President Bach called the meeting to order at 2:00 o'clock P. M., the following members being present: President Bach, Aldermen Ackerman, Anderson, Moody, Morris, Schroeder and Whiting.. Absent: None.. Upon motion by_Moody, second by Morris, the minutes of the meeting of August 16, 1954 were approved. President Bach stated this as being the time and place set for the following hearings: Second hearing on the finish grading, base construction and bituminous surfacing and construction of a sanitary sewer, water main and sewer and water service connections in Sauer's First Sub -Division. There was no one present wishing to be heard. Second hearing on the grading, base construction and bituminous surfacing and construction of a sanitary sewer, water main and sewer and water connections in Peck's Fourth Addition. There was.no one present wishing to be heard. Hearing on the petition for the vacation of that part of 16th Avenue Southeast designated as.a street in Willoyd's Addition. There was no one present wishing to be heard, President Bach read a letter from the Biwanis Club requesting permission to conduct a peanut sale on the downtown streets of Rochester on Monday, September 27, 1954 and the same was ordered placed on file. The following resolution adopted by the Public Utility Board was read and the same was ordered placed on file: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota, that the Common Council of the said City be and is .hereby requested to authorize the said Board to enter into a contract with CRANE COMPANY for the furnishing, in accordance with speci- fications, of a complete replacement set of pump bowls; the total amount of the contract to be NINE HUNDRED THIRTY SEVEN DOLLARS AND TWENTY CENTS ($937. 20 ) and the said Crane Company being the lowest. responsible bidder." The request of the Board of Public Health & Welfare for permission to employ Miss Ruth Wilkinson as a public health staff nurse, effective September 1, 1954, at a beginning salary of $305.00 per month was read and upon motion by Ackerman, second by Whiting, their request was granted. A communication signed by Lyndon Geselle and Otto Haling requesting an opportunity to submit a proposal for the right to acquire feed from commercial Garbage and authorization to charge for their services in disposing of garbage 4. was read. Mr. Frank Till and Mr. Carl Elford„ of Cascade Township, were present and recommended that the garbage fill be located further out from the City on 136 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., S apt embe r 7, 19 54 account of odors that were noticeable in the present location of the sanitary fill. Mr. C. Bolduan, who lives in the area of the present sanitary fill, was also and complained of odors and urged that the new• hog •feeding farm be present located further from the City than proposed. The recommendation of -the committee to - advise on employees salaries in the Street & Alley, dark; City Farm and Weighmaster Departments was read and ordered placed on file. Mr. tiax Durand, of the A. F. L. Labor Union, was present at the meeting and inquired as to what action the Council would take. He was informed that the Council would -soon be preparing the new budget and requested that he furnish them the • with a schedule of going rates. A letter from the State of Minnesota, Water Pollution Control Commission, advising that plans recently submitted for sewage facilities in the City of Rochester were approved was read and the same was ordered placed on file. A notice from John S. Lodwick, Attorney of injury sustained by Mrs. firs. May -Nelson as a result of a fall on the sidewalk on June 17, 1954 was read and upon motion by Morris, second by Moody, the same was referred to the City Attorney. A notice of hearing before the Railroad and Warehouse Commission on September 9, 1954 at 10:00 A. ri. in the Council Chambers, in the City Hall, in the matter of the application of the Rochester Bus Line, Inc, for an increase in fares was again read and President Bach ordered the some placed on file. . Notices of personal injury to Laura Erickson on August S, 1954 and claim for damages in the amount of $15,000.00 and Garold Erickson claiming damages in the amount of $5,000.00 were each read and upon motion by Whiting, second by Schroeder, the same were. referred to the City Attorney. A summons in the matter of Robert Howard Reichel, by Ruth Reichel, his guardian ad litem, Plaintiff vs. City of Rochester, Defendant and Ruth Reichel, Plaintiff vs. City of Rochester, Defendant, were each read and upon • motion by Whiting, second by Ackerman, the same were referred to the City Attorney. A letter from the Soldier's Field Women's Golf Association stating that they were very gratified to learn of the Park Board recommendation for enlargement of the Club House was read and upon motion by Schroeder, second by Whiting, the same was referred to the Park Board. The request of the Board of Park Commissioners for additional work on the parking lot east of the Mayo Civic Auditorium was read and upon motion by Ackerman, second by Whiting, the same was referred to the Street & Alley Committee and the City Engineer with power to act. No action was taken. Notice of the next regular meeting of the State of Minnesota Fire Chief s Association to be held on September 27th in Minneapolis was read and upon motion by Morris, second by Schroeder, the Chief of the Fire Department and the Civil Defense Director were authorized to attend at city expense. The request of the Planning and -Zoning Commission for an additional $1,000,00 for field topographical and evaluation surveys was read. A motion was made by Whiting, second by Ackerman, that they be auth.orized to. incur indebtednesf up to _$1,000.00 over and above the funds heretofore authorized and that the Common Council will appropriate such authorized funds when and. where needed. The request of Andrew Towey, manager of the Silver Lake Villa, for installation of a street light on the corner of loth. Street and 3rd Avenue N.E. was read and upon motion by Whiting, second by Ackerman, the same was referred to the Lighting_ Committee, with power to act. The request of the Alpek Sheet Metal Works for permission to use a mobile display unit on the streets of Rochester, on Tuesday, September 21, 1954 for approximately two hours in the residential district was read and a .mo_tion:. was made by. Ackerman, second. by. Anderson, that they be permitted to use this sound truck along side their place of business but not tour the streets. All voted in favor of the motion. The request of the Homestead Memorial Church for installation of a sidewalk along the south side of 4th Street Southeast between. llth- Avenue and 13tt Avenue was read and.upon motion by Schroeder,.second by Ackerman] the same was referred to the Street & Alley Committee and the City Engineer. The petition of Freda Sorenson to have her property located at.3 - 7th Street Northeast changed from a residential zone to a commercial zone was read together with a statement of acquiescence signed by 5 residents in that area. Upon motion by Whiting, second by Moody, the same was referred to the Board of Zoning. The recommendation of the Board of Zoning that the petition of Ray C. McKenny and Belvadene Mc%enny to have Lot 4, Block 5, Ireland's First Addition to the City changed from a residential zone to a commercial zone be granted was read and upon motion by Morris, second by Ackerman, the recommendation was approved and the City Clerk was instructed to publish notice of a hearing on the zoning change, said hearing to be held at 7:30 o'clock P. M. on September 20,1954. The recommendation of the Board of Zoning that the petition of Max C. Klingsporn to have the following described property changed from a residential zone to a commercial zone be granted was read and upon motion by Ackerman, second by Schroeder, the recommendation was approved and the City Clerk was instructed to CJ P- 138 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., S e pt embe r 7, 1954 publish notice of a hearing on the zoning change, said hearing to be held at 7:30 o'clock P. M. on September 20, 1954: "Commencing at the Northeast corner of the Northwest i of Section 3-106-14 West and running thence south along the East line of said Northwest i a distance of 199.5 feet for a place of beginning, running thence hest parallel with the North line of said NW4 a distance of 99 feet, thence south parallel with the East line of said NWi a distance of 147 feet to thenorth line .of 3rd Street Southwest, running thence easterly along the north line of 3rdAStreet::Southwest to the east line of said NW* and running thence north 179.5 feet to place of beginning." The recommendation of the Board of Zoning that the petition of David Dee to have Lot 1, Block 3, of D. P. Madden's Addition changed from a residential zone to a commercial zone be granted was read and upon motion by Schroeder, second by Ackerman, the recommendation was approved and the City Clerk was instructed to publish notice of a hearing on the zoning change, said hearing to be_ hold at 7:30 o'clock P. M. on September 20, 1954. The recommendation of the Board of Zoning that the petition of the Peace Evangelical and Reformed Church to -have Lots 1 and 2, Block 22, Northern Addition changed from a residential zone to a commercial zone be granted was read and upon motion by Schroeder, second by Ackerman, the recommendation was approved and the City Clerk was instructed to publish notice of a hearing on the zoning change, said hearing to be held at 7:30 o'clock P. M. on September 20, 1954. Air. Raymond Wagoner presented a. petition requesting the installation of a sidewalk on 14th Street Northeast from Broadway.to 3rd Avenue Northeast. He stated that children going to school were forced to walk in the street which was very hazardous. Air. George Leiferman, Mr. Andy Towey, Mr. Harold Roth, Mr. H. E. Euchenbecker, Mr. L. M. Pennock, Mr..Lester Stiles and Mrs. C. M. Johnson were present and each spoke briefly urging that the sidewalk be installed as soon as possible. After hearing those present a motion was made by Morris, second by Moody, instructing the City Clerk to draw up a resolution ordering the construction of a.sidewalk on the south side of 14th Street Northeast from Broadway to the Silver Lake Drive, except where sidewalk has heretofore been constructed and on the north side of 14th Street Northeast from lot Avenue to 3rd Avenue Northeast. All voted in favor of the motion. The recommendation of the Sewer and Water Committees that all bids received on August 16, 1954 for the construction of sewer and water service con- nections in 7z Avenue Northeast, 8th Avenue Northeast and Northwood Drive in Northwood Addition be rejected and checks returned, and that the owner be per- mitted to contract privately for the construction of the said sewer.and water service connections was read and upon motion by Whiting, second by Schroeder, the recommendation was approved. This recommendation is based on the following consider- ations: 1. The width of the present bridge is sufficient for two lanes of traffic which is equivalent to the roadway of East Center Street. 2. Reconstruction of the floor system of the present bridge will make the bridge safe for full legal weight loads. 3. It is anticipated that with the proposed con- struction of a new road and bridge on 7th Street N.E. that the volume of traffic on East Center Street will not be increased. Woods for a Master Electrician's License was read and upon motion by Moody, second by Morris, the license was granted. The application of Snyder's Drug Store.for a 3.2 "off sale" non - intoxicating malt liquor license was read and upon motion by Schroeder, second by Moody, the license was granted. The applications of Snyder's Drug Store and H. R. Pormady for license to sell soft drinks were each read and upon motion by Schroeder, second by Moody, the licenses were granted. The application of Snyder's Drug Store for a license to sell cigarettes was read and upon motion by Moody, second by Ackerman, the license was granted. The applications of Ernest Schoenfelder and Arthur LeVasseur for a Journeyman Plumber's License were each read and upon motion by Morris, second by Ackerman, the licenses were granted. The applications of Walter B. Fratzke, David S. Gimbert, William E. Suk, Byers V. Nelson, Fred W. Schuster, Earl L. Kidd, Theo. F. Franke, Geo. P. Leiferman, Edgar Jensen, J. E. McMillen, W. H. Cartwright, Ruth Godfrey, Raymond El Karvel, Charles SeLvdey, Bernard' G. Mayou, Lynn Dunca.nson, Norman J. Kuyath, Harry E. Gimbert, Haven H. Hodge, Arthur 'West, Mrs. Helen S. Christianson and Art Anderson for Real Estate Salesman License were each read together with the recommendations of the Real Estate Commission that the said licenses be granted and upon motion by Ackerman, second by Whiting, the recommendations were approved and the licenses granted., The applications of Marion Schleif, Ray Bowers, John M. Hennessey, Arthur E. Driscoll, George J. Miller and V. F. Gitsch for Real Estate Broker's License were each read together with the recommendations of the. Real Estate Commission that the applications be rejected. Upon motion by Schroeder, second by Ackerman, the recommendations were approved and the licenses rejected and the City Clerk was instructed to notify them of the action and refund the fee. The official bond of Anne C. Jensen in the amount of $1,000.00 with the (American Surety Company of New York as surety and the license bond of Michael J. Woods in the amount of $1,000.00 with the Fidelity and Casualty Company of New York were each read and upon motion by Whiting, second by Schroeder, the bonds were approved, the surety thereon accepted and the same were ordered placed on f ile. The contract bonds of H & H Electric Company in the amount of $20,020.00 with the Western Surety Company as surety; Universal Motors, Inc. in the amount of $2,500.00 with the Western Surety Company as surety; Somatz Construction Company in the amount of $38,195.6o with the American Employers' Insurance Company as surety; Leon Joyce (3) in the amounts of $5,144- 71, $4,571.77 and $6,797.28 with the Seaboard Surety Company as surety and Carlisle G. Fraser (3) in the amounts of $1, 339.00, $16, 356. 26 and $7, 299. 80 wit,h the Federal Insurance Company as read • surety were each and President Bach referred the same to the Mayor. The reports for the month of August, 1954 of the Building Inspector showing fees collected f or building permits issued $505, 00; of the Electrical Inspector showing fees collected for electrical permits issued $190.75; of the Plumbing Inspector showing fees collected for plumbing permits issued $318.00; of the Heating Inspector showing fees collected for heating permits issued $129.50 and fees collected for sign permits issued $56.07 were each read and President Bach referred the same to the Finance Committee. The report of the City Weigh.master for the month of August, 1954 showing) fees collected for loads weighed in the amount of $53.30 was read and President Bach referred the same to the Finance Committee. The following resolutions were each introduced and read and President Bach declared the same duly passed and adopted: Resolution ordering the first hearing on the grading, surfacing, sanitar sewer and water main construction on 5th Street S.W. from 17th, to 20th Ave. S.W.; Bn 3rd Street S.W. from 17th to 20th Avenue S.W. ; on 19th Avenue S.W. from 3rd to 5th Street S.W.; and on 20th Avenue S.W. from 3rd to 5th Street S. W. Upon motion by Ackerman, second by Anderson, resolution adopted. Resolution accepting plans, specifications and ordering bids for construction of a sanitary sewer, water main and sewer and .water service connectiox and finish grading, base construction and bituminous surfacing in Sauer's•First Sub -Division. Updn motion by Whiting, second by'Schroeder, the City Clerk was instructed to request all department to submit their budgets for the coming fiscal year, not later than September 20, 1954. The City •Attorney -presented a letter from G. Howard Spaeth, Commissioner of Taxation, stating that -a hearing had been scheduled for Wednesday, September 22, 1954 at 2:00 in Room 209 State Office •Building, to consider-8 applications for refund of taxes on the F. E. Williams Estate property. Upon'motion by Schroeder, second•by Morris, the Mayor, The City Attorney,•a member of the Park Department and the City Assessor were authorized to attend the saidmeeting at city expense. An Ordinance amending -an Ordinance entitled, "An 'Ordinance establishing charges and. rates for the use and service of the Sewage Works of the City of Rochester, Minnesota", was given its second reading. -President Bach called a recess at 5:-30 o l-clock P. M. President Bach called the meeting to order at 7:15 of cl§ck P. M. Mr. Otto Haling -was present and requested: "that the Council give him consideration 'in -the matter of disposing- of commercial garbage for hog feeding'.- • After further discussion on the matter Alderman Whiting introduced a resolution authorizing and directing the Mayor and City Clerk to execute the commercial garbage contract between- the City of Rochester and Donald Kruger. Alderman Anderson seconded the motion and upon ro11 call all voted in favor thereof. A resolution authorizing the City Engineer to publish notice regarding the construction of sidewalk on the south• side of 14th Street Northeast from Broadway to the - Silver Lake Drive, except where -sidewalk has heretoforb been constructed and on the north side of• 14th Street Northeast from First' Avenue I Northeast to 3rd Avenue- Northeast. Upon motion by Anderson; second by Moody, .resolution adopted. The recommendation of the Police Committee that the proposal of H & H- Electric Company to furnish and install all material, labor and. sigflals necessary for school crossings at 7th Street and 3rd Avenue Southeast and 9z Street and, 3rd Avenue Southeast in the amount of $3,050.00 be accepted was read and upon motion by Schroeder, second by Morris, -the recommendation was approved. All voted in favor of the -motion. All voted in favor of the motion.1 A motion was made by Schroeder, second by,Ackerman, that the City Engineer be authorized to convey .to the Minnesota State Highway Department the wishes of .the Council that the said Department complete the preliminary designs for the widening of the 4th Street Southeast bridges. All voted in favor ofthe motion. . An Ordinance regulating the parking of vehicles on the public streets and alleys, providing for the installation, maintenance and use of parking meters, creating a parking meter fund, and providing penalties for the violation thereof, was gl-ven its third and final reading. Alderman Whiting moved that the Parking Ordinance be amended by inserti therein the following section to be numbered as Section 6: Section 6. SPECIAL PARKING ZONES. No person, excepting a person authorized to do so, shall park a vehicle on any street or alley where the Common Council has established -a Special - Parking Zone. The Common Council may establish Special Parking Zones wherever the convenience or necessity of the traveling public requires or wherever necessary in the proper exercising of the police power. Alderman Whiting further moved as a part of this amendment that Section 6 and - subsequent sections of the present ordinance be re -numbered to permit the insertion of the above paragraph as Section 6. Alderman Ackerman seconded the motion and all voted in favor thereof. A motion was made by Ackerman, second by Whiting, that the said ordinance be adopted as amended, and all voting in favor thereof, President Bach declared the said Ordinance duly passed and adopted.
