HomeMy WebLinkAbout03-28-1955Record of Official Proceedings of the Common Council .319 of the City of Rochester, Minn., M a r c h 2 S, 19 5 5 Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, on March 29. 1955. President Bach called the meeting to order at 7:30 O'clock P. M., the following members being present: President Bach, Aldermen Ackerman, Anderson, Moody, Morris, and Schroeder. Absent: Alderman Whiting. Upon motion by Moody, second by Morris, the minutes'of the meetings of March 15th and March 21st, 1955 were approved. :sir. Walter C. Hogenson, Superintendent of the Sewage Treatment Plant • read a report on attendance at the Sewer School held on March 16, 17 and 19, 1955 at the University of Minnesota, President Bach ordered the said report placed on file. Mr. Bert Alexander, Jr..was present at the meeting and reminded the Council that he had previously submitted proposed changes in the ordinance governing cement contractors in the City of Rochester. He inquired as to what had -been done on the matter up to this date and was informed that as yet.. -no action had been taken. The recommendation of the Street & Alley Committee that the bid of Universal Motors, Inc. for furnishing one! ton panel truck for use in the City Engineer's -Department be accepted at the price bid ($1, 11,35.00) and that checks be returned to the unsuccessful bidders was read and upon motion. by Morris, second by Schroeder, the recommendation: wa.s approved. The recommendation of the Street & Alley Committee that the bid of George_ R. Lewis Company for furnishing sewer castings for use in the City Enginse Department for the 1955 season be accepted at the unit prices bid and checks be returned to the unsuccessful bidders was read and upon motion by Morris, second b Ackerman, the recommendation was approved. The recommendation of the Sewer Committee that the storm sewer lateral • to drain the interior of Block 5, Parkside Subdivision be not constructed at the present time was read and upon motion by Morris, second by Schroeder, the recommendation was approved. The recommendation of the Street & Alley Committee that all bids for furnishing asphalt emulsions in truck transport delivery be rejected and the City Engineer be authorized to purchase the seasons' requirements on the open market and that checks be returned to the unsuccessful bidders was read and upon motion by Morris, second by Moody, the recommendation was approved. The following recommendation of the Street .& Alley Committee was read and upon motion by Schroeder, second by Ackerman, the recommendation was approved: "Honorable Mayor & Common Council City of Rochester, Minnesota Gentlemen: The petition for Annexation of 21st Avenue Southwest between s 320 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 29, 19 5 5 3 Street Southwest and 5 Street Southwest was referred to this committee and the Planning Board on March 21, 1955• We are studying the physical questions •relating to the annexation and will report our recommendation as to streets and utilities as -soon as our study is completed. Fie request that you refer the petition to the City Clerk and City Attorney for advise and counsel on the correctness of this petition for annexation. Respectfully, Street & Alley (ARCHIE M. A. - ARMSTRONG, City Engineer" The recommendation of the -Street & Alley Committee that the request that the street name of 72 Avenue Northeast (fronting lots 1 th"ru 9, Northwood Addition) be changed to Northwood Terrace be denied and that all future streets be named numerically as streets and avenues where possible was read and upon motion by Morris, second by Moody, the recommendation was approved. The recommendation of the Street & All-ey Committee that th•e construction of a curb and gutter on 12th Avenue Northeast from Sth Street Northeast to the north line of West's Subdivision be deferred pending the receipt of a. petition for curb and gutter on 12 Avenue from 72 Street Northeast to Sth Street Northeast was read and upon motion by Anderson, second by Ackerman, the recommendation was approved. The recommendation of the Street & Alley Committee that hearings be held on the paving of -Mayo Park Bridge Aporoa.ches and 3rd Avenue Southeast from 3rd to 4th Street Southeast was read and upon motion by Morris, second by Anderson, the recommendation was approved. The following recommendation of the Street & Alley Committee was read and upon motion by Schroeder, second by Moody, the recommendation was approv"ed: "Honorable Mayor & Common Council City of Rochester, Minnesota Gentlemen: We, the undersigned, recommend the approval of the General Plan and Right -Of -Way Plan for Proposed 7 Street Northeast improvement from 2 Avenue Northeest to 11 Avenue Northeast. The plan calls for a 100 foot right-of-way to accomodate a 60 foot roadway with boulevard and sidewalk on each side. Acquisition of additional right-of-way will be required from the Park lands and from other owners. Approval by the Council is requested so that work can be started on right-of-way acquisition, plans and programming and financing. Respectfully, Street & Alley (ARCHIE 14. Nashville Coal Company for furnishing of 5,000 tons of coal screenings at a price of $2.90 per tor_ making a total • contract price of $14, 500. 00, F.O. B. Mine. Sahara Coal Company for the furnishing of 5,000 tons of coal screenings at a price of $3.25 per ton making a contract price of $16, 250. 00, F.O.B. Mine. Republic Coal and Coke Company for the furnishing of 5,000 tons of coal screenings at a. price of $3.25 per ton making a contract price of . $16,250.00, F.C.B. " The three following resoluti6ns adopted by the Commissioners of the Sinking Fund were read and upon motion by Morris, second by Moody, the same were approved: "Be it resolved by the Commissioners of the Sinking Fund of the City of Rochester, Minnesota: That the sum of $130,000.00 be and the said sum,is hereby appropriated from the Sinking Fund of the City of Rochester, Minnesota., and ordered paid to the First National Bank of Rochester, Minnesota, for the purchase of $130,000.00 2% U. S. Treasury motes, dated February 15, 1955 and maturing on August 15, 1957- Be it further resolved: That the said $130,000.00 2% U.S. Treasury Notes maturing August 15, 1957 be purchased, at the market price plus accrued interest as per the following list: Employees Compensation Reserve $9,993.75 Premium none Accrued Interest 20.99 Electric Department Depreciation Reserve$109,931.25 Premium none Accrued Interest 230.95 Steam Department Depreciation Reserve 9,993.75 Premium none Accrued Interest 20.99" "WHEREAS, the sum in the amount of the budget set for the • operation of the Sewage Disposal Plant for the fiscal year ending March 31, 1955 is now available in the Sinking Fund from the collection of sewer service charges. A notice of personal injury to Hubert R. Estes received on March 26, 1955 in the amount of $35,000.00 was read and upon motion by Ackerman, second by Morris, the same was referred to the City Attorney. A notice of personal injury to Mrs. Alvina Jensen received on 'March 29, 1955 in the amount of $750.00 was read and upon motion by Morris, second by Ackerman, the same was referred to the City Attorney. A letter from Max Durand, Representative of City Employees Union Local No. 997 stating that after making a survey of wages in private employment, the following is an average of wages for various types of employees, was read and • President Bach ordered the same placed on file: Heavy duty operators $2.40 per hour Light duty operators $2.20 per hour Truck drivers• $2.00 per hour Laborers $1.SO per hour A letter from Mrs. Sadie 'Williams requesting that the parking of care be permitted on the North side of Nest Center Street, from 7th Avenue to llth Avenue, instead of on the south side, was read and upon motion by Ackerman, second by Schroeder, the same was referred to the Police Committee and .the Chief of Police. The request of the Chief of Police to have Ordinance No. 836 repealed and that a new ordinance be passed providing for the increase In personnel, as planned by the Common Council in the Police Protection Budget for the year 1955 to 1956 %va•s read and upon motion by Schroeder, second by Moody, the City Attorney was instructed to draft an ordinance to include the number of men previously approved by the Common Council. The request' of Leslie giester for a permit to operate a show club in the City of Rochester was read and the same was referred to the Mayor. The report of the Clerk of Municipal Court for the week ending March 25, 1955 showing total criminal fines and costs collected $2,226.25 and civil fees received $3.50 was read and having been approved by the City Attorney, President • Bach ordered the same placed on file. The application of First National Bank of Rochester as Special Administrator in the estate of Ralph P•i. Graen, deceased for "off sale" intoxicating liquor license was read together with two "riders" for the corporate surety bond in the name of Said First National Bark of Rochester as Special Administrator in the estate of Ralph M. Graen, - deceased. A motion was made by Schroeder, second by Anderson, that the license be granted and that the l4iders" be approved. The contract bonds of Truck Service Company in the amount of $2,666. g9 with Western Surety Company as surety and E. J. Foster, R. J. Arend and J. 0. Dalsbo, co-partners doing business as Rochester Sand & Gravel Co. (2) in the Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 29, 1955 323` 1 Ll 1 0 U 1 amounts of $19,200.00 and $13,045.00 with the American Casualty Company of Readings Pennsylvania as surety 'were each read and upon motion by Schroeder, second by Moody, the same were referred to -the Mayor. The following resolutions were each introduced and read and President Bach declared the same duly passed and adopted: Resolution accepting the bid of Universal Motors, Inc. for furnishing of one a ton panel truck for use in the City Engineer's Department. Upon motion by Ackerman, second by Anderson, resolution adopted. Resolution accepting the bid of George R. Resolution accepting plans and specifications and ordering bids for construction of a sanitary sewer, water main and service connections in 152 Avenue' Northwest, 16tba Avenue Northwest, 162 Avenue Northwest, 14th Street Northwest and 16th S•treret Northwest in Bielenberg & Giese Third Addition. Upon motion by Schroeder, second 'by Ackerman, resolution adopted. Resolution accepting plans and specifications and ordering bids for grading, base construction and bituminous surfacing on 152 Avenue Northwest, 16th Avenue Northwest, 16-4 Avenue Northwest, 14th Street Northwest and 16th Street Northwest in Bielenberg &Giese Third Addition. Upon motion by Ackerman, second by Anderson, resolution adopted. Resolution 'accepting plans and specifications 'and ordering bids for convt-ruction of a sanitary sewer in 1ZLt'h Street Northwest 'from 3rd to 5th Avenue Northwest. Upon motion by Anderson, second by Moody, resolution adopted. Resolution accepting plans and specifications and ordering bids for construction of a curb and gutter on 13th_ and 15th Avenue Northwest and on the north side- of 1-4tYg Street Northwest in Bielenberg & Giese.Second Addition. Upon motion by Moody, second by Morris, resolution adopted'. Resolution ordering bids for construction of NW*SW sanitary sewer relief line to be constructed from the Trunk Line sewer in place from the Mill reservation of Northern Qddition on the west * side of Cascade Creek- to 14th Street Northwest at 3rd Avenue Northwest. Upon motion by Ackerman, second by Anderson, resolution adopted. Upon motion by Morris, second by Schroeder,, resolution adopted. Resolution appropriating $44,969.00 from the Sewer Fund and ordering payment made to the Sinking Fund of the City of Rochester. An Ordinance annexing to the City of Rochester, Minnesota, a part of the Southeast Quarter (4) of Section Three, Township One hundred Six North of Range Fourteen West,° in Olmsted County, Minnesota (Baihly's First Addition), was given its first reading. Upon motion by Anderson, second by Ackerman, and upon roll call and all voting in favor thereof, the rules were suspended and the ordinance was given its second reading. An Ordinance annexing to the City of Rochester, Minnesota, a part of Section 25, Township 107, North of Range 14 West, in Olmsted County, Minnesota, ti be known and designated as Woodland Addition, was given its first reading. Upon motion by Moody, second by Morris, and upon roll call and all voting in favor thereof, the rules were suspended and the ordinance was given its second reading: Alderman Moody reported that the Police Department was in need of another desk chair and upon motion by Schroeder, second by Ackerman, the Police Committee was authorized to purchase the said desk chair. Two bills from the H & H Electric Company, totaling $2,213.31, for damage done to traffic signals by two car accidents were presented and the same were referred to the City Attorney. The following claim of the City Clerk was read: C� "Since October 15, 1954 an amendment to the City Charter has required that all fees received by the City Clerk be paid 326 Record of Official Proceedings of the Common Council of the City of. Rochester, Minn., March 29, 1955 • into the City Treasurer. Prior to October 15, 1954- it is estimated that the above mentioned fees amounted to an average of $.30.00 per. month: Since October 15, 1954 it has therefore amounted to a reduction in the City Clerk's compensation of the following: 52 months @ 30.00 . . $165-0011 A motion was mode by Ackerman, second by Morris, that the said bill be allowed as presented. All voted in favor of the motion. A motion was. made by Alderman Schroeder expressing the appreciation of the.Council to the retiring members of the Council, Mr. Archie M. Ackerman land Mr., Stanley M. Morris, for the cooperation received and. the time spent or_ City affairs while they were serving as Aldermen of the City of Rochester.
