President•Bach called the meeting to order at 2:00 o'clock P. M., the following members. being present: President Bach, Aldermen Ackerman, Anderson, Moody, Morris, Schroeder and Whiting. Absent: None. Upon motion by Ackerman, second by Moody, ' the minutes of the meetings of May 24th, May 28th and June 2nd, 1954 were approved. President Bach stated this as being the time and place set for the following hearings: First hearing on the construction of a base course and bituminous surfacing on 3rd Avenue Southwest from 1st to 2nd Street Southwest. There was no one present wishing to be heard. First hearing on the construction of a curb and gutter, base constr- uction and bituminous surfacing on 4th Avenue Southwest from 3rd to 4th Street Southwest. There was no one present wishing to be heard. First hearing on bituminous surfacing of 2nd Avenue Southwest from West Center Street to lst Street Southwest. There was no one present wishing to be heard. Second hearing og grading and surfacing and the construction of a sanitary sewer and watermain in 13th Avenue Northwest, 14th Avenue Northwest and 14th Street Northwest in Bielenberg & Giese Second Addition. There was no one present wishing to be heard. Second hearing on grading and surfacing and construction of a sanitary sewer and water main in Graham Court Southeast, East of 15th Avenue Southeast. There was no one present wishing t.o be heard. Second hearing on the grading and surfacing of 9th and loth Streets Northeast from 19th Avenue Northeast to the east line of Miner's Third Addition. Mr. John Miner was present at the meeting and objected to a re -assessment against a portion of 1-.is property abutting on the project. After hearing Mr. Minerle objections to a re -assessment, a motion was made by Whiting, second by Ackerman, that the City pay one-half of the new assessment and Mr. Miner pay the balance. All voted in favor of the motion except Alderman Moody and Alderman Schroeder, who each voted "no". Second hearing on the construction of a sanitary sewer and water main in 19th Avenue Northeast from 9th to loth Street Northeast and in 9th and loth Streets Northeast from 19th Avenue to the east line of Miner's Third Addition. There was no one present wishing to be heard. Second hearing on the. construction of a curb and gutter in loth Street • • Southeast from 5th to 6th Avenue Southeast. There was no one present wishing to be heard. The -bids of C. M. Boutelle in the amount of $2,659,10 and .Doyle Conner Company in the amount of $2,715.20 were each received and opened and upon motion by Schroeder.' second by Ackerman, the same were referred to the Street & Alley Committee and the City Engineer for tabulation and report. Boutelle for construction of a curb and gutter on 9th Street ?northeast from lst to 2nd Avenue Northeast be accepted at the unit prices bid and checks be returned to the unsuccessful bidder was read and upon motion by Schroeder, second by Ackerman, the recommendation was approved. Bids for the construction of a scale house. The bids of C. C.agenhart in the amount of $4,265.00 and Alvin E. Benike in the amount of $4,295.00 were each received and opened and upon motion by Ackerman, second by Whiting, the same were referred to the Public Grounds Committee and Harold h. Crawford, Architect for tabulation and report. The recommendation of the Public Grounds Committee that the bid of C. C. Pagenhart for the construction of a scale house be accepted at the price bid and checks be returned to the unsuccessful bidders was read -and upon motion by Ackerman, second by Anderson, the recommendation was approved. Bids for furnishing 1000 parking meters (more or less). The bids of Magee -Hale Park-O-Meter Company in the amount of $45,066.00 and The Dual Parking Meter Company in the amount of $41,390.00 were each received and opened and upon motion by Schroeder, second by Whiting, the same were referred to the Police Cheif and the Police Committee for tabulation and report. Mr. Maurice J. Tobiasof the Dual Farking Meter Company was present at the meeting and stated that his company did not receive a notice of bids in time to submit samples and a written proposal, their proposal had been previously received by'telegram. After hearing Mr. Tobias a motion was made by Alderman Whiting, second by Alderman Moody, that all bids be rejected, certified checks returned and that the Council re -advertise for parking meters, a notice of the advertisement to be published in the Construction Bulletin at Minneapolis and in the Roehester.Post Bulletin. The said bids to be received at 7:30 O'clock P. M. on June 21, 1954. Bids for the sale of the house located at 112 First Street Southeast. The all salvage bids of Milton Wood in the amount of $150.00, Wilbert Rueb to.re..ceive'$250:00'and all salvage and Sam Rueb :to. r'eceive- �$-50:.00and/., were each received and opened and upon motion by Schroeder, second by Ackerman, the same were referred to the Public Grounds Committee and the City Engineer for recommendation and re -port. The recommendation of the Public Grounds Committee and the City Engineer 0 62 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., June 7. 1954 • that the bid of Milton Wood for sale and removal of the McGoon house and garage at 112 First Street Southeast be accepted at the price bid, and checks be returned to the unsuccessful bidders, was read and upon motion by Ackerman, second by Schroeder, the recommendation was approved. The following recommendation was read and upon motion by Anderson, second by Ackerman, the same was approved: "Honorable Mayor & Common Council City of Rochester, Minnesota Gentlemen: We, the undersigned recommend that the request .of Max Klingsporn of May 24, 1954, for the annexation of -the 99 ft. frontage on 3 Street Southwest in NWi Sec. 3-T.106-14 be granted. We further recommend that, inasmuch as sanitary sewer and water mains have been laid in 3rd Street fronting this property, the property be assessed a sewer connection charge equal to the assessment levied against other abutting property for this improvement. This assessment was $6.22 a front foot for sanitary sewer. We recommend that this charge of $615.79 be made a condition of, and payable upon annexation. Respectfully, Street & Alley (A• G. Armstrong, City Engineer" The recommendation of the Street & Alley Committee that 19th Avenue Northeast from 9th to loth Street Northeast be regraded and surfaced was read and upon motion by Anderson, second by Schroeder, the recommendation was approved. The following recommendation was read and upon motion by Whiting, second by Schroeder, the same was approved: "Honorable Mayor & Common Council City of Rochester, Minnesota Gentlemen: We, the undersigned, recommend that it is not feasible at this time to construct a sanitary sewer and water main on the South 364.92 feet of the West 162.9 feet of the Southeast 2 Sec.•34-107-14 West (Johnson's Service Station on Second Street S. W. and 17 Avenue S. W.). To serve tl+is tract with sewer and water requires the extension of the existing mains 200 feet West under Trunk Highway 52 and approximately 970 feet South (660of which is outside the City limits). It is the judgement of this Committee that the project cannot be constructed until it is requested by an area sufficiently large to bear the cost. Campbell to have the following described property changed from .a residential to a multiple dwelling zone be granted was read and upon motion by Schroeder, second by Moody, the recommendation was approved -and the City Clerk was instructed to publish notice of hearing on the zoning change, said hearing to be held at 7: 30 o'clock P. M. on June 21, 1954: "Tract No. 1. M. on June 21., 1954: "The west 65 feet of the north 150 feet of Outlot 7 in Cumming's Addition. Also beginning at the northwest corner of said Outlot, thence east along the north line of said Outlot a distance of 65 feet, thence north 23 feet to the south. -line of Center Street West, thence west a distance of 65 feet, thence south to place of beginning." The recommendation of the Board of Zoning that the petition of Libby, McNeil & Libby to have Lot 27, Block 11, Sunnyside Addition changed from a residential to a commercial zone be granted was bead and upon motion by Anderson, second by Moody, the recommendation was approved and the City Clerk was instructei to publish notice of hearing on the zoning change, said hearing to be held at 7: o' clock P. M. on June 21, 1954. The recommendation of the Board of Zoning that the petition of Maurice Alexander to have Lot 9, Block 36, Morse & Sargeants Addition changed from a residential to a multiple dwelling zone be granted was read and upon motion by Schroeder, second by Anderson, the recommendation was approved and the City Clerk was instructed to publish notice of hearing on the zoning change, said hearing to be held at 700 o'clock P. M. on June 21, 1954. A letter from the Board of Public Health & Welfare transmitting a copy of a resolution on fluoridation adopted by their Board on May 7, 1954 were each read and President Bach ordered the same placed on file. Noticesfrom the Cascade Township Board of Health requesting the City to make application for permits to operate the Sewage Disposal Plant and the City Dumping Grounds in Cascade Township were each read and upon motion by Schroeder, second by Ackerman, the same were referred to the City Attorney and the City Clerk to be completed. The City Engineer's preliminary estimate for the construction of a curb and gutter on loth Street Southeast from 5th to 7th Avenue Southeast in the amount of $2, 996. 65 for contract items and $2, 195.00 for non -contract items was read and President Bach ordered the same placed on file. The City Engineer's preliminary estimate for the construction of a sanitary sewer and water main in Bielenberg and Giese 2nd Addition in,the amount of $6,118.75 for sanitary sewer and $9,450.95 for water main was read and President Bach ordered the same placed on file. 64 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., June 7, 1954 • The City Engineers recommendation that a cement contractors license Ibe granted to Hewitt and Finley was read and President Bach ordered the same placed on file. An order issued by M. J. Roffman, Commissioner of highways, designating (detour for Highway No. 63 during construction operations was read and President lBach ordered the same placed on file. A letter from the Minnesota League of Municipalities giving the date of June 10 for discussion of Revenue Legislation at the convention to be held at Moorhead was read and the same was ordered placed on file. A notice from the Police Civil Service Commission that Robert Radam has been certified for permanent duty as of June 1, 1954 on the Rochester Police Department was read and upon motion by Anderson, second by Schroeder, the recommendation was approved. A letter from the Rochester Fire Fighters Association notifying the Council that Mr. Ray Harvel had been appointed to act on the arbritation committee was read and President Bach ordered that the same be placed on file. The request of the Board of Park Commissioners to have the parking lot at the auditorium resurfaced and that the expense be paid from the Parking Meter Fund was read and upon motion by Schroeder, second 'by Morris, their r'equbst was referred to the Street & Alley Committee and the City Engineer. The request of the Board of Park Commissioners that the Council approve a contract for insulation of a surge tank and piping at the Mayo Civic Auditorium, net price being in the amount of $797.00, was read together with their letter requesting that the payment of this contract be made from the Permanent Improvement (Fund. President Bach ordered the same placed on file: The request of Frank W. Everett, Chief of the Fire Department, for permission to send two men to the State Fire Department Association's Seventy Ninth Annual Convention to -be held in Hibbing on June 14, 15 and 16, 1954 was read and upon motion by Ackerman, second by Morris, two members of the Fire Department were authorized to attend the convention at city expense. The petitions of Joe Gores for the grading of streets in Jefferson (Slopes and the construction of a sanitary sewer and water main in Jefferson (Slopes were each read and upon motion by Whiting, second by Schroeder, the same were referred to the Street & Alley Committee, the Sewer Committee, the Water Committee and the City Engineer. A quotation from the Beckley Business Equipment Company on chairs for the Chief of Police and the Council•Committee room was read and upon motion by Writing, second by Moody, the same was referred to the Purchasing Committee. Mr. Glenn Ranfranz and Mr. q. S. Patterson were present at the meeting 1 • 1 CJ and objected to the removal of parking on both sides of llth Avenue Northeast. • Record of Official Proceedings of the Common Council 65 , of the City of Rochester, Minn., June 7 - 19 54 1 • • Also Mr. Dwight Campbell, who operates a grocery store at 623 East Center Street, was present and discussed the matter of the parking of cars at the location of his st ore. Judge Irving L. Eckholdt requested that the Council approve the purchase of a typewriter for his office. Upon motion by Schroeder, second by Ackerman, his request was granted. The report of the City Weighmaster for the month of May, 1954 showing fees collected for loads weighed in the amount of $97.55 was read and President Bach referred the same to the Finance Committee. The reports of the Clerk of r,unicipal Court for the week ending May 29, 1954 showing total criminal fines and costs collected $1,166.05 and civil fees received $2. 2 5 and for the week a nding June 6, 19 54 showing total c riminal fines and costs collected $990.00 and civil fees received $4.70, were each read and raving been approved by the City Attorney, President Bach ordered the same placed on file. The applications of Robert W. Sawinski and Ernest A. Clark for Journeyman Electricians -License were each read and upon motion by Ackerman, second by Anderson, the licenses were granted. The applications of Fred T. Hanel, Wilbur Vieths, Warner Johnson and Kenneth W. Stender for a Journeyman Warm Air Heating, Ventilating and Air Conditioning Worker's License were each read and upon motion by Moody, second by Morris, the licenses were granted. The application of J. G. Bakula-for a Journeyman Plumbers License was read and upon motion by Ackerman, second by Morris, the license was granted. The application of the Wm. T. McCoy Post No. 92 for a permit to sell soft drinks and a. military -style sun helmet as a souvenir of the Convention, at the parade of the First District Convention of the American Legion to be held on June 13, 1954 was read and upon motion by Whiting, second by Schroeder, the permit was granted. The contract bonds of C. M. Boutelle & Son in the amount of $6,390.00 with the Western Surety Company as surety and Carlisle G. Fraser in the amount of $2,376.30 with the Federal Insurance Company as surety were each read and the same were referred to the Mayor for his approval. President Bach read a letter transmitting the following request from the employees at the Sewage Disposal Plant and the same were ordered placed on file: "The honorable Mayor and Common Council City_ of Rochester, Minnesota Gentlemen: We are aware that certain organized groups of City Employees are now asking that the matter of wages and salaries for these groups be submitted for arbitration. We, the undersigned employees of the Sewage Treatment Plant, are not a part of any organized group, nor are we asking at this time that our salaries be submitted for arbitration. Rochester, Minn., June 7, 19 54 E shall be determined by you, as the result of arbitration decisions or otherwise, that a cost -of -living increase is justified for other City Employees, that we also be given the same consideration, even though you feel that certain other salary adjustments previously requested can not be grant ed. Resolution acceiting bid of Milton Wood for the sale of the house at 112 First Street Southeast. Upon motion by Moody, second by Morris, resolution adopted. Dr. Frank Armstrong introduced Dr. Cleve Grueber who:,presented statistics and spoke in opposition to the fluoridation of the water supply in the City. Also Dr. Viktor 0. Wilson, Health Officer, Dr. H. M. Helmholz and Dr. Jos. C. Fawcett were present and urged that the resolution on fluoridation of the water supply be adopted-. No action was taken on the matter at this meet ing. The matter of more room for the Municipal Court Office was again brought to the attention of the Council by Judge Eckholdt. A motion was made by Alderman Anderson, second by Alderman Morris, that the Community Chest be notified that the City wished to use the room now occupied by their office as soon as they could find suitable quarters for their office. All voted in favor of the motion. A request was made to the Council for permission to send seven men from the Police Department to a convention and pistol shoot at Winona to be held on June 21st and 22nd. Upon motion by Morris, second by Moody, tle attendance of seven men from the Police Department was authorized at city expense, Alderman Moody stated that he had recieved a request for a street light on 7t11- Street Southeast between Broadway and 1st Avenue and upon motion by Morris, second by Ackerman, the same was referred to the Lighting Committee wi.th power to act. Alderman Schroeder suggested that the Clerk be instructed to write the various organizations and individuals who participated in making the Elks Centennial Parade a success on June 5, 1954. A motion was made by Schroeder, second by Ackerman, instructing the City Clerk to write the following organization and express to them the appreciation of the members of the Council for their efforts in making the Elks Centennial Parade a success on Saturday afternoon, June 5th: Mr. Pal Thede, Chairman of the combined Elks Centennial Parade Committee, which consisted of the following members. Paul A. Grassle, Sr., Ernest Schlitgus, Leonard Ekstrand, Don Binderim, Harold Cooke, A. J. Lentfer and Bert Ballou, who served on�the City Committee. Robert Moores, Willard Wade, Charle-s Jones, Richard Jones, Harry Nunamaker and William Barden, who served as members of the Committee from the Elks Lodge. Colonel Turner, in charge of Military Police; Mr. and Mrs. Carl Hooper and Mr. Joseph A. Rockenbach, in charge of Red Cross; the Minnesota Highway Patrol; Company C, National Guard, under Captain Smith and Captain Elmo Holets, who directed the line o-f march in the parade; the Eagles Lodge, under the supervision of Mr. Lloyd Stoddard, for serving the meals to those who took part in the parade; the Rochester Chamber of Commerce; the Rochester Public Schools; Mr. C. C. Pagenhart, who supervised the construction of the reviewing stand and the members of the American Federation of Labor, who constructed the stand; the Rochester Bus Company, Inc. who either vacated the streets in the line of parade or re-routed their lines; the Rochester Churches, who made their facilities available for the comfort of guests at the parade; together with the following City Departments, the Rochester Department of Parks, the Rochester Police Department, the Rochester Fire Department and the City Engineer's Department.
