HomeMy WebLinkAbout01-17-1955Record of Official Proceedings of the Common Council 2477 of the City of Rochester, Minn., January 17, 1955 • 1 C� 1 • Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on January 17, 1955- President Bach called the meeting to order at 7:30 o'clock P. M., the following members being present: President Bach, Alderman Ackerman, -Anderson, Moody, Morris and Schroeder. Absent: Alderman Whiting. Upon motion by Ackerman, second by Moody, the minutes of the meeting of January 3, 1955 were approved. President Bach stated this as being the time and place set for the following hearings: Hearing on the proposed change_ of zoning of Outlot 1, Hammer and Fanning Addition, except the South 100 feet thereof, from a residential to a commercial zone. There was no one present' wishing to be heard. A motion was made) that by Moody, second by Morris,/the City Attorney be instructed to amend the Zoning Ordinance to include the above requested change and all present voted in favor of themotion. Hearing on the proposed change of zoning of Lot 16, Block 4. A. W. gutzky's Addition from a residential to a multiple dwelling zone. There was no one present wishing to be heard. A motion was made by Ackerman, second by Moody, that the City Attorney be instructed to amend the Zoning Ordinance to include the above requested change and all present voted in favor of themotion. The following recommendation of the Street & Alley Committee was read and upon motion by Morris, second by Schroeder, the same was approved: "Honorable Mayor and Common Council City of Rochester, Minnesota Gentlemen: We, the undersigned, recommend that the Engineering costs, up to but not exceeding 10% of the construction costs, be assessed on the following type of local improvement projects In annexations and new plats of unimproved lands within the City limits accepted after. January 1, 1955: Street grading, base construction and surfacing. Sanitary sewer and water mains. Storm Sewers. Sewer and Water Service Connections. Respectfully, Street & Alley (A. G. Whiting Committee (Archie Ackerman (Raymond C: Schroeder" The following recommendation of the Street & Alley Committee was read and upon motion by Moody, second by Morris, the recommendation was approved: "Honorable Mayor and Common Council City of Rochester, Minnesota Gentlemen: We; the undersigned, recommend that Lon all new additions and street developments of old additions the minimum street improvements be required and ass.essed;. 1. Sanitary Sewer and water main. 3. Storm sewer, if necessary. 4. Concrete curb and gutter. 5. Sanitary sewer and water service connections. Respectfully, Street & Alley (A. G.• Whiting Committee (Archie * M. Ackerman (Raymond C. Schroeder" The recommendation of the Street & Alley Committee that the operation and maintenance expense of the revenue producing Municipal Parking Lots 1, 2, 3, & 4 be paid from the General Fund because the revenue from these lots is deposited in the General Fund and that at anytime the expanse exceeds the income from these parking lots said excess be paid out of the Parking Meter Fund was read and upon motion by Morris, second by Ackerman, the recommendation was approved. The recommendation of the Street & Alley Committee that hearings be held on the petition to vacate -the -West 100 feet of the East - West Alley in Block 24 of Head & McMahon's Addition was read and upon motion by Morris, second by Anderson, the recommendation was approved. The recommendation of the Police Committee and the Chief of Police that the request of Mae Jacobs, 1004 - 2nd Street Southwest for a guest parking sign in front of -her premises be not granted was read and upon motion by Schroeder, second by Ackerman, the recommendation was approved. The report of the Chief of Police that he had investigated Harold and Harry Rathbun in reference to their request for a non -intoxicating malt beverage license at 117 - 6th Street Southwest and recommended that this application be approved was read and upon motion by Morris, second by Anderson, the recommendation was approved. A plat of land to be known as Bielenberg and Giese Third Addition and described as follows was presented: !!Commencing at a point in the south line of Section 27, Township 107, North of Range 14 West which is 136o feet west of the Southeast corner of -said Section for place of beginning and running thence north at a right angle to said south line 753.37 feet, thence north 240 7' west 58.74 feet, thence due north 10b.80 feet, thence due west parallel with the South line of said Section 875.26 feet to the east right of way line of trunk highway No. 52, thence southerly along the east right of way line of said trunk highway to the south line of said section, thence due east along the south line of said section 888.88 feet more or less, to the place of beginning; and also Lots 1 and 2, Block 2, Bielenberg & Giese Second Addition." The recommendations of the Planning and Zoning Commission and the Public Utility Department that the plat be accepted were each read. A_motion was made by Morris, second by Schroeder, accepting the recommendations, referring the plat to the City Engineer for approval, and instructing the City Attorney to prepare an ordinance annexing the said lands to the City of Rochester. All present voted in favor of the motion. The recommendation of the Public Grounds Committee that repairs and replacements on plumbing fixtures in the City Jail-(women's section) be made in accordance with the proposal of Maass Plumbing and Heating Company was read and upon motion by Schroeder, second by Ackerman, the recommendation was approved. A letter from G. David Gentling, General Manager of KR08, requesting a parking space in front of the 100 First Avenue Building, where their radio and television offices are located,was read. A motion was made by Ackerman, second b Schroeder, that one space be designated as requested. All present voted in favor of the motion. The following petition was read together with a statement of acquiescen signed by 7 property owners in that vicinity and upon motion by Morris, second by Schroeder, the same was referred to the Board of Zoning: "We, the undersigned owners of the property herein described, do hereby petition the Honorable Mayor and Common Council of the City of Rochester, Minnesota, to change the classification of the following described real estate from a residential zone to a multiple dwelling zone. Description of real 'estate: Clair Bakey Duplex 310 - 7th St. S. E. Leonard Vaux 704 - 3rd Ave. S.E. Herbert M. Seybold 710 - 3rd Ave. S.E. David H. Puckett 311 - 7th St. S. E. Donald Long 313 - 7th St. S. E. Hans Jensen 626 - 3rd Ave.S. E. A. L. Blackburn 703 - 4th Ave. S.E. A. L. Blackburn 314 - 7th St. S. E. A. L. Blackburn 707 - 4th Ave. S.E. u A letter from the United States Conference of Mayors requesting that hotel reservations be made at once for the conference to be held on May 19, 20 andl 21 in New York City was read and President Bach ordered that the same be placed on f ile. The request of the Parking and Traffic Steering Committee that negotiat-I ions be re -opened for the purchase of the property known as the Baihly property adjoining on the East to Municipal Parking Lot No. 4 was read and the same was ordered placed on file. The applications for the office of City Scavenger and Dog Catcher of Darwin Pew, Emil Aufenthie, Ernest Turcotte, Herbert Wallace, Edwin Shanrock, Ambrose L. Campion, Paul R. Pearson, Alvin W. Street, John A. Hall, Henry Dessner, Robert Jones, Louis L. Bennett, Lloyd A. Metcalfe and Lyman Kline were each read. Mr. Alvin Street and Mr. Emil Aufenthie were each present at the meeting. A motioi was made by Morris, second by Schroeder, that the applications be referred to the Public Grounds Committee with power to act. All present voted in favor of the motion. Notice of claim of injury to Judith Karen Petersen in the amount of • $750.00 was read and upon motion by Morris, second by Anderson, the same was 250 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., January 17, 1955 referred to the City Attorney. The request of Frank W. Everett, Fire Chief, for permission to attend the twenty-seventh annual Fire Department Instructors Conference in Memphis, Tennessee on February 22 through February 25, 1955 was read and upon motion by Morris, second by Anderson, his request was granted and he was authorized to attend the said conference at city expense. The following resolution adopted by the Public Utility Board was read. No action was taken andthe same was ordered placed on file: "WHEREAS, the Public Utility Department has been making refunds on water main assessments when the property assessed is connected with the City Water'System, and • WHEREAS, said refunds have been from a low of $35.00 per lot to a high of approximately $900.00 per lot, and WHEREAS, the Public Utility Board is of the opinion that the investment per customer should be consistent and that one customer should receive no greater refund than another customer of similar size, and WHEREAS, the average investment per customer on the water department distribution system is approximately $165.00 and the Public Utility Board feels that our present rates can sustain no greater investment than that and the Board believes that it would be in the best interest of all of it's customers if all refunds were the same, THEREFORE, be it and it is hereby resolved by the Public Utility Board that, effective as of this date, the refund per connection with the city water distribution system will be a maximum of ONE HUNDRED SIXTY FIVE DOLLARS ($165.00) based upon the installation of a 6 inch main and the 'Connection' to be installed.under the jurisdication of the City Water Department. Be it and it is hereby further resolved that the Common Council be requested to approve the action herein stipulated." A petition protesting -the building of the proposed Bethel English Luthern Church at the corner of- Sth Street and 3rd Avenue Southeast 'was read. No action was taken. A petition to have the South 36 feet of Lot 3, Block 34, Northern Addition changed from a residential to a commercial zone, signed by Fred A. and Norma Much, was read and upon motion by Morris, second by Ackerman, the petition was referred to the Board of Zoning. A petition to have Lot 20, Block 2, gutzky's First Addition changed from a residential to a multiple dwelling zone, signed by Henry & Malinda • Geerdes, was read and upon motion by Morris, second by Ackerman, the same was referred to the Board of Zoning. The reports of the Clerk of Municipal Court for the week ending January 7, 1955 showing total criminal fines and costs -collected $1, 428. 50 and civil fees received $3..75 and for the week ending January 15, 1955 showing total criminal fines and costs collected $1,799,00 and civil fees received $9.35 were each read and having been approved by the City'Attorney, President Bach ordered the same placed on file. The applications of Eddie's Coffee Bar, Paul Finley and David M. Gaffes for license to sell soft drinks were each read and upon', motion by Anderson, second by Morris, the licenses were granted. The application for transfer of 3..2 Beer -"On Sale" License No. 914 from James Alex to David Caffes was.read and upon motion by Schroeder, second by Anderson, the transfer was granted. The applications of R. G. Brown for a Master'Electriciants license and an Electrical Contractor's license were each read and upon motion by Moody, second by Ackerman, -the licenses were granted. The application of C. J. Anderson for a Journeyman Electrician's licenef was read and upon motion by Moody, second by Ackerman, the license was granted. The indemnity bond for lost warrant of Robert G. Johnson in the.amount of $135.00 was read and upon motion by Morris, second by Moody, -,the bond was approved. The license bond of R. G. Brown in the amount of $1,000.00 with the National Surety Corporation as surety was read and upon motion by Ackerman, seco by Anderson, the bond was approved, the surety thereon accepted and it was ordered that. the same be placed on file. The contract bond of Lyon Chemicals, Inc. in the amount of $3,so6.sz with the Saint Paul Mercury Indemnity Company as surety was read and upon motion bir Morris, second by Ackerman, the same was referred to the Mayor. A letter from the Board of .Park Commissioners requesting that the Council consider future plans for Silver Lake Park due to changes wkich will be necessary when the new 7.th Street bridge and approach are constructed was read and upon motion by Schroeder, second by Morris, the same was referred to the Street & Alley Committee and the City Engineer.. A communication from the Board of Park Commissioners requesting that $17.000.00 be ap propriated to the Park Improvement Fund for lands used for the site of the new fire station No. 2, the said funds to be used for the construction of a new pavilion building with sanitary facilities, was read and upon motion by Schro eater, second by Ackerman, the same was, referred to the Public Grounds - Committee. The following resolutions were each introduced and read and President Bach declared the same duly passed and adopted: Resolution ordering hearing on the .vacation of the west 100 feet of the East and West alley in Block 24, Head McMahon's Addition.- Upon motion by Ackerman, second by Anderson, resolution adopted. Resolution approving general layout plan'for location, improvement and points -of access to Trunk Highway No. 7, renumbered 14, through the City of Rochester (general layout plant .No. 12). 0 11 resolution adopted. Resolution levying special assessments for resurfacing 2nd Avenue • Southwest from lst to 3rd Street Southwest and lat-Street Southwest from 2nd to 3rd Avenue Southwest. Upon motion by Schroeder, second by Ackerman, resolution adopted. Resolution ordering a hearing on the levying of special assessments for the construction of a sanitary sewer and water main in Highland Addition. Upon motion by Anderson, second by Moody, resolution adopted. Resolution ordering a --hearing on the levying of special assessments for finish grading, crushed rock base and bituminous surfacing on 72 and Sth Avenue Northeast and Northwood Drive. Upon motion by Moody, -second by Morris, resolution adopted. Resolution ordering a hearing on the levying of special assessments for grading, crushed rock base and bituminous surfacing in Sauer's First Sub -Division.' Upon motion by Schroeder, second by Ackerman, resolution adopted. Resolution favoring the amendment of Minnesota Statutes, Section 449.09 entitled, "Bands in towns, villages, and certain cities, tax levy," by eliminati therefrom the _application of the $10,000 yearly tax.levy limitation to cities of the second class. Upon.motion by Schroeder, second by Ackerman, resolution adopted. A motion was made by Morris, second by Schroeder, that the matter be referred to the Police Committee and the Chief of Police for recommendation. All present voted in favor of the motion. Alderman Moody stated that'the City Engineer's drafting room was in need 'of improvements to their lighting system. A motion was made by Morris, second by Schroeder, that the matter be referred to the Police Committee, the Chief of Police and the City Engineer with power to act. All present voted in favor of the motion. Mr. R. V. 'Ehrick, City .Attorney, called to the attention of the Council the "cost recently allowed for a personal injury due to the fact that a curb was deficient and recommended that a survey be made in the City to determine other dangerous defective curbs, etc. A'motion was made by Morris, second by Schroeder, referring the matter of obtaining a survey as to how many places need repair and the approximate cost thereof fo the Street & Alley Committee and the City Engineer.
