Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the -Council Chambers in the City gall, in
said City, on May 24, 1954.
President Bach called the meeting to order at 7:30 o'clock P. M., the
following members being present: President Bach, Aldermen Ackerman, Anderson,
Moody, Morris, Schroeder and Whiting. Absent: None.
Upon motion by Morris, second by Moody, the minutes of the meeting of
May 3, 1954, were approved.
President Bach stated this as being the time and place set for the
following hearings:
First hearing on the construction of a curb and gutter and the grading
and surfacing of 14th Avenue Southwest f pom 7th to 9th Street Southwest. There
was no one present wishing to be heard.
First hearing on the construction of a curb and gutter in loth Street
Southeast from 5th to 6th Street Southeast. There was no one present wishing to
be heard.
First hearing on the grading and surfacing of 9th and loth Streets
Northeast from 19th Avenue Northeast to the east line of Miner's Heights. There
l was no one present wishing to be heard.
First hearing on the grading and surfacing and construction of a
sanitary sewer and water main in Graham Court Southeast, east of 15th Avenue
Southeast. There was no one present wishing to be heard.
First hearing on the grading and surfacing and th.e construction of a
sanitary sewer and water main in lath Avenue Northwest, 14th Avenue Northwest and
14th Street Northwest in Bielenberg & Giese's 2nd Addition. There was no one
present wishing to be heard.
First hearing on the construction of a sanitary sewer and water main
in 19th Avenue Northeast from 9th to loth Street Northeast and in 9th Street
Northeast and loth Street Northeast from 19th Avenue to the east line of Miner's
Heights. There was no one present wishing to be heard.
Second hearing on the construction of a curb and gutter on 9th Street
Northeast from 1st to 2nd Avenue Northeast. There was no one present wishing
to be heard.
President Bach stated this as being the time and place set for receiv-
ing and opening bids for the construction of a sanitary sewer and water main in
7th Street Northeast to serve Qut19t 1, E1 Rancho Sub -Division. The bid of
Carlisle G. Fraser in the amount of $2,376.30 was received and opened and upon
motion by Morris, second by Schroeder, the same was referred to the Sewer and
Water Committees and the eity Engineer for tabulation and report.

stated that it was difficult to get sidewalks and streets laid out, due to the
fact that he considered the City Engineer's Department very much under -manned and
under paid. 'He suggested that those desiring street improvements, sidewalks, etc.
should be charged a fee for engineering services and the fee used by the City to
defray the expense of additional survey crews in the -Engineering -Department. He
further stated that the additional employees in the Engineering Department should
be employed from approximately the 1st of March to take care of the demands of
those constructing houses and buildings.
The recommendation of the Sewer and Water Committees that the contract
for the construction of a sanitary sewer and water main in 7th Street Northeast
to serve Outlot 1, El Rancho Subdivision be awarded to Carlisle G. Fraser at the
unit prices bid was read and upon motion by Morris, second by Schroeder, the
recommendation was approved.
The recommendation of the Sewer Committee that the City Engineer be
authorized to install a screen wash pump for #3 Fine Screen at the Sewage Treatment
Plant on force account Basis, and that the costs be paid out of the Sewage
Treatment Plant Construction Fund, the estimated most is $1275.,00, was read and
upon motion by Anderson, second by Morris, the recommendation was approved.
The recommendation of the Street & Alley Committee that curb and gutter,
base construction and bituminous surface, be constructed on 4 Avenue Southwest
from 3rd to 4+th Street Southwest was read and upon motion by Morris, second by
Ackerman, the recommendation was approved.
The recommendation of the Street & Alley Committee that the construction
of base course and bituminous surfacing on 3rd Avenue Southwest from 1st to 2nd
Street Southwest be done was read and upon motion by Ackerman, second by Moody,
the recommendation was approved.
The recommendation of the Street & Alley Committee that hearings be held
on bituminous surf acing.of 2nd Avenue Southwest from West Center Street to 1st
Street Southwest was read and upon motion by Anderson, second by Morris, the
recommendation was approved.
The City Engineer's preliminary estimate for construction of a curb and
gutter on 9th Street Northeast from 1st to 2nd Avenue Northeast in the amount of
$2,209.50 for contract items and $2,1145.40 for non -contract items was read and
President- Bach ordered the same placed on file.
The assignment of collateral by the Olmsted County Bank & Trust Company
in the amount of $250,000.00 was read and President Bach ordered the same placed
on file.
The request of the ' Board of Public Health & Welfare that the Common
Council approve the appointment of Mrs. Lila Swanson for -secretary to the
sanitation program in the health department, effective May 10, 1954 at a salary of

$200.00 per month, was read and upon motion by Morris, second by Schroeder, the
appointment was approved.
The resignation of Caralita Ferber as secretary in the Building
Inspectors office, effective May 12, 1954, was read and upon motion by Schroeder,
second by Morris, the resignation was accepted.
A plat of lands to be known as Sauer's First Sub -Division was again
presented to the Council and upon motion by Anderson, second by Ackerman, the
said plat of lands was approved and the City Clerk was instructed to have same
filed with the Register of Deeds.
A letter from the Minnesota Department of Health transmitting a copy of
a report of their Municipal Water Supply Section covering an examination of plans
on installation of fluoridation equipment at Well No. S for the City was read and
Dresident Bach ordered the same placed on file.
An easement given to the City of Rochester covering a strip of land on
the Southeast side of 4th Street between the State highway premises and the
Rochester State Hospital -to be used for highway purposes was read and upon motion
by Whiting, second by Schroeder, the said easement was accepted and the City
Clerk was instructed to have the same placed on file with the Register of Deeds.
Communications from the Police Benevlolent Association and the
Rochester Fire Fighters Association stating that a majority of each of these
organizations were in favor of a resolution naming a panel to negotiate wage
scales were each read and ordered placed on file.
A communication from the employees of the Department of the City
Engineer (Engineering Staff) alleging that the Council of the City of Rochester
had failed to fairly and justly compensate them for their services and by reason
thereof a grievance and controversy exists -between the employees whose signatures
appeared on the communication and the City of Rochester and further requests
that an arbritation panel be appointed to conduct.an inquiry into their personal
status and salaries was read together with a letter from Max Durand, Represent-
ative for Local Union No. 897, requesting that wages for members of the Street &
Alley Department, Park Department, Health Department and City Scales be submitted
to "Fact Finding". The communications were ordered placed on file for future
reference.
The following resolution adopted by the Public Utility Board were each
read and President Bach ordered the same placed on file:
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota that the Common Council of the said
City be and is hereby -requested to authorize the said Board to enter
into a contract with the GENERAL ELECTRIC SUPPLY C OMPANY for the
furnishin , in accordance with specifications;

the total amount of _the said contract to be ELEVEN THOUSAND EIGHT

"WHEREAS, the following uninvested funds are needed to retire
current. obligations, in connection with the Silver Lake Plant
Extension program -
Sinking Fund for Electric Depart _ment. Depr.Res.erve - $161,640.00
Interest Funds in Electric Dept. Depr, Reserve - . 20,927.72
THEREFORE, be it and it is hereby resolved by the Public
Utility -Board of the City of Rochester, Minnesota, that the Sinking
Fund Commission of the said City be and is hereby requested to
transfer the said amounts from the funds designated to the Public
Utility Fund."

A copy of a resolution adopted by the Commissioners of the Sinking Fund
transferring funds to the Public Utility Department as requested in their
resolution was read and upon motion by Morris, second by Whiting, the same was
approved.
A copy of a resolution adopted by the Board of Park Commissioners
creating new positions in the Park Department and recommending salaries therefor
was read and the same was ordered placed on file.
A copy of a notice to C. C. Pagenhart, General Contractor on the pro jecti
for Fire House No. 2, notifying him that change orders No. 1 and 2 had been
issued, was read and upon motion by Whiting, second by Morris, ,the said change
order® were approved.
A Letter from the Minnesota Highway Department transmitting a fully
executed copy of the agreement between the City of Rochester and the Department
of Highways, covering project S. P. 5513-02, T. H. 296 and also notifying the City
that the agreement provided that the City shall deposit with the State the ,sum of
$30, 915. 77, the estimated amount of the City's share of this project was read and
President Bach ,ordered that the same be placed on file.
An agreement between the City of Rochester and Julius Peters, unmarried,
Frederick L. Sauer and Jeannette X. Sauer, his wife, providing for the drainage
of surface water from Sauer's First Sub -Division was read and upon motion by
Whiting, second by Ackerman, the Mayor and City Clerk were inst.ructed to execute.
the agreement and to have same filed with the Register of Deeds.
Specifications for automatic parking meters as recommended by the City
Engineer, the Street & Alley Committee, the Steering Committee,and the City
Attorney were presented and the same were ordered placed on file.
The recommendation of the Building Inspector that Miss Agnes Decker
be appointed as secretary in the Building Inspectors office beginning June 1,19541
was read and upon motion by Anderson, second by Schroeder, the appointment was
approved.
A letter from the Minnesota Department of Health transmitting a copy of
their report of their Municipal Water Supply Section and covering an -examination
of plans on water main extension installed in the City of Rochester was read and
President Bach ordered the same placed on file.

Aide II, he to receive 95% of the salary set for the position, was read and upon
motion by Anderson, second by Schroed®r, the same was approved.
A letter from Mr: and Mrs. Frank W. Cowan asking that parking space
on the side of the Marlow Apartments at 103 - 4th Avenue Northwest be reserved
for the use of the guests and themselves was read and upon motion by Morris,
second by Ackerman, the same was referred to the Police Committee and the Chief
of Police and the City Engineer.
A communication from School District No. 59 stating that the said
District wished t.o purchase an additional five acre tract of land from the
property known as the City Hog Farm which would be abutting on the South side
of the land on which their school is located was read and upon motion by Morris,
second by Moody, the communication was referred to the Public Grounds Committee.
The recommendation of t•he Planning Commission approving the second
version of Jefferson Slopes Addition to the Gity was read and the same was
ordered placed on file.
The request of the City Assessor for permission to employ a full time
clerk -stenographer and for permission to compensate his present employees for
all overtime worked was read and the same was ordered placed on file.
A letter from the Centennial Elks Parade Committee requesting permission
to use an aerial flare to signify the start of .the•Centennial Elks Parade on
June 5, 1954 was read. and the same was ordered placed on file.
A petition for the construction of a curb and gutter on the south side
of the street in Graham Court S. E. in Block 3, Homestead Addition, west of 15th
jAvenue Southeast was read and upon motion by Morris, second by Moody, the same
was referred to the ,Street & Alley Committee and the City Engineer.
A petition for the construction of a curb and gutter on llth Street
Northwest from 2nd to 4th Avenue Northwest was read and upon motion by Morris,
second by Schroeder, the same was referred to the Street & Alley Committee and
the City Engineer.
The petitions of Robert C. Neill to have the west 65 feet of the: north
150 feet of Outlot 7, Cumming's Addition and beginning at the northwest corner
of said Outlot, thence east along the north line of said Outlot a distance of
65 feet, thence north 23 feet to the south line of Center Street West, thence
a distance of 65 feet, thence south to place of beginning changed from a
residential to a multiple dwelling zone; of Maurice Alexander to have Lot.9,
Block 36, Morse and Sargents Addition changed from a residential to a multiple
dwelling zone; of Libby, McNeill & Libby to have Lot 27, Block 11, Sunnyside
Addition changed from a residential to a commercial zone; and of Charles A.
Campbell to have the Crest SS feet of the north 65 feet of Lots 9 and 9 of
Elliott's Sub -division of the west one-half of Outlots 4 and 5 of Cummings

Addition.and the north 110 feet of Lots 8 and 9 less the west 88 feet thereof in
Elliott's Sub -Division changed from a residential to a multiple dwelling zone were
each read and upon motion by Morris, second by Schroeder, the same were referred to
the Board of Zoning.
A petition from the Hawthorne P.T.A, requesting that hand operated
flashing stop sign w be placed at the suggested•corners of 9a or loth Street at
3rd Avenue S. E. and 7th Street at 3rd Ave. S. E. was read and upon motion by
Schroeder, second by Morris, the said petition was referred to the Police Committee
and the Chief of Police with power to act.
The petition of -Max Klingsporn to have the real estate described as
follows annexed to the City of Rochester was read and upon motion by Schroeder,
second by Morris, the same was. -referred to the Street & Alley Committee, the Sewer
Committee, the Water Committee, the Public Grounds Committee and the City Engineer:
"Commencing at the Northeast corner of the Northwest quarter of
Section.No. three (3) in Township No. one hundred six (106) North
of Range No. fourteen $14) West and running thence -South along
the east line of said Northwest quarter one hundred ninety nine
and 5/10 $199.5) feet for a place of beginning, thence West
parallel with. the North line of said Section ninety nine (99.) feet,
.thence south parallel with the East line of said Northwest quarter
a distance of one hundred forty seven (147) feet to the North line
of Third Street Southwest, thence Southeasterly along the North
line of said Third Street Southwest to the East line of said
Northwest quarter,, thence North one hundred seventy.nine and 5/10
(179.5) feet to the place of beginning.l!
The report of the Steering Committee on parking and traffic regarding
the parking of automobiles on certain streets within the City was read and after
discussion on the matter am motion was made by Schroeder, second by Whiting, that
the report be referred to the City Attorney to prepare an ordinance ingbrpbrating tj
recommendations of the said Steering Committee on parking and traffic and upon roll
call all voted in favor of the motion, es:cept Alderman Moody who voted "no".
The report of the City Weighmaster for the month of April, 1954 showing
fees collected for loads weighed $149.00 was read and President Bach referred the
same to the ' Finance Committee.
The report of the City Treasurer for the month of April, 1954 was read
and President Bach ordered the same placed on file.
The reports of the Clerk of Municipal Court for the week ending May 8,
1954 showing total criminal fines and costs collected $2,047.00 and .civil fees
received $1.40; for the week ending May 15, 1954 showing total criminal fines and
costs collected $3,759.00 and civil fees received $6.40 and for the week ending
May 22, 1954 showing total criminal fines and costs collected $1,045.50 and civil
fees received $3.30 were each read and having been approved by th.e City Attorney,
President Bach ordered the same placed on file.
The applications of Clarence SteiAhagen, Maid Rite Cafe, Charles Rouillarc
E. H. Klopp (2), Harley E. Davis, herb Thienell and Lester Decker for license to

sell cigarettes were each read and upon motion by Moody, second by Morris, the
licenses were granted.
The applications of Clarence Steinhagen, Maid Rite Cafe, Charles
Rouillard, E. H. Klopp (2), Harley E. Davis, Herb Thienell and,Fester Decker for
license to sell soft drinks were each read and upon motion by Morris, second by
Ackerman, the licenses were granted.
The application of Howard Unger for a permit to move a house over certain
streets in the City of Rochester was read and upon motion by Ackerman, second by
Morris, the permit was granted, the said.building to be moved under the super-
vision of the Building Inspector and the Chief of Police.
The application of E. J. Armit for a license to construct cement work,
sidewalks, etc. was read and upon motion by Whiting, second by Ackerman, the
.license was granted.
The application of Hewitt and Finley for a license to construct cement
work, sidewalks, etc. was read and upon motion by Whiting, second by Ackerman,
the same was referred to the City Engineer.
The application for transfer of "on sale" 3.2 beer license No. 919 and
"off sale" 3.2 beer license No. 1547 from Margaret Walker to Harley E. Davis
was read and upon motion by Anderson, second by Moody, the transfer was granted.
The official bonds of Merlin Mewhorter, Jr. in the amount of $500.00
with the Fidelity & Casualty Company as surety and James A. Waters in the amount
of $2,000.00 with the Maryland Casualty Company as surety and the license bonds
of Joseph Cozik and Vincent Huyber each in the amount of $1,000.00 with the
Aetna Casualty and Surety Company as surety were each read and upon motion by
Morris, second by Anderson, the bonds were approved, the surety thereon accepted
and the* same were ordered placed on file.
The contractbonds of C. C. Pagenhart in the amount of $74,900.00 with
the Seaboard Surety Company as surety; Squires Electric Company in the amount of
$4,599.00 with the American Surety Company as surety; and Doyle Conner Company (4)
in the amounts of $3, 969.60; $3, 929.25; $2, 662. 30 and $2, 3g6.00 with the western
Surety Company as surety were each read and upon motion by Morris, second by
Anderson, the same were referred to the Mayor.
The following resolution were each introduced and read and President
Bach declared the same duly passed and adopted:

salaries therefor. No action was taken on the resolution. Alderman Anderson
moved that the employment of a Golf Course Ranger be approved at a salary of
$150.00 per month. Alderman Morris seconded the motion and all voted in favor of
same.
Resolution authorizing the Public Utility Board to enter into contract
with the General Electric Supply Company. Upon motion by Anderson, second by
Morris, resolution adopted.
Resolution accepting the -collateral of the Olmsted County Bank & Trust
Company in lieu of a depository bond. Upon motion by Moody, second by Morris,
resolution adopted.

The matter of a settlement for condemned lands belonging to Mohn &
(Hodge and Chester Johnson on 3rd Avenue Southeast between 3rd and 4th Street was
again discussed and the same was referred to the City Attorney for further
information.
Upon motion by Schroeder, second by Whiting, the Mayor, the members of
the Council, the Engineer, the City Clerk, the City Attorney and other department
reads were authorized to attend, at city expense, the convention of the Minnesota
League of Municipalities, to be held at Moorhead, Minnesota on June 9-12, 1954.

An Ordinance annexing to the City of Rochester, Minnesota., a part of
the West z•.of the Southeast of Section 25, Township 107 North of Range 14 'West
in.Olmsted County, Minnesota, to be -known and designated as Jefferson Slopes
Rochester, Minnesota, was given its third and final reading.
Upon motion by Morris, second. by. Schroeder, that the said ordinance be
adopted as read, and all voting in favor thereof, President Bach declared the sa
ordinance duly passed and adopted.
Upon motion by Whiting, second by Ackerman, that the rules be suspended
and upon roll call and all present voting in favor thereof, an ordinance
specifically repealing certain ordinances which are now obsolete or which hereto-
fore have been repealed by implication was given its third and final reading.
Alderman Morris wgs absent at the time the vote was - taken.
Upon motion by Ackerman, second by -Anderson, that the said ordinance be
present
adopted as read, and all/voting in favor thereof, President Bach declared the said
ordinance duly passed and adopted. _
Upon motion by Anderson, second by Schroeder, that the rules be
suspended and upon roll call and all present voting in favor -thereof, an ordinance

The City Clerk read a letter received from the -Beach Refrigerator Co.
of Flushing 59, New York, N. Y. stating that they were interested in buying used
equipment ( refrigerators, ranges and heaters) from discontinued housing projects
and the City Clerk was instructed to notify the said Company of the new and used
equipment from the housing project which the City now has for sale.
Upon motion by Whiting, second by Ackerman, Mr. Walter $ogenson was
authorized to attend the annual meeting of the Central -States Sewage Industrial
Waste Assn. to be held at Richmond, Indiana on June 24-26, 1954. at city expense.
Upon motion by Ackerman, second by Whiting, the meeting was adjourned
until 3: 30 o'clock P. M. on June 2, 1954.
