HomeMy WebLinkAbout07-19-1954r102 Record of Official Proceedings of the Common Council of the City of, Rochester, Minn., July 19, 19 54 0 Minutes of an adjourned regular meeting of the Common Council of the City lof Rochester, Minnesota, held in the Council Chambers, in the City Hall in said City, on July 19., 1954. Upon motion by Schroeder, second by Whiting, Alderman Anderson was Jappointed as President pro tem of the Common Council in the absence of President (Bach. All voted in favor of the motion. President pro tem Anderson called the meeting to order at 7:30 o'clock IP.M., the following members being present: Aldermen Ackerman, Anderson, Moody, (Morris, Schroeder, and Whiting. Absent: President Bach. President pro tem Anderson stated this as being the time and place set for the following hearings: First hearing on construction -of a sanitary sewer and water main and Ifinish grading and bituminous surfacing on 13th Avenge Northeast and 15th Street Northeast in Jefferson Slopes. There was no one present wishing to be heard. First hearing on grading, surfacing and construction of a water main in l31*Street Northwest from Broadway to 2nd Avenue Northwest. Mr. Franklin Michaels, representing the Aldrich Memorial Nursery, was present and stated that the Nursery building was being moved to 134 Street in the near future and urged that the improvement be made as soon as possible so nursery school could be started on the scheduled date. Mr. George Henke was also present and stated that he felt the improvement should be assessed against both sides of 1A Street and not only on the north side of 1A Street. First.hearing on construction of a sanitary sewer, water main, sewer and water service connections, finish grading and bituminous surfacing on 7J Avenue Northeast, Sth Avenue Northeast and Northwood Drive in Northwood Addition. There was no one present wishing to be heard. Second hearing on finish grading, base and bituminous surfacing of 3rd lAvenue Northeast and 17th Street Northeast in Huey and Reynolds Addition. There was no one present wishing to be heard. Second hearing on repaving of lot Avenue Southwest from West Center 'Street to Second Street Southwest. The City Engineer's preliminary estimate in the amount of $36, 025.00 total estimated cost was read at this time and the same (was ordered placed on file. Miss Priscilla Wagoner was present and urged that any intended improvements in this area be done at this time. President pro tem Anderson stated this as being the time and place set for receiving and opening bids for regrading and surfacing in 19th Avenue Northeast from 9th to loth Street Northeast. The bid of Leon Joyce in the amount of $594- 70 was received and opened and upon motion by Whiting, second by Morris, the same was referred to the Street & Alley Committee and the City Engineer for 1 • 1 C� 1 tabulation and report. • Record of Official Proceedings of the Common Council of the City of. Olmsted County Safety Council stating that it had been called to,their attention that the railroad crossings at llth Avenue N. W. and the crossing at llth Avenue N. E. were dangerous because of existing hazards and that the signals were not adequate for these dangersous crossings was read and upon motion by Schroeder, second by.Ackerman, the same was referred to the Police Committee and the Mayor. The request.of Bernie Lusk for a year round permit for using a public address system on the streets of Rochester was read and upon motion by Ackerman, second by Schroeder, the same was referred -to the Police Committee and the Chief of Police. The request of Bielenberg & Giese for permission to 'install curb and gutter themselves in Bielenberg & Giese's First Addition was read and President pro ten Anderson ordered the same placed on file. The request of the Minnesota Railroad & Warehouse Commission for permission to hold a hearing,on the application of the Rochester Bas Line, Inc. for.an increase in its fares, in the Council Chambers in the City Hall at 10:00 A. M. on September 9, 1954 was read and upon motion by Schroeder, second by Ackerman, the same was approved and the City Clerk was instructed to notify them of the action taken. The request of Lyle W. Gardner -for a military leave from the Fire Department commencing on August 22, 1954, with pay, and extending to and.inclu September.5. 1954 to attend two weeks training camp at Camp McCoy was read and upon motion by Schroeder, second by Morris, his request was granted. The request of Clements Chevrolet Company for permission to conduct the centennial auto ramma parade on July 31, 1954� and displaying the cars between the hours of 4:30 and 7:00 o'clock on First Avenue between Second and Fourth Streets was.read and upon motion by Ackerman, second by Whiting, their request was granted. A letter from the State Department of Employment Security addressed to Alderman Schroeder wherein -it was stated that their job analyst,, -Roy Berg, would be able to give assistance in the job analysis program for the City, was read and President pro tem Anderson ordered the same placed on file. The Mayor's appointment of Mr. Lloyd goenig, of 622 - 3rd Avenue S. W. to the Police Civil Service Commission for three years, term to expire the second Monday in April, 1957 was read and upon motion by Schroeder, second by'Whiting, his appointment was approved. The request of Cranston Typewriter Store, Gopher Welding Supply Co. and Parkhill Brothers for the installation of two twelve minute limit meters between lot Avenue and 2nd Avenue Southwest on the north side of 4th Street Southwest 0 was read and upon motion by Whiting, second by Schroeder, the same was referred ® 4 Record of Official Proceedings of the Common Council of the City of, Rochester, Minn., July 19, 19 54 to the Steering Committee for study. A petition signed by William P. Schultz and Bernice E. Schultz to have 16th Avenue Southeast as It is now laid out and platted as a.public street in the plat of Willoyd's Subdivision vacated was read and upon motion by Whiting, second by Ackerman, the same was referred to the Planning & Zoning Commission, the Street & Alley Committee and the City Engineer. The petition of David Dee to have Lot 1, Block 3, D. P. Madden°s Addition changed from a residential zone to a commercial zone was read and upon motion by Morris, second by Schroeder,. the same was referred. to the Board of Zoning. A petition for grading and surfacing of 7* Avenue Northeast and Anderson Northwood Drive in Northwood Addition was read and President pro tem/ referred the same to the Street & Alley Committee and the City Engineer. A petition for the construction of a sanitary sewer and water main in A Avenue Northeast and Northwood Drive in Northwood Addition with service connections stubbed in was read and President pro tem Anderson referred the same to the Sewer and Water Committees and the City Engineer. A petition.for-the construction of a curb and gutter on 6th Street Southeast from 12.th to 13th Avenue Southeast was read and President pro tem Anderson referred the same to the Street & Alley.Committee and the Citay Engineer. A petition for the construction of a curb and gutter on 13th Avenue Anderson Southeast from 6th to 7th Street Southeast was read and President pro tem/referred the same to the Street & Alley Committee and the City Engineer. A petition for the construction of a curb.and gutter on 6th Street Southeast from the Bridge east to loth Avenue Southeast was read and President pro tem Anderson referred the same to the Street & Alley Committee and the City Engineer. A resolution providing for the fluoridation of the Bochestar Water Supply vetoed by the Mayor on July 8, 1954 was read together with his .veto message of same._ No action was taken at this meeting. The recommendation of the Street & Alley Committee that Bielenberg & Giese"s request to do.their own construction of concrete curb and gutter in Bielenberg & Giese First Addition be granted, with the provision that they provide qualified inspection and supervision of the work and be responsible for its construction in accordance to the plans and specifications, was read and upon motion by Ackerman, second by Moody, the recommendation was approved. The recommendation of the Chief of Police that a street light be placed on let Street Southeast, midway between 6th and 7th Avenues and on 14th Street Northeast at 2nd and 3rd Avenues was read and the same was referred to 1 1 • 1 the Lighting Committee with power to act. 41 Record of Official Proceedings -of the -Common Council of the City of: Rochester, Minn., July 19, 1954 105 1 • 1 • 1 Alderman Ackerman stated that a street light was needed on 7th Avenue Northwest beyond 16th Street Northwest, a dead end street. the matter was referred to the Lighting Committee -with power to act. The following recommendation of the Street & Alley Committee was read and upon motion by Whiting, second by.Ackerman, the same was accepted and it was ordered that notice be given to the public that they can be heard on the matter ofl the establishement of the recommended one-way streets at -the meeting to be held at 2:00 o'clock P. M. on August 2, 1954: "Honorable Mayor & Common'Council City of Rochester, Minnesota Gentlemen: We, the undersigned, recommend that the recommendation of the Parking and Traffic Steering Committee "to .improve 3rd and 4th Avenues West, from Soldiers' Field to 2nd Street Northwest and use them as a one-way pair" (referred to this committee on July 6th) be approved. We, further recommend, that the City advertise for bids for the installation of five (5) traffic signals, to be paid for out of parking.meter income, on 3rd Avenue and 4th Avenue at the following corners: 3rd Ave. S.W. at 4th St. S. The City Engineer's preliminary estimate for finish grading, base and bituminous surfacing on 3rd Avenue.Northeast and 17th Street Northeast in Huey - Reynolds Addition in the amount of $60975.28 was read and President pro tem Anderson ordered the same placed on file, The report of the City Treasurer for the month of June, 1954 was read and the same was ordered placed on file. The reports for the month of June, 1954 of the Building Inspector showing fees collected for building permits issued in the amount of $1, 591,00; of the Electrical Inspector showing fees collected for electrical permits issued in the amount of $146.50; of the Plumbing Inspector showing fees collected for plumbing permits issued $36.75; of the Heating Inspector showing fees collected fo heating permits issued $1, 614. 25 and fees collected for sign permits issued $45. 57. were each read and President pro tem Anderson referred the same to the Finance Committee. The reports of the Clerk of Municipal Court for the ending July 10,1954 0 showing total criminal fines and costs collected $1, 523.00 and civil fees received 106 Record of Official Proceedings of the Common Council of the City of: Rochester, Minn., July 19, 1954 $4.50 and for the week ending July 17, 1954 showing total criminal fines and costs collected $1, 668.00 and .civil fees received $4.05, were each read and having been approved by the City Attorney, President pro tem Anderson ordered the same placed on f ile. The two contract bonds of C. M. Boutelle in the amounts of $3,191.90 and $$2,659.10 with the Western Surety Company as surety and the three contract bonds of Komatz Construction Company. in the amounts of $7,668.50, $5,268.51 and $7,095.35 with the American Employrs' Iasurance.Company as surety were each read and the same were referred to the Mayor for his approval.. The applications of W. H. Cartwright, Walter B. Fratzke, Carl H. Laursen, and Jesse H. DeWitz for Real Estate Broker's License and Alvin C. Fratzke and Harry D. Prouty for Real Estate Saiesmen's License were each read and the same were referred to the Realtors Board for their approval. The application of Fred J. Gagner for license to sell cigarettes was read and upon motion by Schroeder, second.by Morris, the license was granted* The application of Fred J. Gagner for license to sell soft drinks was read and upon motion by Moody, second by Ackerman, the license was granted. The application of A.-H. Story for a House Movers License was read and upon motion by Ackerman, second by Doody, the license was granted. The application of Viker & Sorenson for a license to construct saidewalks was read and upon -motion by Schroeder, second by Morris, the license was granted. The application of Lysne Construction Company for a permit to move a house from 2nd Street Southwest to 13,91 Street Northwest over certain streets in the City'was read and upon motion by Schroeder, second by Whiting, the permit was granted, subject to the approval of the Building Inspector and the Chief of Police. The following resolutions were each introduced and read and President pro tem Anderson 'declared the same duly passed and a doptedt Resolution accepting the bid of Leon Joyce for the regrading and our - facing of 19th Avenue Northeast from gth to loth Street Northeast. Upon motion by Whiting", second by Ackerman, resolution adopted. Resolution accepting plans and specifications and ordering bids for repaving of lot Avenue Southwest from West Center Street to 2nd Street Southwest. Resolution requesting the -State Warehouse and Railroad Commission to grant the Rochester Bus Line, Inc. a rate increase that will be fair and equitable. Upon motion by Moody, second by Morris, resolution adopted. Resolution ordering bids for furnishing school crossing signals at 8th Street Southeast and 3rd Avenue and at. West Center Street and 5th Avenue. Upon motion by Schroeder, second by Whiting, resolution adopted. Resolution ordering bids for furnishing traffic signals at 3rd Avenue S. W. at 4th Street S. W. and West Center Street; and at 4th Avenue S. W. at 4th Street S. W., 2nd Street S. W'. and West Center Street. Upon motion by Whiting, second by Ackerman, resolution adopted. Resolution ordering a hearing on the vacation of 16th Avenue Southeast in Willoyd's Addition. Upon motion by Ackerman, second by Moody, resolution adopted. Resolution appropriating $5,890.73 from the P.I.R. Fund and ordering payment made to C. M. Boutelle & Sons. Upon motion by Moody, second by Morris, resolution adopted. Resolution appropriating $4,415.08 from the P.I.R. Fund and ordering payment made to H. T. Earle & Son. Upon motion by Morris, second by Schroeder, resolution adopted. Mayor McQuillan read a copy of his letter dated July 19, 1954 addressed to the members of the Board of Education of School District No. S. Rochester, Minnesota, in which he stated in substance that the sale of a portion of Soldier's Field as and for a school site was no longer being considered and was no longer possible. Upon motion by Morris, second by Whiting, the Council unanimously approved and concurred in the contents and opinions set forth in the Mayor's letter.
