President. Bach called the meeting to order at 7:30 o'clock P. M., the following members being present: President Bach,. Aldermen Ackerman, Anderson, Moody, Morris, Schroeder and Whiting. Absent: None. Upon motion by Moody, second by Morris, the minutes of the meeting of October: 4, 1954 were approved. The recommendation of the Lighting Committee that the. bid of Naegele Sign Company for Christmas Street Lighting on certain public streets in the City of Rochester be accepted in the amount of $3,944.40 was read and upon motion by Schroeder, second by Ackerman, the recommendation was approved. A letter from the State of Minnesota, Water Pollution Control Commission advising that at its meeting held.on September 29, 1954, plans for sewer projects in the City .of Rochester. had. been approved was read and President - Bach ordered the same placed on file.. The recommendation of the Steering Committee on Parking and Traffic that the collections for,parking tickets -be taken out of the Police Department was read. Mayor MCQuillan and Police Chief Macken each spoke on the matter and cited methods used in other cities in the handling of parking tickets. After discussing the matter a motion was made.by Morris, second by Moody, that the said recommend- ation be referred to the Police Committee for further study. All voted in favor of the motion. A petition for the construction of.a curb and gutter in Bielenberg & Giese Second Addition (On both.sides of 13 Avenue Northwest, both sides of 15th Avenue Northwest and the north side of 14th Street*Northwest) was read and upon motion by Morris, second by Anderson,.the.same was referred to the Street & Alley Committee and the City Engineer. The application of the Mid-Continent.Petroleum Corporation for a permit to operate a sound car on the streets of Rochester on October 22 and 23, 1954 was read. Alderman Schroeder moved.that the request be.denied, Alderman Morris. seconded the .motion and all voted in favor -thereof. . The applications of Charles P. Beach for a license to.sell cigarettes _ and a license to sell. soft drinks were each read and upon motion.by Morris, second by Schroeder, the licenses were granted. The report of the Clerk of Municipal Court for the week ending October 9, 1954 showing, total criminal fines and costs collected $1,094.00 and civil fees received $2.90 was read and having been approved by the City Attorney, President Bach ordered the same placed on file. . • The license .bond of Emil J. Niets in the amount of $1,000.-00 with the 182 Record of Official Proceedings of thd'Common Council of the City of Rochester, Minn., October 11, 1954 E Western Surety Company as surety was read and upon motion by Morris, second by lMoody., the bond was approved, the surety thereon accepted and the bond was bordered placed on file. The contract bond of Carlisle G. Fraser in the amount of $42,992.70 with the Federal Insurance Company as surety was read and the same was referred to the Mayor. The following resolutions were each introduced and read and all voting in favor thereof, President Bach declared the same duly passed and adoptedt Resolution accepting the bid of Haegele Sign Company for Christmas Street Lighting for 1954 on certain public streets of the City of Rochester. Upon motion by Ackerman, second by Anderson, resolution adopted. Resolution appropriating $2,657.03 from the General Fund, $4,982.99 from the S &_ A Fund, $477.25 from the Sewer Fund and $533.82 from the Parking Meter Fund and ordering payment made to Street & Alley Fund, $3,921,95; Gopher Stamp & Die Company, $208.02; Rochester Sand & Gravel Company, $2,393,64; Rochester Ready Mix, $469.45; Universal Motors, Inc., $570.0 5 and Standard Oil Company, $19087.990 Upon motion by Anderson, second by Moody, resolution adopted. Resolution appropriating $1, 237.50 from the P.I.B. fund and ordering jpayment made to Carlisle G. Fraser. Upon motion by Moody, second by Morris, resolution adopted. Resolution appropriating $498.25 from the P.I.R. Fund and ordering payment made to Romatz.Construetion Company. Upon motion by Morris, second by � Schroeder, resolution adopted. Resolution appropriating $4,340.49 from the Park Improvement Fund and ordering payment made to Walter. C. Heins Agency, $1,052.15; Fred Schuster, $437.28; Joe Cozik Plumbing Co.,.$487.31; Rochester Dairy, $200,90; Brinck-Solberg, $253.13 and Mayo Civic. Auditorium Revolving Fund, $1,909.71, Upon motion by Schroeder, second by Whiting, resolution adopted. Resolution ordering first hearing on installing sanitary sewer and water service connections in 13th Avenue Northeast in Jefferson Slopes. Upon motion by Whiting, second by Ackerman, resolution adopted. Resolution appropriating $354.24 from the General Fund, $11.30 from the S & A Fund and $22.20 from the Sewer Fund and ordering payment made to N. W. Bell Telephone Company. Upon motion by Ackerman, second by Anderson, resolution adopted. Mr. Robert Petersdorf was present at the meeting and requested the Council, either by motion or resolution, to notify each department head that in 0 order to hold a job on the City pagroll that the employee must be a resident. in 184 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., October 11. 1954 the City of Rochester. He further -stated that the Charter.vas very clear on the matter. No "tion was taken by the Council. Mr. 0. W. Haling was present and -stated that he was interested in• buying.a part of the land which the City had purchased -from Mr. Brause at the last meeting. He did.nottwish to purchase the entire•property but would like to make an offer on -the West 40 acres in the amount of $4500.00. He.further stated that in his.opinion the east section of this property would be an ideal.site for.an incinerator plant. He also stated that he would be interested in leasing the balance of the -property for perhaps a period of:three years or even a.lesser period of -time. Alderman Moody moved that the matter,be referred to the.Council as a committee of the whole for.their consideration and report at the.neat regular meeting.- Alderman Morris seconded the motion and all voted in favor thereof. Mr. Donald Kruger was present and called to the attention of the Council an ommiss.ion in section 4 (j) of Ordinance -Noe S74 and also recommended changes in,Section 9, of Ordinance No. 974, in the requirements of.a performance bond. Upon motion by Morris, second by Ackerman, the City Attorney was instructed to prepare an amendment to Ordinance No. 874 making the recommended changes in sections 4 and g. All voted in favor of the motion. A r-ece'ss`was:called at 9:45 P. Me President Bach called the meeting to order at 9:20 P. Me . An Ordinance to amend an Ordinance entitled, "An Ordinance granting to ,Donald Kruger the right and privilege.to collect commercial garbage in the City of Rochester", was given its first reading. Upon motion.by Morris,.second by Schroeder, and upon roll.call and all votIAg in favor thereof, the rules.we.re suspended and the.ordinance was given its second reading. • . Upon motion.by Morris, second by Ackerman, and upon roll call and all voting in favor thereof, the rules were suspended andthe ordinance was given its third and.final reading. t Upon motion by Morris, second by Anderson,.that the said Ordinance be adopted as ...read, and all voting in favor thereof, President Bach declared the .said Ordinance duly passed and adopted. An Ordinance entitled, "An Ordinance to provide for the licensing and regulating of certain going out of business sales", was given its first reading. An Ordinance amending an Ordinance entitled, "AA Ordinance establishing charges and rates for the use and service of the-Sevage Works of the City of Rochester, Minnesota", was given its first reading. Alderman Whiting moved that the last line of Section 1, of the above ordinance be amended to read, "The minimum rate shall be seventy-five cents per month." Mayor McQuillan discussed at length the matter of Clarence Crowe's employment in the Public Utility Department, and he recommended that an investiga- tion of.the Public Utility Board, the Utility Plant Management and the Public . Utility Department be made. Alderman Whiting, Me.mber of the Public Utility Board, stated -that there would be no objection to an unbiased investigation of the said department. After hearing others on the matter, Mayor McQuillan stated that he would apply for a grit of mandamus if Clarence Crow was not again on the job within 48 hours. No action was taken by the members of the CommonCouncil on th• matter, Mr. Garnet Spring, Building Inspector, stated that he had discussed an appeal by Gertrude Toomey,f rom the provisions of the Building Code wherein it is required that _a house be built on not less than 5,000 square feet, with the City Attorney and they recommended that the matter be referred to the Board of Zoning. Upon motion by Morris, second by_ Schroeder, the said appeal was ref erred. to the Board of Zoning. Upon motion by Morris, second by Schroeder, the meeting Was adjourned until 7:30 o"clock P.
