Minutes of an adjourned regular meeting of the Common Council of the City
of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said
City, on February 23, 1955-
President Bach called the meeting to order at 2:30 o1clock P. M., the
following members being present: President Bach, Aldermen Ackerman, Moody, Morris,
Absent: ' Aldermen" Anderson and Schroeder.
The Council then proceeded to the polling places in the various
precincts of the City to inspect the registering counters of the voting machines
and to compare the number of votes shown by such voting machines with the returns
submitted by the Judges at the Primary Election held on February 21, 1955-
After making the canvass of the voting machines the Council members
returned to the City Hall and President Bach called the meeting to order, the
following members being present:, President Bach, Aldermen Ackerman, Moody,
Morris and Whiting.
The following resolution was introduced and read and upon motion by
Ackerman, second by Morris, that the said resolution be adopted as read, and all
voting in favor thereof, President Bach declared the said resolution duly passed
and adopted:
"Be it revolved by the Common Council of the City of Rochester, Minnesota:
That the following is a tabulated statement of the number of votes cast for each
erson at the primary election held on the 21st day of February, A. D. 1955, in the City of
Rochester, Minnesota, as determined by said Common Council on the canvass of the returns of
the said Primary Election made this 23rd day of February, A. D. 1955, and that the said
(tabulated statement is hereby declared to show the results of the said Primary Election:

Be it further resolved by the said Common Council:
That Harold A. Hoffman and Claude H. McQuillan are hereby declared to be candidates
for Mayor of the City of Rochester, Minnesota, at the Charter Election to be held March 8, 1955•
That Leo C. Anderson and Howard H. SmitJx are hereby declared to be candidates for
Alderman of the First Ward, of the City of Rochester, Minnesota, at the Charter Election to be
held March 8, 1955.
That Bert J. Alexander and A. G. Whiting are hereby declared,to be candidates for

Alderman of the Second Ward of the City of Rochester, Minnesota, at the Charter Election to be
held March 8, 1955•
That Archie M. Ackerman and Paul,J. Schwar_ke are hereby declared to be candidates for
Alderman of the Third Ward, of the City of Rochester, Minnesota, at the Charter Election to be
held March 8, 1955.
That the City Clerk of said City is hereby instructed to cause the names of the said
persons to be printed as candidates for the respective offices upon the official ballots at the
coming Charter Election,to be held March 8, 1955.11
Upon motion by Ackerman, second by Moody, the meeting was adjourned
until 7:30 O'clock P. M. cn February 23, 1955•
President Bach called the meeting to order at 7.: 30 o'clock P. M,, the
following members being present: President Bach, Aldermen Ackerman, Anderson,
Moody, Morris, Schroeder and Whiting. Absent: None.
Upon motion by Morris, second by Moody, the minutes of the meetings of
February 7th, February loth and February 15th, 1955 were approved.
President Bach stated this as being the time and place set for the
following hearings:
Hearing on the proposed change of zoning of Lot 1, Block 7, Sunnyside
Addition from a residential to a multiple dwelling zone. There was no one present
wishing to be heard. A motion was made by Ackerman, second by Morris, that the
City Attorney be instructed to amend the Zoning Ordinance to include the above
requested change.
Hearing on the proposed .change -of zoning of Lot 20, Block 2, A. ,W.
Rutzky's First Addition from a residential to a multiple. dwelling zone. Upon
motion by Ackerman, second by Moody, the City Attorney was instructed to amend the
Zoning Ordinance to include the above requested change.
Hearing on the proposed change of zoning of the South 36 feet of Lot 3,
Block 34, Northern Qddition from a residential to a commercial zone. Upon -motion
by Ackerman, second by Schroeder, the City. Attorney was instructed to amend the
Zoning Ordinance to include the above requested change.
Mr. Arthur Swan, Attorney representing the Rochester Bus Line, Inc., was
present and presented data that had been accumulated by the Rochester Bus Line
showing the number of runs and passengers on each run for the month of January.
He further recommended that. the Common Council approve the curtailment of certain
runs, particularly on Sundays, Holidays and late night service. After further
discussion, Alderman Moody introduced a resolution approving the curtailment in
service proposed by the Rochester Bus Line, Inc. as set forth in their schedule
and instructing the City Clerk to forward a copy'of this resolution to the
Minnesota Railroad and Warehouse Commission. A motion was made by Ackerman, second
by Moody, that the said resolution be adopted as read, and upon roll call and
all voting in favor. of the motion, except Alderman Schroeder, who voted "no",
President Bach declared the said resolution duly passed and adopted.
A .letter from the Minnesota Department of Health expressing appreciation
for the assistance and cooperation given during the school for sewage plant

operators held in Rochester on January 12, 1955 was read and President Bach
ordered the same placed on file.
A letter from the Planning Commission recommending that the Council
enter into contract with Hurd and Company for a controlled photo -mosaic Aerial
Map to be made of 20 square miles of the City for the sum of $2,000.00 was read
and upon motion by Schroeder, second by Morris, the same was -referred to the
Street.& Alley Committee.
A petition for the construction of a sanitary sewer, water main and
sewer and water service connections in 15$ Avenue Northwest, 16th Avenue Northwest,

162 Avenue Northwest, loth Street Northwest and 16th Street Northwest in
Bielenberg & Gie.se Third Addition was read and upon motion by Schroeder, second
by Moody, the same was referred to the Sewer and Water Committees.
A petition for the grading, base construction and bituminous surfacing
on 151 Avenue. Northwest, 16th Avenue Northwest, 1612 Avenue Northwest, 14th Street
Northwest and 16th Street.Northwest in Bielenberg & Giese Third Addition was read
and upon motion by Schroeder,.second by Whiting, the same was -referred to the
Street & Alley Committee.
A petition signed by John Bielenberg and Henry J. Giese to Have Lot 1,
B1ock.l;.Lot 1, Block 2; Lot 26, Block 2; Lot 1, Block 3; and Lot 26, Block 3,
changed from a residential to a multiple dwelling zone and to have the South
350 feet of Block 4 changed from a residential to a commercial .zone, all the
said property being in Bielenberg & Giese Third Addition, was read and upon
motion by Morris, second by Ackerman, the same was referred to the Board of
Zoning.
A petition signed by Lancey E. Johnson .to have the west 50 feet of the
north 791 feet of the east ,91 feet of Lot 17 and the west 50 feet of the south
55a feet of the east 91 feet of Lot 21, in Block 6, A. W. gutzky's Addition
changed from a residential to a multiple dwelling zone was read and upon motion
by Ackerman, second by Morris, the same was referred to the Board of Zoning,

A petition signed by Dorance N. and Alvina D. Munger to have Lots 2 and
3, Block 2, D. P. Madden's Addition changed from a residential to a commercial
zone was read and upon motion by Ackerman, second by Whiting, the same was
referred to the Board of Zoning,
The following resolution adopted by the Public Utility Board was read
and President Bach ordered the same placed on file:
"Be it and it is hereby resolved by the Public Utility Board of
the City of Rochester, Minnesota, that the Common Council of the said
City be and is hereby requested to authorize the said Board to enter
into contract with the Southern Minnesota Supply Company of this City
for the furnishing, in accordance with specifications, of-
150-Class 3, 35 ft. Western Red Cedar Poles ® $31.46 each
75-Class 3, 40 ft. Western Red Cedar Poles ® $40.40 each
F.O.B. Rochest4r, Minnesota
The total amount of the said contract to be SEVENTY SEVEN HUNDRED FORTY
NINE DOLLARS ($7,749.00) and the said Southern Minnesota Supply Company
being th:e lowest responsible bidder."

The request of Marvin W. Price, City Assessor, asking permission to
attend the annual Assessors School at the League of Minnesota Municipalities,
University of Minnesota, on March 10, 11 and 12, 1955 was read and upon motion by
Morris, second by Ackerman, Mr. Price was authorized to attend -the said meeting
at City expense.
The request of Marvin W. Price, City Assessor, for permission to employ
additional help, commencing April 1, 1955, to assist in canvassing the Personal
Property Class 2 Household Assessments "was read and upon motion by Ackerman,
second by Morris, his request was granted.
Notices of Injury of Mrs. Clara Kemmer in the amount of $20,000.00 and
Albert M. Kemmer in the amount of $5,000.00 were each read and upon motion by
Ackerman, second by Moody, the same were referred to'the City Attorney.
The recommendation of the Street & Alley Committee that the City
advertise for bids to be opened March 21, 1955 for furnishing the season's supply
of crushed rack, sand, gravel and pea gravel; ready mixed concrete; road oil and
cutback asphalts; asphalt emulsion; plant mixed bituminous mixture andsewer
castings for use in the City Engineers Department was read and upon motion by
Morris, second by Schroeder, the recommendation was approved.
The recommendation of the Street & Alley Committee that the City
advertise for bids for furnishing one motor grader and one z ton panel truck for
use in the City Engineers Department, said bids to be received on March 21; 1955,1
was read and upon motion by Morris, second by Anderson, the recommendation was
approved.
The recommendation of the Sewer Committee that the portion of the
Northwest -Southwest Sanitary Sewer Relief Line from the Trunk Line Sewer in place
in the Mill Reservation of Northern Addition on the West Side of Cascade Creek to
14th Street Northwest at Third Avenue Northwest be constructed was read and upon
motion by Anderson, second by Morris, the recommendation was approved.
The recommendation of the Street & Alley Committee that a curb and
gutter be constructed on 1'3th and 15th Avenue Northwest and on the north side of
'14th Street Northwest in Bielenberg & Giese Second Addition was read and upon
motion by Schroeder,'second by Moody, the recommendation was approved.
The recommendation of the Street & Alley Committee that a curb and guttel
be constructed on loth Avenue Northeast from 14th Street'to 16th Street Northeast
and on 15th Street Northeast and 16th Street Northeast in Peck's Third Addition
was read and upon motion by Moody, second by Morris, the recommendation was
approved.

Addition, west of 15th Avenue Southeast, was read and upon motion by Schroeder,

second by Moody, the recommendation was approved.
The recommendation of the Sewer and Water Committees that a sanitary
sewer, water main and service connections be constructed in llth Avenue Northeast
in Peck's Fifth Addition was read and upon motion by Schroeder, second by
Anderson, the recommendation was approved.
The recommendation of the Sewef Committee that a sanitary sewer be
constructed in loth Street Northwest from 3rd to 5th'Avenue Northwest was read
and upon motion by Morris, second by Moody, the recommendation was approved.
The request of the City Engineer for permission for attendance and
expenses at the Annual Schools held under the auspices of the League of Munici-
palities at the University Continuation for four men for the Sewage Works
Operators School on March 16, 17 and 18 and four men for the City Engineer's
School on March 28, 29 and 3.0 was read and upon motion by Whiting, second by
Anderson, his request was granted.
The recommendation of the Street & Alley Committee that grading, base

Northwest, 16Z Avenue Northwest, 14th Street Northwest and 16th Street`Northwest
in Bielenberg & Giese Third Addition was read and upon motion by Moody, second

The recommendation of the Sewer and Water Committees that a sanitary
sewer, water main and service connections be constructed in 15h Avenue Northwest,
16th Avenue Northwest, 162 Avenue Northwest, 14th Street Northwest and 16th
Street Northwest in Bielenberg & Giese Third Addition was read and upon motion by
Anderson, second by Moody, the recommendation was approved.
The recommendation of the Street & Alley Committee that grading, base
construction and bituminous surfacing be done on llth Avenue Northeast and 15th
Street Northeast in Peck's Fifth Addition was read and upon motion by Moody,
second by Morris, the recommendation was approved.
The report of the City Treasurer for the month -of January, 1955 was
read and President Bach ordered the same placed on file,
The reports of the Clerk of Municipal Court for the week ending Feb. 11,
1955 showing total criminal fines and costs collected $1,337.00 and civil fees
received $3.35 and for the week ending Feb. 19, 1955 showing total criminal fines
and costs collected $974.00 and civil fees received $.60 were each read and
having been approved by the City Attorney, President Bach ordered the same placed
on file.
A letter from R. B. Vecellio, Deputy Public Examiner, transmitting
copies of a report on the financial affairs of the Rochester Fire Department
Relief Association covering the year ended March 31, 1954 and a report on the

ended March 31, 1954 was read and President Bach ordered the letter and reports
placed on file.
The applications of Ralph M. Graen, Huey's Liquor Store, Inc., Roy
Bennett, Arthur Glasenapp and Ross Mayhood, Edward Livingston and Norman Wyatt,
Joe Daly, Sr. and Joseph R. Daly, Sam Golob, Donald W. McConnell, Michael J.
Kitzman, Andrew C. Chafouliasand Christ Margellos for "Off Sale" intoxicating
liquor licenses were each read and upon motion by Morris, second by Ackerman,
the licenses were granted, subject to the approval of the State Liquor Control
Commissioner.
The surety bonds of Joe Daly Sr. and Joseph R. Daly, R. M. Graen,
Arthur Glasenapp, Roy Bennett and Ross Mayhood, Edward C. Livingston and Norman
Wyatt, Christ Margellos, Andrew C. Chafoulias and Sam Golob each in the amount
of $1,000.00 with the Western Surety Company as surety; Michael J. Kitzman and
Donald W. McConnell each in the amount of $1,000.00 with the Saint Paul Mercury
Indemnity Ins. Co. as surety; and Huey Drive In Liquor Store, Inc. in the amount
of $1,000.00 with the Hartford Accident & Indemnity Company as surety were each
read and upon motion by Morris, second by Moody, the bonds were approved, the
stirety thereon accepted, and the same were ordered placed on file.

Alderman Schroeder brought up the matter of issuing a building permit
for the donstruction of a bowling alley at 307-311 First Avenue Southwest. After
discussing the. matter a motion was made by Alderman Anderson instructing the
Building Inspector, in the light of possible nuisance conditions in the constructii
of a bowling alley at 307-309-311 First Avenue Southwest, to withhold the issuance
of any building permits on the grounds of possible nuisance until full and complete
plans and specifications are submitted together with a certificate from a qualifies
engineer expressing. his opinion that the plans and specifications are sufficient
to deaden the sound to such an extent that it be unobjectionable in adjoining
buildings. He further moved that the Building Inspector. upon receipt of the
aforesaid plans and specifications and engineers certificate be authorized and
instructed to obtain an additional independent written opinion from a qualified
engineer that the acoustical construction is sufficient to deaden the sound as
aforesaid. Alderman Moody seconded the motion and all voted in favor of same.
Alderman Morris, Chaitman of the Public Grounds Committee, verbally
recommended that the premises known as the City Hog Farm be sold at public auction
in the Council Chambers in the City Hall at an amount not less than $25,000.00
and bidders shall bring with them a certified check in an amount not less than
$5,000.00 to be tendered as down payment, the balance of the money due the City
to be paid over when clear title is acquired. Upon motion by Whiting, second by
Schroeder, the recommendation was approved.
A motion was then made by Alderman Ackerman that the premises commonly
known as the City Hog Farm comprising 47 acres more or less on U. S. Highway No.
52 be sold at public auction on Monday, March loth at 7:30 o'clock P. M. in the
Council Chambers in the City Hall, City of Rochester, Minnesota. The premises to
be sold for cash. Any bid less than $25,000.00 will be rejected. Prospective
bidders must be prepared to deliver to the City Clerk a certified check in the
amount of $5,000.00, made payable to the Mayor of the City of Rochester, upon
acceptance of the bid, and the balance on receipt of a.warranty deed and evidence
of clear title. He further moved that the Public Grounds Committee be charged
with the responsibility of preparing and publishing adequate advertisements of
this sale. Alderman Whiting seconded the motion and upon roll call all voted in
favor of the motion.
Uponmotion by Morris, second by Moody, the Meeting was adjourned.
