of the City. of Rochester, Minn., June 28, 19 54 •
Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall in
said City on June 28, 1954.
President Bach called the meeting to order at 7:30 o'clock P. M., the
following members being present: President Bach, Aldermen Ackerman, Anderson,
Moody, Morris, Schroeder and Whiting. Absent: None.
Upon motion by Schroeder, second by Moody, the minutes of the meeting
of June 21, 1954 were approved.
The recommendation of the Street & Alley Committee that the owners be
permitted to do the rough grading of 13th Avenue and 15th Street Northeast in

Jefferson Slopes Addition, under the supervision of the City Engineer, was read
and upon motion by Ackerman, second by Anderson, the recommendation was approved.
The recommendation of the Street & Alley Committee that the finish
grading, base and bituminous surfacing of 3rd Avenue Northeast and 17th Street
Northeast in Huey & Raynolds Addition be done was read and upon motion by
Moody, second by Schroeder, the recommendation was approved,
The recommendation of the Parking and Traffic Steering Committee that
the steps necessary to improve Third and Fourth -Avenue Wes.t from Soldiers Field
to Second Street N. W. to use them as a one-way pair be taker_ as soon as possible
was read and held for future reference.
A petition for the construction of a water main in 132 Street Northwest
between Broadway and 2nd Avenue Northwest and to connect with trunk line sanitary
sewer in place in 132 Street Northtest and a petition for grading and. surfacing
1'2 Street Northwest between Broadway and 2nd Avenue Northwest were each read
and upon motion by Morris, second by Moody, the same were referred to the Sewer
Committee, the Water Committee, the Street & Alley Committee and the City Engineer.
President Bach stated that he had noted at a number of intersections in
the City that hedges had grown to a heighth which interferred with the view at
the corner of various intersections and especially at the intersection of 6th

Street and 9th Avenue Southwest. He was advised by the Chief of Police that this
hedge had now been trimmed. He also stated that he had received calls regarding a
four way stop on East Center Street at 7th Avenue. The Chief of Police told him
that this complaint had been investigated on previous dates and he did not feel
that a four way stop was necessary at thie location.
The report of the Clerk of Municipal Court for the week ending June 26,
1954 showing total criminal fines and costs collected $992.00 and civil fees
received $1.30 was reed and having been approved by the City Attorney, President
Bach ordered the same placed on file.
A report of the Fact Finding Commission setting forth the results of a
study made on the salaries of the members of the Rochester Fire Department was

read. A motion was made by Schroeder, second by Whiting, that this report be
carried as. unfinished business. All voted in favor of the motion.
The contract bonds of Leon Joyce in the amounts of $1,110.70 and
$1,270.00 with the Seaboard Surety Company as surety and Carlisle G. Fraser in thel
amounts of $5, 617.80, $15, 306. 20 and $9, 829.70 with the Federal Insurance Company
as surety were each read and the same were referred to the Mayor for his approval.
President Bach appointed the following Council members to serve on the
Board of. Equalization for the 'balance of the fiscal year: Alderman A. G. Whiting,
Alderman Thomas A. Moody and Alderman Raymond C. Schroeder.
The following resolutions were each introduced and read and President
Bach declared the same duly passed and adopted:
Resolution ordering the first hearing on the finish grading, base and
bituminous surfacing of 3rd Avenue Northeast and'17th Street Northeast in Huey and
Reynolds Addition. Upon motion by Anderson, second by Morris, resolution adopted.
Resolution ordering first -hearing on repaving of' First Avenue Southwest
from West Center Street to Second'Street Southwest. Upon motion by Moody, 'second
'by -Morris, resolution adopted.
Resolution appropriating $601.00 from the General' Fund and ordering
payment made to Board of Park Commissioners. Upon 'motion by Morris, second by
Schroeder, resolution adopted.
Resolution a.ppropria:ting $572.41 from the General Fund a.nd $17.`65 from
the Fire Protection Fund and ordering payment made to Rochester"Electric Company,
$290.06 and Lysne-Construction.Company, $300.00.• Upon motion'by Schroeder, second
by Whiting, resolution adopted.
Resolution appropriating *$3316.78 from the' Parking Meter Fund and* $215.9C
from the Sewer Fund and ordering payment made to Municipal Equipment Co., $215.90
and Doyle Conner, $336.78. Ugon'motion by Whiting, second by Anderson, resolution
adopted. -
Resolution appropriating $16 818. 0 from the Sewer Fund' �- 9 and ordering
payment made to the Sinking Fund of the City of Rochester. upon motion by Anderson
second by Moody, resolution adopted.
Resolution approving joint proposal of Rochester Board of Public Health
and Welfare and the Olmsted County Board of Health regarding salaries of Health
Officer and Health -Educator. Upon motion by Moody,'second by Morris, resolution
adopted.
Resolution appropriating $506.00 from the General Fund and ordering
payment made to Richard Manahan,'$300.00'a.nd Claude H. McQuillan, $�0.0.00. Upon
motion by Morris, second by Schroeder, resolution adopted.
Resolution -fixing salary of stenographer -clerk in the City Assessors

office for -the ensuing fiscal year. Upon motion by Whiting, second by Ackerman,

resolution adopted.
Resolution amending the resolution setting the salary of the Clerk -
Typist Clerk Registration in the City Clerk's office. Upon motion by
and.of
Whiting, second by Ackerman, resolution adopted.
The following -claims were read and upon motion by Anderson, second by
Morris, the same were approved and the Mayor and City Clerk were authorized and
directed to draw warrants upon the City Treasurer and make payments accordingly:

The matter of appointing a new real estate board was, considered by the
Council and upon motion by Ackerman, second by Moody, President Bach and Alderman
Whiting were instructed to meet with the Real Estate Group and request their
recommendation as to the appointment of three members on the said Real Estate
Board from the membership of their organization.
An Ordinance amending an ordinance entitled, "An Ordinance for the
puxpose of promoting health, safety, order, convenience and general welfare by
regulating the use of land, the location, size, use and heightof buildings, and
the arrangement of buildings on lots, and the density of population within the
City of Rochester, Minnesota, all in accordance with a comprehensive plan", same
being No. 559, was given its first reading.
Upon motion by Ackerman, second by Schroeder, and upon roll cell and
all voting in favor thereof, the rules were suspended and the ordinance was given
its second reading.
Alderman Ackerman stated that he had received numerous reports from
people living on 16th Avenue Southwest and Northwest about papers and rubbish
being blown into the streets and on to their property from Miracle Mile. A
motion was made by Ackerman, second by Moody, that the Mayor and Alderman Morris
be instructed to notify the authorities at the Miracle Mile to abate the said
nuisance.
The matter of complaints regarding dust from the Gamble Robinson
Warehouse, the Northwest Terminal and other companies in that area was also taken
up at this time. A motion was made by Schroeder, second by Ackerman, instructing
the City Clerk to notify the companies mentioned and others in that vicinity to
take steps for the prevention of dust at their places of business.
Alderman Whiting brought up the matter of the care of trees on the
boulevards of the streets of the City. After discussing the matter, a motion was
made by Ackerman, second by Schroeder, appropriating an amount not to exceed
$500.00 to the Park Improvement Fund.for the removal of trees which are now a
definite hazard. The said expense to be paid from the General Fund. All voted
in favor of the motion.
Mayor MCQuillan stated that he had received a complaint from Mr. Frank C.
Schermerhorn of 505 - 6th Street Southeast that the assessments against his

property for the construction of sewer and water mains and the grading of streets

were excessive. Upon motion by Whiting, second by:Ackerman, the matter was
referred to the City Attorney for study and report.
Mayor McQuillan also brought up the matter of trucks traveling on 2nd
Street Southwest and over various other streets in the City which was very dis-
.turbing, to residents on these truck routes. Upon motion by Schroeder, second by
Morris, the matter of truck routes within the City limits was referred to the
Traffic and Parking Commission,
The matter of setting up an ordinance which would govern the holding of
sales in the business section of the City was also brought to the attention of the
Council by the Mayor. A motion was made by Morris, second by Ackerman, that the
Mayor procure sample ordinances from the Teague of Minnesota Municipalities and
other Cities which have been adopted, governing sales in Cities.
Upon motion by Morris, second by Ackerman,,the meeting was adjourned.
