Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
said City, om December 20, 1954.
President Bach called the meeting to order at 7:30 o'clock P. M., the
following members being present: President Bach, Aldermen Ackerman, Anderson,
Moody, Morris, Schroeder and Whiting. Absent: None.
Uponmotion by Moody, second by Morris, the minutes of the meeting of
December 2, 1954 and December 6, 1554 were approved.
The following recommendation of the Street & Alley and Seger Committees
was read and upon motion by Morris, second by Moody, the same was approved:

"Honorable Mayor & Common Council
City of Rochester, Minnesota
Gentlemen:
On the matter of the request of School District No. 9 for
annexation of approximately 37 acres in Section 34 - Cascade
Township, we report as follows:
1. The area is not platted, and annexation should be
subject to agreement that the School Board plat and
dedicate an acceptable street pattern as soon as
their building plans permit.
2. Dedication for the south a of 14th Street Northwest,
which is along the north boundary of the area, should
be dedicated at this time.
3. The sanitary sewer in 7th Street Northwest east of
llth Avenue Northwest was not designed to accomodate
the entire area west of 11 Avenue Northwest, of which
the school property is a part. It appears that it
will be necessary to.construct a relief sewer to
adequately serve the entire area west of 11 Avenue
Northwest and north of the railraod tracks.
4. This property should expect to participate in the
cost of such a relief sewer as well as any storm
sewers necessary for the development of the area.

The recommendation of the Sewer Committee that bids be taken for the
•
annual supply of Anhydrous Ferric Chloride, -approximately 46,200 lbs., for
use at the Sewage Treatment Plant was read and -upon motion by Morris, second by
Anderson, the recommendation was approved.
The recommendations of the City Engineer, the Public Utility Department
and the Planning and Zoning Commission that annexation of Peck's Fifth Addition
be approved were each read. A motion was made by Alderman Morris, second by
Alderman Moody, that the recommendations be approved and that the City Attorney
be instructed to prepare an ordinance annexing the said Peck's Fifth Addition
to the City of Rochester. Upon roll call all voted in favor of the motion.
The request of Lin H. Dalrymple, manager of Hotel Francis, for a
loading zone in front of Hotel Francis at No. 1.7 - 4th Street Southwest, was

read and upon motion by Morris, second by Schroeder, the same was referred to the
Police Committee and the Chief of Police. All voted in favor of the motion.
A letter from Mr. Donald T. Franke expressing his appreciation to the
Council for setting up one-way streets on 3rd and 4th Avenues Southwest and.
Northwest was read and President Bach ordered the same placed on file.
A petition for construction of a curb and gutter on 2nd Street Nort1ra.st
from llth to loth Avenue Northeast was read and upon motion by Schroeder, second
by Morris, the same was referred to the Street & Alley Committee and the City
Engineer.
The Health Officer's Lockup Inspection Report as of December 5, 1954
was read and President Bach ordered the same placed on file.
The report of the Office of Civil Defense for the period of August 1,
1954_to December 1, 1954,was read and President Bach ordered the same placed on
f ile.
The City Treasurer's Statement of Funds for November, 1954 was read and
President Bach ordered the same placed on file.
The reports of the Clerk of Municipal Court for the week ending
December 10, 1954 showing total criminal fines and costs collected $1,.667.00 and
civil fees received $3.30 and for the week ending December 19, 1954 showing total
fines and costs collected $759.00 and civil fees received $3.55 were each read
and having been approved by the City Attorney, President Bach ordered the same
placed on file.
The application of Lysne Construction Company for a permit to move a
Boxcar over certain streets in the City from the Rochester Dairy outof the city
limits was read and upon motion by Morris, second by :Moody, the permit was
granted, -said -building to be moved under the supervision of the Building Inspectorl
and the Chief of Police.
The application of Littrup Nielson for a license to connect with sewers
and drains was read and upon motion by Morris, second by Anderson, the license
was granted.
The license bond of Littrup Nielson in the amount of $1,000.00 with the
Western Surety Company as surety was read and upon motion by Whiting, second by
Ackerman, the bond was approved, the surety_ thereon accepted and the same was
ordered placed on file.
Mr. John J. Pemberton, Jr., representing. Mr. & Mrs. George Waters, was
present and again urged that action be taken by the Council vacating that part of
3rd Street Southwest as petitioned for by his clients. A -resolution vacating the
West 90 feet of that part of 3rd Street Southwest lying between the west lineof
8th Avenue Southwest and the east line of 9th Avenue Southwest, which was introduc

was made by Ackerman, second by Whiting, that the resolution be adopted as read.
Upon roll and all voting in favor of the -adoption of the resolution except Aldermen
Moody and Morris, who voted °noP, President Bach declared the said resolution duly
passed and adopted.
The City Attorney then stated that an easement for utilities across the
said property had been prepared and signed by the proper individuals. To date
the easement has not been filed in the City Clerk's office.
The following resolutions were each introduced and read and President
Bach declared the same duly passed and adopted;
Resolution appropriating $625.40 from the General Fund, $2,317. 53 from
the S & A Fund, $547.00 from the Sewer Fund, $89.60 from the Bridge Fund and
$57,7.80 from the Parking Deter Fund and ordering payment made to the Street &
Alley Fund. Upon motion by Ackerman, second by Anderson, resolution adopted.
Resolution appropriating $273.54 from the General Fund, $42.23 from
the S & A Fund, $29- 52 from the Fire Protection Fund, $1, 470.06 from the Sewer
Fund and $5, 723.50 from the Lightizrg Fund and $2. 52 from the Parking Meter Fund
and ordering payment made to City of 'Rochester, Public Utilities. Upon motion
by Anderson,, second by Moody, resolution adopted.
Resolution appropriating $34,508.69 from the General Fund, $7,240.00
from the Fire Protection Fund and $23,090.95 from the P.I.R. Fund and ordering
payment made to Public Utility Fund,; $7,240.00; Street & Alley Fund, $10,000.00;
P. I. R. Fund, $24,509.69 and Street & Alley Fund, $23,090.55. Upon motion by
Moody, second by Morris, resolution adopted.
Resolution appropriating $901.27 from the General Fund and $2.25 from
the Parking Meter Fund- and ordering payment made to H. Dornack & Son, $345.92;
City of Rochester, P.U., $299.00 and Rochester .Post Bulletin, $269.60. Upon
motion by Morris, second by Schroeder, resolution adopted. -
Resolution appropriating $236.75 from the General Fund, $756.14 from
the S & A Fund and $203. S2 from the Parking Meter Fund and ordering payment made
to Jones & Schmelzer Printing Company, $200.95; H & H Electric Company; $243.36
and Olmsted County Road & Bridge Fund, $752.50. Upon motion by Schroeder, second
by Whiting, resolution adopted.
Resolution appropriating $281.45 from the Sewer Fund, $526.24 from the
Street & Alley Fund and $204.97 from the Parking Meter Fund -and ordering payment
made to Patterson Rock Products, $366.59, Firestone Stores, $365.97 and Peoples
Natural Gas Company,-$280.20. Upon motion by Whiting, second by Ackerman,
resolution adopted.
Resolution appropriating $65, 550.00 from the P.I.P. Fund and ordering

A resolution introduced by Alderman Whiting which reads in part as folio
was read:
"NOW THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE
CITY OF ROCHESTER, that pursuant to the authority contained in
Section 10 of Ordinance Igo. 559 as amended, the application of
subparagraph (ca) of Section 3 of Ordinance No. 559 as amended,
is hereby varied and suspended so as to permit the said -Gertrude
Toomey to construct a single dwelling house upon the following
described land in the City of. Rochester, to -wit:
East eighty-five feet (E.95') of the North
forty feet (N.401) of Lot seven (7) and the east eighty
five feet (E.851) of the South ten feet (5.101)
of Lot -six (6), all in Block nine (9), Head and
McMahon's Addition."
A motion was made by Schroeder, second by Whiting, that the said resolution be
adopted as read and upon roll call and all voting in favor thereof, President Bach
declared the said resolution duly passed and adopted.
A resolution introduced by Alderman Schroeder amending a resolution
establishing -parking and parking meter regulations and provisions pursuant to
Ordinance No. 871. A motion was made by Whiting, second'by'Ackerman, that the
said resolution be adopted as read, and all voting in favor thereof, President Ba
declared the said resolution duly passed and adopted.
Mr.' Robert Petersdorf was present at -the meeting and again discussed the
matter of increasing rates for natural gas in the City of Rochester. He stated
that in his opinion an increase of 25% was excessive and felt that a smaller --
raise should be tried before the 25% increase was approved. A motion was then
made by Alderman Whiting, second by Alderman Ackerman, that the rules be suspended
and an ordinance amending an ordinance granting a franchise to the Peoples Natural
Gas Company be given its third and final reading. Upon roll call Alderman Moody
voted "no".
An Ordinance annexing to the City of Rochester, Minnesota, a part of the
Southeast Quarter of the Southwest Quarter and the Southwest Quarter of the South-
east Quarter of Section 25, Township 107 North, Range 14 West, in Olmsted County

Minnesota, to be known and designated as Peck's Fifth Addition was given its first
reading.
Upon motion by Morris, second buoy Moody, and upon roll call and all voting
in favor thereof,_ the rules were -suspended and the ordinance was given its second
reading.

Upon motion by Moody, second by Ackerman, and upon roll call and all
voting in favor thereof, the rules were suspended and the ordinance was given its
third and final reading.
Upon motion by Anderson, second by Ackerman, that the said ordinance be
adopted as read, and all voting in favor thereof, President Bach declared the
said ordinance duly passed and adopted.
Mr. Desmond B. Hunt was again present at the meeting in regard to the
granting of real estate brokers and salesman licenses. Mr. Hunt stated that the
matter of granting certain licenses to real estate brokers and salesmen appeared
to be a closed corporation and recommended that the Council check over the
examination papers which had been previously submitted for the purpose of
attaining licenses. Mayor McQuillan stated that he had already checked into some
of the examination papers and stated that it appeared that licenses had been
granted to applicants when.10 errors appeared in;answering the questions, while
others who had only six errors on their examination papers had not as yet
received their licenses. Alderman Whiting stated that he had contacted Mr. Emil
Heintz in regard to conducting classes, at night school, for realtors and real
estate salesmen and he had been informed by Mr. Heints that such a class could
be made available and would last for a period covering about 6 weeks.
The resignations from the Rochester Realty Commission of Mr. Norman
J. Kuyath and Mr. Theo. F. Franke were each read. A motion was made by Whiting,
second by Ackerman, that the resignations be tabled until thenext meeting. All
voted in favor of the motion.
Mr. John J. Pemberton, Jr., attorney representing Mr. & Mrs. George
Waters, requested that the following recommendation by the Board of Zoning be
approved:
"To theHonorable Mayor and
Members of the Common Council
City of Rochester, Minnesota
Gentlemen:
A letter from Mr. & Mrs. George Waters which reads
in part as follows, was read at a meeting of the Board
of Zoning held on November 18, 1954:
'However, if the City Council decides not to
vacate the easement adjoining our property, we
therefore petition you to permit us to build on
our existing property line, otherwise half of
our house would end up in the middle of the
tennis court. Such a location would be consis-
tent with that of the neighboring house to the
east, owned by G. A. Peters (the old Braasch
house) which also stands on the same extended
property line. •
Mr. Garnet Spring, Building Inspector, advised that
the Board of Zoning view the property before making any
decision, which was done.
After inspecting the property a motion t:,ras made,
seconded, and duly carried, recommending to the Common
Council that the Building Inspector be authorised to
issue a permit to Mr. & Mrs. George Waters t•o construct
a residence located on -the property as requested in
their letter of November 12, 1954.

A motion was made by Ackerman, second by Anderson, that the recommendation of the
.Board of 'Zoning be approved and upon roll call, all voted in favor of the motion
except Aldermen Moody and Morris, who voted "no".
Alderman Morris stated that the City Painter would not have time.to do
cleaning and painting in the City Hall which is needed this winter and had asked
for help -to take care of the work in the City Hall. Upon motion by Schroeder,
second by Ackerman, the matter was referred to the Public Grounds Committee with
power to act.
The City Engineer stated that C. C. Pagenhart had asked for permission
to close the alley on the east side of the new Post Bulletin Building for six
months. No action was taken by the Council.
The City Engineer stated that the Planning and Zoning Commission had
asked for permission to use funds which were included in the City budget for plan-
ning the area North of 14th Street Northwest between Highways No. 52 and -63. A
motion was made by Writing, second by Morris, that the Council go onrecord as
approving same.
Alderman Moody brought up the matter of purchasing new equipment for thel
washing and cleaning �of pa-rking meters. A motion was made by Whiting, second by
Morris, that the matter be referred to the Police Committee with power to act.
Alderman Morris suggested that steps be taken to sell the land known as
the Ci-ty Hog Farm. A motion was made by Morris, second by Whiting, that the City
Clerk advertise for bids for the sale of the said land, bids to be received on
February 7, 1954, with the provision that the Common Council reserves the right
to -reject any and all bids and that the City Attorney furnish to the City Clerk a
legal description of the said real estate. All voted in favor of the motion.
The request of Dr, Robert W. Oelslager, for a parking place at No. 4 -
lst Avenue Southeast where he will conduct his practice as a Chiropractor and
Physio-Therapy was read tog ether- with a letter from Dr. F. L. Armstrong recommendi
that his request be granted. Upon motion by Schroeder, second by Morris, the same
were referred to the Police Committee and the Chief of Police.
Upon motion by Morris, second by Moody, the meeting was adjourned.
