matter was referred to the Council, as a committee of the whole, the City Engineer and the City Attorney. A petition for the construction of a curb and gutter on 12th Avenue Southeast from 4th to 6th Street Southeast wasxead and upon motion by Schroeder, second by Ackerman, the same was referred to the Street & Alley Committee and the City Engineer. The resignation of Mis's Bonnie Anderson as secretary in the Building Inspector's office was read and upon motion by Anderson, second by Morris, the same was accepted. The application of Mrs. Caralita Ferber for reappointment as secretary in the office of the Building Inspector was read and upon motion by Whiting, second by Anderson, the same was approved. The recommendation by Mr. Harold 0. A letter addressed to Mr. C. A. Armstrong, City Engineer, from the Chicago Great Western Railway Company transmitting two copies of a lease covering lands which the City intends to use for parking purposes was read and upon motion by Whiting, second by Schroeder, the same was referred to the City Attorney. The report of the Clerk of Municipal Court for the week ending April 17, 1954 showing total criminal fines and costs collected $2,042.70 and civil fees received $8.55 was read and having been approved by the City Attorney, President Bach - otdered the same placed on file.. The applications of Charles E. Batch, J. H. Fischer and George Webb for license to sell cigarettes were each read and upon motion. by Anderson, s.econd by Moody, the licenses were granted. The application of Joe Cosik for a Master Plumber's License was read and upon motion by Morris,.second by Whiting, the license was granted., subject to the payment of penalty. The applications of Charles E. Batch and J. H. Fischer for license to sell soft drinks were each read.and upon motion by Schroeder, second by Ackerman, the licenses were granted. The application of Carlisle G. Fraser for license to connect with sewers and drains was read and upon.motion by Anderson, second by Ackerman, the license was granted. The application of George Svendsen for a Journeyman Hot Water and Steam Fitter's License was read and upon motion by Ackerman, second by Morris, -the license was granted. The application of Lysnie Construction Company for a permit to moire four hog houses from Highway No. 52 to Highway No. 14, thence on Highway No. 14 to Highway No. 63 thence down Highway No. 63 to loth St. N. E., thence on 14th Street N. E. out of the City limits was read and upon motion by Anderson, second by Ackerman, the same was granted, the same to be moved under the supervision.of the Building Inspector. The request of Mr. A. H. Story for the approval of permits to move two buildings over certain streets in the City of Rochester was again read and upon motion by Ackerman, second by Moody, the permits.were granted, subject to the buildings being moved under the supervision of the Building Inspector. The official -bonds of F. R. Finch in the amount of $500.00 with the Great American Indemnity Company as surety; Garnet Spring in the amount of $1000.00 and Darrell Sanford, Ivan Boyd, Paul W. Sandberg and Harold Wiesener each in the amount of.$500.00 with the Fidelity Casualty Company of New York as surety; and the license bonds of Carlisle G. Pagenhart in the amount of $74,900.00 with the Seaboard Surety Company as surety was read and upon motion by Moody, second ,by Anderson, the same was referred to the Mayor for his approval. Upon motion by Ackerman, second by Anderson, resolution adopted. Utility Resolution authorizing the. Public/Board to enter into contract with the Sterling Electric Company. Mr. Roy Goddard, Chairman of the Charter Commission, formally submitted a draft of the proposed amended City Charter to the Mayor, who in turn presented same to the Common Council and requested that they adopt a resolution ordering an election as to whether or not the proposed amended Charter be adopted. A resolution ordering proposed amended Charter filed and ordering the' same to be voted on at a special election to be held on June 1,.1954 was read. A motion was made by Anderson, second by Ackerman, that the said resolution be • adopted and upon roll call and all voting in favor thereof, President Bach declared the said resolution duly passed and adopted. An Ordinance -relating to the real estate business, defining real estate brokers and real estate salesmen, providing for licensing the same, creating a real estate commission, providing for the enforcement of this ordinance and pre- scribing penalties for violations thereof, was given its first reading. An Ordinance annexing to the City of Rochester, Minnesota, a part of the North Half of t-he Southwest Quarter of Section 25, Township 107 North, Range 14 West in Olmsted County, Minnesota, to be known and designated as Northwood Addition to Rochester, Minnesota, was given its first reading.
