HomeMy WebLinkAbout02-07-1955F02 62 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., F e b rua ry 7. 19 5 5 Minutes of a regular meeting of the Common Council of the City of (.Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on February 7, 1955. -President Bach called the meeting to order at 2:00 o'clock P. M., the following members being present: President Bach, Aldermen Ackerman, Anderson, Moody, Morris, Schroeder,: and Whiting. Absent: None. Upon motion by Morris, second by Moody, the minutes of the meetings of January 28, January 31, and February 1, 1955 were approved. President Bach stated_ this as being the time and place set for the following hearings: Hearing on the levying of special assessments for the finish grading, crushed rock base and bituminous surfacing in Sauer's First Sub -Division. There was no one present wishing to be heard. Hearing on the levying of special assessments for the finish grading, crushed .rock base and bituminous surfacing on 7� and 8th Avenues Northeast and Northwood Drive. There was no one present wishing to be heard. Hearing on the levying of special assessments for the construction of a sanitary sewer and water main in Highland Addition. There was no one present wishing to be heard. President Bach stated this as being the time and place set for receiving and opening bids for the purchase of the land known as the City Hog Farm, located .one mile southeast of the City of Rochester on Highway No. 52. The bid of Geo. Leiferma,n Realty Company in the amount of $450.00 per acre on approximately forty- eight acres more or less was received and opened. A motion was made by Ackerman, second by Morris, referring the bid to the Council as a committee of the whole. All voted in favor of the motion. Mr. L. M. Sather, Secretary of the Rochester Home Builders Association, was present and stated that the members of the said organi2ation were very con- cerned as to the amount of engineering services that could be expected on new plats and additions. He further stated that they knew the City Engineer's Depart- ment was understaffed and recommended that more help be employed but did not feel that the engineering costs should be assessed and protested the policy adopted by the Common Council on January 17, 1955. Mr. Ray Karvel was also present and stated that he felt engineering costs should be paid for out of general taxation as had been done in previous years and not assessed against the property. Mr. Haven Hodge stated that he felt assessments on lots were already high and if engineering costs were added the price would be so high the average person could not afford to buy lots within the City, thus tending to create suburban areas. Mr. Herschel Hoaglund, Mr. Henry Giese and Mr. John Miner each spoke briefly on the matter. Mr. Robert Petersdorf, Regional Orgs.ni-zar of the A. Mayor Mcquillan stated that he fel more engineering services should be secured and the cost of same should be taken care of by general taxation. He cited that ,the increased income since 1941 on approximately the same mill Ievy was due largely to new additions being annexed to the. City. After hearing those present, the matter was referred to the Street & Alley Committee to meet with representatives from the Home Builders Association to review the matter further. Said meeting to be at 4:00 o'clock on Wednesday, February 9, 1955. A letter from the Lo-eal 472 Operative Plasters and Cement Finishers making the following proposals for changes in city ordinance concerning cement contractors was read: 1. Applications for licenses should be read at the first regular meeting following their being filed and thereupon referred to the City Engineer for investigation and report which would be made at the next regular meeting when said appiica.tion would be voted on.. 2. Applicants for licenses as cement workers should present proof of liability and workman's compensation insurance coverage, have in their employment one qualified cement mason, and contractor's social security number. 3. Applicants should be required to post a bond in the sum of $__ to cover loses the city or its residents might sustain due to improper work and materials. Mr. Bert Alexander, Jr. was present and stated that he felt an investigation should be made before issuing licenses to cement contractors and also recommended that the fee be raised. A motion was made by Schroeder, second' by Anderson, -that the matter be referred to the License Committee for study and recommendation. All voted in favor of the motion. The application for transfer of intoxicating "Or_ Sale," liquor license No. 348 at 12 South Broadway;from Steve F. Gromek to Edna M. Rubenstein was read together with a request for transfer of location of the On SaleIntoxicating Liquor License from the Broadway Circus Bar, 12 South Broadway, to the front portion 27 feet deep and 44 feet wide known as 309 and 311 First Avenue Southwest on March 25, 1955. Mr. Jack Rubenstein was present and again presented a plan of the said building at 307, 309 and 311 First Avenue Southwest. After further dis- cussion on the same, Alderman Anderson moved that the "on salel` liquor license now held by Steve F. Gromek be transferred to Edna M. Rubenstein and that such transfer be effective as soon as proper bond is filed by the said Edna M. Rubenste Alderman Whiting seconded the motion and all voted in favor thereof. Alderman Ackerman moved that the application of Edna M. Rubenstein to transfer the location of the "on sale" intoxicating liquor license from the Broadway Circus B.a.r, at 12. South Broadway, to the front portion 27 feet deep and 44 feet wide of the premises known at 309 and 311 First Avenue Southwest, Rochester Minnesota, be granted, transferring said license as requested, effective March 25, 1955. That this motion is made with the understanding that the contemplated i ln. I� • II construction on the premises known as 307, 309 and 311 First Avenue Southwest of al 264 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., February 7. 1955 bowling alley, restaurant and bar be such that there be no direct or indirect connection or doorway between said bar and the restaurant or bowling alley, except for the crash or panic door between the bowling alley and the bar as required by fire regulations and laws, which door shall be used for fire escape_ purposes only, and that the Council reserve the right to revoke the said "on sale" liquor license in the event construction is. not carried through as represented. Alderman Whiting seconded the motion and upon roll call, Aldermen Ackerman, Anderson, Whiting and President Bach voted in favor of the motion and Aldermen Moody, Morris and Schroeder voted "no". The recommendation of the Street & Alley Committee that advertising be done for the purchase of one Four Door 6 Cylinder Sedan, one Two Ton Dump Truck and one a Cubic Yard Material Loader for the City Engineer's Department, with bids to be received on March 7, 1955 was read and upon motion by Whiting, second by Ackerman, the recommendation was approved. The, recommendation of the Street & Alley Committee that Edwin W. Winter be appointed to the position of Parking Lot Attendant beginning February 1, 1955, at 95% of the established rate, was read and upon motion by Morris, second by Anderson, the appointment was approved. A report by the City Engineer on the plat of Bielenberg & Giesels 3rd Addition listing the following recommendations was read and ordered placed on file: 1. The street widths and alignment,' lot widths, and service by extensions of existing sewer system meet the requirements of Ordinances Nos. 704 and 806. 2. Only the north 33 feet of 14th Street Northwest is included in this plat, but the School Board, owner'of most of the property from which the south 33 feet of 14 Street must be taken, have agreed to dedicate the necessary right-of-way thru the property they own. The west 270 feet of the south half of 14 Street may have to be acquired by condemnation. It is recommended that these costs be assessed back against this plat. 3. In block 4 of the proposed plat, the owners have platted lots right upto the existing Highway right-of-way line. The District Highway Engineer advises me that the Highway Department is planning improvements at this point which will require widening of the existing right-of-way, and requests that the City defer approving any platting of areas thus affected until the new right-of-way line is established. The recommendation of the Board of Zoning that Lhe petition of Henry & Melinda. Geerdes to have Lot 20, Block 2, gutzky's First Addition changed from a residential to a multiple dwelling zone be granted was read and upon motion by Anderson, second by Ackerman, the recommendation was approved and the City Clerk was instructed to publish a. notice of hearing to be held at 2:30 o'clock P. M. on February 23, 1955. The recommendation of the Board of Zoning that the petition of Fred A. and Norma Much.to-havethe South 36 feet of Lot 3, Block 34, Northern Addition changed from aresidential to a commercial zone be granted was read and upon motion by Ackerman; second by Morris, the recommendation was approved and the-"C-1ty •i 1 • 1 • 1 • a Record of Official Proceedings of the Common Council 265 5 of the City of Rochester, Minn., February, 7,-,1955 Clerk was instructed to publish a notice of hearing to.be held at 2:30 o'clock P. M. on February 23, 1955• The recommendation of the Board of Zoning that the petition of Vernon D. Wendland and Shirley B. Wendlant to have Lot 1, Block 7, Sunnyside Addition changes from a residential to a multiple dwelling zone be granted was read and upon motion by Ackerman, second by Moody, the recommendation was approved and the City Clerk was instructed to publish a notice of hearing to be held at.2:30 o-'clock P. M. on February 23, 1955. A corrected plat of Bielenberg & Giese's Third Addition was presented • and upon motion by Schroeder, second by Moody, the same was approved. A letter from the Parking and Traffic Steering Committee stating that at a meeting on Friday, January 21, 1955 they agreed unanimously to support the Council's action.of January 17, 1955 in requiring minimum street improvements in new subdivisions was read and President Bach ordered the same placed on file. A letter from the Minnesota Highway Department acknowledging the City Clerk's letter of December 7, 1954 relative to the.preparation of an agreement between the City of Rochester and the Minnesota Highway Department for the S. W. resurfacing of Broadway between 6th Street and 4th Street N. W. and stating that this matter will be given immediate attention upon the return of Mr. Hoffman, who has been ill, was ,read and President Bach ordered the same placed on file. The acceptance of the. Rochester Bus Line, Inc. of the franchise granted by Ordinance No. 885 was read. and President Bach ordered the same placed on file. A summons issued in the matter of Richard H. McAdams, Plaintiff vs City of Rochester, Defendant and a summons issued in the matter of Lillian M. McAdams, Plaintiff vs. City of Rochester, Defendant were each read and upon motion by Whiting, second by Ackerman, the same were referred to the City Attorney. The following resolution adopted by the Commissioners of the Sinking Fun was read and upon motion by Morris, second by Moody, the same was approved: • "Be it resolved by the Commissioners of the Sinking Fund of the. City of Rochester, Minnesota: That the sum of $50, 118. 11 be and the said sum is hereby appropriated from the Singing Fund of the City of Rochester, Minnesota., gnd.ordered paid to the First National Bank of R&chester, Minnesota, for the purchase of $50,000.00 1 5/8% Treasury Notes of Series B 1957, dated October 4, 1954 and maturing on May 15, 1957. Be it further resolved: That the said bonds be purchased for the Electric Department Depreciation Reserve at the following market price as of this date: $50,000.00 1 5/8-'% Treasury Notes Series B 1957 - $49,875.00 Accrued Interest to date . . . . . . 24�.11 $50,118.11" A report from the Department of the Public -Examiner on the examination of the City Treasurer's books as of. December 31, 1954 was read and President Bach ordered the same placed on file. A communication from Honorable Walter Burdick tra.nsmktting a copy of a bill -drafted governing the levying of taxes for bands, ,setting a limitation of • $25,000.00 was read. A motion was made by Schroeder, second by Whiting, instructs 266 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., F e b rua ry 7, 1955 the City Clerk. to notify Mr. Burdick that same met with the approval of the Common ICouncil. A letter from the Parkside Citizens Committee stating that heavy traffic is flowing across the Boulevard at 7th Avenue and Memorial Parkway S. 11. and requesting that this traffic be diverted back to the street was read and upon motion by Schroeder, second by Moody, the same was referred to.thp Street & Alley Committee. A letter from the Peoples Natural Gas Company requesting renewal of the present franchise ordinance No. 609, which otherwise terminates August 2nd, 1958, and transmitting copies of a proposed ordinance was read and upon motion by Schroeder, second by Ackerman, the matter was referred to the Council as a committee of the whole. All voted in favor of the motion. A jetition to have the East one half of Lots 7, 8 and 9, in Block 5, lWm. McCullough's Addition changed from a multiple dwelling zone to a commercial zone was read and upon motion by Ackerman, second by Schreoder, the same was referred to the Board of Zoniti-g. The report of the City Weighmaster for the month of January, 1955 showing fees collected.for loads weighed in the amount of $130.45 was read and I President Bach, referred same to the Finance Committee. The City Treasurer's report for the month of December, 1954. was read and President Bach ordered- the same placed on file. The report of Duff and Phelps, Public Utility Security Analysts, was presented and President Bach, ordered the same placed on file. Mayor McQuillan also read a memorandum to the Rochester Municipal Electric System and. Dairyland Power Cooperative from the Federal Power Commission which was ordered.placed on file. The report of the Fire Department Relief Association for the year ended December 31, 1954 was read and President Bach ordered the same placed on file. The reports of the Clerk of Municipal, Court for the week ending January 22, 1954 showing total criminal fines and costs collected $1,477.50 and civil fees received. $2.15.; for the week ending January. 29, 1955 showing total criminal fines and costs collected $1,508.66 and civil fees received $2.70; and for the week ending February 5, 1955 showing total criminal fines.and costs collected $1,338.40 and civil fees received $.35 were each reada.nd having been approved by the City Attorney, President Bach ordered the same placed on file. The reports for the month of January, 1955 of the Building Inspector showing fees collected for building permits issued.in the amount of $215.00; of the Electrical Inspector showing fees collected for electrical permits issued 1 • 1 • in the amount of $136.50; of the Plumbing Inspector showinig fees collected for a Record of Official Proceedings of the Common Council 267 7 of the City.of Rochester, Minn., February 7.. 195 5 • 1 • 1 'plumbing permits issued in the amount of $20.25; of the Heating Inspector showing fees collected for heating permits issued $112.00; and fees collected for sign permits issued $13.60, were each read and President Bach referred the same to the Finance Committee. A contract in triplicate for the furnishing of gas for space heaters at the Sewage Disposal Plant betweeii the City of Rochester and Peoples Natural Gasl Company was read and upon motion by Ackerman, second by Anderson, the Mayor and City Clerk. were authorized and directed to execute the said contract. A recess was called at 5:45 P. M. President Bach called the meeting to order again at 7:30 P. M. The applications of Red Owl Store located at 36 17th Avenue N. W. for licenses to sell cigarettes, soft drinks and "off sr,.left 3. 2 beer were each read and upon motion by Schroeder, second by Ackerman, the licenses were granted.. The application of Red Owl Store at 11 - 4th Street Southeast for a license to sell soft,.drinks was read'and upon motion by Schroeder, second by Ackerman, the license was granted. The applications of Lest2r L. Olson, Vern Day, Riess G. Stuhler, Jack Elliott and R. P.' Bohn for real estate salesman's license were, each read together with the recommendations of the Rochester Realty Commission that these applibatior for salesman license be granted. Upon motion by Ackerman, second by Schroeder, the licenses were granted. The application of Lysne Construction Company for a. permit to move a 12 story house over certain streets in the City 'of Rochester was read and upon motion by Schroeder, second by Morris, the permit was granted, said house 'to be moved under the supervision of the Building Inspector and the Chief of Police. The application of Fets. Cab Company for transfer of taxi license No'. 32 `t'o a 1954 Ford with License AH 2679 and ta.xi license No. 33'to a. '1955 Ford with License AJ 88i6 was read' and upon motion by 'Morris, second -by Moody, the transfer was granted. The application of Jack Rubenstein for a, license to operate a bowling alley (10 alleys) was read. A motion: was rude by Ackerman, second by Whiting, that the said license be'granted and upon roll call all voted in favor of the motion except Alderman Moody, 'who voted "no". The application of Arthur C.' Freeman for a Junk Buyer's License was read and upon motion by Morris, second by Whiting, thelicense was granted. The license bond of Sanitary Company in the amount of $1,000.00 with thel Aetna: 6a.sual-ty and Surety Corflpany as surety was read and upon motion by Morris, second by Schroeder, the bond was approved, the'surety thereon accepted and the bond was ordered placed on file. The license'bond of Arthur C. Moody, the bond was approved, surety thereon accepted and the bond was ordered placed on file. Notice of cancellation of Bond No. N-2498010 by the Hartford Accident and Indemnity Company as surety, issued to Louis J. Karrib as Principal was read and upon motion by Schroeder, second by Morris, the same was referred to the City Attorney. The following resolutions were each introduced and read and President Bach declared the same duly passed and adopted: Resolution levying special assessments for the construction of a (sanitary sewer and water main and trunk line sewer in Highland Addition. Upon (motion by Ackerman, second by Anderson, resolution adopted. Resolution levying special assessments for the finish grading and crushed rock base and bituminous surfacing on 72 Avenue and 8th Avenue Northeast and Northwood Drive. Upon motion by Anderson, second by Moody, resolution. adopted. Resolution levying special assessments for the finish grading,crushed rock base and bituminous surfacing in Sauer's First Sub -Division. Upon motion by (Moody, second by Morris, resolution adopted. Resolution appropriating $778.27 from the General Fund, $8_44.32 from the S & A Fund, $63.09 from the Fire Protection Fund, $23.27 from the Sewer Fund, $21.65 from the Bridge Fund and $10.91 from the Parking Meter Fund end ordering payment made to City of Rochester, Minnesota, $1,474.45 and Dodge Lumber & Fuel Company, $277.06. Upon motion by Morris, second by Whiting, resolutiom adopted. Resolution appropriating $689.17 from the Parking Meter Fund and $585.46 from the Sewer Fund and ordering payment made to Gopher Stamp & Die Company, $439.67; Magee Hale Park-O-Meter Company, $249.50 and'Woodhouse Bros., $585.46. Upon motion by Whiting, second by Ackerman, resolution adopted. Resolution appropriating $2,400.06 from the General Fund, $1.053.16 from the S & A Fund and $320.40 from the Sewer Fund and ordering payment made to K. M. McGhie, $640.50; Darrell Sanford, $200.00; Hans Jensen, $1,559.56; Peoples Natural Gas Co., $320.40 and Treasurer of Olmsted County, $1,053.16. Upon motion by Ackerman, second by Anderson, resolution adopted. Resolution appropriating $7,840.08 from the Park Improvement Fund, $155.48 from the Lighting Fund, and $319.60 from the F. E. Williams Estate Fund and ordering payment made to City of Rochester, P.U., $1,485.12; Rochester Plumbing & Heating, $453.10; Botsford Lumber Company, $587.17 and Mayo Civic Auditorium Revolving Fund, $5,789.57• Upon motion by Anderson, second by Moody, resolution adopted. Resolution appropriating $5,926.05 from the P.I.R. Fund and ordering 1 C� L� 11 payment made to Carlisle G. .Fraser. All voted in favor of the' motion.. - The following recommendation of the Street•& Alley Committee and the City" Engineer was read: "Honorable Mayor &, Common Council - City of Rochester, Minnesota Gentlemen: We, the undersigned, recommend that the following policy and procedure be approved and made applicable to all curb and gutter -projects. 1. That the roadway also be constructed or reconstructed to the standard required by the streets use. These standards are outlined in the Street Improvement Assessment • Policy approved June 21, 1954. 2. That on locations where abutting property has not been assessed - previously for pavement; base, or surfacing, -the costs be assessed to the property owners, with a maximum assessment of $1.40 per -front -foot for residential property: The reason for this recommendation is to provide sufficent funds to build a sat isfactory-roadway on curb and'iguttet projects: For the past 10 years, or more, the City has been assessing the property owners only for the -cost of the concrete curb & gutter. The work done on the roadway has been paid for out of maintenance funds. The maintenance funds have not been sufficient for'proper construction, and consequently, the roadways between the new curb and gutter have been laid back down without adequate base or surface., This has resulted in unsatisfactory streets and costly maintenance. • We feel•that.an adequate roadway must be constructed whenever concrete curb and gutter is constructed. If the major part of this •cost•is borne by the proposed assessment, it will permit the curb and gutter program to continue in the same degree that is has been, approximately, 20 blocks a•year. If there is'no assessment made for the roadway construction, the curb and gutter program will be limited • • strictly to the number of 'blocks that the maintenance funds can pay for -approximately, 6 or 7 blocks a year. It was further recommended that the property owners who had previously submitted petitionss for the construction of curb and gutter be notified, by the City Engineerss'Department, of the new policy to they could withdraw their petitions they desired. • -if so A protest signed by 17 people against having a'cocktail lounge next to a bowling alley at •227 First Avenue Southwest was read and President Bach •ordered the same placed on file. A petition signed by-8-property owners in that vicinity objecting to the changing from a residential'to'a multiple dwelling zone of the properties located at 310, 311, 313 and'314•Seventh Street S. E., 626, 704 and 710 Third Avenue S. E.• and 703 and 707 Fourth Avenue Southeast, was read and upon motion by Schroeder, second by Morris, the same was referred to the Board of Zoning. Mayor McQuillan brought up the matter of a. lot on the corner of 6th Street and 8th Avenue Southeast which Arleigh C. Smith had given to the City but apparently the deed had not been recorded. Smith. All voted in favor of themotion. An Ordinance annexing to the City of. Rochester, Minnesota, a plat of land to be-kn,own and designated as Bielenberg and- Giese Third ,Addition, was given its first reading. Upon motion by Morris, second by Moody, and upon roll call and all voting in favor of the motion, the rules were suspended and the ordinance.was given its second reading. Upon motion by Whiting, second by Ackerman, and upon roll call and all voting in favor thereof, the rules were suspended and the ordinance .was given its third and final reading. Upon motion by Anderson, second by Morris, that the said ordinance be adopted as read, and all voting in favor thereof, Presid.ent Bach-dec.la.red the saic ordinance duly passed and adopted. An Ordinance amending the Zoning Ordinance, same being Ordinance No. 558, (changing Lot 16, Block 4, Butzky's First Addition to a multiple dwelling zone and changing Outlot 1, except the South 100 feet thereof,` Hammer & Fa.nnings Addition to a commercial zone), was given its first reading. Upon motion by Whiting, second by Anderson, and upon roll call and all voting in favor thereof, the rules were suspended and the ordiance was given its second reading. Upon motion by Ackerman, second by Anderson, and :upon roll call and all voting in favor thereof, the rules were suspended and the Ordinance was givens its third and final reading. Upon motion by Whiting, second by Ackerman, that the ,said Ordinance be adopted as read, and all voting in favor thereof, President Bach declared the said ordinance duly passed and adopted. A resolution amending a resolution establishing parking and parking meter regulations and provisions pursuant to Ordinance No. 871 `was introduced and read.
