Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council.Chambers in the City Hall in said City,
on March 7, 19 55.
President Bach called the meeting to order at 2:00 o'clock P. M., the
following members being present: President Bach, Aldermen Ackerman, Anderson,
Moody, Morris and Schroeder. Absent: Alderman Whiting.
Upon motion by Moody, second by Ackerman, the minutes of the meetings of
February 23rd and March lst, 1955 were approved.
President Bach stated this as being the time and place set for the

following hearings:
First hearing on the construction of a curb and gutter on 13th and 15th
Avenue N. W. and on the north side of 14th Street N. A'. in Bielenberg & Giese
Second Addition. There was no one_ present wishing to be heard.
First hearing on the construction of a curb and gutter on loth ,-Avenue
N. E. from 14th to 16th Street Northeast and on 15th Street N. E. and 16th Street
N. E. in Peck's Third Addition. There was no one present wishing to be heard.
First hearing on the construction of a curb and gutter on the south
side of Graham Court Southeast in Block 3, Homestead Addition, west of 15th
Avenue Southeast. There was no one present wishing to be heard.
First hearing on the construction of a sanitary sewer,.water main and
service connections in llth Avenue Northeast in Peck's Fifth Addition. There was
no one present wishing to be heard.
First hearing on the construction of a sanitary sewer in 14th Street
Northwest from 3rd to 5th Avenue Northwest. There was no one present wishing to
be heard.
First hearing on the grading, base construction and bituminous surfacin
in Bielenberg & Giese Third Addition. There was no one present wishing to be
heard.

First hearing on the construction of a sanitary sewer, water main and
servirce connections in Bielenberg & Giese Third Addition. There was no one
present wishing to be heard.
First hearing on grading, base construction and bituminous surfacing on
17t h Avenue Northeast and 15th Street in Peck's Fifth Addition. There was no one
present wishing to be heard.
President Bach stated this as being the time and place set for receiving
and opening the following bids;
Bids for furnishing one 2 cubic yard material loader for use in the City
Engineer's Department. The bids of Rosholt Equipment Company in the amount of
$4, 250.00; Borchert Ingersoll, Inc. in the amount of $5, 550.00 and A-W Company
Inc. in the amount of $5,975.00 were each received and opened and upon motion by

Ackerman, second by Schroeder, the same were referred to the Street & Alley
Committee and the City Engineer.
Bids for furnishing one -two (2) ton :dump truck"` . for use in the City
Engineer's'Department. The bids of Universal Motors, Inc. in the amount of
$2,698.00; Clements Chevrolet Company in the amount of $2.,794.00; Allen Lloyd
Company in the amount of $2,702.12; Howell Motor Company in the amount of
$2,699.00 and T.ruck Service Company in the amount of $2,666.59 were each
received and opened and upon motion by Schroeder, second by Moody, the same were
referred to the Street & Alley Committee and the City Engineer.
Bids for furnishing one four door six cylinder sedan for use in the
City Engineer's Department. The' bids of Universal Motors, Inc. in the amount
of $1,695.00; Clare Fischer Motor Inc. in the amount of $1,900.00 and Clements
Chevrolet Company in the amount of $1,999.00 were each received and opened and
upon motion by Schroeder, second by Moody, the same were referred to the Street &
Alley Committee and the City Engineer.
President Bach stated this as being the time and place set for a hearing
for the vacation of the west 100 feet of the east and west alley in Block 24, Head
& McMahon's Addition. Letters from Georgia Ellis and Mrs. Burt Elliott Eaton
requesting that the alley be kept open were each read. Mrs. Eaton and Miss Ellis
were present at the meeting and stated that they hoped the alley could be kept
open. Mr. Martin Opem was present and spoke in favor of the alley being vacated.
After further discussion on the matter a motion was made by Schroeder, second by
Ackerman, that the west 100 feet of the east and west alley in Block 24, Head &
McMahon's Addition be not vacated. Ali voted in favor of themotion.
A petition for the construction of a. storm sewer in 7th Avenue and Sth
Avenue and 112 Street Southwest and Memorial Parkway in Parkside Subdivision was
read and upon motion by Schroeder, second by Ackerman, the same was referred: to
the Sewer Committee.
A petition for the construction of a storm sewer lateral to drain the
interior of Block 4, Parkside Subdivision was read and upon motion by Schroeder,
second by Ackerman, the same was referred to the Sewer Committee.
The following resolution adopted by the Public Utility Board was read
and President Bach ordered the same placed on file;
"Be it and it is hereby resolved by the Public Utility Board of
the City of Rochester, Minnesota, that the Common Council of the said
City be and is hereby requested to authorize the said City to enger
Into a contract with the LAYNE-MINNESOTA COMPANY for the furnishing, in
accordance with specifications, of a pumping unit replacement; the
total amount of the contract to be THREE THOUSAND EIGHTY THREE DOLLARS
($3,O93.00) and the said Layne -Minnesota Company being the lowest
responsible bidder. n
A letter from the Rochester Fire Department Relief Association
requesting the approval of a home loan to be made to George H. Davis in the

amount of $4,000.00 was read and upon motion by Anderson, second by Ackerman, I� •

the same was approved.
The request of the Minnesota Society for Crippled Children and Adults,
Inc. for permission to hold a sale of paper Easter lilies on the streets of our
city on Saturday, April 2, 1955 was read and upon motion by Schroeder, second by
Ackerman, their request was granted.
A letter from Lyle R. Rostad inquiring as to what had been done about
payment for -damages claimed on his car was read and upon motion by Schroeder,
second by Anderson, the City Attorney was instructed to advise him that no record
could be found of the said accident.
A letter from the League of Minnesota Municipalities transmitting copies
of a report entitled nMinnesotals Tax Structuren was -read and President Bach
ordered the same placed on file.
Notice from the League of Minnesota Municiplaities of"Municipal short
courses to be held at the University of Minnesota, Continuation Center, was read
and President Bach ordered the same placed on file.
A letter from Orville C. Peterson, Attorney for' the League of Minnesota
Municipalities, concerning liquor and beer license fee bills was read and Presides
Bach ordered same placed on file.
A letter from Robert E. & Helen J. Rogers of 602 - 7th Avenue Southeast
asking $200.00 for replacement of damaged trees was read and upon motion by
S;chroeder, second by Moody, the same was referred to the City Attorney.
The request of the -Public Health & Welfare Department for. permission to
employ Ralph E. Petz, 949 -'llth Avenue Northeast, as a sanitarian -in -training
effective March 9, 1955 at a salary of $301.50 was road -and upon motion by
Ackerman, second by Anderson, the request was approved.
The petitions (3) for construction of a sanitary sewer,,water main and
service connections; construction of storm sewer and street grading, base
construction and bituminous surfacing all in Baihlyls First Subdivision were each
read and upon motion by -Schroeder, second by Anderson., the same were referred to
the Street & Alley Committee, the Sewer Committee, the Water Committee and the CitZ
Engineer.
The request of Paul Plantz, Electrical Inspector, for permission to
attend the lSth annual upper midwest Electrical Industry Convention on March Sth
and 9th at the R adisson Hotel in Minneapolis was read and upon motion by Schroeder,
second by Anderson, his request was denied.

A petition for annexation of lands to be known as Woodland Addition and
described as follows was read together with a plat of the said land:
"That part of the Southwest Quarter of the Southeast Quarter of
Section No. Twenty five (25) in Township No. One Hundred Seven
(107) North, Range No. Fourteen (14) West, described by metes
and bounds as: Commencing at a point Two Hundred Siaty-four and
4/10 (264.4) feet North of the Southwest corner of the -Southeast
Quarter of the Southeast Quarter of said Section No. Twenty-five
(25) and running thence North Four Hundred Forty-eight and 5110
( 449- 5) feet; thence West Two Hundred Fifty and 47/100 (250.47)
feet; thence South Six Hundred Seventy-three and 9/10 (6.73.9)
feet and running thence Northeasterly to the place of beginning,
subject to highway easements.0
A motion was made by Ackerman, second by Schroeder, referring the plat and petition
to the City Engineer.
A letter from Mr. 0. W. Haling requesting the City to determine what
part of the Weih farm belongs to the City and what rights or easements were made
covering the road to the buildings was read. A motion was made by Schroeder,
second by Moody, instructing toe City Engineer. to notify Mr. Haling that as soon
as the weather permits the City will survey the -property and determine which
part belongs to the City.
The request of Clements Chevrolet Company for a permit to hold an
auction sale on March 31; 1955 was read and upon motion by Ackerman, second by
Moody, the permit was granted.
The recommendation of the Street & Alley Committee that the bid of
Rosholt Equipment Company for furnishing one z cubic yard material loader for
use in the City Engineer's Department be accepted at the price bid, $4,250.00
and checks be returned to the unsuccessful bidders was read and, upon motion by
Morris, second by Anderson, the recommendation was approved.
The recommendation of the Street & Alley Committee that the bid of
Universal Motors, Inc. for furnishing one four -door six cylinder sedan for use
in the City Engineer's Department be accepted at the price bid, $1,695.00 and
checks be returned to the unsuccessful bidders was read and upon motion by
Anderson, second by Moody, the recommendation was approved.
The recommendation of the Street & Alley Committee that the Council
enter into a contract with Mark Hurd Aerial Surveys Inc. for a controlled Photo -
Mosaic Aerial Map to be made of 20 square miles of the City for the sum of $2,000.00,
the actual area to be designated by the City Engineer, was read and upon motion
by Morris, second by Anderson, the recommendation was approved.
The recommendation of the Street & Alley Committee that hearings be
held on the petitions to construct curb and gutter in the following locations,
was read: 9th Avenue Southeast from 9th to loth Street Southeast; 14th Avenue
Northeast from 7th to 9th Street Northeast; 12th Avenue Southeast from 4th to
6th Street Southeast; llth Street Northwest from 2nd to 4th Avenue Northwest;
13th Avenue Southeast from 6th to 9th Street Southeast; 6th Street Southeast ffom

The recommendation of the Street & Alley Committee _that a curb and gutter
be not constructed on 9th Street Northwest from Broadway to 2nd Avenue Northwest
due to the low percentage of petition signeas.was read and upon motion by Ackerman,
second by Morris, the recommendation was approved.
The recommendation of the Street & Alley Committee that the petition for
the construction of a curb.and gutter on 2nd Avenue Northwest from llth to 12th
Street Northwest be tabled pending the receipt of petitions for,the construction
of a. curb and gutter on 2nd Avenue Northwest from loth to llth Street Northwest
and on.2nd Avenue Northwest from 12th to 13th Street Northwest all to be construct
as one project, was read and upon motion by Moody, second by Anderson, the
recommendation was approved.
The recommendation of the Street & Alley Committee that the petition for
the construction of curb and gutter on 7th Street Northwest from Broadway to 2nd
Avenue Northwest be tabled pending further study of the feasibility of widening
and paving with County participation and_the extension of the proposed improvement
to 4th Avenue Northwest was read and upon motion by Moody, second by Schroeder, the,)
recommendation was approved.
The recommendation of the Street & Alley Committee that the petition for
construction of a curb and gutter on llth Avenue Northwest from 2nd to 4th Street
Northwest be deferred, pending further study of widening and paving in this
location, was read and upon motion by Morris, second by Schroeder, the recommendati
was approved.
The recommendation of the Street & Alley Committee that the constructions
of curb and gutter on 9th Avenue Northeast and 17th Street Northeast in Peck's
Fourth Addition be deferred until the 1956 construction season was read and upon
motion by Moody, second by Anderson,'the recommendation was approved.
The recommendation of the Street & Alley Committee that the construction)
of curb and gutter on llth Avenue and 15th Street Northeast in Peck's Fifth
Addition be deferred until the 1956 season was read and upon motion by Schroeder,
second by Morris, the recommendation was approved.
The recommendation of the Sewer Committee that a storm sewer be constr-
acted in 7th Avenue Southwest, Sth Avenue Southwest, Memorial Parkway and 112
Street Southwest in Parkside Subdivision and that each of the lots affected by the
improvement be assessed $125.00 per lot for the construction of the main storm
sewer system was read and upon motion by Anderson, second by Moody, the recommenda-
tion was approved.

The recommendation of the Sewer Committee that a storm sewer lateral
�be constructed to drain the interior of Block 4, Parkside Subdivision and that the
total cost of this construction be assessed to the lots in Block 4, Parkside
Sub -Division was read and upon motion by Moody, second by Schroeder, the recomm-
endation was approved.
The report of the City Weighmaster for the month of February, 1955
showing total fees collected for loads weighed in the amount of $129.65 was read
land President Bach referred the same to the Finance Committee.
The reports for the month of February, 1955 ofothe Building Inspector
showing fees collected for building permits issued $379.00; of the Electrical
Inspector showing fees collected for electrical permits issued $90.00; of the
Plumbing Inspector showing fees collected for plumbing permits issued $74.25; of
the Heating Inspector showing fees collected for heating permits issued $40.25;
and fees collected for sign permits issued $16.06, were each read and President
Bach referred the same to the Finance Committee.
The reports of the Clerk of Municipal Court for the week ending
February 26, 1955 showing total criminal fines and costs collected $2,265.00 and
civil fees received $4.00 and for the week ending March 5, 1955 showing total
criminal fines and costs collected $1,467.05 and civil fees received $6.40, were
each read and having been approved by the City Attorney, President Bach ordered
the same placed on file.
The following resolutions were each introduced and read and President
Bach declared the same duly passed and adopted:
Resolution accepting the bid of Rosholt Equipment Company for furnish-
ing one a cubic yard material loader for use in the City Engineer's Department.
Upon motion by Ackerman, second by Anderson, resolution adopted.
Resolution accepting the bid of Universal Motors, Inc. for furnishing
one four door six cylinder sedan for use in the City. Engineer's Department. Upon
motion by Anderson; second by Moody, resolution adopted.
Resolution authorizing the Public Utility Board to enter into contract
with Layne -Minnesota Company. Upon motion by Moody, second by Morris, resolution
adopted.

Mr. B. H.: Drummond, representing the Rochester Guest Rome Association,
was present at the meeting and presented a proposed ordinance regulating, licening
and controlling the operation of all transient housing accomodations in the City
of Rochester. He stated that he felt such an ordinance would take care of many
of the problems arising from the operation of some of these businesses. After
discussing the matter a motion was made by Ackerman, second by Moody, referring
the matter to the Council as. a committee of the whole, for further study. All
voted in favor of the motion.
An Ordinance amending the Zoning Ordinance, same being No. 559,(by
adding Lot 20, Block 2, A. W. Kutzky's First Addition and Lot 1, Block 7, Sunnysidl
Addition to the Multiple Dwelling Zone and the south 36 feet of Lot 3, Block 34,
Northern Addition to the Commercial Zone), was given its first ,reading.
Upon motion by Ackerman, second by Morris, and. upon roll call and all
voting in favor thereof, the rules were suspended and the ordinance was given its
second reading.
Upon motion by Morris, second by Moody, and upon roll call and all votir
in,favor thereof, the rules were suspended and the ordinance was given its third
and final reading.
Upon motion by Schroeder, second by Anderson, that the said ordinance
be adopted as read, and all voting in favor thereof, President Bach declared the
said ordinance duly passed and adopted.
Mayor McQuillan stated that Mr. Frank Benjamin of 330 - 19th Avenue S.W.
had contacted him in regard to damage done to his proper.ty, which he claimed had
been done during construction work on 19th Avenue Southwest. The matter was
referred to the Street & Alley Committee to meet with Mr. Benjamin.
Upon motion by Ackerman, second by Morris, the meeting was adjourned
until 2:30 O'clock P. M. on March 9, 1955•

The recommendation of the Street & Alley Committee that the bid of
Truck Service Company for furnishing one two -ton dump truck for use in the City
Engineer's Department, be accepted at the price bid $2, 666. 99 and that checks be
returned to the unsuccessful bidders was read and upon motion by Moody, second by
Schroeder, the recommendation was approved.
A resolution accepting the bid of Truck Service Company for furnishing
one two -ton dump truck for use in the City Engineer's Department was read. A
motion was made by Ackerman, second by Anderson, that the said resolution be
adopted as read and all voting in favor thereof, President Bach declared the said
resolution duly passed and adopted.
