Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota,, held in the Council Chambers in the City Hall, in
said City, on August- 16, 1954.
President Bach called the meeting to order at 7:30 o'clock P. M., the
following members being present: President Bach, Aldermen Ackerman, Anderson,
Moody, Morris and Whiting. Absent: Alderman Schroeder.
Upon motion by Morris, second by Ackerman, the minutes of the meeting
of August 9, 1954 were approved.
President. Bach stated this as being the time and place set for the
following hearings:
First hearing on the construction of a sanitary sewer and water main,
sewer and water service.connections and the finish grading, base construction and
bituminous surfacing to be done in 7th Street Northeast and 16th, 17th and 18th
Avenues Northeast in Sauer's First Sub -Division. There was no one present wishi
to be heard.
First hearing on the construction of a sanitary sewer, water main and
sewer and water connections and the grading, base construction and bituminous
surfacing to be done in 9th Avenue N. E. and 17th Street Northeast in Peck's
Fourth Addition. There was no one present wishing to be heard.
President Bach stated this as being the time and place set for receivi
and opening bids.'for.. the_follow_ing projects:
Bids for construction of a water main in 132 Street Northwest from 2nd
Avenue Northwest to a point 481.73 feet west of the Southeast corner of Block 29,
Northern Addition. The bid of Carlisle G. Fraser in the amount of $1,339.00 was
received and opened and upon motion by Whiting, second by Morris, the same was
referred to the Water Committee and the City Engineer for tabulation ,and report.
Bids for construction of a sanitary sewer, water main, sewer and water
service connections, finish grading and bituminous surfacing on 72 Avenue
Northeast, 8th Avenue Northeast and Northwood Drive in Northwood Addition. The
The bids of Carlisle G. Fraser in the amount of $16,356.26 and Barbarossa & Sons,
Inc. in the amount of $17,410.50 for sanitary sewer and water main and the bid of
Carlisle G. Fraser in the amount of $3,325.00 for sewer and water service
connections were each received and opened and upon motion by Morris, second by
Moody, the same were referred to the Sewer & Water Committees andthe City Engineei

for tabulation and report. The bid of Leon Joyce' in the amount of $5, 144- 71 for. �
grading was received and opened and upon motion by Morris, second -by Ackerman, the
same was referred to the Street & Alley Committee and the City Engineer for
tabulation and report.

in Jefferson Slopes. The bids of Carlisle G. Fraser in the amount of $7, 299. SO
and Barbarossa & Sons, Inc. in the amount of $9,165.50 for sanitary sewer and
water main and the bid of Leon Joyce in the amount of $4,571.77 for finish grading
base and bituminous surfacing were each received and opened and upon motion by
Morris, second by Anderson, the same were referred to the Sewer and Water
Oommittees, the Street &,Alley Committee and the City Engineer for tabulation
and report.
Bids for finish grading, base and bituminous surfacing on 3rd Avenue
Northeast and 17th Street Northeast in Huey -Reynolds Addition. The bid of Leon
Joyce in the amount of $6, 797.29 was received and opened and upon motion by
Ackerman, second by Anderson, the same was referred to the Street & Alley
Committee and the City Engineer for tabulation and report.
A communication from the Board of Public Health & Welfare regarding
the question as to whether the City of Rochester should enter an arrangement
with an individual for the collection of commercial garbage for disposal by
hog feeding was read and after discussion on the matter Alderman Whiting moved
that in the light of the numerous discussions of the Council concerning the
question of the disposal of commercial garbage and its contacts with Mr. Donald
Kruger of Tacoma, Washington and in the light of the letter from the Public
Health & Welfare Board dated August 14, 1954 and the suggested terms and
provisions of garbage disposal as outlined by the Board, that the Board of Public
Health & Welfare and the City Attorney be instructed to prepare an instrument
in conjunction with Mr. Kruger and his Attorney, granting the right to collect
commercial garbage in the City of Rochester. Alderman Morris seconded the
motion and upon roll call all present voted in favor of the motion.
Mr. Max Durand, President of the A. F. L. Central Labor Union, was
-present at the meeting and stated that it appeared that the Fact Finding
Committee consisting of Robert J. Petersdorf, C. C. Pagenhart and Dr. Emil
Heintz had not submitted a report. The matter was referred to the Mayor to meet
with the members of the said committee.
Mr. Gilbert Wade, Mr. Charles Brown and Mr. Clarence Wollner were
present and protested the installation of parking meters on 3rd-Avenue Northwest
(north of West Center Street. Also a written protest against installing parking
meters on 3rd Avenue and truest Street signed by 14 residents in that area was
read and ordered placed on file.
A letter from the Rochester Chamber of Commerce requesting the Council
to give careful study to, and take action on, the adoption of the necessary
ordinance or ordinances to legitimately govern "Going Out of Business Sales" and
the control of solicitations and house to house sales was read and President
Bach ordered the same placed on file,

A letter from C. A. Armstrong, City Engineer, transmitting a copy of
a report from the Minnesota State Highway Department on the condition of the Eastl
Center Street Bridge was read together with the said report and President Bach
ordered the, same placed on file.
The following preliminary estimates submitted by the City Engineer 'were
each read and President Bach ordered the same placed on file:
Preliminary estimate for construction of a sanitary sewer, water main and sewer
and water connections in 7a Avenue Northeast, 8th Avenue Northeast and Northwood
Drive in Northwood Addition in the amounts of $9,159.60 fro sanitary sewer
$6,266.59 for water main and $?,280.00 for sewer and water connections; ,
Preliminary estimate for construction of a sanitary sewer and water main in 13th
Avenue Northeast and 15th Street Northeast in Jefferson Slopes in,the amounts of
$3, 171.90 for sanitary sewer and $3,939- 70 for water main;
Revised preliminary estimate for construction of a 6" water main in 13'ff' Street
Northwest f rom 2nd Avenue Northwest to a point 481.73 feet. west of the Southeast
corner of Block 29, Northern Addition in the amount of $1,291.,40;
Preliminary estimate for the construction of finish grading, base and bituminous
surfacing on 13th Avenue Northeast and 15th Street Northeast in Jefferson Slopes
Addition in the amount of $4,965.70; and
Preliminary estimate for construction of finish grading, base and bituminous
surfacing on 7j Avends Northeast, 8th Avenue Northeast and Northwood Drive
Northeast in Northwood Addition in the amount of $5,324.9o.
President Bach called a recess at 9:05 P. M. The meeting was called to
order at 9:45 P. M.
A letter from the Minnesota Department of Health transmitting a copy of
the report of their Municipal Water Supply Section covering an examination of.
plans on water main extensions for the City of Rochester was read and President
Bach ordered the same placed on file.
The following resolution adopted by the members of the Sinking Fund
was read and upon motion by Morris, second by Moody, the resolution was approved:
"WHEREAS, the City of Rochester, Minnesota, now holds $250,000.00
U. Be Treasury 2 5/8% Certificates of Indebtedness of Series D - 1954
which mature August 15, 1954, and
WHEREAS, the 2 5/8% Certificates may be exchanged far 2 1/8%
Treasury Bonds maturing November 15, 196o, par for par.
SO THEREFORE, Be it resolved by the Commissioners of the Sinking
Fund of the City of Rochester, Minnesota: That the $250,000.00 2 5/9%
Certificates of Indebtedness maturing August 15, 1954 be exchanged for
$250,000.00 2 1/8% Treasury Bonds maturing November 15, 1960, the said
bonds belonging to the following investments accounts:
Waterworks Depreciation Reserve . $_80,000.00
Employee's Compensation Reserve . . . . . . . . 20,000.00
Bridge Fund Reserve . . . . . . . . . . . . . . Via -00n_nn"
The recommendation of the Steering Committee on Parking and Traffic
that the City Council adopt a resolution requesting the Highway Department of the
State of Minnesota to enter into an agreement with the City of Rochester,Minnesot
to participate in the resurfacing of Highway #63 (Broadway) from the Chicago
N. W. Railway tracks on North Broadway to the South Broadway Bridge was read and
upon motion by Morris, second by Moody, the same was referred to Street & Alley.
Committee and the City Attorney to prepare the said resolution.
The recommendation of the St eering Committee on Parking and Traffic
that the municipal parking lot known as the Fire Hall Parking Lot be put on a
paying basis; i.e. that a reasonable hourly fee and/or monthly fee be charged for
parking in the lot and that the administration of the lot be placed under the

same department as the other municipal lots now in oTeration was read and upon
motion by Morris, second by Whiting, the same was referred to the Street & Alley
Committee, the Steering Committee and the City Engineer.
The Mayor's appointments to the Library -Board of Fredrick J. Furlow,
Dr. C. R. Holland and William Sperling, their terms to expire on the third
Saturday of July, 1957 was read and upon motion by Morris, second by Ackerman,
the appointments were approved.
The petition of the Peke Evangelical &_Reformed Church to have Lots 1
and 2, Block 22, Northern Addition changed f rom..a residential zone to a commercial

zone was read and upon motion by Morris, second by Ackerman, the same was referred
to the Board of Zoning.
A petition for grading and bituminous surfacing of the alley in Oak Rest
Replat was read and upon motion by Morris, second by�Ackerman, the same was
referred to the Street & Alley Committee and the -City Engineer.
The request of David Bemel, Co -Chairman of 40-and B Day, for permission
to place their 40 & 8 Box car in front of the Woolworth Building on August 19,
20 and 21, 1954 was read and upon motion by Ackerman, second by Anderson, the
request was granted.
The application of Warren L. Edwards for a license to sell soft drinks
was read and upon motion by Ackerman, second by Morris, the license was granted.
The surety bond of Vincent A. Huyber dba H & H Electric Company in the
amount of $2,020.00 with the Western Surety Company as surety was read and upon
motion by Morris, second by Ackerman, the same was referred to the Mayor.
The reports for the month of July, 1954 of the Building Inspector
showing fees collected for building permits issued in the amount of $709.00; of
the Electrical Inspector showing fees collected for electrical permits issued
in the amount of $208.00; of the Plumbing Inspector showing fees collected for
plumbing permits issued .in the amount of $1, 205. 25; of the Heating Inspector
showing fees collected for heating permits issued in the amount of $797.00 and

fees collected for sign permits issued $31.09 were each read and President Bach
referred the same to the Finance Committee.
The report of the City Treasurer for the month of July, 1954 was read
and President Bach ordered the same placed on file.
The reports of the Clerk of Municipal Court for the week ending
August 7, 1954 showing total criminal fines and costs collected $1,249.00 and
civil fees received $9.10 and for the week ending August 14, 1954 showing total
criminal fines and costs collected $1,007.00 and civil fees received $9.05 were
each read and having been approved by the Citi Attorney, President Bach ordered
the same placed on file.
The recommendation of the Water Committee and the City Engineer that

the bid of Carlisle G. Fraser for construction of a water main in 132 Street N.W.
from 2nd Avenue Northwest to a point 491.73 feet west of the Southeast corner of
Block 29, Northern Addition be accepted at the unit prices bid and checks be
returned to the unsuccessful bidders was read and upon motion by Morris, second
by Anderson, the recommendation was approved.
The recommendation of the Sewer and'Water Committees and the City
Engineer that the bid of Carlisle G. Fraser for construction of a sanitary .sewer
and water main in 7a Avenue Northeast, Nth Avenue Northeast and Northwood Drive
in Northwood Addition be accepted at the unit prices bid and checks returned
to the unsuccessful bidders was read and upon motion by Anderson, second by
Moody, the recommendation was approved.
The recommendation of the Street .& Alley Committee and City Engineer
that the bid of Leon Joyce for construction of finish grading, base and bituminous
surfacing on 72 Avenue Northeast, 8th Avenue Northeast and Northwood Drive
Northeast in Northwood Addition be accepted at the unit prices bid was read and
upon motion by Morris, second by Anderson, the recommendation was approved.
The recommendation of the Sewer and Water Committees and the City
Engineer that the bid of Carlisle G. Fraser for construction of a sanitary sewer
and water main in 13th Avenue Northeast and 15th Street Northeast in Jefferson
Slopes be accepted at the unit prices bid and checks be returned to the
unsuccessful bidder was read and -upon motion by Moody, second by Morris, the
recommendation was approved.
The recommendation of the Street 8e Alley Committee that the bid of Leon
Joyce for construction of finish grading, base and bituminous 'surfacing on 13th
Avenue Northeast and 15th Street Northeast in Jefferson Slopes' be accepted at the
unit prices bid was read and upon motion by Morris, second by Anderson, the
recommendation was approved.
The recommendation of the Street & Alley Committee and the City Engineer
that the bid of Leon Joyce for construction of finish grading, base and bituminous
surfacing on 3rd Avenue Northeast and 17th Street Northeast in Huey -Reynolds
Addition be accepted at.the unit prices bid was read and upon motion by Moody,
second by Morris, the recommendation was approved.
The recommendation of the Street & Alley Committee and the City Engineei
that the City Engineer be authorized to construct a sidewalk on the west side of
3rd Avenue Southeast from Mayo Park Bridge.to 3rd Street S. E. and on the north
side of 3rd Street Southeast facing Lot 30 Ln Block 20, Moe & Olds Addition tnd
that the costs be paid out of the Bridge Fund because this construction is part
of the bridge approach necessitated by the construction of the Mayo Park Bridge
was read and upon motion by Morris, .second by Ackerman,.the recommendation was

The following resolution were each introduced and read and President
Bach declared the same duly passed and adopted=
Resolution ordering plans, specifications, profile and estimate of cost
and 2nd hearing on finish grading, base construction and bituminous surfacing
and construction of a sanitary sewer-, water main and sewer and water service
connections in Sauer's First Sub -Division. Upon motion by Anderson, second by
Moody, resolution adopted.
Resolution ordering plans, specifications, profile and estimate of cost

in 9th Avenue Northeast and 17th Street Northeast in Peck's Fourth Addition.
Upon motion by Moody, second by Morris, resolution adopted.
Resolution accepting the bid of Leon Joyce for finish grading, base
and bituminous surfacing on 3rd Avenue Northeast and 17th Street Northeast in
Huey -Reynolds Addition. Upon motion by Ackerman, second by Anderson, resolution
adopted.
Resolution accepting bid of Carlisle G. Fraser for construction of a
water main in 132 Street Northwest from 2nd Avenue Northwest to a point 481.73
feet west of the southeast corner of Block 29,' Northern Addition. Upon motion by
Anderson, second by Moody, resolution adopted.

sanitary sewer, water main in 712 Avenue Northeast, 8th Avenue Northeast and
(Northwood Drive in Northwood Addition. Upon motion by Moody, second by Morris,
resolution adopted.
Resolution accepting bid of Leon Joyce for finish grading and bituminous
surfacing on 72 Avenue Northeast, 8th Avenue Northeast and Northwood Drive in
Northwood Addition. Upon motion by Morris, second by -Whiting, resolution adopted.

(sanitary sewer and water main in 13th Avenue Northeast and 15th Street Northeast
in Jefferson Slopes. Upon motion by Whiting, second by Ackerman, resolution

A proapective.ordinance relating to the Licensing of Peddlers,
Canvassers, and Transient Merchants and providing penalities for violation
thereof was discussed.
An Ordinance amending an Ordinance entitled, "An Ordinance establishing
charges and rates for the use and service of the Sewage Works of the City of
Rochester, Minnesota", was given its first reading.
Alderman Anderson stated that he had gotten a request for school
crossing signals on 3rd Avenue Southeast at the.intersections of 7th Street and
92 Street Southeast. Upon motion by Morris, second by Whiting, the matter was
referred to the Police Committee, the Chief of Police and the City Engineer.
Upon motion by Anderson, second by Morris, the meeting was adjourned.
