President pro tem Morris called the meeting to order at 4:45 o'clock P.M., the following members being present: Aldermen Ackerman, Anderson, Moody, Morris, Schroeder and Whiting. Absent: President Bach. The call of the special meeting was read and President pro tem Morris ordered the same placed on file, the said meeting having been called for the purpose of considering a resolution recommending to the Board of Freeholders (Charter Commission), for their consideration, certain amendments to the Charter of the City of Rochester, Minnesota, and any other business the said Common Council may deem proper. A resolution recommending the following amendments to the Charter ofthe City of Rochester to the Board of Freeholders (Charter Commission) for their con- sideration was introduced and read: AMENDMENT NO. 1 Amend Section 94 of the Charter of the City of Rochester, Minnesota so that the said section, as amended, shall read is its entirety as follows: "Section 94. The President or, in his absence, the President'Pro Tem, shall preside at meetings of the Common Council. Each alderman, including the presiding officer',, shall have one vote on all matters." AMENDMENT NO. 2 Amend Sections 110 and 111 of the Charter of the City of Rochester. Minnesota so that the said sections, as amended, shall read in their entirety as follows: "Section 110. The City Clerk shall have power to administer oaths, and affirmations and take the acknowledgment of deeds and other writings. He shall keep a record of all his acts and doings, which record shall be at all times open to the inspection of all parties interested. He shall retain in his possession all records, files, books and papers incident to, his office, and shall not allow them to, pass from his possession -except under the direction of the Common Council. He shall receive for his services such sum as the Common Council shall deem proper. "A Deputy City Clerk shall be appointed by and serve at the pleasure of the City Clerk. Such appointment shall be effective from and after confirmation by the Common Council. In the event the Position of Deputy City Clerk remains vacant for a period of 30 days or more, the Common Council may appoint a suitable person to fill. such -position. When appointed by the Common Council, the Deputy City Clerk may be removed by the City Clerk with the consent of the Common Council. The salary of the Deputy City Clerk shall be fixed by the Common Council and shall be paid from City funds. The Deputy City Clerk shall perform such duties as may be assigned to him by the City Clerk and, subject to the direction and control of the.City Clerk, shall exercise all. the powers and authorities of the City Clerk." "Section 111. All fees received by the City Clerk from private individuals ' for filing and recording papers and for other services shall be paid over'to the City Treasurer and be the property of the City. " AMENDMENT N 0. 3 Amend Sections 163 and 164 of the Charter of the City. of _Roches -ter, Minnesota as follows by adding to Section 163 imme diately after subdivision "Fifteenth" the new paragraph set forth below to be numbered subdivision "Sixteenth"; and by addition to Section 164, at 0 too Record of Official Proceedings of the Common Council of the City of Rochester, Minn., July 9. 19 54 the end thereof, the new paragraph set forth below: "Section 163. "Sixteenth. A police Fund, into which shall be.paid all taxes levied by the Common Council for the purpose of providing police protection and services for the city. e "Section 164. "For the Police Fund, so much as may be necessary to provide adequate police protection and services for the city." AMENDMENT No. 4 Amend Sections 275 and 276 of the Charter of the City of Rochester,. Minnesota so that the said sections, as amended, shall read in their entirety as follows: "Section 275. All contracts for commodities or service to be furnished or performed for the City, or any department thereof involving an • expenditure of more than Fifteen Hundred Dollars ($1500) shall be made as in this chapter provided, and not otherwise. The words "commodities" and "service" as used in this chapter, shall be construed to include all work, labor, materials, supplies or other property and all lighting and other service, and all local or public improvements, but shall not include the employment of City officers and employees and the setting of their salaries, the employment of independent professional services, and the purchase of real estate. The word "contract" as used in this chapter, shall be construed to include every agreement, in writing or otherwise, executed or executory, by which any commodities, work or service are to be furnished to or done for the City, and every transaction whereby an expenditure is made or incurred on the part of the City or any department or any officer thereof, except contracts for the employment of City officers and employees -and the setting of their salaries, contracts for the employment of independent professional services, and contracts for the purchase of real-estate. "Ali action in this chapter required.or authorized to be taken by the Common Council shall be.by resolution or ordinance. If the proposed contract be in the hands of a Board, under this Charter, this Board shall take the same proceeding as herein provided for the Common Council, and the Clerk or Secretary ofsuch Board shall do those acts in relation to such contract as are provided by this chapter to be done,by the.City Clerk if the letting of the contract were in the hands of the Common Council." "Section 276. "The First step toward making such a contract; shall be for the Common Council or Board charged with the duty of making such contract, to have the cost of the proposed commodity, work orservice to be estimated and determined by such officer, employe or other person or persons as it shall deem best. "If such estimated cost does not exceed fifteen hundred dollars ($1500) the Common Council or Board, in whose hands the matter may be, may direct that the commodities, work or service be procured by or through the proper department or officer, without advertisement and public bids." • Upon motion by Ackerman, second by Anderson, and all voting in favor thereof, that the said resolution be adopted, President pro tem Morris declared the said resolution duly passed and adopted. A resolution requesting the services of the Minnesota Department of Employment and Securities to conduct a survey and job analysis of the -Municipal Employees of the City of Rochester, Minnesota, was introduced and read and upon motion by Anderson, second by Schroeder, that the said resolution be adopted as read, President pro tem Morris, declared the said resolution duly passed and adopted. Upon motion by Whiting, second by Ackerman, theCity Clerk was instructed to prepare a certified copy of the resolution requesting the services of the • Record of Official Proceedings of the. Rochester, Minn., July 9. 19 54 Iq lot 1 • • 1 Minnesota Department of Employment and Securities and Alderman Schroeder was authorized to meet with a representative of that department together with the Mayor in his office. A resolution rescinding the resolution adopted by the Common Council on July 6, 1954 ordering the first hearing on construction of a sanitary sewer on'. 14th Street Northwest from 3rd to 5th Avenue Northwest and on 5th Avenue Northwest) from llth to 14th Street Northwest was introduced and read and upon motion by Schroeder, second by Whiting, that the said resolution be adopted as read, and all voting in favor thereof, President pro'...tem Morris declared the said resolution dull a passed and adopted. Upon motion by Anderson, second by Schroeder, a motion adopted by the Common Council on July 6, 1954 ordering the Sewage Disposal Plant Construction Funi encumbered in the amount o.f •$18,000.00 for sewer construction was rescinded in its entirety. It was brought.to the attention of the Common Council that rubbish and garbage was littered along 2nd Avenue Northwest in the vicinity of 14th Street. A motion was made by.Schroeder, second.by Ackerman, that the matter be referred to the Public Grounds Committee with power to act, together with the matter of trimming the brush and trees in that locality. Upon motion by Ackerman, second by Schroeder, the meeting was adjourned. City Clerk L�
