HomeMy WebLinkAbout09-15-1954150 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., Sept ember .15, 1954 Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, on September 15, 1954. Alderman Whiting moved that Alderman.Schroeder act as President Pro Tem. Alderman Morris seconded the motion and all present voted in favor of same, . President pro tem Schroeder then called the meeting to order at 3:15 o'clock P. M., the following members being present: Aldermen Ackerman, Anderson, Morris, Schroeder and Whiting. Absent: President Bach and Alderman Moody. A motion was made by Morris, second by Ackerman, that Alderman Whiting be appointed to act on the Olmsted County Canvassing Board. The Council then proceeded to the polling places in the various precincts of the City to inspect the registering counters of the voting machines .and to compare the number of votes shown by such voting machines with the returns submitted by the Judges at the Special Election on September 14, 1954. After making the canvass of the voting machines the Council members returned to the City Hall and President Pro Tem Schroeder called the meeting to order, the following members being present: President Pro Tem Schroeder, and Aldermen Ackerman, Anderson, Morris, Schroeder and Whiting. The following resolution was introduced and read and upon motion by Arnderson, second by Morris, that the said res.olution be adopted as read, and all voting in favor thereof, President Pro Tem Schroeder, declared the said resolution duly passed and adopted: "Be it resolved by the Common Council of the City of Rochester, Minnesota: That the following is a tabulated statement and list of the number of votes cast for and against the amendments at the Special Election held on September 14, 1954, in the City of Rochester, Minnesota, as determined by said Common Council on the canvass of the returns of said special election made on the 15th day of September, 1954, and said statement is hereby declared to show the result of the said special election; said tabulation list and statement being as - follows: First Ward Second Ward Third Ward District No. District No. District No. 1 2 3 4 5 1 2 3 4 5 1 2 3 4 5 6 Total Amendment No. 1 Amend Section 94 of the Charter of the City of Rochester, Minnesota so that the said se.ction., as amended, shall read in its entirety as follows: Section 94. The President, or, in his absence, the President Pro Tem, shall preside at meetings of the Common Council. Each alderman, including the presiding officer, shall have one vote on all matters. The City Clerk shall have power to -administer oaths, and -affirmations and take the acknowledgment of deeds and other writings. He shall retain in his possession all records, files, books and papersincident to his office, and shall not allow them to pass from his possession,. except under the direction of the Common Council. He shall receive for h1s services such sum as the Common Council shall deem proper. "A Deputy City Clerk shall be appointed by and serve at the pleasure of the City Clerk. Such appointment shall be effective from and after confirmation by the Common Council. In the event the position -of Deputy City Clerk remains vacant for a period of 30 days or more, the Common Council may appoint a suitable person to fill such position. When appointed by the Common Council, the Deputy City Clerk may be removed by the City Clerk with"the consent of the Common Council. The salary of the Deputy City Clerk shall be fixed by the Common Council and shall be paid from City funds. The Deputy City Clerk shall perform such duties as may be assigned to him by the City Clerk and, subject to the direction and control of the City Clerk, shall exercise all the powers and authorities of the City Clerk". Section 111. All fees received by the City Clerk from private individ- uals for filing and recording papers and for other services shell be paid over to the City Treasurer and be the property of the City." All supplies for public utilities shall be contracted for and purchased by said Board in the name of the City, but every appropriation for the amount of Fifteen Hundred Dollars ($1500.00) or more to be paid to any one person, firm, or corporation, and the letting of any job or work, or the author- izing of any contract or purchase involving the expenditure fvom the City Treasury of Fifteen Hundred Dollars ($1500.00) or more, and the fixing of any officer's salary or employee's wages at the aggregate sum of Fifteen Hundred Dollars ( $1500.00) or more a year, and every provision for the sale of any real or personal estate pertaining to said plant, of the value of Fifteen Hundred Dollars ($1500.00) or more, and every determination to make any improvement pertaining to public utilities of the City, shall first be authorized by a resolution duly passed by the Mayor and Common Council, before the said Public Utility Board shall have any right or authority to act thereon." "Section 275. All contracts for commodities or service to be furnished or performed for the City, or any department thereof involving an expenditure of more than Fifteen Hundred Dollars ($1500.00) shall be made as in this chapter provided, and not otherwise. The words "commodities" and "service" as used in this chapter, shall be construed to include all work, labor, materials, supplies or other property and all lighting and other service, and all local or public improvements, but shall not include the employment of City officers and employees and the setting of their salaries, the employment of independent professional services, and the purchase of real estate. The word "contract" as used in this chapter, shall be construed to include every agreement, in writing or otherwise, executed or executory, by which any commodities, work or service are to be furnished to or done for the City, and every transaction whereby any expenditure is made or incurred on the part of the City or any department or any officer thereof, except contracts for the employment of City officers and employees and the setting of their salaries, contracts for the etihployment of independent professional services, and contracts for the purchase of real estate. "All .action in this chapter required or authorized to be taken by the Common Council shall be by resolution or ordinance. If the proposed contract be in the hands of a Board,. under this Charter, this Board shall take the same proceeding as herein provided for the Common Council, and the Clerk or Secretary of such Board shall.do those acts in relLation to such contract as are provided by this chapter to be done by the City Clerk if the letting of the contract were in the hands of the Common Council.. Section 276. Rochester, Minn., September 15, 1954 Amendment No. 4 Amend Sections 163 and 164 of the,Charter of the City of Rochester, Minnesota, so that the said sections, as amended, shall read in their entirety as follows: "Section 163.is amended by the addition, immediately following sub- division "Fifteenth" thereof, of a new paragraph, to be numbered subdivision "Sixteenth" and to read as follows: "Sixteenth. A Police Fund, into which shall be paid all taxes levied by the Common Council for the purpose of providing police protection and services for the City." "Section 164 is amended by the addition at the end thereof of a new paragraph to read as follows: "For the Police Fund, so much as may be necessary to provide adequate police protection and services for the City." The following officers of the City shall receive each year salaries as follows: "The Mayor One Thousand Dollars ($1,000.00), Aldermen, each, Seven Hundred Fifty Dollars ($750.00). "In Addition to his salary the Mayor shall in any and -all events have the exclusive control of a contingency fund in the amount of One Thousand Dollars ($1,000.00) each year, or in such greater amount as the Common : Council may by resolution provide. Expenditures made from this fund shall be subject to such post -audit as the Common Council may provide."
