of the City of Rochester, Minn., March 21, 1955
Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
said City, o'n March 21, 1955.
President Bach called the meeting to order at 7':30 o'clock P. M., the
following members being present: President Bach, Aldermen Ackerman., Anderson,
Moody, Morris and Schroeder. Absent: Alderman Whiting.
Upon motion by Morris, second by Anderson, the minutes of the meetings
of March 7th an& March 9th, 1955 were approved.
President bash stated this as being the time and place set for the
following hearings:
First hearing on the construction of a storm sewer in Parkside Sub -
Division. There was no one present wishing to be heard.
First hearing on the construction of a storm sewer lateral in Block 4,
Parkside Addition. There was no one present wishing to be heard.
Second hearing -on the grading, base construction and bituminous surfacing
on llth Avenue Northeast and 15th Street Northeast in Peck's Fifth Addition. There
was no one present wishing to be heard.
Second hearing on the construction of a sanitary sewer, water main and
service connections in llth Avenue Northeast in Peek's Fifth Addition. There was
no one present wishing to be heard.
Second hearing on the construction of a curb and gutter on 13th and 15th
Avenues Northwest and on the north side of 14th Street Northwest in Bielenberg &
Giese Second Addition. There was no one present wishing to be heard.
Second hearing on the construction of a.curb and gutter on loth Avenue
Northeast from 111th to 16th Street Northeast and on 15th Street Northeast and
.16th Street Northeast in Peck's Third Addition. There was no one present wishing
to be heard.
Second hearing on the construction of a curb and gutter on the south
side of Graham Court Southeast in Block 3, Homestead Addition, west of 15h
Avenue Southeast. There was no one present wishing to be heard.
Second hearing on the grading, base construction and bituminous surfacing
in 151, Avenue Northwest, 16th Avenue Northwest, 16Z Avenue Northwest, loth Street
Northwest and 16th Street Northwest in Bielenberg & Giese Third Addition. There
was no one present wishing to be heard.
Second hearing on the construction of a sanitary sewer, water main and
service connections in 15th Avenue northwest, 16th Avenue Northwest, 162. Avenue
Northwest, 14th Street Northwest and 16th Street Northwest in Bielenberg & Giese
Third Addition. There was no one present wishing to be heard.

1955 season. The bids of the following were received and opened and upon motion
by Morris, second by Moody, the same were referred to the Street & Alley Committee

and opened and upon motion by Morris, second by'Schroeder, the same was referred
to the Street & Alley Committee and the City Engineer for tabulation and report.

The bid of Rochester Sand & Gravel Company in th6 amount of $19,200.00 was
received and opened and upon motion -by Schroeder; second by Morris, the same was
referred to the Street & Qlley Committee and the City Engineer for tabulation
and report.
Bids for furnishing sewer castings for use in the City Engineer's
Department. The bids of George R. Lewis Company in the amount of $2,595.00 and
.Neenah Foundry Company in the amount of $2,760.00 were each received and opened
and upon motion by Ackerman, second by Moody, the same were referred to the
Street & Alley Committee and the City Engineer for tabulation and report.
Bids for furnishing one i ton panel truck for use in the City Engineer's
Department. The bids of Truck Service Company in the amount of $1,625.00; Allen
Lloyd Company in the amount of $1, 53s.99; Clements Chevrolet Company in the
amount. of $1,679.00 and Universal Motors, Inc, in the amount of $1,495.00 were
each received and opened.and upon motion by Schroeder, second by Morris, the
same were referred to the. Street & Alley Committee and the City Engineer for
tabulation and report.
Bids for furnishing one motor grader for use in the City Engineer's
Department. The bids of Wm. H. Ziegler Co. in the amount of $14, 595.00; Rosholt
Equipment Company in the amount of $13,500,00; Borchert Ingersoll,- Inc, in the
amount of $14, 77 5.00 and The George T. Ryan Company in the amount of $13, 972.00
were each received and opened a'nd upon motion by Schroeder, second by Ackerman,
the same were referred to the Street & Alley Committee and the City Engineer for
tabulation and report.
The recommendation of the Street & Alley Committee that the bid of
Rochester Sand & Gravel Company for furnishing the season's supply of crushed
reek, washed sand, pit -run gravel and pea gravel be accepted at the unit prices
bid and that the bid of Patterson Rock Products for furnishing the season's supply
of crushed rock at quarry be accepted at the unit price bid was reed and upon
motion by Morris, second by Anderson, the recommendation was approved.
The recommendation of the Street & Alley Committee that the bid of

Ready -Fixed Concrete for use in the City Engineer's Department be accepted at the
unit prices bid and checks be returned to the unsuccessful bidders was read and
upon motion by Morris, second by Moody, the recommendation was approved.
The recommendation of the Street & Alley Committee that the bid of
Standard Oil Company for furnishing the season's supply of road oil and cutback
asphalts for 10,000 gal. tank car delivery be accepted at the unit prices bid and
that the bid of Northwestern Refining Company for furnishing the season's supply
of road oil and cutback asphalt in truck transport delivery be accepted at the
unit prices bid and that checks be returned to the unsuccessful bidders was read
and upon motion by Anderson, second by Schroeder, the recommendation was approved.
The recommendation of the Street & Alley Committee that the bid of
Rochester Sand & Gravel Company for furnishing the season's supply of plant -mixed
bituminous mixture for street surfacing and patching for use in the City Engireer'l
Department be accepted at the unit prices bid and that checks be returned to the
unsuccessful bidders was read and upon motion by Moody, second by Anderson, the
recommendation was approved.
The recommendation of the Street & Alley Committee that the bid of Wm.
H. Ziegler Company for furnishing. one motor grader for the City Engineer's
Department be accepted at the price bid ($14, 595.-D0) and that checks be returned
to the unsuccessful bidders was read and upon motion by .Jiorris, second by Schroeder
the recommendation was approved.
The recommendation of the -Board of Zoning that the petition of John
Bielenberg and Henry J. Giese to have Lot 1, Block 1; Lot 1, Block 2; Lot 26,
Block 2; Lot 1, Block 3 a•nd-Lot 26, Block 3 in Bielenberg & Giese Third Addition
be changed from a residential to a multiple dwelling zone and that the South 350
feet of Blocl: 4 .in Bielenberg & Giese Third Addition be changed from a residential
to a commercial zone be granted was read and upon motion by Morris, second by
Schroeder, the recommendation was approved and the City Clerk was instructed to
publish a notice of hearing to be held at 2:00 o'clock P. M. on April 4, 1955•
the recommendation of the Board of Zoning that the petition of Lancey E.
Johnson to have the West 59 feet of the North 791 feet of the east 91 feet of
Lot 17 and the West 50 feet of the South 552 feet of the East 91 feet of Lot 21,
Block 6, A.-W. Kutzky's Addition changed from a residential to a multiple dwelling.

changed from a residential to a commercial zone be granted was 'read and upon motioi

was instrudted to publish a notice of hearing to be held at 2:00 o'clock P. M. on
April 4, 1955.
A letter from James J. Macken, Jr., Chief of Police, advising that Mrs.
Esther Golob, a part time employee of Bob -Liquor Store, was charged with selling
beer to a minor person and at the hearing held she was found guilty and paid a
fine of $100.00 and also a letter advising that Mike Janet„ an employee of
with selling
DeFosse's Belt Line Tavern, was charged/beer to a minor person and at a hearing
held he was found guilty and paid a, fine of $100.00, were each read. A motion
was made by Morris, second by Schroeder, the matter was referred to the Police
Committee, the License Committee and the Chief of Police for further discussion
and recommendation at the meeting on March 29, 1955.
The following preliminary estimates were presented by the City Engineer
and President Bach ordered the same placed on file:
Preliminary estimate for construction of a curb and gutter on the
south side of Graham Court Southeast in Block 3, Homestead Addition,
west of 15th Avenue Southeast in the amount of $2, 737. s0,
Preliminary estimate for construction of a curb and gutter on loth

Preliminary estimate for construction of a curb and gutter on 13th
and 15th Avenue Northwest and on the north side of loth Street

The two following resolution adopted by the Public Utility Board were
each read and President Bach ordered the same placed on file. -
"Be it and it is hereby resolved by the.Public Utility Board
of the City of Rochester; Minnesota that the Common Council of
the said City be and is hereby requested to authorize the said
Board to enter into a contract with the Southern Minnesota Supply
Company of this City for the furnishing, in accordance with speci-
fications, of-

A notice of personal injury to Esther Saterdalen in the amount of
$5,000.00 was read and upon motion by Morris, second by Schroeder, the same was
referred to the City Attorney.
An order issued by the Railroad and Warehouse Commission -of the State
of Minnesota, authorizing discontinuance of certain bus schedules, effective
March 18, 1955, upon suitable notice to the public, by the Rochester Bus Line, Inc!
was read and President Bach ordered the same placed on file.
A notice from the State of Minnesota, Department of Taxation, of the
annual meeting for the instruction of assessors and a member of each of thelocal
boards to be held on March 28, 1955.at the Olmsted County Court House, unless
anotlier place is designated, was read and President Bach ordered the same placed
on file.
The request of the -Board of Public Health Welfare for -permission to
fill two vacant public health nursing position by transferring two nurses
presently employed on State Funds, effective March 1, 1955, was read and upon
motion by liorris, •second by Anderson, their request was granted.
A -communication from the City of Hope, National Medical Center, giving
the address of Los Angeles, California and also Cleveland, Ohio, requesting per-
mission to install in retail establishments canisters for solicitation of funds
and to hold a tag day on May 7, 1955 was read Upon motion by Ackerman,ssecond
by Schroeder, the communication was referred to the Board of Public Health &
Welfare.
A letter from N. D. Cory, Superintendent of Schools, stating that the
architects had not progressed far enough with the plans to give the information
as requested in a. previous letter from the City of Rochester, in regard to the
annexation of the Gooding property, was read and President Bach ordered the same
placed on file.
The following letter from the Planning and Zoning Commission was read
and upon motion by Morris, second by Schroeder, the same was referred to the Stree
& Alley Committee, the Public Grounds Committee and the City Engineer for further
study:

Members of the Common Council
City of Rochester, Minnesota
Gentlemen:
At a meeting of the Planning and Zoning Commission held on
March 18th, it. was voted to recommend to the Council that they
approve the following projects:
(1) A general plan for establishing a highway on 5th Street
northwest from highway 52 near Miracle Mile to 8th Avenue Northwest.
(2) Subject to approval of the, general plan mentioned above,
the purchase of a piece of property, now abed by Maas and Kreter,
which lies along 5th Street northwest between 8th and 9th Avenues,
this property to be used in part for the above -mentioned highway
and in part for. park and flood control purposes.

A letter addressed to the City Clerk from the State Public Examiner
transmitting a report on the examination of the financial affairs of the City of
Rochester for the year ending March 31, 1954 was read and the same was ordered
placed on file.
The following request of the Rochester Bus Line, Inc. was read:
"Honorable Mayor

Rochester,,Minnesota
Gentlemen:
The Rochester Bus Line, Inc. respectfully requests permission to
extend the North Broadway and Carroll and 7th Ave. and 6th Street
S. W. routes,one block as follows:
North Broadway & Carroll -extend present route from 14th St.
N. E. and 7th Ave. N. E. east toSth Ave. N: E., north on 8th Ave.
N. E. to 16th St. N. E., west on 16th St. N. E. to 7th Ave. N. E.
and present route.
7th Ave. and 6th St. S.W.-extend present route from 7th Ave.
S. W. and loth St. S. W. south to llth St. S. W., west on llth
St. S. W. to Sth Ave. S. W. ,. north- on 8th Ave. S. W. and present
route.
If permission is granted, we would appreciate a letter to the
Minnesota Railroad and Warehouse Commission stating Council
approval of the above extensions.

The petitions for construction of a sanitary sewer, water main, service
connections and grading, base construction and bituminous surfacing on 15tr
Avenue Northeast and. 15th Street Northeast. were each read and upon motion by
Ackerman, second by Morris, the same were referred to the Sewer Committee, the
Water Committee and the Street & Alley Committee
A petition for the construction of a storm.sewer lateral to drain the
interior of Block 5, Parkside Sub -Division was read and upon motion by Morris,
second by Ackerman, the same was referred- to the Sewer Committee.
The petition of Martin W. Opem for permission to build a single story
addition, with basement, upon his house at 616 Eighth Avenue Southwest, for the
purpose of converting his single family dwelling into a duplex was read. Mr.
Opem was present and urged that his request be granted. A motion was made by
Schroeder, second by Ackerman, that the permit for the addition be granted,
subject to Mr. Opem presenting a statement of acquiescence signed by all the
abutting property owners to the Building.Inspector before the permit is issued.
Upon. roll..call' all present voted in favor of the motion.
The petition of Hubert Rose to have Lot 5, Block 22, Northern Addition
and Harold G. Jones to have Lot 6, Block 220 Northern Addition changed from a
residential to a commercial zone was read and upon motion by Morris, second by
Anderson, the same was, referred to the Board of Zoning.

Rochester, Minnesota, a municipal Corporation, defendant, was read and upon motion
by Morris, second by Ackerman, the same was referred to the City Attorney.
The petition of Karvel & Suk, Inc. to have the following described
property, to be known as Baihly's First Addition, annexed to the City of Rochestex
was read together with a plat of the said lands:.
"All that part of the South 2 of the Southeast Quarter of Section 3,
Township 106, North of Range 14 West, in' Olmsted County lying
south and east of the center line of the highway known .as the
Rochester -Salem road(which is the westerly extension of llth St.
S. W. in the City of Rochester) , and lying northerly of the center
line 'of Trunk Highway Nd. 14-7 as described in the final certificate
recorded in Book B-lof miscellaneous records on page 27 in the office
of the'Register of Deeds, Olmsted County, Minnesota, subject to the
highway easement of said trunk highway. This parcel also being
described as follows: beginning at a, point on the east line of
said section 224 and 2/.10 feet north of the Southeast corner of
said section which point is the intersection of the center of
Trunk Highway No. 14-7 with said section line, thence north along
the section line a distance of 710.1 feet to the center line of the
Rochester -Salem road as. it is now traveled, thence south 890o4l
west a distance of 781.4 feet along the center of said road, thence
Southwest a distance of 90 feet more or less to the center line
of Trunk Highway No. 14-7, thence Southeasterly along the center
line of said trunk highway, which is on a 20 curve to the left to
the point of beginning, subject to existing road and trunk highway."
Upon motion by Schroeder, second by Morris, the petition and plat were referred
to the City Engineer for recommendation and the City Attorney was instructed to
prepare an ordinance annexing the said land to the City of Rochester.
A petition to have the property abutting on 21st Avenue Southwest
between 3rd and -5th Street Southwest, signed by 16 property owners on that avenue,
annexed to the City of Rochester,
was re'ad and upon motion by Schroeder, second by Morris, the same was referred to
t#e City Engineer and the Planning and Zoning Commission.
The request of the Gideons to hold a street service on Saturday night,
April 23rd, at the First National 'Bank corner on 1st Avenue and 2nd Street
Southwest was read and upon motion by Schroeder, second by Morris, the request
was granted, 'subject to the supervision by the'Chief of Police. All present voted
in favor of the motion.
The reports of the Clerk of Municipal Court for the week ending March 12,
1955'showing total criminal fines and costs collected $1,696.0o and civil fees
received $2.95 and for the week ending March 19, 19S5 showing total criminal fines
an'a' costs collected $2, 493.00 and civil fees received $3. 15, were each read and
having been approved by the City Attorney, President Bach ordered the same placed
on file;
The report of the City Treasurer for the month of February, 1955 was read
and President Bach ordered the same placed on file.
The contract bond of Universal Motors, Inc. in the amount of $1,695.00
with the Western Surety Company as surety was read and upon motion by Morris,
second bz� Ackerman, the same was referred to the Mayor.

Resolution requesting the State of Minnesota, Department of Highways,
to prepare surveys, plans and estimates for improving the entire width of Trunk
Highway No. 63 and Broadway Street, the cost of such surveys, plans and estimates
to be'born by the City of Rochester in the event the project of improvement is
not undertaken and to be considered as part of the cost of such improvement
project in the event the same is undertaken. Upon motion by Schroeder, second
by Ackerman,- resolution adopted.
A circular letter from the -Committee -of Independent Milk Dealers calling
the attendtion of the Mayor and the Common Council to Senate File 1011, which was
just recently introduced in the Legislature, and commonly known as the Milk
Control Bill, was read. The letter was referred to the Mayor,- he in turn to
contact the local dairies.
A letter from C. A. Armstrong, City Engineer, stating that 'the proposed
plat of Woodland Addition met the requirements of Ordinance No. 704 and recommending
same for annexation was read. A motion was made by Morris, second by Ackerman,
instructing the City Attorney to draft an ordinance annexing the 'said Woodland
Addition to the City of Rochester. All present voted in favor of the motion.
A motion was made by Schroeder, second by Ackerman, commending the
Chief of Police, Mr. Carl J. Briese and Mr. A. C. Anderson for -their special
interest in -the promotion of safety. All voted in favor of the motion.
Upon motion by Ackerman, second by Morris, the meeting was adjourned
until 7:30 o'clock P. M. on March 29, 1955-
