HomeMy WebLinkAbout11-22-1954Record of Official Proceedings of the Common Council of the City of Rochester, Minn., November 22, 1954 qq 211 1 • 1 • Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on November 22, 1954, President Bach called the meeting to order at 7:30 o'clock P. M., the following members being present: President Bach, Aldermen Ackerman, Anderson, Moody, Morris, Schroeder and Whiting. Absent: None. Upon motion by Moody, second by Morris, the minutes of the meeting of November 15, 1954 were approved. The petition of School District No. 9 to have the following described property annexed to the City of Rochester was read and upon motion by Moody, second by Morris, the.same was referred to the Street & Alley Committee, the Sewer Committee and the City Engineer for recommendation and report. All voted in favor of the motion. nA piece of land in the Northeast quarter of Section 34- Township No. one hundred seven (107) North of Range No. fourteen (14) West described as follows: Beginning at a point on the North line of said Section No. thirty four which is six hundred sixty two (662) feet East of the Northwest corner of the Northeast quarter of said Section No. thirty four, thence South on a line parallel with the East line of State Trunk Highway No. fifty two (52) and two hundred .seventy (270) feet East therefrom, to the North line of County Road I (Seventh Street Northwest extenddd), thence Southeasterly along the North line of said County Road I to the west line of Gooding's Addition to Rochester, Minnesota, thence Northerly along the West line of said Gooding's Addition to the North line of said Section No. thirty four, thence West along the North line of said Section No. thirty four (34) to the place of beginning." - Notice by the League of Minnesota Municipalities of Municipal Short Courses to be conducted at the Continuation Center of the University of Minnesota through January, February and March, 1955 was read and President Bach ordered the same placed on file. The recommendation of the Board of Zoning that the petition of Calvary Episcopal Church to have Lot 11, Block 6, A. W. Kutzky's Addition changed from a residential to a multiple dwelling zone be granted was read and upon motion by Schroeder, second by Morris, the recommendation was approved and the City Clerk was instructed to publish a notice of a hearing to be held on December 6, 1954. The recommendation of the Hoard of Zoning that the petition of Olmsted County Bank & Trust Company, Guardian of the estate of Margaret Phillips, to have Lots 1 and 29 Block 25, Northern Addition changed from a residential to a commer- cial zone be not granted was read. A motion was made by Schroeder, second by Ackerman, that the petition be denied. All voted in favor thereof. A change order issued by the City Engineer to Leon Joyce to omit and delete from the contract for grading and surfacing in Highland Addition the following items: Construct concrete footing 50 cys ® $30. $1500. 00 Construct Concrete Block Retaining 150 cys. 0$24.. 3600. o0 Total 5100.00 A motion -was made by Schroeder, second by Ackerman, that the' change order be CJ 212 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., November 22, 1954 approved and the said changes be deleted from the said contract. All voted in favor of the motion. The resignation of Karl H. Postier as City Treasurer of the City of Rochester, effective after December 31. 1954 was read and upon motion by Ackerman, second by Moody, his resignation was accepted, Requests for audit by the Public Examiner of the books, records, accounts and affairs of the City Treasurer of said .City for the period ending December 31, 1954 and of the City of Rochester for.the period from April 1, 1954 to March 31, 1955 were each read. Report of the Clerk of Municipal Court for the week ending November 20, • 1954 shoring total criminal fines end costs collected $1,409.00 and civil fees received $.50 was read and having been approved by the City Attorney, President Bach ordered t he same placed on file. The application of Green Parrot Company for a permit. to conduct an auction sale at the Light House Cafe on Friday, November 19, 1954 was read and upon motion by Schroeder, second by Ackerman, the license was granted. Upon motion by Ackerman, second by Whiting, the amount of $15.00 was refunded to the Green Parrot Company for overpayment of the license fee. The application of Rochester Bus Line, Inc. for transfer of City License No. 4 from Bus #23 to Bus # 41 and requesting a city license for Bus #42 was read and upon motion by Ackerman, second by Morris, the same were granted. The request of the Rochester Bus Line, Inc. for renewal of the bus franchise, which expires December 4, 1954, was read and upon motion by Schroeder, second by Moody, the same was referred to the City Attorney Vo prepare a new franchise. Mr. David Bemel, representing the Lions Club was present at the meeting and requested the approval of the Council for permission to be granted to the Lions Club to sell "bags of bulbs" for the purpose of raising funds to pay the way of blind children to a camp at Annandale, Minnesota. • Mr. Joe Robbins, Manager of the Peoples Natural Gas Company, was before the Council and requested their approval of the proposed increase in rates for the sale of gas in the City of Rochester. After hearing Mr. Robbins a motion was made by Alderman Ackerman, second by Alderman Morris, instructing the City Attorney to prepare a franchise governing the sale of natural gas in the City of Rochester by the Peoples Natural Gas Company. All voted in favor of the motion. The following resolutions were each introduced and read read, and all voting in favor thereof, President Bach declared the same duly passed and adopted: Resolution appropriating $1, 450.35 from the General Fund, $1, 575.90 from the Sewer Fund and $644.87 from the Lighting Fund and ordering payment made to Continental Oil Company, $1,200.60 and City of Rochester, P.U., $2,470.52. Upon motion by Moody, second by Morris, resolution adopted. .Resolution appropriating .$11, 32.2.00 from the Permanent. Improvement Fund and ordering payment. made to C. C,. Pagenhart: Upon motion ,by Morris, second by Schroeder, resolution adopted. Resolution appropriating. $309.00 from the Parking Meter Fund and orderinj payment made to Gopher Stamp & Die Company. Whiting, resolution adopted. Upon motion by Schroeder, second by Resolution ordering examination of books, e.nd records'of the. City Treasur� for the period of April 1, 1954 through December 31, 1954. Upon motion by Whiting, second by Ackerman,, resolution adopted. Resolution ordering examination.of books and records of the City of Rochester for the fiscal year.April 1, 1954 to April 1, 1955. Upon motion by Ackerman, second by Anderson, resolution adopted. . Resolution appropriating $470.97 from the General Fund and. ordering payment made to Northwestern Refining Company. Upon motion by Anderson, second byl Moody, resolution adopted. The following claims were each read and upon motion by Anderson, second by Morris, the same were approved and the Mayor and City Clerk were authorized andl directed to draw warrants upon the City Treasurer and make payments accordingly: From the General Fund: N. Before considering the adoption of the budget setting up the tax levy for the fiscal year beginning April 1, 1955 and ending March 31, 1956, Alderman Schroeder explained that the Council had been working on the budget during the past month and felt that adequate provisions had been made for increased expense of operation in various City departments. Mr. Orville Mertz, an employee of the Fire Department; stated that the proposed wages, as submitted by the panel, for .the Fire Dpeartment was not covered.by the amount.as shown in the proposed budget. Also Mr. Jack Toogood,,a member of the.Fire.Department, inquired as -to whether s the $233,900.00 proposed salary budget included the salaries of the 12 new firemen. He was informed that it.did. Mr. Mertz and Mr. Toogood were each again heard later .in.the evening. Mr..Robert Petersdorf, of the Building Trades & Construction Council, stated that a fireman received less than a common laborer and he thought the Council should set the salaries.as.previously recommended by the panel•on fire department salaries. he later.stated that he thought the Council could actually set salaries at this time for the following fiscal year. Mr. Emrold Thiem inquired as to_whether all department heads had received copies of the proposed budget and did not understand why more copies.had not been prepared by the City Clerk's office. Mr., Harold Schmidt, President of the Lions Club, inquired if police protection would be impaired if the number of patrolmen requested was not. granted' in full. Mr. James Hoben of the Miracle Mile Shopping Center and Mr. E.F. 1 • • 0 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., November 22, 1994 _q 215 • 1 • 1 Hrabe of Red Owl Stores, Inc. were present and asked for more police protection at the said shopping district. Mr. Hrabe stated that the Red Owl Store cashed many checks and carried same on hand from the late afternoon until they closed at 9: 30 P. M. Chief of Police, James J. Macken, Jr., recommended that more patrolmen be added to .the police force in order to take care of the said shopping district. It was suggested that a mill be added to the proposed police budget for the purpose of employing more patrolmen. A resolution levying taxes as shown in the proposed budget was read. A motion was made by Alderman Ackerman, second by Alderman Moody, that the resolution be adopted. After- further discussion, the motion and second were withdrawn. Mr. Dwight J. Campbell, proprietor of the Midway Grocery at the corner of East Center Street and 7th Avenue was again before the Council in regard to parking space in front of his store on the North side of Center Street so that cars going west could stop at his store. This parking area would be in addition to the parking area which is now provided on the South side of Center Street across from his store. No action was taken on the -matter at this time. Upon motion by Ackerman, second by Morris, the meeting was adjourned until 7:30 o'clock P. M. on November 29, 1954. DeRfity City Clerk •
