HomeMy WebLinkAbout11-15-1954Record of Official Proceedings of the Common Council 201 of the City of Rochester, Minn., November 15, 1994 Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on November .15, 1954. President Bach called the meeting to order at 7:30 o'clock P. -M., the following members being present: President Bach, Aldermen Ackerman, Anderson, Moody, Morris and Whiting. Absent: Alderman Schroeder, due to,illness. Upon motion by Morris, second by Ackerman, the minutes of the meeting of November 1, 1954 were approved. President Bach stated this as being the time andplace set for a hearing • on the levying of special assessments for the resurfacing of 3rd Avenue Southwest from lst to 2nd Street Southwest.. There was no one present wishing to be heard. The City Engineers preliminary estimate of cost for construction of a water main in 5th Street Southwest from lgth Avenue Southwest to the west line of Mohn & Hodge Replat and 18th Avenue Southwest from 5th Street to the south end of Riolen Addition in the amount of $5, 489.40 was. read and the same was ordered place on file. A letter from the Minnesota Railroad and Warehouse Commission trans- mitting a notice of hearing covering an application of Monson Dary Line, Inc. for additional authortiy, said hearing to be held on November 30, 1954 at 10:30. A. M., and requesting permission to use the Council Chambers for the said hearing was read and upon motion by Morris, second by Ackerman, their request.was granted. A letter from Mrs. Ralph Bremseth of Racine, Minnesota regarding the disposal of stray dogs in the City of Rochester was read and the same was ordered placed on file. The following communication was read and upon motion by Morris, second by Ackerman, the.same was referred to the Board of Zoning: "The Honorable Mayor and The Common Council Rochester, Minnesota • Gentlemen: Providing the City Council vacates the easement adjacent face t to the South property line of the lot described as the west 90 feet of the south 160 feet of Block 29, Head and McMahon's Addition owned by Mr. and Mrs. George F. Waters, we petition that you give an easement to build our house 25 feet back from our South property line. However, if the City Council decides notto vacate the easement adjoining our property, we therefore petition.you to permit us to build on our exisiting property line, otherwise half of our house would _end, up in the middle of the tennis court. Such a location would be consistent with that of the neighboring house to the east, owned by G. A. Peters (the old Braasch house) which also stands on - the same extended property line. We would be most grateful for your thoughtful consideration on this matter at your next meeting. Respectfully yours, George F. Waters Mrs. George F. Waters" The application of Carl A. Theel for appointment to the office of City • Treasurer when there is a vacancy was read and the same was ordered placed on file. 2 ® 2 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., November 15, 1994 The application of Huey's Liquor Store, Inc. for permission to move their store f rom 230 South Broadway to 325 South Broadway was read and upon motion by Morris, second by Ackerman, their application was -approved. The request of H. S. Patterson for a parking zone in fraont of his apartment building at 420 North Broadway was read and upon motion by Morris, second by .Whiting, the same was referred to the Police Committee and the Chief of IPolice. The request of Lysne Construction Company for a permit to move a garage located at the Rochester City Farm to the old sewage treatment plant was read and upon motion by Morris, second by Ackerman, the permit was granted, subject Ito. the supervision of the Chief of Police and the Building Inspector. The petition of the Rochester Downtown Retail Merchants Association to establish amplifiers outside of their stores on Broadway during the Christmas Iseason (December 1 to December 24) during store hours to play Christmas music lwas read and upon motion by Whiting, second by -Morris, the petition was granted. The recommendation of the Board of Zoning that the petition of C. A. "Pat" Moore to have Lot 11, Block 2, Kutzky's First Addition changed from a residential to a multiple dwelling zone be granted was read and upon motion by Morris, second by Ackerman, the recommendation was approved and the City Clerk was instructed to publish a notice of hearing to be hold at 2:00 P. M. on IDecember 6, 1954. The recommendation of the Board of Zoning that the petition of Freda Sorenson to have the West a of Lots 1 and 2, Block 32, Northern Addition charf d from a residential to a commercial zone be granted was read and upon motion by Morris, second by Ackerman, the recommendation was approved and the City Clerk was instructed to publish a notice of hearing to be held at 2:00 P. M. on December 6, 1954. The recommendation of the Board of Zoning that the request of Gertrude Toomey for an appeal from the decision of the Building Inspector in the matter square of the.request of Gertrude Toomey to construct a house on less than 5,000/feet, the said property being described as the •East 85 feet of the. South 50feet of Lot 5, Block 9, Head & McMahon's Addition, be granted was -read and upon motion by Whiting, second by Morris, the recommendation was approved and the City Clerk was instructed to publish a notice of hearing to be held at 2:00 P. M. on December 6, 19 54.` President Bach read a letter from Sister Mary Brigh, Adminstrator for St. Mary's Hospital, in reference to the change in rates for sewage treatment, in accordance with the new ordinance recently adopted, which seemed excessive. Sister Brigh suggested that the Council give the matter further study. A. Armstrong and City Attorney R. V. Ehrick would makean appointment to meet with her and go over the matter. The City Treasurer s statement of*funds- for t'he month of October, 1954 -was read and President Bach ordered the same placed on file. The report of the City Weighmaster for the month of October,' 1954 showing fees collected for loads weighed in the amount of $152,65 was read and President Bach referred the same to the Finance Committee. The reports of the Clerk of Municipal Court for the week ending November 6, 1954 showing total criminal fines and costs collected $970.00 .and civil fees .received $1.65 and for the week ending November 13, '1954 showing total criminal fines 'and costs collected $2, 039* 00 and civil fees received $10- 55, were each read and having been approved by the City Attorney, President Bach ordbred the same placed on file. The contract bonds of L. M. Feller Company in the amount of $39,969.21 with the Seaboard Surety Company as surety and Viker & Sorenson in the amount of $1,679.70 with the Travelers Indemnity Company as surety were each read and the same were referred to the Mayor for his approval. The following communication from the Vets Cab Company was read and upon motion by Morris, second by Moody, the same was referred to the Police Committee and the Chief of Police for report at the meeting of December 6, 1954: "Honorable Mayor and Common Council Rochester, Minnesota Gentlemen: I hereby make application for the return to use by the Vet's Cab Company of -our taxi stand on lst St. S.W. and 2nd Ave. S.W. on the South side of 1st S., West of 2nd Ave. Also the return to use of our taxi stand on the West side of 1st Ave. 'at 1st St. S. W. I also would like to have the taxi stand on Fimt Ave. S.W. hear the Eagle Restaurant changed to the South Side of First St, S. W. at 3rd Ave. S,14. at the Virginia Hotel. The reason for this change is that this stand nearly always has other cars parked in it,and is not of much use to us. Carl F. Petersen Owner of Vet's .Cab Co." Mr. Joseph H. Kremer, Manager of the Rochester Yellow Cab Corporation was present at the meeting and requested permission to set up a two cab stand on 2nd Avenue S. W. on the west side of 2nd Avenue at 1st Street S. W. and a two cab stand at let Street S.W. on the south side of the street at west end of 200 block and also, they have a three cab stand on the west side of the'Kahler Hotel and would like to move one of these cabs to the south door of the Kahler. Mr. Kremer- was requested to submit his request in writing and upon motion by Morris, second by Anderson, the same was referred to the Police Committee and the Chief of Police for report at.the meeting of December 6, 1954. 0 Mr. D. B. Hunt, Attorney representing realtors and real estate salesman, 204 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., November 15, 1954 who had not been granted licenses, stated that he did not think that the committee who investigated applications for realtors and real estate salesmen should be made up of members who are in that business. Mayor McQuillan expressed himself as being in agreement with Mr. Hunt. Mr. Robert Petersdorf was present and stated that he thought the committee was proper as set up. Upon motion by Morris, second by Ackerman, the matter was referred to the License Committee, and the City Attorney to make investigation as to how the examination is being conducted and see that everthing is being done in accordance with the ordinance. All voted in favor of the motion. Mayor McQuillan read a request from the Public Utility Department for an emergency order to construct a water main in 5th Street S. W. from 18th Avenue S. W. to the west line of Mohn & Hodge Replat and in 18th Avenue S. W. from 5th Street to the south end of Riolen Addition and asked the Council if they considered it an emergency. City Engineer Armstrong explained that -;:at present contractors were working in that area and_ for that reason the construction might be done more economically than if the hearings were held and bids taken which would also postpone the job until spring. The Council expressed themselves as being in favor of the project being done under the Mayor's emergency order. Mayor McQuillan presented a statement of his petty cash fund to date of November 5, 1954 and requested that the Council appropriate the Mayor's allowance covering the last 5 mmonths of the year as provided in the Charter amendment effective October 14, 1954. Upon motion by Morris, second by Ackerman, the requested amount was appropriated from the General Fund and ordered paid to the Mayors Contingent Fund, said amount being $458.31. Mayor McQuillanL r easi a request from Dr. A. H. Sanford, a member of the Band and Music 8ommittee, asking that the Council instruct the City Attorney Ito prepare a resolution to be presented to our State Senator and Representative to increase the amount which the statutes allow for.the maintenance of a band in the City of Rochester. Upon motion by Ackerman, second by Morris, the City Attorney was instructed to prepare the said resolution,.the same to be presented on December 6, 1954. Mayor McQuillan stated that the owner of Dells Grocery Store at 1109 West Center Street had requested that the parking on one side only.of.Center Street be changed from the north side to the south side.. Upon motion by Whiting, second by Ackerman, the City Attorney was instructed to prepare a resolution no changing parking on West Center Street from llth to 16th Avenue from the north to the south side of the street. All voted in favor of the motion. Mayor McQuillan next brought up the matter of the Peddler's Ordinance stating that he thought the one recently adopted should be repealed and further k 1 • 1 • study made before starting to redraw the ordinance. CJ 1 • 1 40 the Electrolux Company was present at the -meeting and spoke in 'favor of the ordinance as adopted." Mayor McQuillan stated that he had received a call from a party who resides on 4th "Avenue Southeast next to loth 'Street Southeast asking if it would be possible to continue the water main which services that area, so that it could be hooked up and circulate the water as it is now dead and -stale. Upon motion by Anderson, second by Ackerman, the matter was -referred to the -Public Utility Department to investigate the -matter and correct same 'if possible. - Earlier in the "meeting Mayor McQuillan brought up the matter of taking care of the house on the Weih-Brause property in order to avoid the freezing of water pipes, etc. At this time Alderman Moody stated that some time ago the 'Council gave him authority 'to negotiate with Mr. 0. W. Haling 'for the sale of the Brause=Weih farm and had now finally come to Tan 'understanding 'as to the price he would pay for the farm (65 -acres). He further stated that Mr. Brause had installed a new space heater and had also constructed a new fence. Also the matter of connecting t-o t'he gas line to the S.ewage Treatment Plant, which service Mr. 'Ealing would like .to 'have, was brought up and the same was referred to the Cit; Engineer 'to determine if this service" could be available to Mr. Haling. Mr. C. A. Armstrong, City Engineer, stated that the' storm sewer which drains the area at'the north entrance of the Kayo Civic Auditorium should be repaired. • Upon motion by Morris, second by Moody, the City Engineer was authorized to make the ne'ces'sary 'repairs to the storm 'sewer, the cost of same -to be paid from the Parking Meter Fund.- All voted in favor of the motion.
