Record of Official Proceedings of the Common Council
of the City of Rochester, Minn., November 1, 1954
Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City,
on, November 1, 1954. -
President Bach called the meeting to -order at 2:00 o'clock P. M.,-the
following members being present: President -Bach, -Aldermen Ackerman, Anderson,
Moody, Morris, Schroeder and Whiting. • Absent :. - None.
Upon.motion by Moody, second by Ackerman, the minutes of the meeting of
October 19, 1954.were approved.
President. Bach stated this as being the time and place set. for the
I -following hearings:
Second hearing on the construction of sanitary sewer and water
service connections in 13th Avenue Northeast in Jefferson Slopes. There was no
one present wishing to be heard.
Hearing on the levying of special assessments for the construction of
a sanitary sewer and water main and sewer connections in Peck's 4th Addition.
There was no one present wishing to be heard.
Hearing on the levying of special assessments for the paving of lst
Avenue Southwest from Center Street to 2nd Street Southwest. There was no one
present wishing to be heard.
Hearing om the levying of special assessments for the construction of
a sanitary sewer and water main in Northwood Addition. There was no one present
wishing to be heard.
President Bach stated this as being the time and place set for receiving
and opening bids for the following projects:
Bids for installing sanitary sewer and water service connections in
Jefferson Slopes,. The bids of Carlisle G. Fraser in the amount of $1, 710. 50
and Viker & Sorenson in the amount of $1,679.70 were each received and opened
and upon motion by Ackerman, second, by Moody, the same were referred to the
Sewer and Water Committees and the City Engineer..
Bids for repairs to the East Center Street Bridge. The bids of
L. M. Feller Company in the amount of $39,969.21 and H. S. Dresser & Son in the
amount of $41, 506.60 were each received and opened and upon motion by Schroeder,
second by Morris, the same were referred to the Street & Alley Committee and
the City Engineer,
Mr. Richard Sabrowski, salesman for Aluminum Cooking Utensils, was
before the Council and protested the new ordinance relating to the licensing of
peddlers, canvassers and transient merchants. Later in the afternoon, Mr. Hermison
of the Fine Arts Company, Mrs. Hedstrom, Regional Manager for Beauty Counseller
Cosmetics and eight others were present and protested the terms of the said
ordinance. Mayor McQuillan spoke on the matter and recommended that the said

The three following resolutions adopted by the Public'' Utility Board were
each read and President Bach ordered the same placed on file:
"Be it and it is hereby resolved by the Public Utility
Board of the City of Rochester, Minnesota. that the Common Council
of the said City be and is hereby requested to authorize the
said Board to enter into a contract with the CLEMENTS CHEVROLET
COMPANY for the furnishing, in accordance with specifications, of
ONE (1) DELUXE MODEL 1954 TWO DOOR SEDAN
the total amount of the said contract to be $1,960,00 less as
allowance of $675.00 for trade-in of a 1950 Plymouth Coupe,
leaving a. net contract price of ELEVEN HUNDRED EIGHTY FIVE
DOLLARS ($1,185.00) and the said Clements Chevrolet.Company being
the lowest responsible bidder."
"Be it and it is hereby resolved by the Public Utility
Board of the City of Rochester, Minnesota that the Common„ Council
of the said City be and is hereby requested to authorize the said
Board to enter into a contract with UNIVERSAL MOTORS, INC*, for
the furnishing, in accordance with specifications, of
ONE (1) 1954 Model 12 TON FORD TRUCK,
the total amount of the said contract to be $2,633.85 with an
allowance of $900.00 for trade-in of a 1947 la Ton. Studebaker Truck,
leaving a net contract price of SEVENTEEN HUNDRED THIRTY THREEr'DOLLARS
AND EIGHTY FIVE CENTS ($1, 733. 85) ; the said *Universal Motors, Inc.,
being the lowest responsible bidder."
"Be it and it is hereby resolved by the Public Utility
Board of the City of Rochester, Minnesota that the Common"Council
of said City be and is hereby requested to authorize the said
Board to enter into a contract with DUFF e,nd PHELPS- of Chicago,
Illinois for the making of a economic and financial survey relative
to the operations of the Public Utility Department's electric
plants with special emphasis on the results of future expansion
relative to rate structures and areas served, the maxiumum cost
of the said survey to be FIVE THOUSAND DOLLARS ($5,000.00)."
The City Engineers preliminary estimate for construction of sanitary
sewer and water service connections in Jefferson Slopes in the amount of $1,430.001
was read and President Bach ordered the same placed on file.
The City Engineers preliminary estimate for repairs to the East Center
Street Bridge in the amount of $39,126.74 was read and President Bach ordered the
same placed on' f ile.
A letter from the State of Minnesota, Department of Highways, trans-
mitting an executed copy of an agreement between that Department and the City of
Rochester relative to improvements on Trunk Highway No. 296 along 4th Street S.E.
from Broadway to 6th Avenue Southeast was read and President Bach ordered the same
placed on file.
A letter from the Minnesota Department of Health together with a report
of their Municipal Water Supply Section covering an examintation of plans on
water main extensions in the City of Rochester were each read and President Bach
ordered the same placed on file.
Notice of claims for personal injury of Lillian McAdams in the amount
of $10,000.00'and Richard McAdams in the amount of $3,000.00 were each read. Mr.
George Pougiales, Attorney representing Mr. and Mrs. McAdams, was present and
spoke on the matter. A motion was then made by Morris, second'by Ackerman,
referring the said claims to the. City Attorney.

"To the Common Council
City of Rochester
Rochester, Minnesota
Gentlemen:
At a special meeting of the Board of Education, held in the
Coffman Building at 7:30 P. m. on Tuesday, September 25th,
1954. the following resolution was.une.nimously adopted:
"BE IT RESOLVED, by the Board of Education of School District
Number Eight (9) in Olmsted County, Minnesota, being the school
district included in the limits of the City of Rochester, Olmsted
County, Minnesota, that there be, and is hereby levied upon all
tamable property in said_ district a special school tax for:
Maintenance $1,162,750.00
capital Outlay 163, 450.00
Debt Service 259,700.00

or a grand total of one million, five hundred eighty-five
thousand, nine hundred dollars ($1, 585,900.00) for the use of
said district, and the Clerk of said Board of Education is
hereby instructed to notify the Common Council of said City of
Rochester, Minnesota, and to request their approval of the said
levy in accordance with the provisions of the City Charter."
The purpose of which said sum. is levied is as per copy attached.

The request of Calvary Episcopal Church to have Lot 11, Block 6, A. W.
Eutzky's Addition changed from a residential to a multiple dwelling zone was
read and upon motion by Schroeder, second by Anderson, the same was referred to
the Board of Zoning.
The request of the Olmsted County Bank and Trust Company, in its
official capacity as guardian of the estate of Margaret Phillips, requesting
that Lots 1 and 20 in Block 25, of Northern Addition be changed from a
residential to a commercial zone was read and upon motion by Schroeder, second
by Whiting, the same was referred to the Board of Zoning.

President Bach called a recess at 3:30 P. M. The meeting was called
to order again at 4: 15 P. M.
A petition for the construction of a water main in 18th Avenue S. W.
from 5th to 6th Street Southwest was read and upon motion by Ackerman, second
by Anderson, the same was referred to the Water Committee and the City Engineer.
A petition to have street lights installed in the 1600 block of 2nd
Avenue Northeast signed by 20 property owners in that area was read. Alderman
Moody advised the Countil that the requested street lights had already been
installed.
A letter from the Chief of Police calling the attention of the Council
to a condition of pedestrian crossing across 2nd Avenue between 1st and 2nd Street

Southwest, or in other words between the new clinic building and the old clinic
suggested
building was read. In the letter it was m ak/by the Chief of Police that the
problem might be solved by closing the street and making turn-arounds on each end,
putting -up a railing to prevent pedestrians from crossing or some other type of
engineering change. Further discussion was held on the matter but no action was
taken.
The application of Gerald F. Wright, National Gurad Armory Concession,
for a license to sell soft drinks was read and upon motion by Morris, second by
Ackerman, the license was granted.
The reports of.the Clerk of Municipal Court for the week ending
October 23, 1954 showing total climinal fines and costs collected $1,170.00 and
civil fees received $12.70 and for the week ending October 30, 1954 showing total
criminal fines and costs collected %1, 229.70. and civil fees received $3. 55, were
each read and having been approved by the City Attorney, President Bach ordered the
same placed on file.
The reports for the month of October, 1954 of the Building Inspector
showing fees collected for building permits issued $955.00; of the Electrical
Inspector showing fees collected for elec#rical permits issued $2,053.50; ofthe
Plumbing Inspector showing fees collected for plumbing permits issued $714.75; of
the Heating Inspector showing fees collected for heating permits issued $804.00
and fees collected for sign permits issued $92.26 were each read and President Bac
referred the same to the Finance Committee.
The surety bond of Naegele Sign Company in the amount ;of $3,944.4D with
the Travelers Indemnity Company as surety was read and the same was referred to thel
Mayor for his approval.
Mr. David Clappier,representing the Junior Chamber of Commerce, was
present and requested permission to put up a banner on Broadway from Dayton's
corner to Woolworth's corner to advertise their annual turkey shoot to. be held on
November 13 and 14, 1954. Upon motion by Schroeder, second by Morris, their
request was granted, subject to the supervision of the Building Inspector.
The recommendation of the Sewer and Water Committees and the City Engines,
that the bid of Viker and Sorenson for the installation of sanitary sewer and water
service connections in 13th Avenue Northeast in Jefferson Slopes be accepted at the
unit prices bid and checks be returned to the unsuccessful bidders was -read and
upon motion by Anderson, second by Moody, the recommendation was approved.
The recommendation of the Street & Alley Committee and the City Engineer
that the bid of L. M. Feller Company for repairs to East Center Street Bridge be
accepted at the unit prices bid and checks be returned to the unsuccessful bidders
wqs read and upon motion by Morris, second by Anderson, the recommendation was

The following recommendation of the Street & Alley Committee was read:
"Honorable Mayor & Common Council
City of Rochdoter, Minnesota
Gentlemen;
We recommend that the vest 90 ft. of 3 Street Southwest
lying between 9 and 9 Avenue Southwest be vacated as petitioned.
We, further recommend, that it be stipulated that the
petitioners accept the responsibility for the surface drainage
and surface drainage line in the area vacated, and save the
City free from any -responsibility on account of drainage across
the vacated area from existing streets.

After discussing the matter a motion was made by Ackerman, second by Whiting, that the
recommendation be accepted,
and upon roll call and President Bach and Aldermen Ackerman, Anderson, Schroeder
and Whiting voting in favor of the motion, and Aldermen Moody and Morris, voting
"no", the motion -was declared carried.
A motion was made by Alderman Whiting instructing the City Clerk to
request the Public Utility, through its meter readers, to make -a survey of the
residential garbage grinders; in use.and how many normally in the family. Alderman
Ackerman seconded the motion and all voted in favor thereof.
Mr. Stanley Drips, Secretary of the Central Area Improvement Assn.,
brought .to the attention of the Council that certain signs specifiying the
parking meter time limits were still not erected in certain locations. After
discussing the matter a motion was made by Whiting, second by Ackerman, author-
izing the Chief of Police to purchase signs for 30 minute zones for parking. All
voted in favor of themotion.
Mayor McQuillan stated that he had received compalints about no parking
being allowed in front of Sheppard's Grocery on 3rd Avenue Southeast and also on
6th Street Southwest between 2nd and 3rd Avenues where no parking is allowed on
either side of the.street.
Mayor McQuillan requested authorization to contact the Chicago North
Western Railway Comapny and insist that repairs be made on the railroad crossilp
which are, now in bad condition. A motion was made by Schroeder that the Mayor
be authorized to take whatever steps necessary to require the Railroad Company
to make repairs on the crossings. Alderman Morris seconded the motion and all
voted in favor thereof.
Mr. Gene Haylett, Manager of the Chamber of Commerce, was present and
spoke briefly on the ordinance about going out of business sales.
An Ordinance to provide for thelicensing and regulating of certain
going out of business sales, was given its second reading.
Upon motion by Whiting, second by Morris, and upon roll call and all
voting in favor thereof, the rules were suspended the ordinance was given its

Upon motion by _Schroeder, second,by Morris, that the said ordinance be
adopted as read, and all voting in favor thereof, President Bach declared the saic
ordinance duly passed and adopted.
An Ordinance• amending an ordinance. entitled, "An Ordinance establishing
charges and rates for the use and.ser-vice of the Sewage Works of the City of
Rochester, Minnesota," was given its second reading-.
Upon motion -by Whiting, second by Ackerman, and upon roll call and all
voting in favor thereof, the rules were suspended and -the ordinance was given its
third and final reading.
Upon motion by Moody, second by Morris, that the said ordinance be
adopted as read, and all voting in favor thereof, President Bach declared the sa
ordinance duly passed and adopted.
The following resolutions were each introduced and read and all -voting
in favor thereof, President Bach declared. the same duly passed and adopted:
Resolution accepting bid of Viker & Sorenson for installing sanitary
sewer and water service connections in Jefferson Slopes. Upon motion by Ackerman,)
second by Anderson, resolution adopted..
Resolution accepting bid of.L. M. Feller Company for repairs to the Eastl
Center Street- Bridge. Upon motion by Anderson, second by Moody, resolution
adopted.
Resolution ordering a hearing on the levying of special assessments for
the resurfacing of 3rd Avenue Southwest from 1st to-2nd Street' Southwest. Upon
motion by Moody, second by Morris, resolution adopted.
Resolution appropriating $2,353.34 from the General Fund and ordering
payment made to Universal Motors, Inc. Upon motion by Morris, -second by Schroeder!
resolution adopted.
Resolution appropriating $249.78.from the General Fund, $304.35 from the
Fire Protection Fund and $500.00 from the Parking Meter Fund and ordering payment
to Whiting Press, Inc., $249.78; Fire & Safety, Inc., $304.35 and H & H ElEctric
Company, $500.00. Upon motion by Schroeder, second by Whiting, resolution
adopted.
Resolution appropriating 4654.00 from the General Fund and $461.25 from
the Sewer Fund and ordering payment made to Dresser Trap Rock Co.* $654.00 and
Cutler Magner Company, $461.25. Upon motion by Whiting, second by Ackerman,
resolution adopted.
Resolution appropriating $1,241.73 from the Street & Alley Fund and

The meeting was recessed at 6:00 P. M. President Bach called the
meeting to order at 7:30 P. M.,-all members of the Council were present except
Alderman.Moody.
An Ordinance.amending an;ordinance entitled, "An -Ordinance relating

.pe4alties for the violation-thereoVI, was given its first, -second and third
reading under suspended rules. Alderman Whiting moved that the said ordinance
be adopted as read, Alderman Schroeder seconded the motion, and all present
,voting in favor thereof; President Bach declared the said ordinance duly passed
and adopted.
Alderman Ackerman moved that Alderman Schroeder -be authorized to write
to the League of Minnesota Municipalities and extend the use of City -facilities
to conduct a meeting of the Finance Committee on November 20, 1954, Alderman
Whiting .seconded the motion and all present voted in favor thereof. —
Upon •mot.ion by Whiting, second by Morris, -the meeting was adjourned
